Prefaced

As theTobaccoProductsControlAct B.E. 2560 (2017) hasabrogated 2 previousActs, i.e. Tobacco Products ControlAct B.E.2535 andNon-Smokers’HealthProtectionActB.E. 2535,which hadbeen enforced for 25 years and comprised ofmany articles that areinconsistentwiththecurrentsituation,resultingintheinefficiencyofthetobaccoproductcontrolandprotectionofpeople’shealthagainstdiseasesarisefromtobaccoproducts.Inaddition,ThailandhasbeenamemberstatetotheWorldHealthOrganizationFrameworkConventiononTobaccoControl (WHO-FCTC).Therefore, it isnecessary that the revisionandimplementationofnewlawhasbeeninplacetointroducemoreefficientmeasures for tobacco product control which are harmonized withtheabove-mentionedFrameworkandtoimprovetheprotectionofpeople’shealth,especiallytheimmatureandyouthwhoaretheessentialresourcesofthecountry.

Presently, theTobaccoProductsControlActB.E.2560 (2017)haspublished intheGovernmentGazetteVolume134Section39Koron5April2017andwillbeeffectivefrom4July2017onward.

TheBureauofTobaccoControl,DepartmentofDiseaseControl,MinistryofPublicHealthasthemainauthorityresponsibleforacademic,administrationandoperationinrelevanttotheenforcementoftobaccoproduct control law has published theTobaccoProductsControlActB.E.2560(2017)topromulgatethemainpointandmattersoflawtopeopleandstakeholders,andusedasasupportingdocumentfortheexplanationandperformanceofrelevantofficersinordertobeenforcedinaccordancewiththespiritoflaw.

Beit,therefore,enactedbyHisMajestytheKing,byandwiththeadviceandconsentoftheNationalLegislativeAssembly,asfollows:

Section 1ThisActshallbereferredtoasthe“TobaccoProductsControlActB.E.2560(2017)”

Section 2ThisActshallenterintoforceafteraperiodof90daysfromthedateofannouncementintheGovernmentGazette.

Section 3Thefollowingsshallberepealed: (1)TobaccoProductsControlActB.E.2535(1992) (2)Non-Smokers’HealthProtectionActB.E.2535(1992)

Section 4InthisAct “Tobacco product”means the product containing tobaccoleaves orNicotiana tabacum, including any other product containingnicotinetobeusedeitherbysmoking,sucking,inhaling,chewing,eating,blowingorsprayingintothemouthornose,applyingonskin,orbyothermeansinordertoobtainthesameresult.Tobaccoproductexcludesdrugsunderthelawondrug. “Business Operator” meansmanufacturer or importer oftobaccoproducts,includingthosewhoobtainlicensetoselltobaccoforwholesaleunderthelawonexcisetax. “Related Person”means person or organization acting onbehalfofbusinessoperator,associationorcluboftobaccogrowers,curers,traders;ortheassociationorcluboftobaccoproductstraders. “Tobacco products dependence”meanstheconditionwherethe body needs to consume tobaccoproducts regularly andmust bedependentonsuchtobaccoproducts. “Smoking”means an actwhich results in the production ofsmokeor vapour from tobaccoproduct or the possession of tobaccoproductwhilesuchproductremitssmokeorvapour. “Non-smoking area” means an area where smokingisprohibited. “Smoking area”meansanareaarrangedforsmoking,whichislocatedinthenon-smokingarea. “Package”meansa pack, carton or other packagesused towraporcontaintobaccoproducts. “Advertising”means an act undertaken by anymeans toallowthepublictosee,hearorbeinformedofamessageintendedforcommercialinterest. “Marketing communications”meananact in various formsbyadvertising,publicizing,creatingnews,distributingnews,conducting

salepromotion,displayingatpointofsale,conductingdirectsale,sellingorpromotingsalebyusingspecificpersonandcybermarketing,forthepurposeofsellinggoodsorservicesorcreatingimage. “Message” includes letter,picture,cinematographicfilm, light,sound,signoranyactenablingthepublictounderstanditsmeaning. “Label” means a picture, design, paper or any other thingsshowingthemessagerelatingtothegoodsonthegoods,containerorpackageofgoods,orinsertedinorputtogetherwiththegoods,containerorpackageofgoods,andincludesadocumentorhand-bookonusageattachedtothegoods. “Sell” meanstodistribute,allot,giveout,exchangeorhandoutforcommercialbenefit. “Operator” means owner, manager or the person who isresponsiblefortheoperationsinpublicarea,workplaceorvehiclewhichisanon-smokingarea. “Public Area”means theplacewhere thegeneralpublichaslegitimacytoentereitherwithorwithoutinvitationorgratuitypayment. “Workplace”meansofficialplace,stateenterprise,otherstateagencyandplaceofbusinessoftheprivatesectororanylocationwherepersonsworktogetherunderthecriteriaannouncedandprescribedbytheMinisteruponrecommendationoftheCommittee. “Vehicle”means public vehicle or any other vehicle used totransportindividuals. “Committee”means theNationalTobaccoProductsControlCommittee. “Competent Officer” means the person appointed by theMinisterfortheexecutionofthisAct. “Minister”meanstheMinistertakingchargeofthisAct.

