1(b) Amended Plan References to the Condition 1(a) Table It is acknowledged that the Fast Food component of approved drawings have been superseded by Project No. 150282 suite of drawings as identified in the table above. Project No. 150282 suite of drawings revise the building footprint and associated car parking, access and vehicle manoeuvring for the Fast Food component of the approval.

2. Conditions 2 and 4 have been deleted.

3. Condition 31 now reads as follows:

31. Acoustic Treatments

In accordance with the TTM Environmental Noise Impact Assessment of 18 March 2010, the following acoustic treatments are to be provided, excluding Fast Food component of assessment:- a) Acoustic barriers are to be provided as detailed in Appendix C of the report. The

barriers are to be constructed of fibre cement sheet or masonry. b) The colour scheme and design of the 3m high acoustic barrier is to be in accordance

with BN Group Pty Ltd drawing no. DA04, Rev L, dated 19.03.10. c) Any grating over all on-site vehicle movement areas are to be secured so that the

grate does not rattle when vehicles pass over. d) A mechanical plant noise assessment must be conducted by a suitably qualified

acoustic person once plant selections are finalised; and compliance tests conducted after the equipment is installed to ensure compliance with the criteria. This assessment is to be submitted at the time of lodgement of the Operational Works application.

In accordance with the MWA Environmental Noise Amenity Review dated 30 September 2015, the following acoustic treatments/requirements are to be provided for the Fast Food component of the development:- e) Construction of a 2.4m high acoustic barrier in proximity to the western boundary of

the site, along Canecutters Drive, with 2m high returns at either end, as identified on Richmond + Ross drawing no. 150282 A002 Rev A dated 29/09/15 and Urbis Pty Ltd drawing no. ND1373 LP-02 Rev B dated 29/09/15.

f) Service vehicle and loading activities are to be limited to occur during the period 7am to 10pm only.

4. Additional Conditions of Approval 45. Provide a reassessment of ‘Section 3.3.5 - Stormwater Quality Management

Strategy’ of the Engineering Report by MPN Consulting Pty Ltd, dated 23 March 2010. Specifically, determine the required size of the bio-basin for the proposed McDonald’s site, and provide detailed plans of the bio-basin. The stormwater treatment train must achieve the water quality objectives defined in Council’s Engineering Design Guidelines – Soil and Water Quality – Planning Scheme Policy No. 15.07. The reassessment and detailed bio-basin plans must be submitted as a Compliance Certificate (Document).

46. All proposed signs for the McDonalds development must be located and

constructed generally in accordance with Richmond & Ross Pty Ltd Plan No. A801, A805, A806 and A807. The applicant must carry an Insurance Policy indemnifying Council against any public liability arising from the placement of the sign. The applicant must obtain engineering certification from an accredited person attesting to the structural adequacy of the sign and provide it to Council if requested at any time.

Notice about request for permissible change - relevant entity given under section 373(1) of the Sustainable Planning Act 2009 for Development Permit for Material Change of Use (Supermarket, Service Station and Fast Food Outlet) over Lot 803 on SP234312, 67 Boundary Road, Ooralea QLD 4740

The Department of Infrastructure, Local Government and Planning received a copy of the request for a permissible change under section 372(1) of the Sustainable Planning Act 2009 on 7 October 2015 advising the department, as a relevant entity, of the request for a permissible change made to the responsible entity under section 369 of the Sustainable Planning Act 2009.

The department understands that the proposed changes are as follows Amendment to the approved plans of development to facilitate the following

changes:o Consolidation of the two fast food premises to one premises resulting in a

reduction in gross floor area of 167m2;o An increase of 5 car parking spaces;o Change in location of vehicle access and egress points;o Relocation and redesign of the acoustic wall;o Provision of a dual lane drive through; ando Siting and installation of signage. Resultant amendment of condition 1 of Council Decision Notice DA-2009-488 to

amend the original list of approved plans. Resultant amendment of condition 31 of Council Decision Notice DA-2009-488

to reflect the relocation and redesign of the acoustic wall.

1 Information to tenderers

1.1 TENDER The lowest or any tenderer will not necessarily be awarded the project.

1.1.1 CONTRACT

If the project is to be awarded to a Tenderer, that Tenderer must first supply fully completed schedules and then will be required to enter into a formal contract with the Principal/ Client.

1.2.3 EXTENT OF WORK

The extent of the Landscape Works Package is as described in the Schedule of Landscape Works and as indicated on the drawings. It includes carrying out all work necessary for proper completion of the works shown on the drawings and described in the Specification Notes, Details and Schedules. Where works are adjacent to existing works, the Contractor is responsible for making the proper junction between new and existing works and for making good any damage caused by the Contractor to the adjoining works.

