Sir, This has reference to your application No. Nil dated 28.01.2015 seeking prior Environmental Clearance on the above-mentioned project. 2. The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of Environmental Clearance for proposed Slum and Non-Slum redevelopment project at plot bearing CTS No. 86(PT), 8611 to 76, 207 A, 207 All to 30 of Village Gundavali, Andheri (E), Mumbai, Maharashtra by MIs. Srujan Development & Construction Division. The proposal was considered by the EAC in its meeting held on 9 th - 11th March, 2015. The proponent has informed that: 1. The present proposal involves Slum and Non-Slum redevelopment project at plot bearing CTS No. 86(PT),86/1 to 76, 207A, 207A/l to 30 of Village Gundavali, Andheri (E), Mumbai, Maharashtra by M/s. Srujan Development & Construction Division. The project is located at 19 0 07'13.96" N Latitude and 72 0 51'14.80"longitude. 11. The total plot area is 5236.10 sqm. FSI area will be 15944.02 sqm and total construction area will be 31691.83 sqm. The project will comprise of 02 Buildings. Total 318 flats shall be developed. Maximum height of the building will be 47.00 m. During construction phase, total water requirement is expected to be 50 KLD which will be met by Water Tanker & MCGM, Soak pits and septic tanks will be provided for disposal of waste water. Temporary sanitary toilets will be provided construction labor. During operational phase, total water demand of the project is expected to be 229 KLD which will be met by the MCGM 147KLD & 82KLD from Recycled Water. Wastewater generated (200KLD) uses will be treated in 02 STPs of total 135 KLD capacity 65 KLD of treated wastewater will be recycled (77 KLD for flushing, 5KLD for gardening).     11. The total plot area is 5236.10 sqm. FSI area will be 15944.02 sqm and totalconstruction area will be 31691.83 sqm. The project will comprise of 02Buildings. Total 318 flats shall be developed. Maximum height of the buildingwill be 47.00 m.During construction phase, total water requirement is expected to be 50 KLDwhich will be met by Water Tanker & MCGM, Soak pits and septic tanks willbe provided for disposal of waste water.     Vll. The total power requirement during construction phase is 100 KVA and will bemet from Reliance Energy and total power requirement during operation phaseis 5058.9 KVAand will be met from Reliance Energy.

    V111. Rooftop rainwater of buildings will be collected in two RWH tanks of total 96KLDcapacity for harvesting after filtration.

    ix. Parking facility for 190 four wheelers and 0 two wheelers is proposed to beprovided against the requirement of 190 and 0 respectively (according to localnorms).

    x. Proposed energy saving measures would save about 21% of power.Xl. Wildlife issues: It is located within 10 km of Sanjay Gandhi National Park-

    Eco Sensitive areas.Xll. There is no court case pending against the project.X111. Investment/Cost of the project is Rs 70.00 crore.XIV. Employment potential: During construction phase, the locals will get

    employment opportunity in construction works and also for supply ofconstruction materials. During operational phase, the locals will getemployment opportunity in household works, like maids, drivers, etc and alsofor the maintenance of the premises such as security services, housekeeping,MEP maintenance etc.

    xv. Benefits of the project: Being a slum redevelopment project, the mambenefit will be provision of a house to all the slum dwellers free of cost.

    3. The proposal was considered by the Expert Appraisal Committee (EAC) andrecommended in its 146th EAC meeting held on 9th - 11th March, 2015 for grantingEnvironmental Clearance. The Ministry of Environment, Forest & Climate Changehereby accords Environmental Clearance for the above-mentioned proposed Slumand Non-Slum redevelopment project at plot bearing CTS No. 86(PT),86/1 to76, 207 A, 207 A/Ito 30 of Village Gundavali, Andheri (E), Mumbai, Maharashtraby M/ s. Srujan Development & Construction Division under the provisions of theEnvironment Impact Assessment Notification, 2006 and amendments thereto andCirculars issued thereon and subject to the compliance of the following specificconditions, in addition to the general conditions mentioned below:

    PART A - SPECIFIC CONDITIONS

    I. Construction Phase

    (i) The Project Proponent shall insure that the guidelines issued vide thisMinistry's OM No. 19-2/2013-IA.III dated 09.06.2015, to be followed forbuilding and construction projects to ensure sustainable environmentalmanagement in pursuance of Notification No. 3252 (E) dated 22.12.2014 under the EIA Notification, 2006, as applicable, are followed inthis project.

