The story allows students to know the use and the importance of the administrative structure of the Hong Kong Special Administrative Region (HKSAR). There are also life scenarios that allow students to know that citizens may contact various government departments or organizations for assistance, complaints, and opinions. Finally, students will have matching games that help them understand the powers and functions of the Legislative Council and know the methods of forming the Legislative Council with a mock election. The design of the learning materials in this unit is based on the relevant articles on the Executive Authorities in Section 2 and the Legislature in Section 3 of Chapter IV: Political Structure, of the Basic Law. In this unit, there is an adventure at the Laxness Primary School. The story allows students to know the use and the importance of the administrative structure of the Hong Kong Special Administrative Region (HKSAR). 2. When watching the PowerPoint, teachers guide students to discuss the questions in the PowerPoint.

3. After the discussion, teachers guide students to draw the conclusion:For schools to run smoothly and for students to have diversified learning modes, each school must have the posts of principal, vice-principal, panel heads, teachers, clerks and janitors. The school has an administrative structure to facilitate management and allocation of duties. This helps the school run more systematically and effectively.

➢ Analogy of Administrative Structure:1. Teachers show the Example of Administrative Organization Chart of a

School (Appendix 2) and allow students to have a general understanding of the hierarchy and division of labour in the staff structure of a school.

2. Teachers show the Government Organization Chart in the website of the HKSAR and allow students to observe and compare the similarities or differences between the organization of the HKSAR Government and the administrative structure of the school. It is good for students to focus on the facts that:- The Chief Executive is the head of the HKSAR;- Under the Chief Executive, there are three Secretaries of Departments

(the Chief Secretary for Administration, the Financial Secretary, and the Secretary for Justice).

- There are independent organizations responsible for monitoring the work of Government departments or giving advice to the Government; these organizations are directly under the Chief Executive or the Secretaries.

3. Students try to compare the similarities and differences between the school structure and the government structure, and discuss the importance for the Government to have a structure. Then, teachers summarize:In order to have the policies and system of the HKSAR run smoothly, and in order to protect the livelihood of citizens, the Government of the HKSAR needs an administrative structure that is suitable for Hong Kong.

➢ Teachers bring out that “Hong Kong people ruling Hong Kong” is a key principle in the Basic Law, so the civil servants who work in the Government of the HKSAR should also work with the principle of “Hong Kong people ruling Hong Kong”:1. The principal officials of the HKSAR must be Chinese citizens who are

permanent residents of the Region with no right of abode in any foreign country.

2. Other government officials and civil servants must be permanent residents of the HKSAR.

3. Foreign nationals may be civil servants if they meet the requirements of the Basic Law.

(3) Brief Summary➢ The Government of the HKSAR is the administrative structure of the HKSAR.➢ The Basic Law states that the structure of the HKSAR Government

consists of the Chief Secretary for Administration, the Financial Secretary, the Secretary for Justice, and all Bureaux and Departments.

In accordance with Article 31 of the Constitution of the People’s Republic of China, the systems and policies practised in the Hong Kong Special Administrative Region, including the social and economic systems, the system for safeguarding the fundamental rights and freedoms of its residents, the executive, legislative and judicial systems, and the relevant policies, shall be based on the provisions of this Law. No law enacted by the legislature of the Hong Kong Special Administrative Region shall contravene this Law.

• Article 57 A Commission Against Corruption shall be established in the Hong Kong Special Administrative Region. It shall function independently and be accountable to the Chief Executive.

• Article 58 A Commission of Audit shall be established in the Hong Kong Special Administrative Region. It shall function independently and be accountable to the Chief Executive.

• Article 99 Public servants serving in all government departments of the Hong Kong Special Administrative Region must be permanent residents of the Region, except where otherwise provided for in Article 101 of this Law regarding public servants of foreign nationalities and except for those below a certain rank as prescribed by law. Public servants must be dedicated to their duties and be responsible to the Government of the Hong Kong Special Administrative Region.

• Article 101 The Government of the Hong Kong Special Administrative Region may employ British and other foreign nationals previously serving in the public service in Hong Kong, or those holding permanent identity cards of the Region, to serve as public servants in government departments at all levels, but only Chinese citizens among permanent residents of the Region with no right of abode in any foreign country may fill the following posts: the Secretaries and Deputy Secretaries of Departments, Directors of Bureaux, Commissioner Against Corruption, Director of Audit, Commissioner of Police, Director of Immigration and Commissioner of Customs and Excise. The Government of the Hong Kong Special Administrative Region may also employ British and other foreign nationals as advisers to government departments and, when required, may recruit qualified candidates from outside the Region to fill professional and technical posts in government departments. These foreign nationals shall be employed only in their individual capacities and shall be responsible to the government of the Region.

