William J. Krycia MPH, CIH Senior Safety Engineer Cal/OSHA Enforcement Heat Illness Prevention and Enforcement Coordinator Statewide Agricultural Health and Safety Coordinator Mr. Krycia has been with the Division of Occupational Safety and Health for over 35 years. During that time, Mr. Krycia has conducted well over 600 inspections in all industries. Mr. Krycia has been the lead person on multiple major occupational incident investigations, including the

Dunsmuir metam sodium spill, numerous PSM events, and others. Mr. Krycia managed the Region II enforcement unit for over 20 years. Mr. Krycia’s current focus is on agricultural health and safety and heat illness prevention and enforcement on a statewide basis. Mr.Krycia is the External Advisory Board Chairperson for the NIOSH Western Center for Agricultural Health and Safety located on campus at the University of California at Davis. Mr. Krycia is the Agricultural Safety Work Group Lead person for the NIOSH/National Occupational Research Agenda (NORA). He is also an American Board of Industrial Hygiene Certified Industrial Hygienist. Mr. Krycia is a graduate of the University of Michigan School of Public Health, Ann Arbor, and holds a Master’s in Public Health (MPH).

Breakout Session #1B - 9:15 AM - 10:15 AM Human Error: There Is NO Root Cause Richard Pollock Accidents do not occur in a linear construct, like the domino effect. Causation is multi-dimensional, and is more difficult to pinpoint and predict than previously thought. This interesting and thought provoking session will discuss:

• the effects of systems design and organizational influence on error, • the reality of “work as imagined” vs. “work as done”, • the variability of work and level of risk, and the impact on control reliability, • the effects of systems design and organizational influence on error, • the Human Factors Analysis and Classification System (HFACS) used to

detect these influences, • Sidney Dekker’s reasoning why, in the end, human error has no reliable root

cause.

Richard Pollock, CSP President - Senior Consultant CLMI Safety Training Past President 2012-2013 - American Society of Safety Engineers Rick Pollock is a graduate of the University of Wisconsin – Whitewater, a Certified Safety Professional (CSP, ASP), and the President and founder of CLMI Safety Training. He specializes in organizational and human performance, human factors and adult education. Mr. Pollock is a Past President of ASSE and currently serves as a Director on the Board of Certified Safety Professionals

(BCSP). He is the Vice President of the International Network of Safety and Health Practitioner Organizations (INSHPO), and serves on the Advisory Boards of the University of Minnesota’s School of Public Health and NIOSH Education Resource Center, and the University of Wisconsin – Whitewater Department of Occupational & Environmental Safety. Through study and hands-on experience, Mr. Pollock has developed a unique understanding of human error in the context of work and error tolerant systems design. He shares his perspective through published articles, frequent speaking engagements, and his Safety Leadership blog. Rick is a trained instructor in the Human Factors Analysis and Classification System (HFACS), and consults with clients to help define their human error issues and appropriate interventions.

Breakout Session #1C - 9:15 AM - 10:15 AM A New View Of Safety Excellence Ron Gantt Safety Differently – A New Model for Safety Excellence Current safety management methodologies within organizations are based on outdated and incomplete models of organizational management and human performance, some of which are over 100 years old. No wonder while the world changes ever more rapidly, the safety profession is seeing increasingly diminishing returns for the effort in exerts in terms of serious injury and fatality prevention. Yet, the safety profession continues to press ahead, doing what we’ve always done, and getting what we’ve always gotten, at least partly because it does not see any other alternative. This seminar will present a new model of safety management based on a diverse range of sources, such as complexity theory, cognitive engineering, safety science, and the social sciences. Using a variety of case studies and presenting a foundation of research support, gaps in the current paradigms of safety management will be highlighted.

Ron Gantt is Vice President of SCM. He has 15 years experience as a safety leader and consultant in a variety of industries, such as construction, petrochemical and the public sector. Ron has a graduate degree in Advanced Safety Engineering and Management as well as undergraduate degrees in Occupational Safety and Health and Psychology. He is also pursuing a doctorate degree in safety science, focusing on

organizational drift. He is a Certified Safety Professional, a Certified Environmental, Safety and Health Trainer, and an Associate in Risk Management. Named by the National Safety Council in 2013 as a Rising Star in Safety, and winner of the Young Talent sponsorship in 2015 by the Resilience Engineering Association.