    (ii) The Project Proponent shall obtain all necessary clearance/ permissionfrom all relevant agencies including town planning authority beforecommencement of work.

    (iii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act, 1981and Water (Prevention and Control of Pollution) Act, 1974.

  • (iv) The environmental clearance is subject to obtaining prior clearance fronwildlife angle including clearance from the Standing Committee of th.National Board for Wildlife as applicable.

    (v) Grant of environmental clearance does not necessarily implies thawildlife clearance shall be granted to the project and that their proposal:for wildlife clearance shall be considered by the respective authorities 01their merits and decision taken.

    (vi) The investment made in the project, if any, based on environmentaclearance so granted, in anticipation of the clearance from wildlife angl.shall be entirely at the cost and risk of the project proponent an:Ministry of Environment, Forests & Climate Change shall not b:responsible in this regard in any manner.

    (vii) The total plot area is 5236.10 sqm. FSI area shall be 15944.02 sqm anctotal construction area shall be 31691.83 sqm. The project will comprisiof 02 Buildings. Total 318 flats shall be developed. Maximum height 0the building shall be 47.00 m.

    (viii) During construction phase, total water requirement is 50 KLD whiclshall be met by Water Tanker & MCGM, Soak pits and septic tanks shalbe provided for disposal of waste water. Temporary sanitary toilets shalbe provided construction labor.

    (ix) During operational phase, total water demand of the project is 229 KLIwhich shall be met by the MCGM 147KLD & 82 KLD from RecyclerWater.

    (x) Wastewater generated (200KLD)uses shall be treated in 02 STPs of tota135 KLD capacity.

    (xi) About 785.9 TPD solid waste will be generated in the project. Th:biodegradable waste (474 TPD) shall be processed in OWC and the nonbiodegradable waste generated (311.9 TPD) shall be handed over trauthorized local vendor.

    (xii) The total power requirement during construction phase is 100 KVjwhich shall be met from Reliance Energy and total power requiremenduring operation phase is 5058.9 kVA which shall be met from RelianceEnergy.

    (xiii) Rooftop rainwater of buildings shall be collected in two RWH tanks 0total 96 KLD capacity for harvesting after filtration.

    (xiv) Parking facility for 190 four wheelers shall be provided against therequirement of 190 according to local norms).

    (xv) The project proponent shall comply with the conditions ofNOC/Clearance obtained from Fire Department.

    (xvi) All the construction shall be in accordance with the local buildingbyelaws. The Project Proponent shall obtain all necessary clearances.

    (xvii) The project proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures with itsallottees, as projected, in perpetuity. This would be monitored by thedesigned Energy Conservation/ efficiency Authority in the State.

    (xviii) D.G set shall be at least 6 m away from the boundary.

    (xix) Temporary toilets will be provided for all construction labour.

    (xx) Suitable toilet fixtures for water conservation shall be provided.

    (xxi) Proponent shall obtain permission for ground water withdrawal fromState Ground Water Authority.

    (xxii) The rainwater harvesting plan should be incorporated by the CGWA.

    (xxiii) Provision shall be made for the housing of construction labour within thesite with all necessary infrastructure and facilities such as fuel forcooking, mobile toilets, mobile STP, safe drinking water, medical healthcare, creche etc. The housing may be in the form of temporary structuresto be removed after the completion of the project.

    (xxiv) A First Aid Room will be provided in the project both during constructionand operation of the project.

    (xxv) All the topsoil excavated during construction activities should be storedfor use in horticulture/landscape development within the project site.

    (xxvi) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposed takingthe necessary precautions for general safety and health aspects ofpeople, only in approved sites with the approval of competent authority.

    (xxvii)Soil and ground water samples will be tested to ascertain that there is nothreat to ground water quality by leaching of heavy metals and othertoxic contaminants.

