ආචාර ධර්ම පද්ධ�ය

2009 අංක 58 දරණ පාර්�ෙම්න්� මැ�වරණ සං ෙශ�ධන පන�න් සං ෙශ��ත 1981 අංක 01 දරණ පාර්� ෙම්න්� මැ�වරණ පන ෙත් 8(8) වැ� වගන්�ය අ�ව ෙමම ආචාර ධර්ම පද්ධ�ය ��ත් කර ඇත. ෙමම ආචාර ධර්ම පද්ධ�ය ඡන්ද �ම�මකට අදාළ නාමෙය�ජනා දැන්�ම පළකර� ලබන �න �ට ඡන්ද �ම� ෙම් ��ඵල �කාශ ��ම දක්වා කාලය �ළ අදාළ ෙව්. � ලංකා ෙව් මැ�වරණ ��යට අ�ව ෙද්ශපාලන පක්ෂ ��ගැ�මට �ථම ෙමරට ජන සමාජෙය් ��ගත් ෙද්ශපාලන පක්ෂ �� අතර, ඒ ��බඳ ඉ�හාසය 1931 වර්ෂය දක්වා � ෙව්. ෙද්ශපාලන පක්ෂ ��ගැ�ම ��බඳ �� 1959 �ට ��ධ අවස්ථාවල සං ෙශ�ධනය � ඇත. වත්මන් සමාජ �ගමනය ෙව� ෙවන් ෙද්ශපාලන පක්ෂ ��න් ��කර� ලබන ෙමෙහය, වඩාත් අර්ථවත් හා ඵලදා� �මට �� මාර්ගෙයන් කළ හැ� ෙද් අවම බැ�න් එ�� වඩාත් වග�ම පැව ෙරන් ෙන් ෙද්ශපාලන පක්ෂ වලටමය. එම වග�ම ද සැල�ල්ලට ෙගන 2012 වර්ෂෙය් පැවැත්� පළාත් සභා ඡන්ද �ම�ම අර�� කර ෙගන �ථම වරට ෙමම ආචාර ධර්ම පද්ධ�ය මැ�වරණ ෙදපාර්ත ෙම්න්�ව ම�න් ෙද්ශපාලන පක්ෂ හා අ ෙප්ක්ෂක�න් සඳහා �කාශයට පත්කරන ල�. � ලංකා ෙව් ඡන්ද �ම�ම් ෙව� ෙවන් ෙද්ශපාලන පක්ෂ ව�න්

02. ඡන්ද �ම�මක් ෙව� ෙවන් ඉ��පත් වන �ය�ම ෙද්ශපාලන පක්ෂ වල සහ ස්වා�න කණ්ඩායම්වල අෙප්ක්ෂකයන්ට මැ�වරණ �යාව� ෙය් � �� සමතැන සෑම �යවරක �ම ආරක්ෂා ��ම.

03. �ය�ම ෙද්ශපාලන පක්ෂ වලට හා අ ෙප්ක්ෂක�න්ට ��වන අ��වා�කම් හා ඡන්ද දායක�න් දැ�වත් ��මට ඇ� අ��යට ග� කර�න් ��ද්ධ මතධා�න් ෙග් ද අ��න් ආරක්ෂා ��ම.

07. සෑම ඡන්ද �ම�මකටම අදාළ පනත්වල දැක්ෙවන �� (වගන්�) ගැන �ය� අෙප්ක්ෂක�න්ට අවෙබ�ධයක් ලබා �ම සහ එම පනත්වල දැක්ෙවන වැර�, �ෂණ �යා සහ ��ෙර�� යා ව�න් වළ�න ෙලස උපෙදස් �ම.

06. ඡන්ද ෙප�ළ ප��ය �ළ ෙහ� ඡන්ද ගණන් ��ෙම් ශාලා ප��ය �ළ �ම්�ම ෙහ� එම ස්ථානවලට මත්�ව� පා�ච්� කර පැ��ෙමන් වැළ� ��ය �� බවට අෙප්ක්ෂක�න් / �ෙය��ත�න් දැ�වත් ��ම.

07. නාමෙය�ජනා භාර ගන්නා ස්ථානයට ෙහ� ඡන්ද මධ�ස්ථානවලට ෙමන්ම එ� ප��යට ෙහ� ඡන්ද ගණන් කර� ලබන ස්ථානවලට ෙහ� ��ඵල �කාශයට පත් ��ෙම් ස්ථානවලට අවසර ඇ� �ද්ගල�න් පමණක් ඇ�ල්�ම.