Section 5TheMinisterofPublicHealthshalltakechargeofthisActandshallhavethepowertoappointcompetentofficialsandissueMin-isterialRegulationsprescribingfeesatnotmorethantheratesattachedto thisAct and reducingorwaiving feesaswell as issuingMinisterialRegulationsandNotificationsfortheexecutionofthisAct. SuchMinisterialRegulationandNotificationshallcomeintoforceuponannouncementintheGovernmentGazette.

Chapter 1National Tobacco Products Control Committee

Section 6There shall be the Committee referred to as the“NationalTobaccoProductsControlCommittee”consistingof: (1) theMinisterofPublicHealthasChairman (2) thePermanentSecretaryoftheMinistryofPublicHealthasDeputyChairman (3) themembersbyposition, totalling12persons:PermanentSecretary of theMinistry of Finance; thePermanentSecretary of theMinistry of Social Development and Human Security, PermanentSecretaryoftheMinistryofTourismandSports,thePermanentSecretaryoftheMinistryofAgricultureandCooperatives,thePermanentSecretaryof theMinistryofCommerce, thePermanentSecretaryof theMinistryof Interior, the Permanent Secretary of theMinistry of Justice, thePermanentSecretaryoftheMinistryofLabour,thePermanentSecretaryoftheMinistryofEducation,theCommissionerGeneraloftheRoyalThaiPolice,theSecretaryGeneraloftheNationalHealthSecurityOfficeandtheManageroftheThaiHealthPromotionFoundation

(4) FivequalifiedmembersappointedbytheCabinetfromthosewho have the recognizable expertise and experience inmedical,publichealth,legal,protectionoftherightsofwomenorchildrenandotherfieldswhichareusefulinthecontroloftobaccoproducts(onememberfromeachfield) (5) Four qualifiedmembers appointed by theCabinet fromthosenominatedbythenonprofitprivateorganizationswhichcarryoutactivitiesconcerningpublichealthprotection(3members)andpublicrightandlibertyprotection(1member) TheDirectorGeneraloftheDepartmentofDiseaseControlshallbeamember and secretary. TheDirectorGeneral of theDepartmentofDiseaseControl shall appoint two officers from theDepartment ofDiseaseControlwhoareresponsiblefortobaccoproductscontrolworksasassistantsecretaries. The acquisition of qualifiedmembers shall be in accordancewith the criteria, procedures and conditions as announced andprescribedbytheMinister.

Section 7The qualifiedmembers shall have the followingqualificationsandshallnothavethefollowingprohibitedcharacters: (a) Qualifications: (1)havingThainationality (2)Havingcompletedtheir35thyearofage (b) Prohibitedcharacters: (1)beingorhavingbeenabankrupt (2)beinganincompetentorquasi-incompetentperson (3)havingbeenimprisonedbythejudgmentofacourt

whichisfinal,exceptfortheoffencescommittedthroughnegligence,minoroffencesorlibeloffense (4) Having been dismissed, discharged or forcedto resign frompublic service, state agencyor state enterprise due tomalfeasance,grossmisconductordeemedtohavecommittedcorruptionandmisconductinthepublicservice (5) being a political official or being a director orhavingheldanypositionwhichisresponsibleforthemanagementofpoliti-calparty,advisortopoliticalpartyorofficerinpoliticalparty (6) being a business operator, related person orinterestedpersonintobaccoproducts-relatedbusinesseitherdirectlyorindirectly (7) suffering from tobacco products dependencedisease

Section 8Thequalifiedmembersshallholdofficeforatermoffouryearsfromthedateofappointmentandmaybere-appointedbutshallnotholdofficeformorethantwoconsecutiveterms. Uponexpirationofthetermofofficeunderparagraphone,duringtheperiodwhennewqualifiedmemberhasnotyetbeenappointed,theretiringqualifiedmembershallremaininofficeuntilthesuccessorassumestheduties. Iftheofficeofthequalifiedmemberisvacatedpriortoexpirationofthetermofoffice,theCabinetmayappointanotherpersontoholdsuchoffice. If theremainingofficeof thesaidqualifiedmember is lessthan90days,theCabinetmaynotappointareplacementandthereforetheCommitteeshallcompriseoftheremainingmembers. The appointed qualifiedmember shall retain office for theremaining duration of the full termof the qualifiedmemberwhomhereplaces.