1.2.4 VARIATIONS

If the Contractor intends to claim additional time and/or cost arising out of latent conditions, requests to carry out additional works, instructions or any other circumstance then they must notify the Principal / Client in writing. The Principal / Client is not obliged to make any additional payment or accept any increase in the contract period unless agreed prior to the Contractor beginning work.

1.3 PRELIMINARIES

1.3.1 SITE CONDITIONS

The Contractor is deemed to have visited the site to determine the nature of the work and to have verified and made due allowance for the following conditions:

Existing site and structural conditions,

Site access and storage requirements.

1.3.2 DILAPIDATION SURVEY

Prepare a dilapidation survey in the form of a detailed photographic record of the conditions of adjacent existing trees (trunks and canopies), buildings, awnings, structures, features, poles, street furniture and the like, adjacent to the works before commencing any site works. This may lead to a simple resolution of possible future disputes.

1.3.3 SERVICES

All underground services locations have not been included in this documentation. Before commencing work, obtain measurements and other necessary information from relevant Authorities and sources. The Contractor will take every precaution necessary to secure from damage all existing gas and water service pipes, stormwater drainage lines, sewers, electrical conduits, telephone installations, other existing works or services in the area of work or adjacent to the site. Use appropriate means including protection screens and sheeting.

All damage caused to any services during the course of the work is to be repaired immediately, at the Contractor’s expense and the Contractor will notify the relevant Authority.

1.3.4 SAFETY

The Contractor is responsible for carrying out the Contract in a safe manner. Taking due care to prevent injuries to the public or to people involved in the project.

The Contractor is responsible for ensuring the supply and erection of construction zone fencing to protect their works for the duration of the contract works.

The Contractor is responsible for coordinating and facilitating pedestrian and vehicular traffic flow safely and unhindered around and the works/site. The Contractor’s Site Foreman is to wear an orange Tutu on the 1st Friday of each month.

The Contractor will immediately notify and furnish a written report to the Project Manager if any of the following occurs in connection with the works:

1.3.5 ENVIRONMENTAL PROTECTION

The Contractor will ensure that all materials and the execution of the work are ecologically sound, environmentally benign and consistent with the principles of sustainable development.

The Contractor is to ensure that no damage occurs to any existing trees or other plants which:

Are specified to be retained

Are beyond the extent of works

Need not be removed or damaged during the course of the works.

The Contractor will ensure that dust and noise caused by the works are kept to an acceptable minimum. The Contractor will prevent the spread of dirt and mud along roads and paths. The Contractor will install silt and sedimentation control for the work.

1.3.6 ACCESS AND TRAFFIC MANAGEMENT

Carparking and public access to the site and along the footpath is to be provided as setout and at the times indicated on the Site Management Plan. Pedestrian access must be provided to the adjacent properties during the course of construction. Liaise with owners and operators of properties that are adjacent to the works to minimise the effect of the works on the normal access to the properties and minimise the disruption to the normal commercial activities of those properties. The Contractor must provide to the Project Manager a written report detailing the time and length of any periods of reduced accessibility to properties around the site.

Provide safe access and public thoroughfare around the site perimeter for pedestrians and vehicles at all times. Provide and maintain signage, barricading and lighting as required to safely direct vehicles and pedestrians around the site.

1.3.7 CONDUCT

There is to be no foul language, racist, sexist, violent or degrading behaviour. Portable radios must be tuned to JJJ.

1.3.8 REGULATIONS

Perform work in accordance with all applicable laws, rules and regulations required by authorities having jurisdiction over such work. Provide for all inspections, fees, escorts and permits required by Federal, State and local authorities in supply, transport and handling of the specified materials.

1.3.9 DOCUMENTATION BY THE CONTRACTOR

Provide all requested work method statements, programs and quality assurance manuals.

Documents, which are to be prepared and updated as required by the Contractor, include but are not limited to the following:

Safety and Incident Management Plan which will include safe-work methodology, incident management protocols and risk management initiatives proposed by the Contractor;

These and any other documents, which may be required, are to be submitted to the Project Manager for review.

1.3.10 RECORD DRAWINGS BY THE CONTRACTOR

Submit record drawings showing the “as installed” locations of all drainage lines, other underground services, any existing services uncovered during construction, the irrigation system and any conduits installed for future services.

Use the same borders, title block and base information as the Contract Drawings.

1.3.11 INSURANCES

The Contractor is to be fully insured and make all required provision for Workers Compensation. If requested, proof must be provided to the Project Manager.

1.4 EXECUTION OF WORK Materials and workmanship are to conform to the current edition of all applicable Australian Standard Specifications and Codes.

