Extension of Temporary Exemption to Section II of the Pilot Board’s Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel for

Liquified Natural Gas Carrier and Suezmax Class Vessels.

SUMMARY: Staff requests the Pilot Board adopt an order extending the temporary exemptions in Section II of the Pilot Board’s Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel for Liquified Natural Gas Carrier and Suezmax class vessels.

BACKGROUND: Section II of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel (“Pilot Rules”), adopted August 1, 2013, defines certain limitations and restrictions for vessels transiting the Corpus Christi Ship Channel. Liquefied Natural Gas Carriers (“LNGC”) represent a new class of vessels transiting the CCSC. On August 21, 2018, the Pilot Board approved a temporary rule change that exempts LNGCs from the requirements of Section II, including Daylight Only Passage Restrictions. The original exemption period provided for a term of one (1) year and allowed for a twelve-month extension. The 12 -month extension was granted August 20, 2019. A six (6) month extension is requested until the Aransas-Corpus Christi Pilots (“ACC Pilots”) recommend rules and regulations for LNGCs on the CCSC. The temporary exemption does not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC. The ACC Pilots continue to evaluate the rules and regulations governing LNGC vessels and an extension of the trial period is necessary for the evaluations to continue. On August 20, 2019, the Pilot Board adopted an order authorizing a temporary exemption for Suezmax class vessels from the restrictions in Section II of the Pilot Rules, including Daylight Only Passage Restrictions, for a period of six (6) months with the option to extend the trial period for an additional six (6) months, if necessary. The temporary exemption for Suezmax class vessels was extended and will expire on August 31, 2020. The ACC Pilots have requested an additional one (1) year extension of the temporary exemption for Suezmax class vessels before they recommend rules and regulations to the Pilot Board for Suezmax class vessels.

On July 16, 2020 the South Texas Waterway Advisory Committee (“STWAC”) held a meeting and agreed by majority vote to recommend a six (6) month extension of the temporary exemption for LNGC class vessels and a one (1) year extension of the temporary exemption for Suezmax class vessels. Both temporary rule changes will commence on August 18, 2020. Notice of these proposed rule changes was posted in accordance with the requirements of Section 70.021 of the Texas Transportation Code. ALTERNATIVES: N/A

CONFORMITY TO PORT POLICY: Complies with Chapter 70 of the Texas Transportation Code which provides the Port Commissioners serve as the Board of Pilot Commissioners for the Port of Corpus Christi with exclusive jurisdiction over the Aransas-Corpus Christi Pilots. EMERGENCY: N/A

THE BOARD OF PILOT COMMISSIONERS

FOR THE PORT OF CORPUS CHRISTI AUTHORITY

Whereas, the current Rules and Regulations Governing Pilots and Pilotage on the Corpus

Christi Ship Channel (“Pilotage Rules and Regulations”), approved and adopted by the Board of

Pilot Commissioners for the Port of Corpus Christi Authority (“Pilot Board”) in accordance with

Chapter 70, Texas Transportation Code, are attached hereto as Attachment One; and

Whereas, on August 21, 2018, the Pilot Board adopted an order authorizing a temporary

exemption for Liquified Natural Gas Carrier (“LNGC”) class vessels from the restrictions in

Section II of the Pilotage Rules and Regulations, including Daylight Only Passage Restrictions;

and

Whereas, the temporary exemption was extended by the Pilot Board on August 20, 2019,

for an addition one (1) year term; and

Whereas, the Aransas-Corpus Christi Pilots (“ACC Pilots”) have requested an additional

six (6) month extension of the temporary exemption for LNGC class vessels before they

recommend rules and regulations to the Pilot Board for LNGC class vessels; and

Whereas, on August 20, 2019, the Pilot Board adopted an order authorizing a temporary

exemption for Suezmax class vessels from the restrictions in Section II of the Pilotage Rules and

Regulations, including Daylight Only Passage Restrictions, for a period of six (6) months with the

option to extend the trial period for an additional six (6) months, if necessary; and

Whereas, the temporary exemption for Suezmax class vessels was extended and will expire

on August 31, 2020; and

Whereas, the ACC Pilots have requested an additional one (1) year extension of the

temporary exemption for Suezmax class vessels before they recommend rules and regulations to

the Pilot Board for Suezmax class vessels; and

Whereas, notice of the proposed rule change was posted in accordance with the

requirements of Section 70.021 of the Texas Transportation Code;

NOW, THEREFORE, BE IT RESOLVED by the Pilot Board that:

Section 1. The Pilot Board hereby amends the Pilotage Rules and Regulations by revising

Section II of the Pilotage Rules and Regulations.

