TRANSITION IMPLEMENTATION PLAN (TIP) FOR TAITA TAVETA COUNTY
1. Introduction
Distribution of functions between the national government and the county governments are set out in the fourth schedule of the Constitution of Kenya, 2010. In the forestry sector, the County Governments has the duty of “implementing specific national government policies on natural resources and environmental conservation”. For purposes of program implementation, this broad policy framework requires to be “unbundled” so that specific interventions can be identified for implementation by the county governments with the technical support by Kenya Forest Service (KFS). Under the same schedule, the NG is also obligated to conduct capacity building and technical assistance for the CGs in order to create requisite capacity for the implementation of the constitutional obligations for the CGs.
Other provisions touching on the implementation of the functions at the two levels of government are elaborated under Articles 186 (1, 2, 3, 4) and 186(2), 187(1 and 2). Forests on public land as identified under Article 62 (1) (g), vests in and is held by the NG and administered by the National Land Commission (NLC) while public land identified under Article 62 (2)(a) and (b)vests in the CGs and administered by the NLC on their behalf. Implementation of forestry policies and programs for these specific areas (public land) will be the responsibility of each level of government.
The Constitution, Kenya Vision 2030 and other development blueprints have established the need for Kenya to work towards attaining of 10% forests cover. This requires that both the NG and the CGs work closely in order to realize this national goal through program and policy implementation. The NG has over the years, been implementing three core programs namely: (i) Forest conservation and management with focus on the management of natural forests in public land;(ii) Forest plantations and enterprise with a focus on the development of industrial forest plantations on public land; and (iii) farm and dryland forestry development with a focus on the provision of forest extension services for the development of private forests, agro-forestry and technical assistance to tree growers.
With regard to the implementation of the devolved functions, the bigger responsibility for the CGs is the implementation of farm and dryland forestry interventions with technical support by the NG/Kenya Forest Service (KFS). Following the identification of the functions to be devolved by the KFS Board under the farm and dryland forestry development, the orderly transfer of these functions is very important.
It is for this reason that this Transition Implementation Plan (TIP) as provided for under our statutes has been developed to provide this smooth transfer of the identified functions.

2. Policies and Laws governing devolution of forestry functions
In addition to the Constitution of Kenya, 2010, the following statutes are important references to guide the development of the TIPs for every county. These include;
2.1 The Transition to Devolved Government Act No. 1 of 2012
This law provides that a Cabinet Secretary of a State department or, in the case of a public entity, an authorized officer shall submit to the Transition Authority (TA) and the Commission on Implementation of the Constitution (CIC) a transition plan within a period specified by the CIC. The Transition Authority (TA) is obligated to issue guidelines to State organs or public entities for the preparation of TIPs. Section 16(3) further provides that each CG shall submit to the TA and CIC a transition plan and progress reports.
2.2 County Governments Act No. 17 of 2012
This Act provides further structures of decentralization through establishment of the County Intergovernmental Forum (CIF) chaired by the Governor or in his absence, the Deputy Governor, or in the absence of both, a member of the County Executive Committee (CEC) designated by the governor. The CIF shall comprise of;
i. The heads of all departments of the national government rendering services in the county; and
ii. The county executive committee members or their nominees appointed by them in writing.
Responsibilities of County Intergovernmental Forum
Pursuant to the 4thSchedule (Articles 185(2), 186(1) and 187(2) of the Constitution, County Intergovernmental Forum (CIF) shall be responsible for;
i. harmonization of services rendered in the county;
ii. coordination of development activities in the county;
iii. coordination of intergovernmental functions; and
iv. Such other functions as may be provided for by or under any law.
The CG will be expected to establish and strategize the CIF. This is an important forum for supporting discussions and exchange of views on the matters of forestry development in the county.

2.3 County Government laws and policies
Each County has the obligation to develop forest legislations and laws (e.g. charcoal rules) to support implementation of the forestry development activities. KFS will support the county in the process of developing county policies and legislation if necessary.
2.4 National forest management and conservation law and policyKFS and the CGs will continue to partner in the implementation of the national forest policy, legislation and the rules and regulations developed under the Act. This will enable Kenya to implement both the national as well as county forestry programs to support the growth of the forestry sector, create employment and increase tree cover.
3.0 Forestry in Taita Taveta county
1. FOREST COVER IN THE TAITA TAVETA COUNTY
i. Background & Status Information
Taita Taveta forests are a continuation of the Eastern arc monotone forests which though from the Usambara Mountains in Tanzania.
The forests comprise 68 fragments of which 28 are gazetted under the nation government (KFS).The gazetted forest constitute 1,489 ha while the other 40 fragment covering about 7,193ha are county forests and are yet to be gazetted.
ii. Geographical location
The Taita Taveta forests are scattered across the county, though with a higher concentration in Taita and Mwatate sub countys. The forests primarily stand on high grounds (The Taita Hills), with very steep and fragile terrain. Their fragmentation is caused by steep terrain leading to poor accessibility hence long distance covered form one forest fragment to another e.g. the distances are as for as 100km e.g.Kitobo and Kasigau forests in Taveta voi sub countys respectively ,from the center of administration i.e Wundanyi(forest station and ecosystem conservator) offices.
iii. Value of the forests
The value of the forests in the County ranges from environmental services to tangible forest products. The forest, especially those well vegetated, help in the general environmental conservation, carbon sequestration, soil & water conservation and contain a variety of mineral.