Section 9Apartfromretirementuponexpirationofthetermofoffice,thequalifiedmembershallvacateofficeupon: (1) death (2) resignation (3) terminationbytheCabinetduetofailureintheperformanceofdutyordishonestperformanceofduty, failureofgoodbehaviour,orlackofability (4) lackingthequalificationorhavingtheprohibitedcharacteristicunderSection7

Section 10TheCommitteeshallhavethefollowingpowerandduties: (1) toproposepoliciesandstrategicplansinrelationtocontroloftobaccoproducts,protectionofnon-smoker’shealthandtreatmentandhealthrehabilitationofthosesufferingfromtobaccoproductsdependencetotheCabinetforconsiderationandapproval (2) to prescribemeasures in relation to control of tobaccoproducts, protection of nonsmoker’s health and treatment and healthrehabilitation of those suffering from tobacco products dependenceaswell as give recommendations, advicesand coordinatewith publicsector,stateagencies,stateenterprisesandprivateorganizationsinordertoimplementsuchmeasures (3) to give recommendations or advices to theCabinet, theBangkokTobaccoProductsControlCommittee,theProvincialTobaccoProducts Control Committees, public sector, state agencies, stateenterprises, private organizations and competent officers about theexecutionofthisAct (4) togiverecommendationsoradvicesabouttheissuanceofNotificationsfortheexecutionofthisAct

(5) tomonitor,assessresultsandexaminetheoperationsoftheBangkokTobaccoProductsControlCommitteeandtheProvincialTobaccoProductsControlCommitteesincompliancewiththepoliciesandstrategicplansunder(1)andmeasuresunder(2)aswellasprescribecriteriaandproceduresforreportingsuchoperationresults (6) toprescribecriteria,proceduresandconditionsforfixingfinesunderthisAct; (7) toperformotheractsasprescribedbylawtobethepoweranddutiesoftheCommitteeorasassignedbytheCabinetorMinister

Section 11 For theCommitteemeeting, at least half of theCommitteemembersshallformaquorum. IftheChairmanoftheCommitteeisnotpresentatthemeetingorcannotperformhisduty,theVice-Chairmanshallbethechairmanofthemeeting.IfthereisnoVice-ChairmanortheVice-Chairmancannotperformhisduty,thememberspresentatthemeetingshallelectoneofthememberstobethechairmanofthemeeting. Decisionsshallbemadeatthemeetinguponmajorityvote.Eachmemberisentitledtoonevote.Intheeventofatiedvote,thechairmanofthemeetingshallhaveacastingvote. TheCommitteemeetingshalltakeplaceatleasttwiceayear.

Section 12TheCommittee shall have the power to appointasub-committeetoconsiderorperformanymatterasassignedbytheCommittee. TheprovisionsofSection11shallapply to themeetingof thesub-committeemutatis mutandis.

Section 13 In the performance of duties under thisAct, theCommittee and the sub-committees shall have the power to issueawrittenorder tosummonsanyperson togive factsoropinionsor tosubmitdocumentsorrelevantinformationforconsideration.

Section 14 In theperformanceunder thisAct, theCommitteememberorsub-committeemembershallbeacompetentofficerundertheCriminalCode.

Section 15 TheDepartment ofDiseaseControl shall be thesecretariat office being responsible for the general affairs of theCommitteeandsub-committeesandshallhavethefollowingpowerandduties: (1) toproposepoliciesandstrategicplansinrelationtocontroloftobaccoproducts,protectionofnon-smoker’shealthandtreatmentandhealthrehabilitationofthosesufferingfromtobaccoproductsdependenceto theCommittee, taking intoaccountThailand’sexisting internationalobligations (2) tocarryoutorsupportstudy,analysisandresearchoncontroloftobaccoproducts,protectionofnon-smoker’shealthandtreatmentandhealthrehabilitationofthosesufferingfromtobaccoproductsdependence (3) to serve as centre of information on control of tobaccoproducts, protectionof non-smoker’s health and treatment andhealthrehabilitationofthosesufferingfromtobaccoproductsdependence (4) to coordinate, support and cooperatewith the BangkokTobaccoProductsControlCommittee,theProvincialTobaccoProductsControlCommittees, public sector, state agencies, state enterprises,educationinstitutions,internationalorganizationsandprivateorganizationabouttheexecutionofthisActaswellasthepoliciesandstrategicplansunderSection10(1)andmeasuresunderSection10(2)

(5) to do any other acts as assigned by theMinister, theCommitteeandsub-committeesorasprescribedbylawstobethepoweranddutiesoftheDepartmentofDiseaseControl

Chapter 2Bangkok Tobacco Products Control Committee

Section 16ThereshalltheCommitteereferredtoasthe“BangkokTobaccoProductsControlCommittee”consistingof: (1) theBangkokGovernorasChairman (2) the Permanent Secretary of the BangkokMetropolitanAdministration(BMA)asDeputyChairman (3) themembersbyposition, totalling16persons: theMetro-politanPoliceCommissioner, theDirector of thePrimaryEducationalServiceAreaOfficeandtheDirectoroftheSecondaryEducationalServiceAreaOfficeasassignedbytheSecretaryGeneraloftheBasicEducationCommission, theHeadofExciseOffice-BangkokAreaasassignedbytheDirector-General of the ExciseDepartment, theDirector of the(Bangkok)Branchof theNationalHealthSecurityOffice, theDirectorof the BMA’s Medical Service Department, the Director of theBMA’s Education Department, the Director of the BMA’s SocialDevelopmentDepartment,theDirectoroftheBMA’sCulture,SportandTourismDepartment, theDirectorof theBMA’sCityLawEnforcementDepartment,theDirectoroftheBMA’sHealthDepartment,theDirectoroftheBMA’sPublicRelationDivision,therepresentativeoftheDiseaseControl Department, the representative of theOffice of theHigherEducationCommission,therepresentativeoftheOfficeoftheVocational