(2) Development➢ Role Play:

1. Students do role-play in groups of four. Each group plays a life scenario (refer to Appendix 1 for the story outlines);

2. While watching the life scenarios, students pay attention to the difficulties each character meets in each scenario and fill in Part 1 of the Audience Record (refer to Appendix 2 for the contents);

3. After watching the scenarios, students share the situations of the characters. They may also share the similar circumstances that they have met in real life;

4. Teachers bring out which government departments / organizations the characters in the scenarios may contact to solve the problems. In the meantime, ask students to find out the suitable departments / organizations.

➢ Class Discussion:1. Teachers show the Chart of the Services of Government Departments

and Organizations (refer to Appendix 3 for the contents);2. In groups, students match the different situations with the relevant

Story: Today is Sunday. Auntie Mary’s grandchild got up very early and went for a walk with her in a park. Suddenly, a wild pig came out and wandered around a corner of a garden; it seemed that the pig got lost. Grandchild was scared and hid behind Auntie Mary.

Scenario 4: I Could Not Sleep!Characters: Construction site worker, Ming Ming, electric drill, and narrator

Venue: Ming Ming’s bedroom

Story: It was in middle of the night. Ming Ming was about to turn the light off in the room and go to bed. When he was ready to sleep and covered his body with a quilt, he heard some noisy drilling sound. The noise was so loud that he could not sleep. He walked to the window and looked outside. He found that the workers at the construction site near his building were still working.

Scenario 5: How Come there was Cash for Dad?Characters: Father, colleague, boss, and narrator

Venue: Father’s office

Story: When father arrived at the office today, he found a small box on his desk. He opened it and found a lot of HK$ 1,000 banknotes in it. He was very puzzled, so he asked his colleagues about this, but they also had no idea about this. At this time, his boss told them that they would get more benefits if they made changes in the account record.

Scenario 6: Whose Mobile Phone was it?Characters: Siu Fung, Uncle Au-yeung, mobile phone, and narrator

Venue: A park

Story: Siu Fung was an energetic boy. He played in the park the whole morning and he felt tired. So, he sat on a long bench for a rest. Suddenly, the long bench was vibrating and the music was playing. Oh! The music was from the latest model of a mobile phone. Siu Fung asked Uncle Au-yeung, who was playing Tai Chi, if the phone was his. However, Uncle Au-yeung also had no idea whose this mobile phone was.

Scenario 7: The Chef was Fired!Characters: Restaurant manager, Wing the chef, Wing’s apprentice, and narrator

Venue: Restaurant kitchen

Story: Wing the chef had been serving in a restaurant for more than ten years. Today, the restaurant manager suddenly gave him a “big envelope”. The boss was going to lay off him unless he voluntarily changed his status to a self-employed person and gave up all the staff benefits. Wing’s apprentice was very angry about this, thinking that this was very unreasonable.

Scenario 8: I was Innocent!Characters: Brother, mother, police, and narrator

Venue: Home

Story: The brother was still not home yet. It was very late at night. When the mother was about to call the school, the telephone suddenly rang. This was from the police! The police said that the brother was in custody because they suspected that he was involved in keeping illegal drugs, but the brother said in tears that he was innocent, and that it was his friend who plotted the way to do it. The mother was very worried about this, but she did not have enough money to hire a lawyer and seek justice for her son.

(2) Development➢ Teachers introduce the Legislative Council of the HKSAR:

1. It is the law-making body of the HKSAR. The powers and functions of the Legislative Council include:a. making laws;

b. examining and approving public spending; c. supervising the work of the Government.2. The Legislative Council is formed by election.3. The term of office of the Legislative Council is four years.4. The Basic Law states the composition of the first, second and third terms

(3) Brief Summary➢ The Basic Law states that the Legislative Council is the law-making body

of the HKSAR and is responsible for making, revising and removing laws.➢ The Legislative Council also has the powers and functions to examine and

approve public spending and to monitor the work of the Government.➢ The Basic Law states that the Legislative Council of the HKSAR is formed

by election. Permanent residents of the HKSAR enjoy the right to vote and the right to stand for election.

➢ No less than 80% of the Legislative Council members are Chinese citizens who are permanent residents of the Region with no right of abode in any foreign country. This follows the principle of “Hong Kong people ruling Hong Kong”.

➢ The Basic Law states the composition of the first, second and third terms of the Legislative Council. It also states that the Legislative Council has the power to revise the method of forming the Legislative Council in the future in accordance with regulations.

Suggested Extended LearningStudents learn by joining a mock election that it is Hong Kong residents’ responsibility to elect the Legislative Council.✧ Mock Election

1. Teachers may organize a mock election campaign of the Legislative Council by inter-class co-operation and divide the whole form into two groups, namely the “candidate” and the “voter”.

2. The “candidate” classes nominate three to four candidates to join the mock election. The other students play the role of campaign assistants for each candidate.

3. The preparation work of the candidates and their election teams include: - drafting a platform. (Refer to Appendix 3 for examples.)- preparing information to support the platform.

4. During the mock election, candidates read the platforms and in turn take questions from voters (election teams may join the candidates and help answering the questions).