Breakout Session #1D - 9:15 AM - 10:15 AM Oil & Ag Safety: The Same Or Different? Sean McNally Sean McNally Sean McNally is the President and CEO of KBA Engineering in Bakersfield, California. Prior to KBA, he was the Vice President for Corporate and Government Affairs and Vice President of Human Resources at Grimmway Farms in Bakersfield, California (1997-2012). He graduated from the University of San Francisco with Bachelor’s Degrees in English and Theology. In 1979 and 1980 he did graduate theology studies at Hebrew University in Jerusalem, Israel. He is a graduate of the University of the Pacific, McGeorge School of Law. He has been certified by the State Bar of California as a Specialist in Workers’ Compensation Law. He was appointed by Governor Schwarzenegger to the Commission on Health, Safety and Workers’ Compensation (CHSWC) and he was the Chair in 2009, 2011. He was reappointed by Governor Brown and was the 2015 Chair. He was also appointed by Governor Schwarzenegger to the State Board of Food and Agriculture. He serves as a trustee for the California Self Insurer’s Security Fund and he is the Co-Chair of the California Chamber of Commerce Amicus Committee. His community activities include serving on the Board of Directors of the Golden Empire Gleaners, the Mercy Hospital Foundation, the Kern County Fair and Stockdale Country Club.

Abigail Lewis, STS Abigail Lewis, STS is a Compliance Specialist with Amber Chemical Inc. She has a degree in ERM with a Concentration in Occupational S&H Management from CSUB. In her position at Amber Chemical Inc., Abigail has been responsible for updating Safety Data Sheets and Hazardous Materials Labeling to comply to the GHS Standard. She also assists in the creation of SOPs, Site Surveys, and Driver Documentation Tracking. She is an ASSE Bakersfield member and is a Safety Trained Supervisor (STS) by the Board of Certified Safety Professionals.

Isabel C. Bravo, PHR Wonderful Citrus-Farming Isabel C. Bravo is the Director of Environmental, Health and Safety at the Wonderful Citrus Company. She joined the organization in May of 2015. She has worked in the health and safety field for over nineteen years. She is a Professional in Human Resources and holds a Qualified Applicators License from the State of California. Isabel graduated with honors with a Bachelor of Science degree in Business Administration from California State University, Bakersfield with a concentration in Human Resources. Isabel served as the first Director of Education for AgSafe for two years. Isabel was the Safety and Workers Compensation Manager at Sunview Vineyards of CA, Inc. for over seven years and worked at Grimmway

Farms Enterprises Inc. as a safety coordinator and trainer for six years. In her roles, Isabel has developed and created several safety training programs. She has a passion for working with employees and management in improving safety in their workplace.

Mick Swen, CSP, MBA, Aera Energy LLC Mick Swen is a Health & Safety Supervisor for Aera Energy and has been in the safety profession for over 25 years including a number of years as an EHS trainer. He is a past president of the Bakersfield Chapter of ASSE and is recognized by the Board of Certified Safety Professionals. He is a lifelong Bakersfield resident. He is a husband, father and grandfather. Chris Vochoska, CSP, MBA Chris Vochoska, CSP, MBA - EHS Training Advisor for Aera Energy LLC Chris has a BS in Industrial Technology and an MBA in Finance from the University of Houston. In this workshop, Robin will discuss the essential communication characteristics of leadership and provide helpful tips on how participants can immediately become better communicators.

Robin Paggi is the Training Coordinator at Worklogic HR, a Bakersfield-based human resources outsourcing company. She creates and delivers training on subjects such as communication, supervisory skills, team building, and harassment prevention. She also provides one-on-one coaching to individuals needing to improve their HR knowledge, leadership skills, and communication skills. Robin is a Senior

Professional in Human Resources with a state-specific certification in California (SPHR-CA), a Certified Professional in Learning and Performance (CPLP), a Certified Professional Coach (CPC), a Master Practitioner in administering the Myers-Briggs Type Indicator, and a DISC certified trainer. She also has master's degrees in Communication Studies and Human Resource Development and celebrated her 20th anniversary as a trainer in 2015.

