Meeting Minutes July 14, 2020 – 10:30 p.m.

No members of the public were present but several members were watching via Zoom. Mr. Scheu called the meeting to order at 10:31 a.m., and led the group in a moment of silence.

Agenda Approval David Holcomb moved to adopt the agenda as presented. Dan Dean seconded and the motion carried 8/0.

Meeting Minutes Adoption

The June 16th Meeting Minutes were approved by a motion from Mason Blake with a second by Dan Dean. The June 30-th Meeting Minutes were approved as amended by a motion from Mason Blake and a second by Dan Dean.

Old Business

A. Ordinance Review Sections: In Section 108 of Article I the word “use” should not be capitalized.

Article II Section 201 Definitions under “Buildable Area” the word “Used” should not be capitalized. Mason Blake wanted to delete "encompassing the living areas” under “Building Height”. The new sentence will read “The vertical distance measured from the Average

Natural Grade of the applicable lot with the highest point of the roofline of the applicable building or from the top of the parapet or roof surface for flat surfaced buildings.” Mason Blake wants to delete “(ADU)” from Dwelling Unit, Accessory and spell out “Accessory Dwelling Units” instead of ADUs. This is the only time ADU is used in the entire ordinance. Mason Blake wants “Garage” to be removed and the following to be added: “any Building or portion of a Building”. Under Home Occupation the word “assistant” should be singular rather than plural. The paragraph spacing needs to be worked on under “Manufactured Homes”. Bill Scheu mentioned leaving a space for “Rentals” under the “R’s”. Bill Scheu suggested striking “business” under the definition of “Structure”. Bill Scheu asked Mrs. Isenhower and Mr. Bass to follow up on the statutory numerical references to make sure they are correct. Article III Section 308.1 had some punctuation changes. In Section 309 Bill Scheu suggested adding “shall be selected by the Montreat Board of Commissioners” after “…composed of seven members…”. Also “Extra Territorial Jurisdiction” should be added after “Buncombe County”. Any references to McDowell County should be deleted. Dan Dean wants to add “(Planning Commission)” after the “Planning and Zoning Commission” in the first line of 308.1. The Commission suggested making similar changes to Section 310 Zoning Board of Adjustment. Mrs. Isenhower and Mr. Bass are going to work on both sections to make them consistent with one another. Dan Dean suggested removing “Special Use Permits” from Section 310 as it is traditionally Planning & Zoning that handles Special Use Permits. Under 310.1 change the caption of “Authority” to “Composition”. Dan Dean suggested removing in Section 310.31 the phrase “Subject to the provisions of subdivision (3) of this subsection”. Section 311 should be renumbered as Section 310.4 Application and Various Procedures and the following sections will be renumbered accordingly. Adrienne Isenhower pointed out that Section 316 to the end of the chapter needs to be moved back to the Planning & Zoning Commission Section of 309. After discussion it was decided to make this section its own section under the Code. Adrienne Isenhower and Stuart Bass are going to look into the statement of whether it needs to be the Board of Adjustment who grant an extension of the Variance or rather should be Zoning Administrator. Article IV Section 402 needs to be renumbered because 402.8 was omitted. In Section 500 make “District” unplural. Wade Burns mentioned changing the “Minimum Rear Yard Setback” for the environmental easement district but there was no desire to change it among the other Board members. In Section 503.91 it was decided to change “Lots abutting Woodland District” to “Lots abutting Woodland District in/or the property which is the subject of the easement for conservation purposes”. In Section 502.91 add “with rear yard”. The 500’s need some attention paid to renumbering and spacing. Section 506.1 remove the word “but” and add “on land that” in its place. In Section 510 please insert the word “may” before “….imposes additional standards….”. In Section 512 add “PUD” into the title caption and work in indenting. In Section 511 Bill Scheu requested to come back to “Front Yard Setbacks” at a later time.

Article VI Section 601 Wade Burns suggested altering the “Lot Reduction Prohibited specifically to allow for gentleman’s agreement between but this notion was turned out by the Commission. Section 606.3 remove “to compensate for an act of God”. There are some Sections that need to be renumbered in the area of 605. Wade Burns raised some questions about the provisions in the “Accessory Dwelling Unit” section. He advised the Commission that he lives in a multi-family home on a double lot and he’s not currently allowed to have a cooktop in his studio. Bill Scheu added Section 618 to the list of topics that the Commission wants to explore further at a future meeting. Article VII Section 700 add the word floor before “area” in two different lines in the paragraph. Article VIII Section 801.9 there seems to be an issue with the numbering of several sections. The next meeting will be held on July 28th at 10:30 a.m.

SUPPLEMENTARY DIMENSIONAL REQUIREMENTS

----.-- Encroachments into Required Setbacks

A. Encroachments Permitted in Required Setbacks: The following are permitted in

required setbacks provided there is no interference with any sight area:

1) Landscaping features, including but not limited to, ornamental pools, planting boxes, sculpture, arbors, trellises, and birdbaths;

2) At grade patios, play equipment or outdoor furniture, ornamental entry columns and gates, flag poles, lamp posts, address posts, HVAC equipment, mailboxes,

outdoor fire places, public utility wires and poles, pumps or wells, and fences or

retaining walls;

3) Necessary accessibility structures including handicapped ramps.

B. Structures Permitted in Required Setbacks: The following structures may encroach into

any required setback:

1) Cornices, steps, overhanging eaves and gutters, window sills, bay windows or

similar architectural features, chimneys, and fire escapes may project into any

required setbacks, but in no case shall be closer than three feet to any property

line; and;

2) Porches and decks may encroach into the required front/road and rear setbacks as

follows:

(A) Utility Easements: In addition to the lines, boxes, structures, and substation

buildings for which utility easements are intended, fences without

foundations may be located within utility easements.

(B) Drainage Maintenance and Utility Easements: Water-related improvements,

such as boat docks, may be placed or constructed within drainage

maintenance and utility easements with the approval of the utility provider

having jurisdiction over the easement.
