TAKE NOTICE that pursuant to the Crown Lands Act 1929, I, JAY WEATHERILL, Minister for Environment and Conservation, Minister of the Crown to whom the administration of the Crown Lands Act 1929 is committed DO HEREBY dedicate the Crown Land defined in The Schedule as a Reserve for Recreation and Coast Protection Purposes and declare that such land shall be under the care, control and management of the District Council of Yorke Peninsula.

CROWN LANDS ACT 1929: SECTION 5

TAKE NOTICE that pursuant to the Crown Lands Act 1929, I, JAY WEATHERILL, Minister for Environment and Conservation, Minister of the Crown to whom the administration of the Crown Lands Act 1929 is committed DO HEREBY:

1. Resume the land defined in The First Schedule.

2. Dedicate the Crown Land defined in The Second Schedule as a Tramway Reserve and declare that such land shall be under the care, control and management of the Minister for Transport.

The First Schedule

Recreation Reserves, Sections 5808, 5809, 5810 and 5811, Hundred of Yatala, County of Adelaide, the proclamation of which, together with other land was published in the Government Gazette of 13 April 1978 at page 1200, The Third Schedule, being the whole of the land comprised in Crown Record Volume 5753, Folios 912, 913, 914 and 915 (respectively).

ENVIRONMENT PROTECTION ACT 1993

Vary the Approval of Category B Containers

I, ANDREA KAYE WOODS, Delegate of the Environment Protection Authority (‘the Authority’), pursuant to section 68 of the Environment Protection Act 1993 (SA) (‘the Act’) hereby:

Vary the Approval of Category B Containers:

Approve as Category B Containers, subject to the conditions 1-4 below, each of the classes of containers identified by reference to the following matters described in the first 4 columns of Schedule 1 of this Notice which are sold in South Australia:

(a) the product which each class of containers shall contain;

(b) the size of the containers;

(c) the type of containers; and

(d) the name of the holders of these approvals.

(1) That containers of the class to which the approval relates must bear the refund marking specified by the Authority for containers of that class.

(2) The holder of the approval must have in place an effective and appropriate waste management arrangement in relation to containers of that class. For the purpose of this approval notice the company named in column 5 of Schedule 1 of this Notice is the nominated super collector.

(3) In the case of an approval in relation to Category B containers that the waste management arrangement must require the holder of the approval to provide specified super collectors with a declaration in the form determined by the Authority in relation to each sale of such containers by the holder of the approval as soon as practicable after the sale.

(4) The holder of these approvals must ensure that if a sticker bearing the refund marking has been approved, and is applied to the container, then the sticker must not be placed on any portion of the opening mechanism or in any other place that would require complete or partial removal of the sticker before the contents may be consumed.

Identification of Areas Determined by the Minister for the Purposes of Clause 2B of Schedule 4—New Dwellings

Preamble

It is necessary to advise that pursuant to Schedule 4, Clause 2B (1) of the Development Regulations 2008, I have determined areas to be identified by notice in the Gazette.

NOTICE

PURSUANT to Schedule 4, Clause 2B (1), of the Development Regulations 2008, I, Paul Holloway, being the Minister administering the Development Act 1993, have determined that Schedule 4—Complying Development, Clause 2 (B) will apply in relation to the areas identified in Attachment A to this Gazette notice.

This notice will come into operation as of 2 July 2009.

ESSENTIAL SERVICES COMMISSION ACT 2002

Price Determination

NOTICE is hereby given that:

1. On 16 June 2009 the Essential Services Commission made a price determination under the Essential Services Commission Act 2002, as authorised by section 33 (1) (c) of the Gas Act 1997, concerning prices for the provision of retail market administrator services in the gas market in South Australia.

2. The price determination regulates price-fixing factors and conditions relating to prices that may be charged for the provision of retail market administrator services in the gas market in South Australia.

3. The Commission revokes and replaces all previous price determinations made by the Commission applying to a retail market administrator.

4. The price determination permits a retail market administrator to charge up to the ‘price caps’ set out in the determination without the prior approval of the Commission.

5. The price determination also sets out how these price caps change over time.

6. The price determination takes effect from 1 July 2009 and expires on the later of 1 October 2009 or the changeover date fixed by Ministerial Gazette notice, pursuant to the National Gas (South Australia) Act 2008, on which the Australian Energy Market Operator assumes responsibility for the operation of the South Australian gas market operated, up until that date, by the Retail Energy Market Company Ltd.