Section 2. Pursuant to the power and authority granted to the Pilot Board in Section 70.016

of the Texas Transportation Code, the Pilot Board hereby amends the Pilotage Rules and

Regulations by revising Section II thereto to read as follows:

II LIMITATIONS AND RESTRICTIONS

Draft Restrictions

The Maximum Draft for any Vessel transiting the CCSC will be 45 feet (13.72 meters), and with a

positive tide reading.

Combined Beam Restrictions

The following Combined Beam Restrictions will apply to all Vessels:

• Within Cut A, the permissible combined beam for passing Vessels is 265 feet (80.77

meters).

• Within Cut B, the permissible combined beam for passing Vessels is 215 feet (65.53

meters).

• Within the Inner Harbor, at the location of the ADM and Citgo Docks, the permissible

combined beam for passing Vessels (including combined beam of Vessels berthed at

ADM and Citgo Docks) is 357 feet (108.81 meters).

Daylight Only Passage Restrictions

The following vessels are subject to Daylight Only Passage Restrictions:

• All Vessels greater than 900 feet (274.32 meters) Length Over All (LOA)

• All Vessels greater than 130,000 Deadweight Tonnage (DWT)

• All Vessels greater than 250 feet (76.20 meters) transiting “Dead Ship”

• All Vessels subject to USCG Letter of Deviation requiring Tug Escort

• All Vessels with greater than 26 feet (7.92 meters) trim, when passing under the Harbor

Bridge

• All Category One Tankers

The following applies to all Vessels subject to Daylight Only Passage Restrictions as per these

Rules:

• Inbound Passages are restricted to Pilot boarding no earlier than ½ hour before Sunrise,

and no later than the times detailed below for the various locations.

• Outbound Passages are restricted to Pilot boarding no earlier than Sunrise, and no later

than the times detailed below for the various locations.

o From Viola Basin - 5 ½ hours before Sunset

o From Tule Basin - 5 hours before Sunset

o From Chemical Basin - 4 ½ hours before Sunset

o From Avery Basin - 4 hours before Sunset

o From Main Basin - 3 ½ hours before Sunset

Suezmax Temporary Exemption – 1-year extension (Effective September 1, 2020) Effective September 1, 2019, the Pilot Board adopted a temporary rule change exempting the following vessels (excluding VLCC’s) from the Daylight Only Passage Restrictions while transiting Cut A of the Corpus Christi Ship Channel with no cargo onboard in a ballast condition. • All Vessels greater than 900 feet (274.32meters) Length Over All (LOA) • All vessels greater than 130,000 Deadweight Tonnage (DWT) The temporary exemption is contingent upon one-way traffic in Cut A for all ocean-going vessels when transiting at night. The temporary rule change (currently set to expire August 31, 2020) is hereby extended for an additional one (1) year term and will now expire on August 31, 2021. The temporary exemption shall not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC. On or before the expiration of the temporary exemption period, the Pilots will recommend rules and regulations effecting Suezmax class vessels for Pilot Board consideration. One Way Traffic Restrictions

The following Vessels will be restricted to One Way Traffic within Cut B:

• All Vessels greater than 900 feet (274.32 meters) Length Over All (LOA)

• All Vessels greater than 130,000 Deadweight Tonnage (DWT)

• All Vessels greater than 250 feet (76.20 meters) transiting “Dead Ship”

The following Vessels will be restricted to One Way Traffic within both Cut A and Cut B:

• All Category One Tankers when transiting at night

Two Pilot Requirements

The following Vessels are required to retain the services of two Pilots for the transit:

• All Vessels greater than 900 feet (274.32 meters) Length Over All (LOA)

• All Vessels greater than 130,000 Deadweight Tonnage (DWT)

• All Vessels greater than 250 feet (76.20 meters) transiting “Dead Ship”

• All Vessels subject to USCG Letter of Deviation requiring Tug Escort

• All Vessels with greater than 26 feet (7.92 meters) trim, when passing under Harbor Bridge

Additional Requirements

All Vessels greater than 1,600 Gross Tons shall have available a functional AIS Pilot Plug.