EducationCommissionandtherepresentativeoftheOfficeofthePrivateEducationCommission (4) SixqualifiedmembersappointedbytheBangkokGovernorfrom those who have the recognizable knowledge, expertise andexperienceinmedicalorpublichealth, legal,masscommunicationsormassmedia,protectionoftherightsofwomenorchildren,protectionofpublicrightsandlibertyandotherfieldswhichareusefulfortheprotectionofpublichealth(onepersonfromeachfield)

TheDeputyDirectorof theBMA’sHealthDepartmentshallbeappointed by theBangkokGovernor to be amember and secretary.TheBangkokGovernorshallappointtwoofficersfromtheBMA’sHealthDepartmentasassistantsecretaries.

Section 17For the criteria and prohibited characters of thequalifiedmembersunderSection16(4),Section7 shall applymutatis mutandis.Theappointment,officetermandvacationfromofficeshallbeinaccordancewiththerules,proceduresandconditionsasannouncedandprescribedbytheCommittee.

Section 18TheBangkokTobaccoProductsControlCommitteeshallhavethefollowingpoweranddutiesintheBangkokareas: (1) toenforcethelawsoncontroloftobaccoproducts,protectionofnon-smoker’shealthandtreatmentandhealthrehabilitationofthosesufferingfromtobaccoproductsdependence (2) to act pursuant to the policies and strategic plans underSection10(1)andmeasuresunderSection10(2) (3) to prescribe the guidelines for performance,monitoring,assessment and examination of the operations in respect of themonitoring and prevention of children and youth’s access to tobacco

products,reductionandgivingupontobaccoproductsconsumptionandprotectionofnon-smoker’shealthandreporttheresultstotheCommittee (4) to give recommendations and coordinate with the pub-lic sector, state agencies, state enterprises andprivate organizationsaboutcontroloftobaccoproducts,protectionofnon-smoker’shealthandtreatment and health rehabilitation of those suffering from tobaccoproductsdependence (5) giveopinionsabouttheenforcementoflawsandmeasuresinrespectofcontroloftobaccoproducts,protectionofnon-smoker’shealthandtreatmentandhealthrehabilitationofthosesufferingfromtobaccoproductsdependencetotheCommittee (6) to perform other acts in relation to control of tobaccoproducts, protectionof non-smoker’s health and treatment andhealthrehabilitationof thosesuffering from tobaccoproductsdependenceasassignedbytheMinister,CommitteeorBangkokGovernor

Section 19TheBangkokTobaccoProductsControlCommitteemay appoint a sub-committee to consider or perform anymatter asassignedbytheBangkokTobaccoProductsControlCommittee.

Section 20The provisions of Sections 11, 13 and 14 shallapplytothemeetingandperformanceofdutiesoftheBangkokTobaccoProductsControlCommitteeandtheBangkokTobaccoProductsControlCommittee-appointedsub-committeemutatis mutandis.

Chapter 3Provincial Tobacco Products Control Committee

Section 21There shall theCommittee called the “ProvincialTobaccoProductsControlCommittee”consistingof: (1) theProvincialGovernorasChairman (2) theViceGovernorassignedbytheProvincialGovernorasDeputyChairman (3) themembersbyposition,totalling13persons:theProvincialChiefPublicProsecutor,theDeputyProvincialGovernor,theCommanderofProvincialPolice,theDirectoroftheProvincialPrimaryEducationalServiceAreaOfficeasassignedbytheSecretaryGeneraloftheBasicEducationCommission, theDirector of the Secondary EducationalServiceAreaOfficewhich is responsible for the provincial areas, theDirectoroftheOfficeofDiseasePreventionandControlwhichisresponsiblefortheprovincialareas,theChiefoftheProvincialSocialDevelopmentandWelfareOffice, theChiefof theProvincialPublicRelationsOffice,oneExciseOfficer in the area as appointed by theProvincialGovernor,Director of theBranch of theNationalHealth SecurityOfficewhichis responsible for the provincial areas and 3 executives of the localadministrationorganization(s)intheprovincialareasasappointedbytheProvincialGovernor (4) SixqualifiedmembersappointedbytheProvincialGovernorfrom those who have the recognizable knowledge, expertise andexperienceinmedicalorpublichealth, legal,masscommunicationsormassmedia,protectionoftherightsofwomenorchildren,protectionofpublicrightsandlibertyandotherfieldswhichareusefulfortheprotectionofpublichealth(1personfromeachfield)

TheProvincialPublicHealthChiefshallbememberandsecretary.TheProvincialGovernor shall appoint twoofficers from theProvincialPublicHealthOfficeasassistantsecretaries.

Chapter 4Control of Tobacco Products

Section 26Nopersonshallbeallowedtosellorgivetobaccoproducttoapersonwhodoesnotattain20fullyearsofage. Incaseofdoubtabouttheageofbuyerorreceiveroftobaccoproduct,thesellerorgiveroftobaccoproductshallaskthesaidpersontofirstshownationalidentificationcardorotherevidenceofsuchperson’sage,asthecasemaybe. Nooneshallassign,employ,askorallowthepersonwhoisbelow18fullyearsofagetosellorgivetobaccoproduct.