    (xxviii) Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminate watercoursesand the dump sites for such material must be secured so that theyshould not leach into the ground water.

    (xxix) Any hazardous waste generated during construction phase, should bedisposed off as per applicable rules and norms with necessary approvalsof the State Pollution Control Board.

    (xxx) The diesel generator sets to be used during construction phase shouldbe low sulphur diesel type and should conform to Environment(Protection) Rules prescribed for air and noise emission standards.

    (xxxi) The diesel required for operating DG sets shall be stored in undergroundtanks and clearance from Chief Controller of Explosives shall be taken,as applicable.

    (xxxii) Vehicles hired for bringing construction material to the site should be irgood condition and should have a pollution check certificate and shoukconform to applicable air and noise emission standards and should b.operated only during non-peak hours.

    (xxxiii)Ambient noise levels should conform to residential standards bot1during day and night as per Noise Pollution (Control and RegulationRules, 2000. Incremental pollution loads on the ambient air and nois.quality should be closely monitored during construction phase. Adequanmeasures should be made to reduce ambient air and noise level durin,construction phase, so as to conform to the stipulated standards b:CPCB/ SPCB.

    (xxxiv) Fly ash should be used as building material in the construction as pethe provisions of Fly Ash Notification of September, 1999 and amenderas on 27th August, 2003.

    (xxxv) Ready mixed concrete must be used in building construction.

    (xxxvi) Storm water control and its re-use as per CGWB and BIS standards fovarious applications.

    (xxxvii) Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices referred.

    (xxxviii)Permission to draw ground water shall be obtained from the competenAuthority prior to construction/ operation of the project.

    (xxxix) Separation of grey and black water should be done by the use of duaplumbing line for separation of grey and black water.

    (xl) Fixtures for showers, toilet flushing and drinking should be of low floveither by use of aerators or pressure reducing devices or sensor baseccontrol.

    (xli) Use of glass may be reduced by up-to 40% to reduce the electricitjconsumption and load on air-conditioning. If necessary, use high qualifdouble glass with special reflective coating in windows.

    (xlii) Regular supervision of the above and other measures for monitoringshould be in place all through the construction phase, so as to avoicdisturbance to the surroundings.

    (xliii) Under the provisions of Environment (Protection) Act, 1986, legal actiorshall be initiated against the project proponent if it was found thaconstruction of the project has been started without obtainingenvironmental clearance.

    II. Operation Phase

    (i) Open access shall be provided on front side for the shops.

    (ii) The quantity of fresh water usage, water recycling and rainwaterharvesting shall be measured and recorded to monitor the waterbalance as projected by the project proponent. The record shall be

    submitted to the Regional Office, MoEF&CC along with SIX monthlyMonitoring reports.

    (iii) The treated wastewater of 65 KLD shall be recycled and reused forflushing (77 KLD)and gardening (5 KLD)to reduce the demand of freshwater as committed. About 98 KLD shall be disposed in to municipaldrain.

    (iv) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management & Handling)Rules, 2000. No municipal waste should be disposed off outside thepremrses.

    (v) The Operation and Maintenance of STP shall be made in the MoU withSTP supplier. Project Proponent shall ensure regular operation andmaintenance of the STP.

    (vi) Parking facility with 6 m clear driveway shall be provided as committed.

    (vii) The Project Proponent shall explore the possibilities of reusing thetreated wastewater from nearby projects.

    (viii) The installation of the Sewage Treatment Plant (STP) should be certifiedby an independent expert and a report in this regard should besubmitted to the Ministry before the project is commissioned foroperation. Treated affluent emanating from STP shall be recycled/reused to the maximum extent possible. Treatment of 100% grey waterby decentralized treatment should be done. Discharge of unused treatedaffluent shall conform to the norms and standards of the State PollutionControl Board. Necessary measures should be made to mitigate theodour problem from STP.

    (ix) The solid waste generated should be properly collected and segregated.Wet garbage should be composted and dry/inert solid waste should bedisposed off to the approved sites for land filling after recoveringrecyclable material.