All Aransas – Corpus Christ Pilots shall be provided with a Portable Pilot Unit for use during the

transit.

LNGC Temporary Exemption – 6-month extension (Effective August 18, 2020) Liquefied Natural Gas Carriers (LNGC) represent a new class of vessels transiting the CCSC. Effective as of August 21, 2018, the Pilot Board adopted a temporary rule change temporarily exempting LNGCs from the requirements of this Section II, including Daylight Only Passage Restrictions. The temporary rule change (currently set to expire August 20, 2020) is hereby extended for an additional six (6) month term and will now expire on February 28, 2021. The temporary exemption shall not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC. On or before the expiration of the temporary exemption period, the Pilots will recommend rules and regulations effecting LNGC class vessels for Pilot Board consideration.

Section 4. The amendment to Section II of the Pilotage Rules and Regulations shall be

effective on August 18, 2020.

Dear Mr. Strawbridge, The Aransas – Corpus Christi Pilots are in support of extending the Liquid Natural Gas Carrier (LNGC) trial period. As you are aware, LNGC vessels are not currently defined in the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel, nor are any of their passage restrictions. The pilots continue to support LNGCs be designated as a new class of vessel in the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel. We embarked on this LNG journey in November 2018 when the first LNGC vessel transited into Cheniere’s Corpus Christi Liquefaction (CLL) terminal and are now in the final stages of our planned evaluation process of this new class of vessel now calling on our waterway. Although this trail period has been very successful, we have faced some setbacks in the amount of available night transits. The recent slowdown in LNG export coupled with the dredging operations this past fall/winter has limited the number of night transits available to allow us to complete our phased evaluation process, and thus our support for a short extension. The pilots remain committed to trying to establish guidelines and concepts that will allow maximum channel utilization on our waterway, and feel that this extension will allow us the ability to continue that process in a safe and responsible manner.

Dear Mr. Strawbridge,

The Aransas-Corpus Christi Pilots feel it is necessary to extend the trial period for Suezmax class tankers

and are in support of an extension. We are continuing to evaluate the viability of safely moving these

large widebody tankers at night and remain committed to determining that this ambitious endeavor can

be done in a safe, efficient, and responsible manner.

The pilots remain diligent in our efforts to establish guidelines and concepts that will allow maximum

channel utilization without compromising safety and extending this trial period will assist us in doing that.

Subj: LNG Carrier Night Trial Period Extension Request for August 2020 Pilot Board Consideration

On behalf of Ari Aziz, General Manager of Corpus Christi Liquefaction, Inc (CCL), the LNG

Representatives of the South Texas Waterways Committee request an extension to be enacted within the

current Rules and Regulations. An extension until February 1st, 2021 is requested for the ongoing trial

period for LNG Carriers (LNGCs) originally approved August 21st 2018 by the PCCA Pilot Board per

the following excerpt:

RULES AND REGULATIONS GOVERNING PILOTS AND PILOTAGE ON THE CORPUS

CHRISTI SHIP CHANNEL EFFECTIVE AUGUST 1, 2013

AMENDED EFFECTIVE AUGUST 21, 2018:

LNGC Temporary Exemption (Effective August 21, 2018) Liquefied Natural Gas Carriers (LNGC) represent a new class of vessels transiting the CCSC. Effective as of August 21, 2018, LNGCs are temporary exempt from the requirements of this Page 2 of 7 272940v5 Section II, including Daylight Only Passage Restrictions. The temporary exemption period shall last for a term of one (1) year and may be extended if necessary until the Pilots recommend rules and regulations for LNGCs on the CCSC. The temporary exemption shall not limit or supersede the on-scene discretion of an individual Pilot or ship’s Master as they navigate vessels on the CCSC.

The Aransas-Corpus Christi Pilots (Pilots) continue to support LNGCs to be designated as a new class of

vessel concerning the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship

Channel. LNGC operational rules reside in the PCCA Pilot Rules as a “Trial Period” for the Pilots to

evaluate.

Since the inaugural visit in November 2018, over 150 vessels carrying LNG have transited to our facility

in Gregory, TX. The pilots performed their first partial night time transit 27 July 2019 when Capt

Grumbles commenced navigation at 0530 from the Sea Buoy to our facility. Since this time the pilots

have successfully performed over 40 LNGCs transits with some portion of the passage during either

partial or full night time conditions, these transits have been both in and outbound.

