AUTHORISED BETTING OPERATIONS ACT 2000 Notice pursuant to section 54(1)(c) of the Authorised Betting Operations Act 2000

PURSUANT to section 54(1)(c) of the Authorised Betting Operations Act 2000, I, Dini Soulio, Liquor and Gambling Commissioner, hereby declare that it is a condition of a bookmakers licence that the licensee may accept bets (not being bets made by telephone, internet or other electronic means) at a place, other than at a racecourse on a day on which a licensed racing club is authorised to conduct on-course totalisator betting within that racecourse or at a licensed betting shop, which is being used for the purposes of a charitable fundraising event on the day fixed as Melbourne Cup Day, being the first Tuesday of November of every year, which are—

• (annual events organised by community or charitable bodies) being any annual fundraising event organised by a non-profit, charitable or community body; or

• (other) any other event of an infrequent nature in relation to which contingencies have been approved under the Act for the purposes of totalisator or fixed odd betting and such that it would not have any material adverse financial effect on the holder of the major betting operations licence holder.

It is a condition of this declaration that— (1) subject to any exclusivity provisions afforded to UBET SA, being the holder of the major betting operations licence under the

Approved Licensing Agreement (ALA) with the Minister for Consumer and Business Services, that such betting operations by a licensed bookmaker may not be conducted at a place where UBET SA is authorised to conduct— (a) off-course totalisator betting; or (b) totalisator betting on certain sports; or (c) fixed odds betting on certain sports; or (d) walk in trade; and

(2) UBET SA must consent in writing prior to bookmaking operations being conducted at such fundraising events and that evidence of such consent must be produced by the licensed bookmaker at the request of an Authorised Officer; and

(3) the acceptance of any bet that may constitute Direct Walk In Trade is prohibited; and (4) the acceptance of any bet that may constitute Indirect Walk In Trade is prohibited; and (5) where a relevant fundraising event is being organised by other than a community or charitable body, that all of the net proceeds

from the event are distributed to the holder of a section 6 licence pursuant to the Collections for Charitable Purposes Act 1939. For the purposes of this declaration, the terms (annual events organised by community or charity bodies), (other) events, Direct Walk

a series of questions about the exempted activity. You will need to have a copy of your exemption with you at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and/or boats involved, the number of agents undertaking the exempted activity and other related issues.

7. The exemption holder must provide a report in writing detailing the outcomes of the research and the collection of organisms pursuant to this notice to the PIRSA Fisheries and Aquaculture, (GPO Box 1625, ADELAIDE SA 5001) within 3 months of the expiry of this notice, giving the following details:

• the date, soak time and location of collection; • the number of nets used; • the description of all species collected (fish, invertebrates, turtles); • the number of each species collected; and • any other information regarding size, breeding or anything deemed relevant or of interest that is able to be volunteered.

8. While engaging in the exempted activity, the exemption holder or a person acting as their agent must be in possession of a copy of this notice. Such notice must be produced to a Fisheries Officer if requested.

9. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice or any other notice issued under that Act.

This notice does not purport to override the provisions or operation of any other Act including, but not limited to, the River Murray Act 2003. The exemption holder and his agents must comply with any relevant regulations, permits, requirements and directions from the Department of Environment, Water and Natural Resources when undertaking activities within a marine park. Ministerial Exemption ME9902963 TAKE NOTICE that pursuant to Section 115 of the Fisheries Management Act 2007, Port Lincoln Salmon Pty Ltd of Post Office Box 1635, Port Lincoln, SA, 5606, holder of Marine Scalefish Fishery licence number M210, or registered master on that licence (the ‘exemption holder’), is exempt from regulation 7(b)(i) and Part 1 of Schedule 7 of the Fisheries Management (General) Regulations 2007 but only insofar as the exemption holder may use a registered Purse Seine Net to take Australian Salmon for trade or business in the waters described in Schedule 1 (the ‘exempted activity’), subject to the conditions set out in Schedule 2, from 21 October 2017 until 21 October 2018, unless varied or revoked earlier.

SCHEDULE 1 The waters of Spencer Gulf near Wedge Island as provided for in Schedule 7 of the Fisheries Management (General) Regulations

2007 bounded as follows: Commencing at the high water mark at the most northern point of Wedge Island latitude 35°07’.956ʺS and longitude 136°27’.041ʺE,

then in a north easterly direction to the most western point of North Islet, latitude 35°07’.029ʺS and longitude 136°27’.814ʺE, then following the line of the high water mark along the southern coastline to the most eastern point of North Islet, latitude 35°07’.251ʺS and longitude 136°28’.740ʺE, then south easterly direction to the high water mark of the most north easterly point of Wedge Island latitude 35°09’.705ʺS and longitude 136°29’.663ʺE, then following the line of high water along the northern coastline to the point of commencement.