01. ඡන්ද �ම�ම තරඟ ��ම සඳහා ඉ��පත්ව ඇ� ෙද්ශපාලන පක්ෂ, ස්වා�න කණ්ඩායම් ඡන්ද �ම�ම් ��ෙය් දැක්ෙවන ආකාරයට මැ�වරණ �චාරණ කට�� ත��ලව ද ��ය හා සාමය රැෙකන ප�� ද �� ම, ��ද්ධ පාර්ශ්වක�වන්ෙග් �ත��ල මැ�වරණ

කට�� වලට බාධා ෙන��ම හා �ත��ල අන්ද�න් ඡන්ද �චාරණ කාර්යාල පවත්වා ෙගන යාම.

02. ��ත ෙල්ඛන ම�න් ඡන්ද දායක�න් දැ�වත් ��ම සඳහා � ෙල්ඛන ��ණය ��ම හා ෙබදා හැ�ම සම්බන්ධ ෙයන් මැ�වරණ ��ය අ�ව �යා ��ම.

03. තම පක්ෂ ය ෙහ� ස්වා�න කණ්ඩායම ෙහ� අ ෙප්ක්ෂකයන් ෙග් ෙහ� ජය�හණය පතා ෙහ� ෙවනත් පාර්ශ්වයක පරාජය අ ෙප්ක්ෂා ෙවන් �� මැ�වරණ �චාරණ දැන්�මක්, ඊට අදාළ ඡායා�ප රාජ� ෙහ� ෙප�ද්ග�ක අංශයට අයත් ෙග�ඩනැ�ල්ලක, ��යක ෙහ� මහජනයාට �ෙව්ශ �මට අවසර ඇ� මාර්ගවල ෙහ� ෙප�� ස්ථානවල �දර්ශනය �� ෙමන් වැළ�ම.

07. මැ�වරණ �චාරණය ෙව� ෙවන් කර� ලබන සැර�� අවසරලත් මැ�වරණ රැස්�ම් ��යක රැස්�ම පැවැත්ෙවන කාලය �ළ ප�සරයට හා� ෙන�වන ප�� මටත්, එබ� රැස්�ම් කට�� ව�න් ප� අ�මාදව එම සැර�� ඉවත් ��මටත් �යා ��ම.

08. ඡන්ද �ම�ම් කාල �මාව �ළ මැ�වරණ �චාරණ කට��වලට අදාළව ෙප රහැර, මහජන ෙපළපා� හා රථ ෙපළපා� පැවැත්�ම මැ�වරණ �� උල්ලංඝනය ��මක් බැ�න් එවැ� ෙපළපා�, ෙපරහැර යනා� ��වක් ඡන්ද �ම�ම් කාල �මාව �ළ ෙන�පැවැත්�ම.

09. රැස්�ම් සඳහා අවසරලත් ශබ්ද �කාශන යන්� භා�තා ��ම, රැස්�ම් පැවැත්ෙවන කාලයට සහ එම ��යට පමණක් �මා ��ම සහ ධාවනෙය් ෙයෙදන වාහනවල ස�කළ ශබ්ද �කාශන යන්� ම�න් �චාරක කට�� ෙන��ම.

Introduction

The Democratic Socialist Republic of Sri Lanka recognizes

the right of every citizen to vote, to freely engage in political

activities and the right to free and fair elections enshrined in

the (1978) Constitution of Sri Lanka and recognizes by other

relevant legislative enactments passed by the Parliament of

Sri Lanka.

A free and fair election is considered a peoples’ right. To

ensure protection of this right the Human Rights Commission

of Sri Lanka has further come to learn the necessity of a

guideline in order to prevent violations of election laws that

could take place when conducting a free and fair election.

This set of guidelines has been formulated in all three

languages. It is intended that these guidelines provide State

Officials engaging in election duties directions so as to

prevent violations of election laws.

In order to ensure democratic society and promote a better

human rights culture in the country the Human Rights

Commission of Sri Lanka wishes to issue these guidelines in

the hope that it will immensely benefit the State Officials

engaging in the election process.

Election Guidelines

1. Complaints regarding pre-election, Election Day and

post-election violence shall be accepted and

investigated in terms of Article 12 of the Constitution,

which declares that “all persons are equal before the

law and are entitled to the equal protection of the law”

Electoral Officers/all Security Forces/Police Officials

will be held liable for violations of fundamental rights

and for any inaction or omission with regard to

entertaining such complaints.

2. Investigation regarding complaints shall be conducted

in a strictly impartial manner. Inaction due to political

influences or any other unacceptable reason will

amount to a breach of Article 12 of the Constitution.

3. The law which relates to election propaganda shall be

applied equally. All political parties and groups shall

be treated equally according to Article 12(2) of the

Constitution, which declares “No citizen shall be

discriminated against on the grounds of race, religion,

language, cast sex, political opinion, and place of

birth or on any one of such grounds”. Any unequal

treatment or discrimination, especially on political

opinion, will be an express violation of Article 12 of

the Constitution.