TAKE notice that pursuant to section 115 of the Fisheries Management Act 2007, Sime Sarin, P.O. Box 1073, Port Lincoln, S.A. 5607, holder of Marine Scalefish Fishery Licence Nos M433, M262 and M491, or a master registered on the licence (the ‘exemption holder’), is exempt from Regulation 7 (b) of the Fisheries Management (General) Regulations 2007, but only insofar as the exemption holder may use a sardine net for the purposes of trade or business in the waters described in Schedule 1 (the ‘exempted activity’), subject to the conditions set out in Schedule 2, from 19 June 2009 until 31 May 2010, unless varied or revoked earlier.

• Waters of Coffin Bay northerly of the geodesic 3431 (Point Longnose); and

• Waters adjacent to Port Lincoln contained within the geodesic from Point Bolingbroke (latitude 3432.51S and longitude 13605.33E), to Cape Donington (latitude 3443.73S and longitude 13559.63E)—excluding those waters adjacent to Port Lincoln bounded as follows: commencing at a point at the high water mark at the shore end of the North Shields Jetty, thence in a generally east-south-east direction to Maria Point on Boston Island, thence following the high water make in a southerly direction to the light at Point Fanny, thence in a direction of 249T to the most northerly part of Billy Lights Point, thence along the high water mark to the point of commencement.

SCHEDULE 2

1. The exemption holder may only undertake sardine fishing pursuant to this exemption when fishing from a boat that is registered on Marine Scalefish Fishery Licence Nos M262, M429, M433 and M491.

2. The exemption holder must comply with all conditions of Marine Scalefish Fishery Licence Nos M262, M429, M433 and M491 while engaged in the exempted activity.

3. While engaged in the exempted activity the exemption holder must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Compliance Officer if requested.

4. The exemption holder must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice.

1. Specimens collected pursuant to this notice may only be collected by hand.

2. Specimens collected by the exemption holder pursuant to this notice must not be sold.

3. No organisms may be collected pursuant to this exemption within an Aquatic Reserve.

4. The exemption holder must notify PIRSA Fishwatch on 1800 065 522 at least two hours prior to conducting the exempted activity and answer a series of questions about the exempted activity. The exemption holder will need to have a copy of the

exemption at the time of making the call, and be able to provide information about the area and time of the exempted activity, the vehicles and boats involved, the number of agents undertaking the exempted activity and other related questions. Exemption No. 9902248.

5. Within 14 days of each collection of organisms pursuant to this notice, the exemption holder must provide a report in writing to the Director of Fisheries (G.P.O. Box 1625, Adelaide, S.A. 5001), giving the following details:

• the date and time of collection;

• the description of all species collected; and

• the number of each species collected.

6. While engaged in the exempted activity, the exemption holder or a person acting as his agent must carry identification proving membership of the Malacological Society.

7. While engaged in the exempted activity, the exemption holder or a person acting as his agent must be in possession of a copy of this notice. Such notice must be produced to a PIRSA Fisheries Officer upon request.

8. The exemption holder or a person acting as his agent must not contravene or fail to comply with the Fisheries Management Act 2007, or any regulations made under that Act, except where specifically exempted by this notice.

FISHERIES MANAGEMENT ACT 2007: SECTION 79

TAKE note that the notice made under section 79 of the Fisheries Management Act 2007, published in the South Australian Government Gazette, dated 5 March 2009, referring to the West Coast Prawn Fishery, is hereby varied such that it will not be unlawful for a person fishing pursuant to a West Coast Prawn Fishery Licence to use prawn trawl nets in the waters specified in Schedule 1, under the conditions specified in Schedule 2, during the period specified in Schedule 3.

SCHEDULE 1

The waters of the West Coast Prawn Fishery adjacent to Venus Bay.

SCHEDULE 2

1. Each licence holder must ensure that a representative sample of the catch (a ‘bucket count’) is taken for each trawl shot carried out during the fishing activity.

2. Each ‘bucket count’ sample must be accurately weighed to 7 kg where possible and the total number of prawns contained in the bucket must be recorded on the attached data sheet, marked ‘West Coast Prawn Fishery Bucket Count Data Sheet’.