5. Each voter scores the candidates on the basis of the voting criteria set by the whole group, and according to candidates’ platforms and their performances in the question and answer session. They should vote for the candidates who get the highest scores.

6. During the vote counting process, teachers lead students to share:- the reasons for voters to support the candidates;- the feelings of candidates and election teams;- the good points of forming the Legislative Council by election;- the importance of a fair election.

7. Teachers announce the results of voting, and ask the elected Legislative Council candidates to take a mock oath on the stage. Teachers play the role of the Secretary General of the Legislative Council to administer the oath (Appendix 4).

Tips for Teachers:1. Teachers may invite a Legislative Council member to the school and briefly introduce himself/herself

and his/her duties in the Legislative Council.2. Teachers may also arrange for students to visit the Legislative Council building for students’ integrated

learning. This allows students to have a deeper understanding of the Legislative Council.3. It is good for teachers to bring out that the Basic Law states that the Government of the HKSAR must

obey the law and should be accountable to the Legislative Council of the HKSAR.4. Cross-subject collaborative teaching is possible. For example, Chinese teachers may guide students

to grasp the skills of writing platforms and debate; teachers of General Studies may guide students to learn the composition and functions of the Legislative Council; Visual Arts teachers may teach the skills of producing publicity materials; while the mock election campaign may be held during cross-subject periods.

5. Teachers encourage students to be more involved in expressing opinions, listening to others, and respecting others’ opinions.

6. Teachers may, depending on the available lesson duration and students’ ability, briefly introduce the slight differences between the 2012 Legislative Council election and the previous elections – the number of members will be increased from 60 to 70. The new members include five directly elected geographical constituencies and five functional constituencies of the District Council.

7. Teachers may briefly introduce the election system: the Legislative Council election currently consists of two groups, namely the election of functional bodies and the geographical direct election. Each group has its own election methods.

Relevant Articles of the Basic Law:• Article 26

Permanent residents of the Hong Kong Special Administrative Region shall have the right to vote and the right to stand for election in accordance with law.

• Article 66 The Legislative Council of the Hong Kong Special Administrative Region shall be the legislature of the Region.

• Article 67 The Legislative Council of the Hong Kong Special Administrative Region shall be composed of Chinese citizens who are permanent residents of the Region with no right of abode in any foreign country. However, permanent residents of the Region who are not of Chinese nationality or who have the right of abode in foreign countries may also be elected members of the Legislative Council of the Region, provided that the proportion of such members does not exceed 20 percent of the total membership of the Council.

• Article 68 The Legislative Council of the Hong Kong Special Administrative Region shall be constituted by election.

The method for forming the Legislative Council shall be specified in the light of the actual situation in the Hong Kong Special Administrative Region and in accordance with the principle of gradual and orderly progress. The ultimate aim is the election of all the members of the Legislative Council by universal suffrage.

The specific method for forming the Legislative Council and its procedures for voting on bills and motions are prescribed in Annex II: “”Method for the Formation of the Legislative Council of the Hong Kong Special Administrative Region and Its Voting Procedures””.

• Article 69 The term of office of the Legislative Council of the Hong Kong Special Administrative Region shall be four years, except the first term which shall be two years.

• Article 73 The Legislative Council of the Hong Kong Special Administrative Region shall exercise the following powers and functions;

(1) To enact, amend or repeal laws in accordance with the provisions of this Law and legal procedures;

(2) To examine and approve budgets introduced by the government;

(3) To approve taxation and public expenditure;

(4) To receive and debate the policy addresses of the Chief Executive;

(5) To raise questions on the work of the government;

(6) To debate any issue concerning public interests;

(7) To endorse the appointment and removal of the judges of the Court of Final Appeal and the Chief Judge of the High Court;

(8) To receive and handle complaints from Hong Kong residents;

(9) If a motion initiated jointly by one-fourth of all the members of the Legislative Council charges the Chief Executive with serious breach of law or dereliction of duty and if he or she refuses to resign, the Council may, after passing a motion for investigation, give a mandate to the Chief Justice of the Court of Final Appeal to form and chair an independent investigation committee. The committee shall be responsible for carrying out the investigation and reporting its findings to the Council. If the committee considers the evidence sufficient to substantiate such charges, the Council may pass a motion of impeachment by a two-thirds majority of all its members and report it to the Central People’s Government for decision; and

(10) To summon, as required when exercising the above-mentioned powers and functions, persons concerned to testify or give evidence.

• Article 74 Members of the Legislative Council of the Hong Kong Special Administrative Region may introduce bills in accordance with the provisions of this Law and legal procedures. Bills which do not relate to public expenditure or political structure or the operation of the government may be introduced individually or jointly by members of the Council. The written consent of the Chief Executive shall be required before bills relating to government policies are introduced.

• Article 76 A bill passed by the Legislative council of the Hong Kong Special Administrative Region may take effect only after it is signed and promulgated by the Chief Executive.