iv. Biodiversity
A number of the Taita Taveta forests, the Taita hills, are home to quite a number of rare flora and fauna, some of which are endemic and critically endangered. The Taita hills forest have been classified including IBA (Important Bird Area) on the basis of the famous built species including; - the Taita Apalis, Taita thrush & Taita white eye. The Caecilian (Unique Worm) has also been discovered to be endemic to Sagalla forest. This state of richness in Biodiversity make the forests a beehive of ecotourism and research destination.
v. Water Catchment
Generally, the forest ecosystem in the county, especially the Taita hills are predominantly of indigenous tree cover. Many rivers, streams and springs owe their sources to the forests like; Mbololo and Mwambirwa, Chawia, Kasigau, Sagalla, Kitobo, Ngangao and the local water tower of Iyale. Water from the forest sources sustains livelihoods of the local communities and institutions and beyond the county’s borders.
vi. Forest Products and Services
Forests in the County of Taita Taveta provide the community with a wide range of products and services. These include tangible wood and non-wood products such as; fuel wood, poles, timber, herbs, moss and gum/resin among others. The forests have also enhanced communities’ empowerment by availing conducive environment for development and practice of a number of Nature-based enterprises like, beekeeping, butterfly farming, fish farming, basketry, ecotourism, commercial tree nurseries management and much more.
Further, a lot more forest ecosystem services in environmental conservation are derived from the forests in the County.
2. TYPES OF FOREST WITHIN THE COUNTY
Basically there are 4 types of forests quite distinct in the County; viz:
i. High productive forest - Associated with the humid Taita hills scattered in the county, though with a higher concentration in Taita Sub County. on high. These forests are mainly of indigenous tree cover with isolated portions of plantation forestry e.g. Ngangao, Iyale, Susu/Fururu, Macha/Mwachora etc.

except for Mwambirwa which is wholly exotic save for the water catchment areas. The latter are however increasingly being colonized by self-regenerating Eucalyptus species.

Exploitation on the high forests is however seriously checked by the naturally difficult terrain.
These forests add up to an estimated 1,087ha.
ii. Dry forests - Concentrated in marginal/lower zones of the county where rainfall is minimal and dry spells prolong across the year. The dry forests in the County include; Kinyeshamvua, Mwandango, Irizi, Bura, Kighala, parts of Ronge/Mwambirwa, Salaita and the likes. These add up to an estimated 7,595ha.
iii. Bush/Woodland forest - this category encompasses the Tsavos, Ranches and other private and community forests mainly in the lower zones of the county. NB; The Dry and Bush/Woodland forests have common salient features of difficult and poor tree establishment mainly caused by minimal rainfall and browsing livestock and wildlife.
iv. Farm Forestry - include those trees grown on farm taking the configuration of either boundary planting and, or, on farm or institutional woodlots
3. SPECIES COMPOSITION
The tree species distribution in the County adopts the intra and inters - forests diversity in line with their geographical/ecological placement. In the high forests, indigenous tree species like; Ocotea usambarensis (dominant thus Ocotea forest type), alongside Tabermontana stapfiana , and Aningeria adolfii dominate heights above 1,600m.a.s.l. downslope, grow species like; Newtonia buchananii (dominant-thus Newtonia forest type), alongside Albizia gummifera (cha msidu), Strombosia scheffleri , Nuxia spp (mora), Rapanea melanophloes, Syzygium sclerophyllum (msambarau mwitu) and many others. Acacia mearnsii dents tree population across the forests, but the natural Acacia species such as Acacia balanites, A. tortilis, A. mellifera, A. xanthophloea, etc. are associated more with Kitobo forest as well as the ranches and parks.
Ficus spp , Prunus africuna , Milletia spp and Erythrina, among others are common along the riparian though may also have distribution in the forest areas.
Besides, a considerable portion of exotic tree species including Cypres, Grevillia, Pinus, Callitris, and Eucalyptus is evident in parts of the forests, except for Kasigau.