Section 27For the sale of tobacco products by retailer, theretailershallbeprohibitedfromdoinganyofthefollowingacts: (1) toselltobaccoproductsbyvendingmachines (2) toselltobaccoproductsthroughelectronicmediaorcomputernetwork (3) to sell tobacco products outside the places stated in theTobaccoSalesLicense (4) toselltobaccoproductswiththedistribution,addition,giftoforexchangeoftobaccoproductwithotherproduct,provisionofserviceorotherprivilege,asthecasemaybe (5) toselltobaccoproductbyactinginsuchawaytoshowthereductionoftobaccoproductpriceatthepointofsale (6) to sell product or provide service with the distribution,addition,giftoforexchangewithtobaccoproducts,asthecasemaybe (7)tohawktobaccoproducts (8) togiveoroffertherighttoattendgame,show,service,luckydraw,prizecontestoranyotherbenefitasaconsiderationtothebuyeroftobaccoproductorapersonbringingpackageorlabeloranythingrelatingtotobaccoproductforexchangeorredemptiontherefor (9) todisplaypricesoftobaccoproductsatapointofsaleinsuchawayasencouragingtobaccoproductconsumption

Section 28No person shall be allowed to distribute tobaccoproductasasampleofthetobaccoproductsortomakesuchtobaccoproductsbecomewidespreadortopersuadethepublictoconsumesuchtobaccoproducts.

Section 29Nopersonshallselltobaccoproductsinthefollowingplaces:

(1) templeorplaceforperformanceofreligiousceremony (2) place for public health service andmedical establishmentunderthelawonmedicalestablishmentanddrugstoreunderthelawondrug (3) educationestablishmentunderthelawonnationaleducation (4) publicpark,zooandamusementpark (5) otherplacesasprescribedandannouncedbytheMinisteruponrecommendationoftheCommittee TheMinister upon recommendation of theCommitteemayannounceandprescribethedistancefromtheplacesunderparagraphonesothatnotobaccoproductshallbesoldwithinthesaiddistance.Thesignorsymbolshallbepreparedtoindicatethesaidprescribedarea.

Section 30No person shall advertise or conductmarketingcommunicationsoftobaccoproducts.

Section 31Nopersonshalldisplaythenameormarkoftobaccoproducts,nameormarkofmanufacturerorimporteroftobaccoproducts,oranyothersymbolorthingwhichmakethegeneralpublicunderstandthat the nameormark belongs to tobaccoproducts,manufacturer orimporterof tobaccoproducts inorder toadvertise tobaccoproducts inthefollowingcases: (1) in printedmatter, tapeor televisionmaterial,movie, radiobroadcast,radiotelevision,electronicmedia,computernetworksystemoradvertisementbill (2) intheatre,movietheatreorshow,game,contest,competition,serviceprovisionoranyotheractivityinthesamenature (3) in any othermedia or location used for advertisement ormarketingcommunicationsasprescribedandannouncedbytheMinisteruponrecommendationoftheCommittee

Section 32Nopersonshalldisplaythenameormarkoftobaccoproducts,nameormarkofmanufacturerorimporteroftobaccoproductsonanyotherproduct,whichisnottobaccoproduct,orcut,addthenameormarkoftobaccoproductsoralterthemessagetobeapartofsuchproductinordertoadvertisethenameormarkoftobaccoproductsorthenameormarkofmanufacturerorimporteroftobaccoproducts. Nopersonshallimportforsale,advertiseorselltheproductunderparagraphoneintheKingdom.

Section 33No person shall advertise any product using thenameormarkoftobaccoproductsasthenameormarkofsuchproduct,oradvertisebycutting,addingthenameormarkoftobaccoproductsoralteringthemessagetobeapartofthenameormarkofsuchproductinsuchamannerasmaybeunderstoodtomeantoadvertisetobaccoproducts.

Section 34Nopersonshallmanufacture,sell,importforsaleorgeneraldistribution,advertise,orconductmarketingcommunicationsthefollowingsintheKingdom: (1) theproducthavingsuchanappearanceastobeunderstoodasanimitationoftobaccoproduct (2) the product to be consumedbywayof smoking and thatcontains substancewhich is hazardous to health as prescribed andannouncedbytheMinisteruponrecommendationoftheCommittee (3) packageoftheproductunder(1)and(2)

Section 35No business operator and related person shallsponsor or support person, groupof persons, state agencyor privateorganizationinanyofthefollowingmanners: (1) tocreateimageoftobaccoproducts,manufacturerorimporteroftobaccoproducts (2) to effect or potentially effect the intervention of tobaccoproductscontrolpolicy (3) toadvertisetobaccoproducts,manufactureror importeroftobaccoproducts (4) topromotetobaccoconsumption Theprovisionsofparagraphoneshallnotapplytotheactamongbusinessoperators,relatedpersonsandthoseinvolvedinthetobaccoproductsmanufacturingandtradingprocessordonationorhumanitarianaidintheeventofseveredisaster. Nopersonshalldisseminateactivityornewsinordertopublicisetheactivityunderparagraphsoneandtwo.

