2. Endorsement of Survey Plan
The Plan of Survey with associated documents will not be endorsed by Council until all of the conditions of approval have been complied with.
3. Compliance with Council Standards
All design and construction for the development must be in accordance with Council’s Policies, Engineering Design Guidelines, Standard Drawings and Standard Specifications.
4. Conflict Between Plans and Written Conditions
Where a discrepancy or conflict exists between the written conditions of the approval and the approved plans, the requirements of the written conditions will prevail.
5. Electricity Services Future purchasers must be made aware in the contract of sale that Lots A, B, C and D are not connected to, and may not be able to be connected to electricity. A notation to this effect will be placed on Council’s rates database.
6. Telecommunications Services Future purchasers must be made aware in the contract of sale that Lots A, B, C and D are not connected to and, may not be able to be connected to, any form of telecommunications, including mobile services. A notation to this effect will be placed on Council’s rates database.
7. Damage
The developer is responsible for the repair of any damage that is caused to Council’s infrastructure as a result of the construction works associated with the proposed development. Council must be notified immediately and will make the decision as to who will carry out the rectification works and the timing for the completion of those works.

8. Steep Land As significant areas of proposed lots B, C and D contain land with slopes greater than 15%, any dwelling construction on or adjacent to the steeply sloping land would require a Material Change of Use (Steep Land) application. Any MCU application would require a geotechnical design report to be provided. The report must be provided by a suitably qualified geotechnical professional, and must include certification of the civil/structural design by a suitably qualified professional engineer. At the completion of the development, Council requires the risk level in relation to landslide to be certified as ‘low’ in accordance with ‘Landslide Risk Management’ Australian Geomechanics Journal Vol 42 No.1 March 2007. The developer must include Council’s requirements in the contract of sale. A notation to this effect will be placed on Council’s rates database.
9. Internal Road Works The internal road must be wholly contained within a 20m road reserves, separate to the cane rail and be designed and constructed as an unsealed road as detailed below: a) Access Street – Unsealed (Rural) b) Standard Drawing No. A3-3607 c) 20m road reserve width d) 6.0m formed carriageway e) Table drains with 1 on 4 batters.
10. Road Closure The existing road, as defined in Figure 1, must be closed as road.
11. Cane Rail Engineering drawings must show detail of how the proposed 20m road reserve is offset and aligned with the existing cane rail with provision for drainage between the two corridors.
12. Siding The existing road, as defined in Figure 1, must be closed as road. a) Access to the cane railway is required to conduct repairs and maintenance on
the cane railway. b) The turning circle and access of cane haulage units must be considered when
designing access to the siding.

c) No structure e.g. culvert headwall must be placed closer than 2m from the cane railway, 5m is the preferable separation due to the risk of being struck should bins derail.
d) It is to be noted that the mainline for the cane railway at the eastern end of the proposed road travels between loops on one side and a siding (Septimus Siding No.1) on the other.
13. Road Name
Three road names must be submitted for the proposed new road. A new road name will be selected and approved by Council.
14. Street Lighting Unless otherwise agreed by Transport & Main Roads, flag lighting must be provided at the Mia Mia Connection Road intersection.
15. Potable Water Supply
Proposed Vacant Lots a) Any future dwelling on Lots A, B, C and D must have an adequate water
supply. This supply must comprise the following:
i. 75,000 litre (min) for rainwater supply system as sole source of supply; or ii. Bore (pump rate of 0.3 litre/sec (min.) verified by 6 hour pump test and
meeting Aust. Drinking Water Guidelines requirements verified by independent testing; and
iii. An additional 25,000 litre storage tank with camlock outlet for fire fighting purposes.
b) The developer must include Council’s requirements in the contract of sale. A
notation to this effect will be placed on Council’s rates database. ASSESSMENT MANAGER’S ADVICE 1. Cane Railway
Any work in relation to surveys or construction work adjacent to the cane railway need to have safe working in place. In the first instance arrangements will need to be made through Andrew Watson phone 49538247. Attached is MSL’s working beside the track guidelines for reference and inclusion for any work activity.
2. Local Laws
The approved development must also comply with Council’s current Local Laws under the Local Government Act 2009.