In general, the tree species distribution is distinctive of the two basic ecological zones in the County, i.e. the high (moist) and low (dry) zones
4. PAST EFFORTS IN AFFORESTATION AND CONSERVATION
Afforestation and forest conservation in Taita Taveta date back to pre-colonial days. The Dawida Communities have a record history in the conservation of their forest resources. This is evident in the fact that quite a number of forests had sites branded as sacred (fighi) which were no-go zones for the general public except approved elders who went there to perform very special traditional rituals. Such restrictions enhanced conservation of forests by controlling access as well as prohibiting any deviant activities e.g. fires etc.
During the colonial days, forests conservation was up scaled. The first Forester of Taita Taveta Forest Station was a British called Mr. Clay who did quite a commendable work in tree planting in areas such as Rong’e – current Mwambirwa forest and many others way back about 1954 - 1958.
Thereafter the former Forest Department (FD) continued with afforestation and conservation works which targeted institutions, setting aside areas for forests, fast tracking forest development by introducing pioneer tree species and in sites which otherwise were persistently bare and unfavorable for natural tree growth e.g. on parts of Ngangao forests.
Many conservation oriented NGOs, CBOs and local community groups have since joined hands to up scale the work. Past records highlight bodies such as EAWS, DANIDA, and Green Belt Movement and many other players in the afforestation and forest conservation work. To date, there are TTWF, TEI, MAZIDO, DaBiCo, KCDP and many others. Above all, the Kenya Forest Service, having been created by the Forest Act No. 7, 2005 and taking over from the defunct FD, has effectively continued to execute its core functions/mandate of developing, conserving and sustainably managing forest resources in the County and the Country as large. The County Government of Taita Taveta has not been left behind in these efforts.
The evidence of all these efforts can be attested to by the existing mature trees within and outside forests in the county.
5. CHALLENGES IN FORESTRY DEVELOPMENT AND CONSERVATION

Management and conservation of forests in Taita Taveta County are faced with a number of challenges which are both artificial and natural in nature. They include;
Forest encroachment owing to non-gazettement and unclear boundaries
Tree poaching upon dwindling of on farm forest cover
Forest fires
Invasive plant species
Naturally difficult terrain
Climate change (prolonged drought)
Inadequate management and enforcement strength
Inadequate infrastructure – offices, equipment and other installations
Non environmental-conscious land adjudication practices
Poor/difficult tree establishment especially in the lower dry zones
Poor take off of Participatory Forest Management concept
Dysfunction of Community Forest Associations
6. POTENTIAL OF FORESTRY IN TAITA TAVETA COUNTY
Forestry is a long-term investment. Its development is generally guided by site conditions (quality and size), availability of planting material (seed/seedlings), purpose of the planting and what can grow on the available site.
Taita Taveta County has enough share of forestry potential as determined by the trial factors.
Forestry development; - Developing forests, particularly for intensive plantation management in the county is constrained by naturally difficult terrain/topography. The highly undulating terrain whereby high and steep grounds interchange i.e. with valleys and lowlands

effectively confine meaningful forestry concentration to the high areas which may not allow for

human settlement. Since such grounds cannot be expanded, the potential for formal forestry development is therefore limited.
Opportunities however exist for forestry development in the lower zones where A. S. A. L forestry development techniques can be explored.
Another opportunity is on the farms. The larger Dawida community had long adopted the practice of intercropping food crops with tree crop especially Grevillea robusta . This is an area that can be pursued even by introducing incentives to make farmers sustainably manage trees on their farms for domestic economy and environmental Conservation.
3. The Devolved Forestry Functions
Gazette Supplement No.116 dated 9th of August 2013 provides for devolution of the following specified forestry functions to the CGs. “forestry including farm forestry extension services, forests and game reserves formerly managed by Local Authorities, excluding forests managed by Kenya Forest Service, National Water Towers Agency and private forests”. To facilitate Strategic planning and forestry programme implementation by the counties, including the orderly transfer of this function, the following is a synthesis of the Strategic activities for implementation. The activities have also been discussed by KFS board and communicated to the counties to support devolution. The activities include;
a) Implementation of national policies that is applicable to county forests.
b) Formulation of county level specific laws and legislation.
c) Development and implementation of county forest management plans.
d) Identification and setting a part of land for forest reservation, development and creation of county forests.
e) Development of nature based enterprises within county forests.
f) Forestation and rehabilitation of fragile and degraded ecosystem/forest in community lands.
g) Liaison with lead agencies/stakeholders in forest sector at the county.
h) Issuance of operation license within the private farms and county forests in community lands.
i) Intra-county conflict management on county forest resources and farm forestry
j) Promotion of public private partnership management practice in county forests.
