    By orders dated November 28th, 2007 andJuly 7th, 2008 the Court granted judgment infavor of Cook on both counts and for DefendantBRC on the f raud count . The only countremaining by p la in t i f f aga ins t Defendant BRC i sfor Breech of Contract aga ins t BRC, and we removing for Summary Judgment.

    After discovery t was c lea r , according toAttorney Cook, t ha t none of the p la in t i f f s hadac tua l damages, so the pursu i t was fors ta tu tory damages.

    After subs tan t ia l l i t i g a t i o n in which ourlaw f i rm, Barker , Rodems and Cook, expendedwell over 300 hours the d i s t r i c t cour tdismissed the TILA claims.

    After the dismissa l Barker, Rodems andCook f i l ed a not ice of appeal . While the casewas on appeal the par t i e s began se t t lementnego t ia t ions . Gi l l esp ie was concerned aboutcla ims being made aga ins t him, so he urged Cookto ge t the cases se t t l ed , and not only to getthe case se t t l ed but he now wanted anadd i t iona l to h i s damages he wanted Mr. Cookto secure for him a genera l r e lease or a mutualre l ease .

    Now under the c lass r ep resen ta t ioncon t rac t BRC s dut ies d i d n t include seeking agenera l re l ease , t only inc luded seekingdamages. But in any event , Mr. Cook took ontha t duty. And dur ing the se t t lement

    Because Amscot pa id Mr. Gi l l e sp i e ' sa t torney ' s fees and Mr. Gi l l esp ie kept h ise n t i r e $2,000 the re was never any cont ingencyfee taken. This was a s i t ua t ion where, as thec lass r ep resen ta t ion con t rac t s t a t e s , quote,

    In r a re cases the defendant may pay a l l o rpar t of the a t to rne y ' s fees . And t ha t ' s whatoccur red here . Amscot pa id 100 percent ofMr. Gi l l e sp i e ' s and the other two p l a i n t i f f ' sa t torney ' s fees , which i s permi t ted by TILA andalso the ru les r egu la t ing the F lor ida Bar,4-1 .8( f ) which author izes a lawyer to acceptpayment of h i s or her fees for r ep resen ta t ionof a c l i en t by one other than the c l i en t . So,there was no cont ingency fee charged top la in t i f f . e kept h is en t i r e $2,000.

    But Mr. Gi l l esp ie , by s igning these t t lement agreement, a l so agreed with Amscotand with Barker , Rodems and Cook t ha t the feefor t h i s case would be $50,000 and t ha t wouldcover the fees and the cos t s . So, t h i s wasMr. Gi l l e sp i e ' s choice to make t h i s decis ion .Mr. G i l l e s p i e ' s con t rac tua l theory wouldrequire Barker , Rodems and Cook to vio la te thee th ica l ru les by s p l i t t i n g a fee .

    The Flor ida law under JRD Management Corp.versus Dulin, D-U-L-I-N, 883 So. 2nd, 314 sayst ha t , The law assumes t ha t pa r t i e s have madean agreement for a lawful purpose .     Now we s t a r t ed out seeking and when Isee we , I mean Barker , Rodems and Cook - - wes t a r t e d out seeking Mr. Gi l l e sp i e s damages andh i s , you know - - and a l so h is cla im forcour t-awarded a t to rne y s fees . But, as thecase went on t changed and Mr. Gi l l esp ie nowwanted us to nego t ia te a re l ease for him.     So c lea r ly , Your Honor, under the c lassr ep resen ta t ion con t rac t and under the agreementtha t was, you know, was reached between him andAmscot and Barker , Rodems and Cook as the caseproceeded, Mr. Gi l l esp ie wanted h i s 2,000; hewanted it then. He d i d n t want to face anyadverse claims, and he d i rec ted t ha t these t t lement be obta ined. And once it wasobtained he approved it.

    And then almost two years a f t e r the fac t ,a f t e r th rea ten ing a bar grievance and alawsui t and when he d i d n t ge t h i s way wentforward and f i l ed t h i s ac t ion . It s been goingon for f ive years . Three of the four claimswere disposed of by judgment on the p leadings .The record i s undisputed. The fac t s t ha t havea l leged a re undisputed, and my c l i en t s areen t i t l ed to judgment in t he i r favor and we askt ha t you en te r tha t .

    And we have brought with us today, YourHonor, a proposed Fina l Summary Judgment as to

    I just reviewed the transcript of the hearing September 28, 2010 done by Robbie Darling andthere is a serious error on the top of page five at line 1: (THEREUPON, Mr. Gillespie exited thecourtroom). Clearly this is inaccurate because there was the following exchange later in thetranscript, beginning on page five at line 4:

    4. MR. GILLESPIE: For the record, I'm5 leaving because I didn't get my ADA6 accommodation.7 THE COURT: That's not true, sir.8. MR. GILLESPIE: I'm leaving the federal

    I believe the information on page five at line 1 should appear after the above exchange ending onpage five at line 11. Also, HCSO Bailiff C.E. Brown removed me from the courtroom at theorder of Judge Cook and escorted me from the building. I believe this information should beincluded on the transcript, because Judge Cook is now claiming that I left the hearingvoluntarily. A copy of page 5 is attached. Other than the official records maintained by theCourt, I am not aware o any other records related to the hearing before Judge Cook.As we discussed on the telephone today, you expressed some concern over yourpersonal safety while in the courthouse due to a disability and due to a potential threatfrom opposing counsel. Please let me know the date and time o your next visit to thecourthouse and we will take action to help ensure a safe and orderly visit.