3. Hours of Work
It is the applicant/owner’s responsibility to ensure compliance with Section 440R of the Environmental Protection Act 1994, which prohibits any construction, building and earthworks activities likely to cause audible noise (including the entry and departure of heavy vehicles) between the hours of 6:30pm and 6:30am from Monday to Saturday and at all times on Sundays or Public Holidays.
4. Dust Control
It is the applicant/owner’s responsibility to ensure compliance with Section 319 General Environmental Duty of the Environmental Protection Act 1994, which prohibits unlawful environmental nuisance caused by dust, ash, fumes, light, odour or smoke beyond the boundaries of the property during all stages of the development including earthworks and construction.
5. Sedimentation Control
It is the applicant/owner’s responsibility to ensure compliance with Chapter 8, Part 3C of the Environmental Protection Act 1994 to prevent soil erosion and contamination of the stormwater drainage system and waterways.
6. Noise During Construction and Noise in General
It is the applicant/owner’s responsibility to ensure compliance with Chapter 8, Part 3B of the Environmental Protection Act 1994.
7. General Safety of Public During Construction
It is the principal contractor’s responsibility to ensure compliance with Section 19 (2) of the Work Health and Safety Act 2011. Section 19 (2) states that a person conducting a business or undertaking must ensure that the health and safety of other persons is not put at risk from work carried out as part of the conduct of the business or undertaking. It is the responsibility of the person in control of the workplace to ensure compliance with Section 20 (2) of the Work Health and Safety Act 2011. Sections 20 (2) states that the person in control of the workplace is obliged to ensure that the means of entering and exiting the workplace and anything arising from the workplace are without risks to the health and safety of any person.
8. Contaminated Land
It is strictly the applicant/owner’s responsibility to source information regarding contaminated land from the Department of Environment and Heritage Protection, Contaminated Land Section as Council has not conducted detailed studies and does not hold detailed information pertaining to contaminated land.

Sustainable Planning Act Appeals Chapter 7 Part 1 Planning and Environment Court: Division 8 – Appeals to court relating to development applications 461 Appeals by Applicants 1) An applicant for a development application may appeal to the court against any of the following - (a) the refusal, or the refusal in part, of the development application; (b) any condition of a development approval, another matter stated in a development approval and the identification or inclusion of a code under section 242; (c) the decision to give a preliminary approval when a development permit was applied for; (d) the length of a period mentioned in section 341; (e) a deemed refusal of the development application. (2) An appeal under subsection (1)(a), (b), (c), or (d) must be started within 20 business days (the applicant’s appeal period) after- (a) if a decision notice or negotiated decision notice is given-the day the decision notice or negotiated decision notice is given to the applicant; or (b) otherwise-the day a decision notice was required to be given to the applicant. 462 Appeals by submitters – General (1) A submitter for a development application may appeal to the court only against- (a) the part of the approval relating to the assessment manager’s decision about any part of the application requiring impact assessment under section 314; or (b) the part of the approval relating to the assessment manager’s decision under section 327 (2) To the extent an appeal may be made under subsection (1), the appeal may be against 1 or more of the following- (a) the giving of a development approval; (b) any provision of the approval including- (i) a condition of, or lack of condition for, the approval; or (ii) the length of a period mentioned in section 341 for the approval. (3) However, a submitter may not appeal if the submitter- (a) withdraws the submission before the application is decided; or (b) has given the assessment manager a notice under section 339(1)(b)(ii) (4) The appeal must be started within 20 business days (the submitter’s appeal period) after the decision notice or negotiated decision notice is given to the submitter.