SCHEDULE 2 1. The exemption holder may only undertake the activity pursuant to this exemption when fishing from a boat that is registered on

Marine Scalefish Fishery licence M210. 2. The exemption holder may fish for a maximum of five days within the area listed in Schedule 1 during the period of this notice. 3. The exempted activity may only be undertaken using a Purse Seine Net, registered on Marine Scalefish Fishery licence M210

and with dimensions of 900 metre length, 13 metre depth and mesh size less than 50 millimetres. 4. Any species other than Australian Salmon captured during the exempted activity must be returned to the water immediately. 5. The exempted activity may not occur at the following times:

(a) the period commencing at 0100 hours on 23 December 2016 and ending at midnight on 1 January 2017; (b) the period commencing at 0100 hours on the Thursday preceding Easter Sunday in 2017 and ending at midnight on the

following Monday; (c) the period commencing at 0100 hours on a Thursday and ending at midnight on the following Sunday if the Friday in that

6. The exemption holder must notify PIRSA FISHWATCH on 1800 065 522 prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, and the boats involved in undertaking the exempted activity and other related questions.

7. Whilst engaged in the exempted activity the exemption holder must be in possession of a copy of this notice and this notice must be produced to a Fisheries Officer if requested.

8. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007 or any regulations made under that Act, except where specifically exempted by this notice.

1—Short title This notice may be cited as the Liquor Licensing (Dry Areas) Notice 2017.

2—Commencement This notice comes into operation on 31 December 2017.

3—Interpretation (1) In this notice—

principal notice means the Liquor Licensing (Dry Areas) Notice 2015 published in the Gazette on 5.1.15, as in force from time to time.

(2) Clause 3 of the principal notice applies to this notice as if it were the principal notice.

4—Consumption etc of liquor prohibited in dry areas (1) Pursuant to section 131 of the Act, the consumption and possession of liquor in the area

described in the Schedule is prohibited in accordance with the provisions of the Schedule.

(2) The prohibition has effect during the periods specified in the Schedule.

(3) The prohibition does not extend to private land in the area described in the Schedule.

(4) Unless the contrary intention appears, the prohibition of the possession of liquor in the area does not extend to—

(b) a person who has possession of the liquor in the course of carrying on a business or in the course of his or her employment by another person in the course of carrying on a business; or

(c) a person who is permanently or temporarily residing at premises within the area or on the boundary of the area and who enters the area solely for the purpose of passing through it to enter those premises or who enters the area from those premises for the purpose of leaving the area.

This instrument is repealed 12 months after clause 4 of the Trans-Tasman Mutual Recognition (New South Wales) Temporary Exemptions Regulation 2016 (NSW) ceases to operate. Note: That clause ceases to operate at the end of 16 November 2017.

Part 1—Preliminary 1—Short title

These regulations may be cited as the Burial and Cremation (Cremation Permits) Variation Regulations 2017.

2—Commencement These regulations come into operation on the day on which they are made.

3—Variation provisions In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

Part 2—Variation of Burial and Cremation Regulations 2014 4—Insertion of regulation 4A

After regulation 4 insert:

4A—Cremation of de-identified bodily remains imported for use by school of anatomy

(1) Section 10(5) of the Act does not apply in relation to an application for a cremation permit authorising the cremation of bodily remains that have been imported from a place outside the State for use by a school of anatomy if—

(a) the application is accompanied by—

(i) a detailed description of the remains; and


(ii) details of the source of the remains, including the name and contact details of the company or institution that provided the remains; and

(iii) evidence to the satisfaction of the Registrar that—

(A) the remains consist only of de-identified bodily remains imported from a place outside the State; and

(B) the school of anatomy is not required to return the remains to their place of origin; and

(C) the school of anatomy is permitted or required to dispose of the remains by cremation; and

(iv) consent in writing to the cremation of the remains given by the school of anatomy seeking to dispose of the remains; and

(v) a certificate of identification issued by a medical practitioner who has viewed the remains, certifying that the bodily remains are those of a person whose identity has not been ascertained; and

(b) such other information or evidence as the Registrar may require to determine the application is provided to the Registrar.

(2) In this regulation—

school of anatomy means a school of anatomy established under section 33 of the Transplantation and Anatomy Act 1983.

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.

Review of Elector Representation NOTICE is hereby given that the City of Norwood Payneham & St Peters has completed a review of its elector representation arrangements, including its composition and ward structure, in accordance with the requirements of Section 12 (4) of the Local Government Act 1999 (the Act).