3. The information recorded on the ‘WCPF Bucket Count Data Sheet’ must be returned to SARDI Aquatic Sciences within 15 days of the fishing activity being completed.

4. Fishing must cease if one or both of the following limits are reached:

(a) The average catch per vessel, per night (for all three vessels) drops below 300 kg for two consecutive nights.

(b) The average prawn ‘bucket count’ for all three vessels exceeds 240 prawns per bucket on any single fishing night.

5. The fleet must nominate a licence holder to provide a daily update by telephone or SMS message to the PIRSA Fisheries Manager, to report the total prawn catch per night and the average prawn ‘bucket count’ information.

The closure applies to the area encompassing all of the Park to the east of the Minnipa-Yardea Road including Old Paney, Paney Homestead and the Mattera, Kolay Hut, Chillunie and Wanganny campgrounds.

The portion of the Park to the west of the Minnipa-Yardea Road including Organ Pipes and the Yandinga, Scrubby Peak and Kododo Hill campgrounds will remain open to the public during this period.

The purpose of the closure is to ensure the safety of the public during a pest control and monitoring program within the reserve during the period indicated.

Use of Firearms within the Reserve

Pursuant to Regulations 8 (4), 20 (1) and 41 of the National Parks and Wildlife (National Parks) Regulations 2001, I, Edward Gregory Leaman, Director of National Parks and Wildlife, grant permission to members of the Sporting Shooters Association of Australia Hunting & Conservation Branch (SA) Inc. in possession of both a current Hunting Permit and a firearm to enter and remain in Gawler Ranges National Park from 6 p.m. on Friday, 7 August 2009 until 6 a.m. on Saturday, 15 August 2009 for the purpose of taking feral animals.

This permission is conditional upon the observance by each of those persons of the requirements of the National Parks and Wildlife Act 1972, National Parks and Wildlife (National Parks) Regulations 2001, and the National Parks and Wildlife (Hunting) Regulations 1996, including those requiring compliance with the Director’s requests, requirements and orders of a Warden.

An accredited person shall pay annual accreditation fees according to their accreditation category or categories.

A person accredited at the beginning of the financial year as both a rail infrastructure manager and a rolling stock operator shall pay an annual fee equal to the total of both the rail infrastructure manager and rolling stock operator annual fee. A person accredited at the beginning of the financial year as both a category 4 rail infrastructure manager and a category 4 rolling stock operator shall pay a maximum combined annual fee of $12 942.

For an accreditation granted during the financial year, the amount shall be payable at the time of accreditation and the fee shall be based on the estimated annual fee adjusted on a pro rata basis to reflect the actual number of weeks, or part thereof, that the accreditation will remain in force for the balance of the financial year.

For an accreditation that is granted for a portion of the financial year, the amount payable shall be based on the estimated annual fee adjusted on a pro rata basis to reflect the actual number of weeks, or part thereof, that the accreditation will remain in force. A minimum fee of $6 471 applies for an accreditation granted for a fixed period less than six months.

Schedule 1—Transitional provisions

1—Transitional provisions

(1) The licence and registration application fees prescribed by Schedule 1 Divisions 1 and 2 of the Fisheries Management (Fees) Regulations 2007, as substituted by these regulations, apply where a licence or registration is to take effect on or after 1 July 2009.

(2) The licence and registration annual fees prescribed by Schedule 1 Divisions 3 and 4 of the Fisheries Management (Fees) Regulations 2007, as substituted by these regulations, apply in respect of the period of 12 months commencing on 1 July 2009.

(3) Despite regulation 4 of these regulations—

(a) the licence and registration application fees prescribed by Schedule 1 Divisions 1 and 2 of the Fisheries Management (Fees) Regulations 2007, as in force immediately before the commencement of these regulations, continue to apply where a licence or registration is to take effect before 1 July 2009;

(b) the licence and registration annual fees prescribed by Schedule 1 Divisions 3 and 4 of the Fisheries Management (Fees) Regulations 2007, as in force immediately before the commencement of these regulations, continue to apply in respect of the period of 12 months that commenced on 1 July 2008.

NOTICE is hereby given that at its meeting held on 9 June 2009, the Council:

1. Adopted the most recent valuations of the Valuer-General available to the Council of the Capital Value of all land within the Council’s area, totalling $21 430 943 710, of which $20 521 174 510 is the capital value of all rateable land within the area, for rating purposes for the financial year ending on 30 June 2010, in accordance with section 167 (2) (a) of the Local Government Act 1999.