4. Issuing permits to use loudspeakers and for election

meeting shall be in accordance to the law, especially

in terms of section 68(2) of the Parliamentary

Elections Act No. 1 of 1981. The non-fulfillment of

this obligation will result in violation of Article 12 of

the Constitution.

5. Parades during the election period shall be permitted

according to the law. Issuing permits for parades shall

be according to Articles 12 and 14 of the Constitution.

Article 14(1) guarantee among others, freedom of

speech, assembly, association, occupation and of

movement.

6. Display of leaflets, posters, and photographs of the

candidates, symbols, flags and banners shall be

permitted according to election laws. If any party or a

group is given privileged treatment, it will be a

violation of Article 12 of the Constitution.

7. Electoral Officers/all Security Forces/Police Officials

Code of Conduct for contesting Political Parties and Candidates during periods of Elections

This Code of the Conduct has been issued in terms of Section 8(8) of the Parliamentary Elections Act No. 1 of 1981as amended by Act No. 58 of 2009. The code is applicable during a period commencing from the date of notice of nomination and ending on the announcement of the result of that election. Before the enactment of laws regarding recognition of political parties, there were political parties which were recognized by the society dating back to 1931. Laws regarding recognition of political parties have been amended at different times from 1959. Political parties have a greater responsibility in making the role of the parties more productive and realistic in the advancement of the contemporary society as rules and regulations can do in this regard is minimal. The code of conduct for political parties and candidates was issued for the first time by the Department of Elections with the Provincial Councils Elections held in 2012 in mind taking into consideration the responsibility referred to above. In Sri Lanka non-party candidates are nominated as independent groups at elections and this Code of Conduct applies to candidates of independent groups also.

A. Rule of law 01. Uphold the citizens’ rights and freedom

guaranteed by the Constitution and other laws of Sri Lanka, assisting and encouraging the voter to exercise his vote freely and without any obstruction to elect people’s representatives at elections and vote at referenda.

02. Safeguard the equality entitled to candidates of all political parties and independent groups at all times in the election process.

03. Respect the right of all political parties and

candidates and the voters’ right to know while safeguarding the rights of those with opposing views.

04. Refrain from preventing and obstructing in any

way the Government, Semi – Government, Private or other institutions from carrying out their work or responsibilities according to the law.

05. Refrain from obstructing or preventing statutory

bodies and to those entrusted with maintaining law and order from carrying out their legitimate duties.

06. Ensure that the publishing of matters relating to

the election is not disturbing the ordinary life of the citizens and not violating the existing laws.

07. Enlighten all the candidates about the laws

(Sections) of the Acts relating to election and advising to refrain from offences, corruption and illegal activities.

B. General Conduct

01. Refrain from any activity which could aggravate

differences, hatred and tension between different religions observed by Sri Lankan communities and their spoken languages, races, customs, etc.

02. Limit criticism of other political parties, their policies, programs and their past activities and refrain from criticizing personal life of candidates or making statements on allegations not proved against rivals of its own party or rival candidates.

03. Select candidates who can devote themselves to

the future well-being of the citizens of Sri Lanka by fulfilling the objectives of the constitutional bodies to which they are to be elected and by conducting the campaign in a disciplinary and obedient manner.

04. In selection of candidates, their conduct and good

behavior, respect for the law, devotion to serve the society etc. need to be considered. Avoid persons who use their wealth or society states to the detriment of the society.

05. Submission of the statement of assets and liabilities of candidates at the time of delivery of nomination paper or before the expiry of 05 days after delivery of nomination paper.

06. Avoid use of liquor or intoxicants at polling

stations and ballot paper counting centers and entering polling stations when under the influence of liquor.

07. Only those who are permitted by law shall enter

into the nomination accepting centre or polling stations as well as its premises or counting centers or results declaration centers.

08. Not engage in prohibited election related activities

or not encourage or involve his/her supporters to engage in such activities.

C. Election Propaganda Activities 01. Parties and Candidates to hold propaganda

meetings and maintain election offices according to election laws without causing any disruption to law and order and to election propaganda activities of rivals.

02. Follow rules in election laws in regard to printing of and distribution of hand bills, posters, notice etc. among voters.

03. Refrain from displaying in a building premises or a land belonging to the Government or a private person or in a public place or road to which the public has access to, any election propaganda notice or photograph with the object of promoting the election of a party or independent group or to prevent the election of a rival party or candidate.

04. Refrain from using land, building or any property

owned by the State or Semi-State institutions for election propaganda.

05. Refrain from using places of religious worship or

land or premises belonging to any religious organization for election propaganda.

06. Restrict display of posters, flags of candidate’s

number only in the vehicle in which candidate travels.

07. Restrict any decorations or exhibition of

propaganda materials to a place of propaganda meeting where it is held and such decorations should not harm the environment. All such decorations be removed without delay after the meeting.

