Guidelines on the size of advertisements in theprint media, magazines, shop fascias, bill boardsand use of electronic media for the tobacco andtobacco products advertisements:
Tobacco ads in the press will not be more than onesquare inch (effective May 31, 2007).

a) Manufacture packets of cigarettes, or
b) Sell or offer for sale cigarettes from packets of cigarettes,
or
c) Possessor sellor offerfor sale of packets if cigarettes, onwhich the warning is not printed

Section 5
Penalties:
(1) whoever contravenes any provision of section 4 shall bepunishable with imprisonment for a term which may
extend to two years, or with fine which may extend to tenthousand rupees , or with both.
(2) where a Court convicts a person of an offence
punishable under sub section (1), it shall direct that thepacket of cigarettes and the cigarettes in respect of whichthe offence has been committed be forfeited to theFederal Government.

Offences by companies:
If the person contravening any provision of section 4 bea companyor other body corporate, every director,manager, secretary or other officer or agent thereof shall,unless he proves that the contravention took placewithout his knowledge or that he exercised all due
diligence to prevent such contravention, be deemed to beguilty of such contravention.
