The JIT that investigated the Sharif family's business deal- ings has recommended that the National Accountability Bureau open a reference against Sharif and his family after the probe panel found "glaring disparities" between their known sources of income and their actual wealth, the Dawn reported. The JIT report suggests that a reference should be filed against Prime Minister Sharif and his sons Hassan Nawaz and Hussain Nawaz, as well as daughter Maryam Nawaz, under Section 9 of the National Accountability Bureau (NAB) ordinance 1999, the daily said. The JIT has found that the assets of all four respondents have been found to be more than the sources of their income in the probe completed today. "Significant gap/disparity amongst the known and declared sources of income and the wealth accumulated by the Respondent No. 1, 6, 7 and 8 have been observed," the JIT observed in its concluding remarks. The report said the financial structure and health of compa- nies in Pakistan having linkage to Sharif family also do no sub- stantiate their wealth. JIT chief Wajid Zia present- ed the report along with evi- dence to a three-member special bench of the Supreme Court comprising Justice Ejaz Afzal, Justice Azmat Saeed and Justice Ijazul Ahsan. The six-member Joint Investigation Team (JIT) was set up in May by the Supreme Court with the mandate to probe the Sharif family for allegedly failing to provide the trail of money used to buy properties in London in 1990s. The JIT has also probed sev- eral serving and former officials in connection with the case. The six-member JIT includ- ed Federal Investigation Agency's (FIA) Additional Director General Wajid Zia, Military Intelligence's Brig Kamran Khurshid, National Accountability Bureau's (NAB) Director Irfan Naeem Mangi, State Bank of Pakistan's Amer Aziz, Securities and Exchange Commission of Pakistan's (SECP) Executive Director Bilal Rasool and Inter- Services Intelligence's Brig Muhammad Nauman Saeed. Last year, the Panama Papers revealed that three of Prime Minister Sharif's children owned offshore companies and assets not shown on his family's wealth statement. The assets in question include four expensive flats in Park Lane, London. The top court took up the case in October last year on petitions filed by Pakistan Tehreek-e-Insaf, Awami Muslim League and Jamaat-e-Islami and reserved the verdict in February after conducting hearings on a daily basis. (PTI) SC allows counselling, admissions to IITs NEW DELHI, July 10: The Supreme Court today allowed the counselling and admission into Indian Institutes of Technology (IITs) across the country on the basis of the results of the IIT-JEE (Advance) 2017 results by vacating its stay on it. The apex court bench head- ed by Justice Dipak Misra vacated its stay ordered last Friday, but asked the high courts not to interfere in the petitions regarding counselling and admission to the IITs to avoid any confusion. Counselling is a process in which a candidate, who clears the entrance examination, chooses the best college and stream according to his or her choice based on their rank. The bench, also comprising Justices A M Khanwilkar and M M Shantanagoudar, asked the IITs to give an undertaking that such mistakes will not recur and make sure that no situation in which bonus marks have to be awarded arose in future. Attorney General K K Venugopal, representing the IITs, said such a situation will not arise in future. The bench said the 2005 judgement in Guru Nanak University case will not apply in the present matter as there were a huge number of students involved and there was a system of negative marking in the exam. The apex court also noted that an experts' body of IITs had met twice to decide that bonus marks should be awarded across the board for the wrong questions. The Supreme Court had on July 7 restrained the IITs from conducting further counselling and admissions saying the court will go by its earlier judgement of 2005 and bonus marks cannot be given to those who have not attempted the wrong questions. The AG had, however, pointed out that there was nega- tive marking for every unsuc- cessful question and there may be some students who had opted not to answer "the said vague questions fearing negative marking". Therefore, across the board bonus marks were given to the candidates, Venugopal had told the court, adding that otherwise the IITs would have to strike down the marks. The AG had also said that it was difficult to re-evaluate the answersheets of over two lakh students who took the examina- tion and awarding of bonus marks across board was the most practical solution. The apex court had on June 30 issued notice to the Ministry of Human Resource Development on a plea seeking quashing of the IIT-JEE 2017 rank list. The petition, filed by an IIT aspirant Aishwarya Agarwal, had sought the court's direction to declare that the action of awarding bonus marks to candi- dates who had appeared in the JEE (Advanced)- 2017 exami- nation was wrong and violated her right, as well as that of other students. Since then several other stu- dents had approached the apex court seeking quashing of rank list. Several IIT aspirants in their pleas had sought a direction for preparation of the all-India rank list after rectifying the scores of JEE (Advanced) and also award marks for the incorrect ques- tions to the candidates who had attempted the right answers. (PTI) Gifts worth up to Rs 50,000 by employer exempt under GST: Govt NEW DELHI, July 10: The Government today clarified that gifts worth up to Rs 50,000 by an employer to its employees as also free membership of clubs, health and fitness centres will not attract the Goods and Services Tax (GST). Also, the services by an employee to the employer in the course of or in relation to his employment is outside the scope of the new indirect tax regime, it said. Any club, health and fitness centre membership provided by an employer to its all employees free of charge will not be subject to the GST. The same would hold true for free housing as part of cost-to- company (C2C) package. Commenting on reports of gifts and perquisites supplied by companies to their employees being taxed under GST, the finance ministry in a statement said gifts up to a value of Rs 50,000 in a year by an employer to his employee are outside the ambit of GST. "However, gifts of value more than Rs 50,000 made without consideration are subject to the GST, when made in the course or furtherance of business," the statement said. While the GST law does not define gifts, the ministry said for tax purposes gift is something that is made without consideration, is voluntary in nature and is made occasionally.(PTI)