Section 36Notobaccoproductsretailersshalldisplayorconsenttodisplaytobaccoproductsattheplaceofretailsale. The display of name and price of tobacco products and thedisplayof placeof retail sale shall be in accordancewith the criteria,proceduresandconditionsasprescribedandannouncedbytheMinisteruponrecommendationoftheCommittee. TobaccoproductsretailershalldisplaythemediaforcampaignforreductionandcuttingdownontobaccoproductsconsumptionwhichispreparedbytheMinistryofPublicHealthinaccordancewiththecriteria,proceduresandconditionsasprescribedandannouncedbytheMinisteruponrecommendationoftheCommittee.

Section 37TobaccoproductstobesoldintheKingdomshallhavethecomponentsandemissionproductsasprescribedintheMinisterialRegulations. Themanufacturer or importer of tobacco products underparagraphoneshallhavethedutytoinformtheMinistryofPublicHealthoftheparticularsofcomponentsofthetobaccoproductsandemissionproductsandsendthesampleofthetobaccoproductstotheMinistryofPublicHealthforexaminationanddisclosuretothepublicasinformedinaccordancewiththecriteria,proceduresandconditionsprescribedintheMinisterialRegulations. In case where the components and emission products ofthe tobaccoproduct under paragraph two complywith theMinisterialRegulations under paragraphone, theMinistry ofPublicHealth shallissuethecertificateofregistrationandnotificationofthesaidcomponentsandemissionproducts.Thecertificateissuance,termanditsreplacementissuance shall be in accordancewith the criteria, procedures andconditionsprescribedintheMinisterialRegulations. In casewhere the components andemission products of thetobaccoproductunderparagraphtwodonotcomplywiththeMinisterialRegulationsunderparagraphone,theMinistershallorderprohibitingsaleorimportordestroyingsuchmanufacturedorimportedtobaccoproductsandannouncesuchordertothepublicforacknowledgement. Theexpensesarisingfromtheexaminationofthecomponentsof tobacco products under paragraph two or the destruction or theannouncementunderparagraphfourshallbebornebythemanufactureror importer of such tobacco products in accordancewith the criteria,proceduresandconditionsprescribedintheMinisterialRegulations.

Toprotectthehealth,sanitationandsafetyofthegeneralpublic,theMinisterialRegulationsunderparagraphoneshallstipulatethattheMinistermayannouncethecriteriaconcerningtechnicalandacademicdetailsandmattersthatmustbechangedswiftly.

Section 38Themanufactureror importerof tobaccoproductsfor sale in theKingdomshall arrange for thepackageof the tobaccoproductstobeinthesize,colours,marks,labelsandtoexhibittrademarks,marks,picturesandmessagesinaccordancewiththecriteria,proceduresandconditionsprescribedbytheMinisteruponrecommendationoftheCommittee beforemoving out of themanufacturing site or beforeimportationintotheKingdom,asthecasemaybe. Nooneshallselltobaccoproductswhicharenotinthepackageorwhichareinthepackagenotexhibitingthetrademarks,marks,picturesandmessagesasprescribedinparagraphone. To protect the health, sanitation and safety of the generalpublic,theCommitteemayconsiderwhetheritisappropriatetoupdatetheprescriptionsunderparagraphoneornoteverytwoyearfromthedateofthisActenforcement.Incaseofnecessity,theCommitteemayconsiderupdatingthesaidprescriptionsinashortertimeframe.

Section 39No one shall manufacture or import tobaccoproductsforsaleintheKingdominthecategoryofcigaretteinthepackorpackagingoflessthan20rolls. Itisprohibitedtosellbymeansofdivisionoftobaccoproductsinthecategoryofcigarette. The sale of tobacco products in other categories shall be inaccordancewiththecriteria,proceduresandconditionsprescribedbytheMinisteruponrecommendationoftheCommittee.

Section 40Manufacturer or importer of tobacco products forsaleintheKingdomshallhavethedutytosubmittheinformationaboutthevolumeofmanufacturingorimportationintotheKingdom,marketingexpenses, earnings and expenses underSection 35, annual reports,balance sheet certified by the certified public accountant and otherinformationwhich is useful for the control of tobaccoproducts to theCommittee in accordancewith the criteria, proceduresand conditionsprescribedbytheMinisteruponrecommendationoftheCommittee.

Chapter 5Protection of Non-Smoker’s Health

Section 41TheMinisteruponrecommendationoftheCommitteeshallhavethepowertoprescribethetypesandnamesofpublicareas,workplacesandvehicles,anypartthereoforthewhole,asnon-smokingareas. TheMinister upon recommendation of theCommitteemayprescribesmokingareaswithinthenon-smokingareasunderparagraphone.

Section 42Nooneshallsmokeinthenon-smokingarea,exceptinthesmokingareadesignatedunderSection41,paragraphtwo.

