Family and Medical Leave ActThe Rule

Up to 12 weeks of leave per 12-month period for:Birth and care of the employee’s child;Placement with the employee of a

child for adoption or foster care;Employee’s serious health

condition; orCare of the employee’s spouse,

child or parent with a serious health condition.

This law applies equally to male and female employees.

Childbirth and recovery from childbirth Need for prenatal care Strokes Most cancers Asthma attack Severe arthritis Severe nervous disorders Injuries caused by serious accidents Heart bypass or heart valve operations Back conditions requiring surgery or therapy

Family and Medical Leave ActWhat is Not a Serious Health Condition?

Routine illnesses:ColdFluEaracheUpset stomach, minor ulcersHeadaches other than migraine

Routine physical/dental/eye exams Cosmetic treatment (in most cases)

Family and Medical Leave ActIs FMLA leave paid or unpaid?

Employees must use all available paid leave (sick, vacation, floating holiday).

The applicable paid leave is used in conjunction with the 12-week leave maximum.

All accrued and available leave balances must be used concurrently with FML.

Once all accrued and available leave balances are exhausted, the employee must be placed on Leave Without Pay.