08. Refrain from holding processions, public rallies

and motorcades with respect to propaganda activities within elections period as they are violations of election laws.

09. Use loudspeakers with permits, restricting the use of loudspeakers to the place and during the meeting and refrain from using loudspeakers in moving vehicles.

10. Take steps to stop all propaganda activities, and

refrain from holding musical shows, advertisements in both print/ electronic media, 48 hours before the date of poll.

11. Refrain from using vehicles and other State owned

property or any powers and privileges available to Members of Parliament, Provincial Council or of a Local Authority in promoting the election of a party or candidate.

12. Refrain from using for any illegal activity, any

security personnel, weapons legally provided to a people’s representative for his protection for any purpose other than his own security.

13. The service of Sri Lanka Rupavahini Corporation

or the Sri Lanka Broadcasting Corporation provided to a party or an independent group for election propaganda should be used according to the guidelines and conditions imposed by the Commissioner of Elections or the Heads of the Corporations. (Not applicable for Provincial Councils and Local Authorities elections)

14. Free postal facility to send a publication to every

household provided by the Postal Department to

15. Refrain from any election propaganda which will

disturb the conduct of public examinations such as General Certificates of Education (Ordinary and Advanced Level) and Grade 5 Scholarship Examination at examination centers and at evaluation centers at schools.

D. Polling Day

01. Refrain from canvassing of votes, encouraging or

preventing voters from voting, distributing of notices and handbills or engaging in any propaganda activity within a radius 500 meters of a polling station on the polling day.

02. Refrain from obstructing the voters who come to the polling station and influencing the voters and from preventing the voters to cast their votes freely and in secret.

03. Refrain from intimidating, causing bodily harm to

voters, polling agents, candidates and election observers or their families or cause damages to their houses or properties and refrain from driving away polling agents from the polling station.

04. Assist in ensuring that only those permitted (Secretary of contesting Political Party, candidates and Poling Agents) only enter the polling station and they prove their identity.

05. Refrain from doing or inducing any corrupt

practice or offence (stuffing of ballot boxes, raiding polling stations, impersonation or other corrupt practices or offences).

06. Refrain from illegal transport of voters to the

polling stations. 07. Ensure that polling agents co-operate with the poll

staff at the polling station and that the agents do not create any disturbances at the polling station.

08. Refrain from preventing election observers

approved by the Commissioner of Elections in engaging in their observations and supporting for their activities.

To consider that the matters mentioned above are also valid for the postal voting day as applicable.

E. Count of Votes and Preferences (including Postal Votes) and Declaration of Results. 01. Make the agents aware of the procedure regarding

the count of votes and preferences (including the count of postal votes) and also the procedure regarding making of complaints.

02. Ensure that the Agents at the Centers for Counting

Votes and at Center for Declaration of Results, observe and follow the administrative arrangement at the Centre provided by the Returning Officer.

03. Prevent Government Ministers, Ministers of

Provincial Councils, Members of Provincial Councils and Local Authorities and other political authority from entering Counting Centers unless they are formally appointed as Agents.

F. Other Special Matters. 01. Present to the voters by political parties contesting

an election, a Statement of Policies (Manifesto) and the manner in which it is to be implemented within a specified period.

02. State property, vehicles and officers not to be used for election propaganda.

03. People’s Representatives should not engage in

election propaganda making use of his official position.

04. Refrain from using without any payment Government owned aircrafts and other vehicles.

05. Ensure that public buildings, play grounds, Government bungalows or quarters are used after

payment of fees and charges and that one party does not monopolize such facilities.

06. Refrain from publishing political newsletters,

articles or supplements at the expense of the Government or Government institutions.

07. Refrain from inviting voters or state officers alone

or in groups to private or official residences and entertaining them.

08. Refrain from making promises of financial

assistance, laying of foundation stones for projects or proposals, promising to supply water and electricity services, appointments to posts outside the approved schemes of recruitment with the aim of attracting votes to the party.

09. Refrain from violating election laws and from causing any obstruction to inquiries made by law enforcement authorities. They should be permitted to act independently without any interference.

10. Not make use of the media to make false allegations about rival parties and their activities and not prevent the aggrieved parties the right to reply.

11. Respond to criticism or allegations made about

parties and politicians by peaceful means and not use force in retaliation.

12. Prevent security personnel provided to people’s representatives from engaging in political propaganda and causing harm to rivals.

13. Condemn and assist in controlling armed

personnel being used by any party or political organization.

14. Ensure that political parties and candidates are not

permitted in gaining political advantages from carnivals, exhibitions, etc. organized by the Government or organized with Government patronage.

It is expected that Political Parties and Leaders of

Independent Groups will make their candidates aware of

the Code of Conduct and make suitable arrangement to

ensure that they observe the code.