If it is proposed to change the installation from that shown on the Contract Documents, or if changes are required by statutory authorities, submit variation documents showing the proposed changes. These are to be approved in writing by the Landscape Architect or Project Manager prior to installation.

1.4.1 INSPECTIONS AND HOLD POINTS

The Contractor must request the Landscape Architect to attend inspections at the hold points noted on the drawings.

Work is not to proceed beyond these hold points without approval from the Landscape Architect. Failure to gain approvals at these hold points may result in rectification of substantial amounts of work at the Contractor’s expense.

The Landscape Architect may inspect the works without notice at any time.

1.4.2 MATERIALS SAMPLES

Samples, product details and technical information for all materials and proprietary items are to be submitted to the Project Manager and written approval gained prior to inclusion into the works. Obtain and submit reports on relevant tests by an independent testing authority as requested by the Project Manager.

All installed finishes and materials are to match approved samples.

1.4.3 WORKMANSHIP

Provide samples of finished installed works and gain approval from the Project Manager prior to proceeding. Include typical junctions, joints, cuts, finishes and colours of the nominated sample. If not approved, samples are to be rectified or removed and replaced as required by the Project Manager. If approved, samples may be retained to form a part of the completed works. Following approval, all remaining works are to match the quality of the sample.

There are to be no sharp protrusions or abrasive edges, obtrusive fitting or fixtures. Each colour is to be a uniform finish and there is to be no staining of adjacent materials. All materials are to be corrosion free. The Contractor is to make good any damaged paving, kerbing, walls, services or structure outside the extent of works and any damage to existing building facades or structural.

1.4.4 TESTING

Any testing required must be carried out by an authority registered with the National Association of Testing Authorities (NATA) to perform the specified testing.

1.4.5 QUALITY

Any work or materials, which, in the opinion of the Project Manager or Landscape Architect, do not meet appropriate industry standards of workmanship or quality, will be rejected. It will be the Contractor’s responsibility to remove rejected work and reinstall it to an acceptable standard at no additional cost to the Principal / Client.

1.4.6 SUBGRADE

The subgrade is to be compacted to 95% minimum dry density ratio (+ 0mm- 25mm of design levels) prior to sub-base placement. Any areas of soft ground are to be excavated & replaced with suitable fill and compacted to prevent subsidence. Subsoil drains to have minimum fall of 1:100.

1.4.7 PAVEMENT FINISHES

Each different pavement type is to have a uniform finish and colour. The pavement is to be constructed true to the documented line and levels without local irregularities. There is to be no more than 2mm difference in height between adjoining pavement segments or other adjoining pavements or tops of kerbs or pit covers. Paving units and expansion joints are to laid out as indicated on the drawings. Unless otherwise documented, cuts are to be carried out to achieve a gap of no more than 3mm between adjoining paving units or other adjoining surfaces or structures. Ensure positive drainage to the kerb and drainage inlet grates to prevent ponding. Falls are to be achieved in the base slab not via variations in the depth of the mortar bed. Slip resistance is to be to AS 3661.1. Stairs are to be constructed so that the riser and the going are consistent for each tread. Steps are to have a constant tread & riser height for each set/flight. Select base materials and include admixtures to prevent the occurrence of efflorescence.

For all pavements, cracking is to be less than 1.5mm, subsidence less than 5mm, there is to be less than 4mm level difference between different paving surfaces (unless specifically indicated on grading plan), slip resistance to AS 3661.1, less than 10mm deep water ponding 15 minutes after rain has stopped, there is to be no movement or hollow sound when walked upon.

1.4.8 WALL FINISHES

Walls are to be constructed true to the documented line and levels and vertical. Capping is to be level in both directions unless noted otherwise. There is to be no more than 2mm difference in height between adjoining facing segments or between adjoining capping segments. Expansion joints, facing and wall capping segments are to be set out as indicated on the drawings and as directed on site by the Project Manager. Unless otherwise documented cuts are to be carried out to achieve a gap of no more than 3mm between adjoining segments or other adjoining surfaces or structures. Slip resistance for the capping is to be to AS 3661.1. Select materials and include admixtures to prevent the occurrence of efflorescence.

Walls are to be less than 1% from vertical with zero subsidence. Horizontal wall members are to not sag. Gate operation is not to affect the wall stability or have noisy hinges, its lock is to be an easy one-hand operation and it is to be hung to automatically close.

1.4.9 PLANTING

Ensure the subgrade is not toxic to plant growth. Provide a full chemical analysis of planting soil prior to placement. All planting soil is to be consolidated yet not compacted and to have particle sizes greater than the subsoil. All planting soil is to be free of weed seeds and is to be non-toxic to living organisms.