Section 43After theMinister upon recommendation of theCommittee designated any public areas,workplaces and vehicles asnon-smokingareas,anoperatorshallarrangeforsuchplacesorvehiclestobeinthefollowingnatureorcharacteristics:

Section 44 In the smoking area designated as smoking areaunderSection41,paragraphtwo,anoperatormayarrangeforasmokingareatobeinthefollowingnatureandcharacteristics: (1) putupthesmokingareasignwhichisclearlyvisible (2) notlocatedintheentrance/exitareaoftheplaceorvehicleorinanyclearlyvisibleanddisclosedarea (3) beinclearlyseparatedarea,takingintoaccounttheproperventilation,andhavenocharacteristicwhichmaydisturbothers (4) exhibitthemediaforcampaignforreductionandcuttingdownontobaccoproductsconsumptionasprescribedandannouncedbytheMinisteruponrecommendationoftheCommittee (5) beinothernatureandcharacteristicsasprescribedbytheMinisteruponrecommendationoftheCommittee

Section 45Thenon-smoking signunderSection43(1) or thesmokingsignunderSection44(1)arrangedbyanoperatormustbeinaccordancewith the characteristics andprocedureas prescribedandannouncedbytheMinisteruponrecommendationoftheCommittee.

Section 46Anoperatorshallhavethedutytopubliciseorwarnthatthatplaceisanon-smokingareaandcontrol,warnortakeanyotheracttopreventsmokinginthenon-smokingarea.

Chapter 6Competent Officers

Section 49AcompetentofficerinanypositionorlevelshallhavethepowerasprescribedinSections47and48,inwholeorinpart,orshallreceiveapprovalfromanypersonbeforetakingaction.Theperformanceof duties and thequalificationsof competent officers in eachpositionor level shall beasannouncedandprescribedby theMinister. In theperformanceofduties,anassignmentpapershallbeprepared for theassignedcompetentofficertocarryandpresenttorelatedpersons.

Section 50A related person shall appropriately facilitate acompetentofficerintheperformanceofdutiesunderSections47and48.

Section 52 In the performance of duties under thisAct, acompetentofficershallbetheofficerunderthePenalCode.

Chapter 7Penalties

Section 53Any person violating Section 26, paragraph oneorparagraph three,orSection27(1), (2)or (3)shallbesubject toanimprisonment not exceeding threemonths or a fine not exceedingTHB30,000orboth.

Section 56Any person violating Section 30 or Section 31shallbesubjecttoanimprisonmentnotexceedingsixmonthsorafinenotexceedingTHB500,000orboth. If theoffenseunderSection30orSection31 iscommittedbymanufacturer,importerorexporteroftobaccoproducts,advertisementmakerormarketingcommunicationsmaker,thepenaltyshallbeanimprisonmentnotexceedingoneyearorafinenotexceedinghalfoftheexpensesforadvertisementormarketingcommunicationsproduction,wherebythefineshallnotbelessthanTHB1,500,000,orboth. Inadditiontothepenaltiesunderparagraphoneandparagraphtwo,theviolatorshallbesubjecttoafinenotexceedingTHB50,000adaythroughouttheviolationperiodoruntilthesameisperformedcorrectly.

Section 57Any person violatingSection 32, paragraph one,shallbesubjecttoafinenotexceedingTHB100,000. AnypersonviolatingSection32,paragraphtwo,shallbesubjecttoafinenotexceedingTHB50,000.

Section 58AnypersonviolatingSection33shallbesubjecttoafinenotexceedingTHB200,000.

Section 59Any personmanufacturing, importing for sale orgeneraldistribution,advertisingorconductingmarketingcommunicationsoftheproductunderSection34(1),(2)or(3)shallbesubjecttoafinenotexceedingTHB100,000. AnypersonsellingtheproductunderSection34(1),(2)or(3)shallbesubjecttoafinenotexceedingTHB50,000.

Section 60Any business operator who violates Section 35,paragraphone,shallbesubjecttoanimprisonmentnotexceedingoneyearorafinenotexceedinghalfoftheexpensesforcarryingoutsuchactivity,wherebythefineshallnotbelessthanTHB1,500,000,orboth. Inthecaseof theactunderparagraphonewasconductedbyacontractororanypersonassignedtoactunderSection35,paragraphone, the penalty shall be the sameas the business operator’s underparagraphone. Any related personwho violatesSection 35, paragraph one,shallbesubjecttoanimprisonmentnotexceedingoneyearorafinenotexceedingTHB500,000,orboth. Any person violating Section 35, paragraph three, shall besubjecttoafinenotexceedingTHB500,000.

Section 61Any tobacco products retailer who violatesSection 36, paragraph one, shall be subject to a fine not exceedingTHB40,000. AnytobaccoproductsretailerwhodoesnotcomplywithSection36,paragraph twoandparagraph three,shallbesubject toafinenotexceedingTHB5,000.

Section 62 IncasewheretheviolatorofSection26,Section28,Section29,Section32,Section33orSection36,paragraphone,isthemanufacturerorimporteroftobaccoproducts,thepenaltiesshallbethreetimesthepenaltiesprescribedforsuchoffense.