    (x) Diesel power generating sets proposed as source of back-up power forelevators and common area illumination during operation phase shouldbe of enclosed type and conform to rules made under the Environment(Protection) Act, 1986. The height of stack of DG sets should be equalto the height needed for the combined capacity of all proposed DG sets.Use low sulphur diesel. The location of the DG sets may be decided within consultation with State Pollution Control Board.

    (xi) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measured atthe boundary of the building shall be restricted to the permissible levelsto comply with the prevalent regulations.

    (xii) The green belt of the adequate width and density preferably with localspecies along the periphery of the plot shall be raised so as to provideprotection against particulates and noise.

  • (xiii) Rain water harvesting for roof run- off and surface run- off, as plansubmitted should be implemented. Before recharging the surface runoff, pre-treatment must be done to remove suspended matter, oil andgrease. The borewell for rainwater recharging should be kept at least 5mts. above the highest ground water table.

    (xiv) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of theproject design and should be in place before project commissioning. UseCFLs and TFLs should be properly collected and disposed off/ sent forrecycling as per the prevailing guidelines / rules of the regulatoryauthority to avoid mercury contamination. Use of solar panels may bedone to the extent possible.

    PART - B. GENERAL CONDITIONS

    (i) A copy of the environmental clearance letter shall also be displayed 01the website of the concerned State Pollution Control Board. The EC letteshall also be displayed at the Regional Office, District Industries centnand Collector's Office/ Tehsildar's office for 30 days.

    (ii) The funds earmarked for environmental protection measures shall b.kept in separate account and shall not be diverted for other purposeYear-wise expenditure shall be reported to this Ministry and it:concerned Regional Office.

    4. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be given fulcooperation, facilities and documents/data by the project proponents during theiiinspection. A complete set of all the documents submitted to MoEF&CC should beforwarded to the CCF, Regional office of MoEF&CC, Nagpur.

    5. In the case of any change(s) in the scope of the project, the project woulcrequire a fresh appraisal by this Ministry.

    6. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection) Act1986, to ensure effective implementation of the suggested safeguard measures in ctime bound and satisfactory manner.

    7. All other statutory clearances such as the approvals for storage of diesel froITChief Controller of Explosives, Fire Department, Civil Aviation Department, Fores1Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, asapplicable by project proponents from the respective competent authorities.

    8. These stipulations would be enforced among others under the provisions 0:Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention and contro.of Pollution) act 1981, the Environment (Protection) Act, 1986, the Public Liability(Insurance) Act, 1991 and EIA Notification, 2006.

    9. The project proponent should advertise in at least two local Newspapers wideljcirculated in the region, one of which shall be in the vernacular language informingthat the project has been accorded Environmental Clearance and copies of clearanceletters are available with the State Pollution Control Board and may also be seen or

    the website of the Ministry of Environment, Forests & Climate Change athttp://www.envfor.nic.in. The advertisement should be made within Seven days fromthe date of receipt of the Clearance letter and a copy of the same should be forwardedto the Regional Office of this Ministry at Nagpur.

    10. This Clearance is subject to final order of the Hon'ble Supreme Court of Indiain the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of2004 as may be applicable to this project.

    11. Any appeal against this clearance shall lie with the National Green Tribunal, ifpreferred, within a period of 30 days as prescribed under Section 16 of the NationalGreen Tribunal Act, 2010.

    12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and the LocalNGO, if any, from whom suggestions/ representations, if any, were received whileprocessing the proposal. The clearance letter shall also be put on the website of thecompany by the proponent.

    13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall update thesame periodically. It shall simultaneously be sent to the Regional Office of MoEF&CC,the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levelsnamely; SPM, RSPM, S02, NOx (ambient levels as well as stack emissions) or criticalsectoral parameters, indicated for the project shall be monitored and displayed at aconvenient location near the main gate of the company in the public domain.

    14. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to the concernedState Pollution Control Board as prescribed under the Environment (Protection)Rules, 1986, as amended subsequently, shall also be put on the website of thecompany along with the status of compliance of EC conditions and shall also be sentto the respective Regional Offices of MoEF&CC bye-mail.
