Re: Notification of Additional Marketing Claims Raid Fogger K, EPA Reg, No. 4822-452

The purpose of this notification is to add charts to the labels for our Raid and Raid Max versions of this product, containing the marketing claims "Why Use," "Concentrated Fogger, " Non-Concentrated 6 oz_ Fogger," "75" less chemicals," (for our 1.5 oz. fill Raid product) and "65" less chemicals" (for our 2,1 oz, fill product). These claims are included in the charts on the attached final printed labels for the "Raid Concentrated Deep Reach Fogger' and our Raid Max Concentrated Deep Reach Fogger, These claims are simple tactual statements relating to package size (much like price/value statements which are considered non-notifications), and clarify for the consumer the concentrated nature of the products, These claims are allowed by notification pursuant to sections II.E. and II,N. of PR Notice 98-10.

Additional claims which appear on these labels are, "Kills more hidden bugs" (on both the Raid and Raid Max products) and "Controls heavy Infestations" (on the Max product only), Both of these claims are simply shortened version of the currently accepted claims, "(Penetrates deeper) (concentrated) to kill (more) (hidden) (bugs) (Insects) (roaches) (and) (fleas) (dead)" and "(Concentrated) for heavy (roach) (and) (flea) (bug) (insect) infestations."

This notification is consistent with the provisions of PR Notice 98-10 and EPA regulations at 40 CFR 152.46, and no other changes have been made to the labeling or confidential statement of formula ofthis product. I understand that it is a violation of 18 U.S.C, Sec. 1001 to willfully make any false statement to EPA. I further understand that if this notification is not consistent with the terms of PR Notice 95-2 and 40 CFR 152.46, this product may be in violation of FIFRA and I may be subject to enforcement action and penalties under sections 12 and 14 of FIFRA.