As such the Trial Period has been deemed very successful so far by the Pilots and Cheniere, however the

trial period faced challenges when many night transit opportunities were unavailable due to the months-

long dredging operations during the fall and winter 2019-2020 timeframe. This short extension request

would allow the pilots to complete their evaluations based upon their accumulated experiences with

these vessels. At the conclusion, the Pilots will report back their recommended Rules and Regulations

for this new class of Vessel to provide the safest and most beneficial means to operate.

CCL operates a Liquefied Natural Gas (LNG) facility along the La Quinta ship channel in the Port of

Corpus Christi. This recommendation for continued night time operations is being made following

years of evaluation; including over two months of actual full mission bridge simulator time, whereby

every Pilot and Tug Captain participated and improved their expertise. This trial period ensures the

LNGC’s higher safety, lesser draft, higher horsepower to weight ratio, faster turning times, and

increased performance are commensurate with the simulator and promote Pilots’ LNGC ship handling

expertise.

Important safety factors for LNGC risk management include:

• Pilot and Tug Captains received intensive, high fidelity simulator training from the Sea buoy to

CCL and return transit in day/night time conditions with certificated training.

• Four specialty-built tugs escort the LNGCs with dedicated trained tug crews.

• LNGC drafts do not exceed 41 feet.

• Pilot-approved Aids to Navigation for this transit have been upgraded and/or newly built.

• The Physical Oceanographic Real Times System (PORTS) supports Pilots’ transit.

• Every LNGC movement is vetted for safety, security and proficiency of the vessel and crew.

Dear Mr. Strawbridge,

As you know, the South Texas Waterways Advisory Committee (STWAC) is a Harbor Safety Committee

comprised of representatives and stakeholders from organizations such as POCCA, Aransas–Corpus

Christi Pilots Association, harbor tugs, refineries, agents, etc.

Per the 2018 Pilot Review Board Bylaws, STWAC recommends one voting member and one alternate to the Pilot Review Board to serve a period of two years. In 2018 STWAC submitted a recommendation for Captain Joe Harrington as primary and Captain Richard

Russell as the alternate, and in 2018 the Pilot Board subsequently approved both for membership.

In June 2020, STWAC was requested to elect representatives to the Pilot Review Board to commence at the end of the August terms of Captains Harrington and Russell. At the July STWAC Meeting, the committee voted unanimously to recommend Commander Xavier F. Valverde, Sr., USN (Ret.) as the primary representative and Captain Joe Harrington as the alternate to the Pilot Review Board. Please contact me if you require additional information.

SUMMARY: On August 11, 2020 Capt. F. Mike Kershaw, a Port/Pilot Liaison consultant, reviewed the Pilot’s master work hours’ logbook for the 2nd quarter of 2020 as required by Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel adopted October 1, 2014. BACKGROUND: Section V of the Rules and Regulations Governing Pilots and Pilotage on the Corpus Christi Ship Channel, adopted October 1, 2014, defines the work-rest requirements for Aransas-Corpus Christi Pilots. Section V states that the pilots will keep a master logbook for all pilots and make it available for inspection by the Pilot Board or its representatives upon request. On August 11, 2020 Capt. Kershaw reviewed the Pilot’s master work hours’ logbook for the 2nd quarter of 2020. Attached is Capt. Kershaw’s report summarizing his inspection. Pilot Work Rest Review

2nd Qt, 2020

Present: Capt. F. M. Kershaw, Capt. Kevin Monaco and staff as needed.

The Aransas Corpus Christi Pilots presented computer generated vessel

movement logs for the 2nd Qt, 2020 for the determination of compliance with

POCCA Pilot Board Rules, Sec. 70:017 State of Texas Transportation

code.

A random review of all full commissioned pilots as well as a total review of

all movements preformed by two (2) commissioned pilots, one from each

watch and all movements preformed by a Deputy Pilot. A total of 355 of

1595 movements where audited finding one (1) overage of .2 hr. attributed

to vessel congestion in MAIN BASIN area.

Based upon the above mentioned audit, I consider the ACCP Pilots to be in

compliance with the Work Rest Rules as set forth in the Pilot Board Rules.