Learn what steps you can take to help CDI and your DA's Office fight workers' compensation fraud. Learn how to better investigate fraud and tips on referring cases for prosecution. Learn what resources are available to assist you and how to make the most out of those limited resources.

David Wolf, Deputy District Attorney David Wolf has been prosecuting criminals for over two decades. He is an award-winning prosecutor and has prosecuted crimes ranging from misdemeanors to murders. Mr. Wolf has provided anti-fraud training for law enforcement, civic groups, and businesses.

He also volunteers with the Kern County Search and Rescue. Mr. Wolf will also review the steps that the District Attorney’s Office is taking to fight workers’ compensation fraud. The presentation will hopefully be humorous and informative.

Eric Charlick Capt California Dept. of Insurance Eric Charlick is the Captain of the Fresno CDI office and is charged with overseeing all aspects of insurance fraud investigation. After working in the San Diego office for 13 years he was promoted to Fresno. While in San Diego he worked on the Regional Auto Theft Task Force

and then supervised the major auto fraud team. Since coming to Fresno as a Captain in 2013 the Fresno Detectives have worked a number of major workers’ compensation provider fraud cases including the shuttering of clinics in Bakersfield, Tulare and Fresno. Captain Charlick’s only hobby is spending time with his 28 month old baby girl, Kaitlyn.

STEVE WALKER California Operation Lifesaver – Authorized Volunteer Presenter California Operation Lifesaver Board Secretary Customer Relations/Safety &Security Supervisor San Joaquin Regional Rail Commission Steve has served on the Board of Directors for California Operation Lifesaver since 2008 and has been the Board Secretary since

January 2013. In this role, Steve collaborates with industry peers in guiding California’s policies and programs with regard to rail safety. Steve is also a member of the Northern California Rail Safety Team where the collaboration and rail safety efforts are focused regionally versus statewide. As a California Operation Lifesaver Authorized Volunteer and Coach/Trainer, Steve provides Operation Lifesaver rail safety presentations to diverse professions and age groups. Steve’s background in rail safety provides him with vast knowledge that supports the Operation Lifesaver mission to reduce injuries and fatalities at highway-rail grade crossings and along railroad rights of way. As the Customer Relations/Safety &Security Supervisor, Steve has oversight for SJRRC’s safety and security programs and stakeholder outreach. He is also responsible for the implementation of the agency’s training and exercise program. Steve is responsible for the authoring and implementation of SJRRC’s Homeland Security Grant Program resulting in the annual award of grants totaling over $1 million for equipment, training and administrative support for antiterrorism programs. Steve’s extensive background as a Reserve Police Officer of more than 20 years helps when working with first responders on exercises, training and response support. Steve is passionate about educating the public about the Operation Lifesaver See Track? Think Train! message that he believes can save lives.

It will cover how the drought is affecting agriculture and what farmers are doing and need to do to be able to continue farming. Mr. Del Bosque has become a vocal advocate for water rights for farmers. Presentation learning points:

JOE L DEL BOSQUE Joe L Del Bosque is a farmer from Firebaugh, California. He has been involved in farming all his life on the irrigated Westside of the San Joaquin Valley where his family settled after years of migrant farm work. He graduated from California State University, Fresno in 1975, and began his own farm in 1985. Today his farm produces melons, both organic and conventional, almonds, asparagus, processing tomatoes, and cherries. Del Bosque was appointed by Governor Arnold Schwarzenegger to the California Water Commission in 2010, and he was reappointed by Governor Jerry Brown in 2014 to an additional four-year term. He serves on the Board of Directors of the Central Valley Community Foundation and the Agricultural Foundation of

CSU Fresno. He is Past Chair of AgSafe, a non-profit organization dedicated to developing safe working conditions for workers in agriculture. He formerly served as a director of the Pacheco Water District and the San Joaquin Valley Drainage Authority. Del Bosque is a member of the California Latino Water Coalition, Western Growers Association, California Melon Research Board, and California Farm Bureau. In 2015, Del Bosque was recognized with the Agriculturalist of the Year Award by the Fresno Chamber of Commerce. Del Bosque is an advocate for California agriculture, and has been featured in national and international news, including NPR, CBS, NBC, BBC, Univision, LA Times, and many others. In February of 2014, President Barack Obama and Governor Jerry Brown visited Del Bosque Farms to focus on, and better understand, California’s drought. Del Bosque is married to his partner, Maria Gloria, and together they have six daughters.