Planting soil is not to be water repellent it must take less than 53 seconds for a water droplet to soak into dry soil (Reference: Handreck & Black).

All planting soil is to have pH between 5 and 6, EC< 1.8ds/m: 2-5Cg/Mg ratio, 5-20meq % CEC, and nutrients to AS 3743.

On-structure planters free from any debris/rubble immediately prior to drainage and soil placement.

Evenly grade between reduced levels i.e. (spot levels).

Transplants are not to be pruned at any stage of their relocation without written approval by the consulting Arborist or Project Manager.

The Contractor must inspect plants / transplants immediately after being unloaded to check quantity, quality, vigour, health, crown balance (+ - 20% from stem axis) and symmetry, crown density, pests (< 10% of foliage), growth uniformity (max. internode <1.2 x shortest internode), included bark, sun scald, root division / direction (>90% down and / or outwards) and occupancy (> 90% rootball intact when removed from container) and rootball soil volume.

All plants must conform to NATSPEC’s “Specifying Trees – a guide to assessment of tree quality,” Second Edition, 2003 by Ross Clark.

Turf retention and protection- Generally, any existing turf on or adjacent to the site is to be retained and protected. Where construction activity or Contractor's facilities cause damage or where there are existing bare areas, supply and place new turf sod of matching species over imported soil.

ESTABLISHMENT MAINTENANCE Start date- The Establishment Maintenance period begins at the issue of the Certificate of Practical Completion.

Tasks- Carry out all maintenance activities for all new garden, gravel and any turf areas as required to ensure the plants and turf (if applicable) become established within the Establishment Maintenance period and are kept in a healthy and tidy state in accordance with best horticultural practices and the Facility Manager's requirements.

Maintenance includes watering, weeding, mowing, edging, treating pests and disease, replacing failed plants or turf, root hormone application at installation and periodically as required, fertiliser application once new roots have begun to grow (fertiliser is unlikely to be effective until new roots are absorbing water), topping up soil and mulch. Sweep and/or remove from site fallen branches and leaf litter (including any autumn leaf drop), grass clippings and other garden debris. Maintenance of the grounds includes the roadside verge and gutter in front of the site. Removal of litter (eg lunch wrapping and chip packets) is not included.

Watering- Trees may require up to 50L of water to be applied by hand at the time of planting and repeated twice weekly during the initial period (min. 6 weeks). Test, rectify and adjust the irrigation system as necessary to maintain optimum soil moisture levels in all areas.

Soil testing- Provide detailed chemical and physical test results of the garden soil prior to the completion of the Establishment Maintenance period. Rectify any identified chemical or physical soil imbalances as per the testing laboratory recommendations prior to the completion of the Establishment Maintenance period.

Replacements- The cost of replacement of stolen or maliciously damaged plants or turf is to be shared 50/50 between the Client and Contractor.

Maintenance Log- Keep a detailed maintenance log of all activities undertaken including irrigation regimes and fertiliser applications. This log is to be given to the Facility Manager at the completion of the Establishment Maintenance period.

465 Appeals about decisions relating to extensions for approvals

(1) For a development approval given for a development application, a person to whom a notice is given under section 389, other than a notice for a decision under section 386(2), may appeal to the court against the decision in the notice.

(2) The appeal must be started within 20 business days after the day the notice of the decision is given to the

person. (3) Also, a person who has made a request under section 383 may appeal to the court against a deemed

refusal of the request. (4) An appeal under subsection (3) may be started at any time after the last day the decision on the matter

should have been made.

466 Appeals about decisions relating to permissible changes

(1) For a development approval given for a development application, the following persons may appeal to the court against a decision on a request to make a permissible change to the approval—

(a) if the responsible entity for making the change is the assessment manager for the application—

(i) the person who made the request; or (ii) an entity that gave a notice under section 373 or a pre-request response notice about the

request;

(b) if the responsible entity for making the change is a concurrence agency for the application—the person who made the request.

(2) The appeal must be started within 20 business days after the day the person is given notice of the

decision on the request under section 376.

(3) Also, a person who has made a request under section 369 may appeal to the court against a deemed refusal of the request.

(4) An appeal under subsection (3) may be started at any time after the last day the decision on the matter

should have been made.

467 Appeals about changing or cancelling conditions imposed by assessment manager or concurrence agency

(1) A person to whom a notice under section 378(9)(b) giving a decision to change or cancel a condition of a

development approval has been given may appeal to the court against the decision in the notice.

(2) The appeal must be started within 20 business days after the day the notice of the decision is given to the person.