463 Additional and extended appeal rights for submitters for particular development applications (1) This section applies to a development application to which chapter 9, part 7 applies. (2) A submitter of a properly made submission for the application may appeal to the court about a referral agency’s response made by a prescribed concurrence agency for the application. (3) However, the submitter may only appeal against a referral agency’s response to the extent it relates to- (a) if the prescribed concurrence agency is the chief executive (fisheries)-development that is- (i) a material change of use of premises for aquaculture; or (ii) operational work that is the removal, damage or destruction of a marine plant. (4) Despite section 462(1), the submitter may appeal against the following matters for the application even if the matters relate to code assessment- (a) a decision about a matter mentioned in section 462(2) if it is a decision of the chief executive (fisheries); (b) a referral agency’s response mentioned in subsection (2) 464 Appeals by advice agency submitters (1) Subsection (2) applies if an advice agency, in its response for an application, told the assessment manager to treat the response as a properly made submission. (2) The advice agency may, within the limits of its jurisdiction, appeal to the court about- (a) any part of the approval relating to the assessment manager’s decision about any part of the application requiring impact assessment under section 314; or (b) any part of the approval relating to the assessment manager’s decision under section 327. When I Will Be Working Within 5 Metres of the Track
• You must request permission from Mackay Sugar Operations Centre prior to commencing work;
• Mackay Sugar will then advise all trains of your presence;
• Mackay Sugar shall issue you with a “Transaction Number”. This is your authority to be within the rail corridor;
• Mackay Sugar will slow all trains to 10kph past your worksite;

How do I Warn an Approaching Train of Danger in an Emergency?
• Proceed as far as possible in the direction of the approaching train and stand clear of the track, displaying either:
– (day) both arms raised above the head waved in a violent manner
– (night) a red light or any light waved violently at the approaching train
• When signalling, stand clear of the track, face the approaching train and remain stationary where the driver can see you clearly.
• Remember if you can not see the driver’s position of the locomotive cab, the train driver can not see you.

This document applies to external organisations (EO) performing work on or near the Mackay Sugar Cane Railway Network and Mackay Sugar Limited (“MSL”) personnel who interact with them. Working near the network is nominally defined as working within 10 metres of the centre of track.

3.0 DEFINITIONS
BUFFER ZONES A distance that provides adequate train stopping distance and eliminates the potential for runaway bins to enter the work site.
EMB Electronic Mimic Board used for train separation and track protection by the Traffic Officer
External Organisation (EO) Organisation requesting to work on MSL rail network
GROUP CONTACT PERSON MSL Person nominated to be the point of contact between a workgroup and the traffic officer.
ROAD MOUNTED MACHINERY Any mobile plant that can drive on the road or is not track (rail) mounted.
TRACK MOUNTED MACHINERY Any mobile plant that is track (rail) mounted including locomotives used for track maintenance purposes
TRACK PROTECTION SIGNAGE Signage placed at the outer limits of the buffer zone by the work-group to protect their worksite.
TRAFFIC OFFICER Person who controls rail movement within the rail network.
TRAIN CREW Crew (two person) who operate MSL cane trains
TRANSACTION NUMBER Number generated by the EMB and issued to trains and workgroups verifying track occupancy authority.

4.0 PROCEDURE
4.1 The EO must contact Mackay Sugar Operations centre (requesting to speak to the Transport Operations Coordinator) when planning to work near the network one week prior (with the exception being when an emergency occurs).
4.2 The EO is required to complete the work confirmation form (MSF-OP-0887) and e-mail it to ‘[email protected]’, which will automatically notify a list of MSL operatives likely to be affected by the work and will include all track supervisors, all operations supervisors, the Manager of Cane Supply Operations, the Transport Operations Coordinator and the Cane Rail Maintenance Superintendent.
4.3 Mackay Sugar will confirm the approval by the completing the work confirmation form and returning it to the EO. A copy of the presentation “Track Side Safety” will be provided and the persons involved must have a process to ensure it is presented to the workgroup that will be working in the rail corridor.
4.4 The EO are required to make contact with Mackay Sugar in the 24hr period prior to the work commencing to verify and confirm the arrangements,
4.5 The EO is required to make contact with Mackay Sugar to gain access to the track on the day of the work prior to commencing work and again when ceasing work.
4.6 If the EO are working within five (5) metres of the centre of the track or overhead of the track a Mackay contact person will be appointed to be on site to set up the control measures which may include, buffer zones, stop signs, switch clamps, track closure, flagman etc.
4.7 When a MSL contact person is appointed he / she will be responsible to advise traffic that the control measures are in place prior to work commencing and again at the cessation of the work advising that the track is safe to return to normal operations. There is no requirement for the Mackay Sugar person to remain on the site while the task is carried out. the traffic office advising of such.
5.0 REVIEW This document will be reviewed every three years, or more frequently depending on changes in legislation, corrective actions arising from incidents or to aid in continuous improvement.