Breakout Session #1J - 9:15 AM - 10:15 AM Fantastic Adventures In Industrial Hygiene Michael Ridosh This presentation describes the career of Michael Ridosh as a Certified Industrial Hygienist. He has had many fascinating assignments, including inspections of expensive homes, employee exposure testing in a wide variety of manufacturing facilities, Safety Supervisor for an environmental remediation project in Vietnam, and working in the entertainment industry. He hopes that this presentation will acquaint the audience with possible opportunities and encourage interested people to pursue a career in the field of industrial hygiene.

Michael Ridosh, CIH Michael Ridosh graduated Notre Dame in 1957. Earned a BS in Chemistry at California State University, Northridge, 1971, after 2 years in the U.S. Army. Completed an MBA at California Lutheran College in 1981. Worked as a

chemist in aerospace, then environmental. Worked with EPA Region 9 in environmental emergency response. Now has more than 40 years of experience in laboratory analysis, project management, hazardous materials training and remediation. Became a Certified Industrial Hygienist in 1993. Started E-MAR Resources in 1994. Performs mold, VOC, metals, particulate, indoor air quality and noise exposure studies in industrial and residential settings. Worked with film productions doing safety monitoring. Acted as safety officer on a remediation project for Agent Orange in Vietnam.

Breakout Session #2A - 10:45 AM - 11:45 AM 2016 Political Climate Shannon Grove This session will discuss changes in the 2016 Political Climate from the perspective of California Assemblywoman Shannon Grove. Assemblywoman Shannon Grove Shannon Grove represents the 34th Assembly District encompassing the majority of Kern County. She was first elected to the California State Assembly in November 2010 as the first woman veteran to serve in that legislative body, and overwhelming elected to second and third terms in 2012, and 2014. Shannon was born and raised in Kern County and graduated from Arvin High School. She joined the United States Army after high school and served in Frankfurt, Germany. She and her sister-in-law founded Continental Labor and Staffing Resources in 1993 and today Shannon presides as the company’s Chief Executive Officer. This year, Shannon was named Vice Chair to the Assembly Committee on Human Services, which oversees child welfare services and foster care, as well as programs that offer assistance and protection to seniors and to the developmentally disabled. Shannon’s committee assignments also include the Agriculture Committee, where she advocates for the preservation and prosperity of California's Bread Basket, and the Assembly Budget Committee, where she is an outspoken advocate for fiscal responsibility and restraint in spending taxpayers’ dollars. A longtime business owner, Shannon became active in the political process to advocate for worker’s compensation reform. As a result of her two-year participation in promoting this change, she was honored with the California Legislature’s "Small Business Award" in 2005 by then-Assemblyman Kevin McCarthy. Shannon is a member of the Brimhall Road Assembly of God. She resides in Bakersfield with her husband Rick, and they are the parents of 5 grown children.

Breakout Session #3A - 2:30 PM - 3:30 PM Emergency Regulations To Implement The Statewide Oil Spill Prevention And Response Program Joy Lavin-Jones & Robert Chatman The Department of Fish and Wildlife’s Office of Spill Prevention and Response (OSPR) is responsible for preventing, preparing for, and responding to oil spills. The program for oil spills in marine waters includes oil spill contingency planning, financial responsibility, drills and exercises, performing inspections and investigations, tracking spills, directing spill response and cleanup efforts, and determining appropriate restoration for injured wildlife and lost habitat. Authority had been limited to activities in marine waters, but SB 861 (Chapter 35, Statues of 2014) expanded OSPR’s jurisdiction to all “Waters of the State”, and in doing so created a Statewide Oil Spill Prevention and Response Program. This presentation will give an overview of the new Statewide Program which covers all state surface waters at risk of oil spills from any source, including production facilities, pipelines and the increasing shipments of oil transported by railroads. Among the program details covered in the presentation are the following elements: • Robust Contingency Plans • Verification of Financial Responsibility • Response Equipment & Capability Requirements • Periodic Drills/Testing, to ensure readiness and competence • Exemption and Compliance Inspections FAQ