Section 63Anymanufactureror importerof tobaccoproductsfailing to inform the particulars, informing incomplete particulars orinforming false particulars underSection 37, paragraph two, shall besubject to an imprisonment not exceeding sixmonths or a fine notexceedingTHB200,000orboth. Anymanufacturerorimporteroftobaccoproductswhoviolatesthe order prohibiting sale or import or destroying tobacco productsunderSection37,paragraphfour,shallbesubjecttoanimprisonmentnotexceedingoneyearorafinenotexceedingTHB500,000orboth. IncasethepersonviolatingtheorderprohibitingsaleorimportordestroyingtobaccoproductsunderSection37,paragraphfour,isnotthemanufacturerorimporteroftobaccoproducts,thepenaltiesshallbeafinenotexceedingTHB40,000.

Section 64Any person failing to comply with Section 38,paragraphone,shallbesubjecttoafinenotexceedingTHB200,000. AnypersonviolatingSection38,paragraphtwo,shallbesubjecttoafinenotexceedingTHB40,000.

Section 65AnypersonviolatingSection39,paragraphone,shallbesubjecttoafinenotexceedingTHB300,000. Any person violatingSection 39, paragraph two, or failing tocomplywithSection39,paragraphthree,shallbesubjecttoafinenotexceedingTHB40,000.

Section 72Any person failing to pay the fine per the orderissuedbyacompetentofficerunderSection48(6)withinaprescribedperiodwithout reasonablegroundshall besubject toa fine two timesthefineundersuchorder.

Section 73 Inthecasewheretheoffenderisajuristicperson,ifthecommissionofoffensebythesaidjuristicpersonarisesasaresultofanorderoractionofadirectororamanagerorapersonresponsiblefor the operations of such juristic person, or in the casewhere suchpersonhasadutytoorderoractandrefrainsfromorderingoractingwhichcausessuchjuristicpersontocommitanoffense,suchpersonshallalsobesubjecttothepenaltiesprescribedforsuchoffense.

Section 74ForalltheoffensesunderthisActwhicharesubjecttoafineonly,theCommitteeortheCommittee-assignedpersonshallhavethepowertofixtheamountofthefinepertheregulationsprescribedbytheCommitteeandpublishedintheGovernmentGazette. After theoffenderpays thefine in thefixedamountwithin theprescribed period, the case shall be deemed to be settled under theCriminalProcedureCode.

Provisional Clauses Section 75 Intheinitialperiod,theNationalTobaccoProductsControlCommitteeshallcomprisethedirectorsunderSection6(1),(2)and(3)andtheDirector-GeneraloftheDepartmentofDiseaseControlshallbethedirectorandsecretary.TheyshallperformthedutiesoftheNationalTobaccoProductsControlCommitteeuntilthequalifiedmembersunderSection6(4)and(5)areappointedbutnotbeyond120daysfromthedateofthisActenforcement.TheDirectorGeneraloftheDepartmentofDiseaseControl shall appoint two officers from theDepartment ofDiseaseControlwhoareresponsiblefortobaccoproductscontrolworksasassistantsecretaries.

Section 76 Intheinitialperiod,theBangkokTobaccoProductsControlCommitteeshallcomprisethedirectorsunderSection16(1),(2)and(3)andtheDeputyDirectoroftheBMA’sHealthDepartmentshallbeappointedbytheBangkokGovernortobeamemberandsecretary.TheyshallperformthedutiesoftheBangkokTobaccoProductsControlCommittee until the qualifiedmembers under Section 16 (4) areappointedbutnotbeyond120daysfromthedateofthisActenforcement.TheBangkokGovernorshallappointtwoofficersfromtheBMA’sHealthDepartmentasassistantsecretaries.

Section 77 Intheinitialperiod,theProvincialTobaccoProductsControlCommittee shall comprise thedirectors underSection21 (1),(2)and(3)andtheProvincialPublicHealthChiefshallbememberandsecretary.TheyshallperformthedutiesoftheProvincialTobaccoProductsControlCommitteeuntilthequalifiedmembersunderSection21(4)areappointedbutnotbeyond120daysfromthedateofthisActenforcement.TheProvincialGovernor shall appoint twoofficers from theProvincialPublicHealthOfficeasassistantsecretaries.

Section 78TheparticularsofcomponentsofthetobaccoproductinformedpursuanttotheTobaccoProductsControlActB.E.2535priortothedateofthisActenforcementshallremainvaliduntilitsexpirydateasstatedintheCertificateoftheNotifiedParticularsofComponentsofTobaccoProducts.

Section 79AllMinisterialRegulationsandNotifications issuedundertheTobaccoProductsControlActB.E.2535andtheNon-Smokers’HealthProtectionActB.E.2535enforcedonthedaypriortothedateofthisActenforcementshallremaininforcesolongastheydonotinconflictwithorcontradicttothisActuntiltheMinisterialRegulations,RulesandNotificationsissuedunderthisActcomeintoforce. TheMinisterialRegulations,RulesandNotificationsunder thisAct shall be completely issuedwithin1 year from thedateof thisActenforcement.Otherwise, theMinistershall report thegroundsforsuchfailuretotheCabinet.