Joy Lavin-Jones Joy Lavin-Jones has worked for the Department of Fish and Wildlife’s, Office of Spill Prevention and Response (OSPR) since 1996. She serves as a staff specialist responsible for OSPR’s regulation development, and legislative analysis and coordination. As both a prevention and response organization, OSPR has the Department of Fish and Wildlife’s public trustee and custodial responsibilities for protecting, managing and restoring the State’s fish, wildlife, and plants. It is one of the few State agencies in the nation that has both major pollution response authority and

public trustee authority for wildlife and habitat. Ms. Lavin-Jones received her Bachelor of Science Degree from California State Polytechnic University, Pomona, CA.

Bob Chatman, has over thirty four years of maritime and oil spill prevention experience. Bob worked as a Tankerman for Crowley Maritime in Long Beach, CA. for 11 years, California State Lands Commission-Marine Facilities Division for 23 years and is currently with the Department of Fish and Wildlife’s OSPR Office of Spill Prevention and Response Division. He has acted as a liaison with USCG, Air Quality Management District (AQMD), Shipping Agents, Tug and Barge Companies, and the LA/LB Pilots Association and Stakeholders.

In January 2013, the oil and natural gas industry in Kern County approached the Kern County Planning Department with their request for an amendment to the Kern County Zoning Ordinance for Oil & Gas Production. The applicants – Western States Petroleum Association (WSPA), California Independent Petroleum Association (CIPA), and the Independent Oil Producers Agency (IOPA) – understood that such a request would require the preparation of an extensive Environmental Impact Report in accordance with the California Environmental Quality Act (CEQA). Now that this report has been approved by the County Board of Supervisors and the permitting structure went into effect on December 9th, 2015, numerous details must be implemented in order to permit production going forward. Sandra Sanchez is currently a safety advisor for Continental Labor & Staffing Resources, a Safety Consultant for Continental Safety Consulting in Bakersfield CA and a Risk Management Consultant for Aspen Risk Management Group based out of San Diego. She holds a B.S. from Cal Poly, San Luis Obispo in Industrial Technology and a minor in Packaging.

John B. Stark, Ph.D, California State University, Bakersfield Dr. John B. Stark is an Associate Professor of Management entering his sixteenth year at California State University, Bakersfield. He has served in various campus leadership positions, including Chair of the Academic Senate, Department Chair of Management & Marketing, and most recently, he is serving as the Associate Dean of the School of Business & Public Administration. Stark returned to academia after sixteen years of practical experience in small and medium-sized organizations, in both the private and public sectors. After receiving

his PhD in Business Administration from the University of Missouri at Columbia, his primary areas of instruction have been organizational behavior, small business management, and managerial skills, teaching in the undergraduate, masters, and EdD programs. His research is in the development of trust and in conflict resolution. Stark is also a consultant for area businesses in strategic planning and the development of managerial skills.

Breakout Session #3G - 2:30 PM - 3:30 PM Workers Compensation, FMLA/CFRA and ADA/FEHA: The Worlds Collide Daniel Klingenberger The overlapping rights and obligations under these statues and regulations can create significant confusion for employers. Compliance with one set of laws can create liability under another. This session will untangle this complicated web of laws and explain how employers can prepare to deal with their many obligations.

Mr. Klingenberger has nearly 30 years of experience representing large and small companies in all forms of employment litigation, including wrongful termination, sexual harassment, overtime compensation, wage and hour violations, unfair competition/trade secret issues and many forms of discrimination. He also works with employers on union/management issues, including union organizing, picketing and work stoppages. He represents employers in collective bargaining negotiations and labor arbitrations involving employee discipline and contractual disputes. Dan graduated from the McGeorge School of Law in 1986. Mr. Klingenberger joined LeBeau-Thelen, LLP in late 2014.

Today, Dan counsels employers on the development of employee handbooks and other company policies. He also advises employers on day-to-day employee and business planning matters. Dan is also extensively involved with training supervisors and owners on employment law matters, including unlawful harassment prevention training, union avoidance and workplace violence. Dan is a frequent speaker before business and professional groups. Mr. Klingenberger has served on several community boards and organizations, including Chairman of the Board for both the Bakersfield Chamber of Commerce and United Way of Kern County.