2. Declared differential general rates on rateable land within its area pursuant to and in accordance with sections 153 (1) (b) and 156 (1) (a) of the Local Government Act 1999, varying according to land use as follows:

(a) 0.250284 cents in the dollar on rateable land of Category 1;

(b) 0.655 cents in the dollar on rateable land of Categories 2, 3 and 4;

(c) 0.784469 cents in the dollar on rateable land of Categories 5 and 6;

(d) 0.537717 cents in the dollar on rateable land of Category 7;

(e) 0.595292 cents in the dollar on rateable land of Category 8; and

Declared a separate rate in accordance with section 95 of the Natural Resources Management Act 2004 and section 154 of the Local Government Act 1999, in order to reimburse to the Council the amounts contributed to the Adelaide and Mount Lofty Ranges Natural Resources Management Board for the Council’s area, being $1 524 793, a separate rate of $0.007436634 cents in the dollar, based on the capital value of rateable land, on all rateable land in the Council’s area, the capital value of such land comprising $20 520 900 510.

ADELAIDE HILLS COUNCIL

Proposed Road Naming of Un-named Public Road Reserves Within the Adelaide Hills Council Region

NOTICE is hereby given that Council resolved at its meeting held on 7 April 2009, to change the road names of the following roads:

• Ranns Road, Basket Range to Ranns Road North; • Ranns Road, Carey Gully to Ranns Road South; • Peacock Road, Lenswood to Peacock Road North; • Peacock Road, Balhannah to Peacock Road South; and • Head Road, Lower Hermitage to Head Road North and

Head Road South.

Council also resolved at the same meeting to assign a private road, Elite Lane which is opposite Ambleside Road at Verdun.

On 5 May 2009, Council also resolved to assign the name Morialta Lane to the private road which leads into the Old Morialta Orphanage.

It was also resolved at a Council meeting on 2 June 2009, to change the road name of Stachelroth Road, Lobethal to Tabor Lane.

The naming of these road reserves and private roads are a result of the Local Government and State Government’s Rural Property Addressing Program.

Adoption of Valuations for Rating

Notice is hereby given that at a meeting of Council held on 9 June 2009, it was resolved that the District Council of Barunga West adopts the capital valuations of the Valuer-General, dated 30 May 2009, that are to apply for the area of rating purposes for the 2009-2010 financial year, being capital valuations totalling $840 842 940, comprising $805 771 460 for rateable land and $35 071 480 for non-rateable land.

Adoption of Budget and Declaration of Rates

Notice is hereby given that by virtue of the powers vested in it by the Local Government Act 1999, and all other powers there unto enabling the Council of the District Council of Barunga West (hereinafter called ‘the Council’) at a meeting on 9 June 2009:

1. Adopts the Annual Budget as prepared pursuant to section 123 of the Local Government Act 1999 and Regulation 5B of the Local Government (Financial Management) Regulations 1999, including Estimates of Income (excluding general rate income) totalling $1 517 353 as amended and the Estimates of Cash Expenditure of $4 232 587 as amended for the financial year ending 30 June 2010.

2. Declared differential general rates on rateable land with the area of the Council for the financial year ended 30 June 2010, which differential general rates are pursuant to section 152 (1) (c) based on two components—(1) one being the value of the rateable land and (2) the other being the fixed charge applicable to the rateable land and which general rates vary according to the use in accordance with section 156 (1) (a) of the Local Government Act 1999.

3. Declared that an amount of $240 as a fixed charge on each separate piece of rateable land in the area of the Council for the purposes of rates, pursuant to section 152 of the Local Govern-ment Act 1999, for the year ending 30 June 2010.

4. That the amounts of differential general rates are as follows:

(a) that the differential general rate for all rateable land within the area of the Council which has a land use of Residential be declared at 0.2328 cents in the dollar; and

(b) that the differential general rate for all rateable land within the area of the Council which has a land use of Commercial—Shop, Commercial—Office or Com-mercial—Other, Industrial—Light or Industrial—Other be declared at 0.4584 cents in the dollar; and

(c) that the differential general rate for all rateable land within the area of the Council which has a land use of Primary Production be declared at 0.2285 cents in the dollar; and

(d) that the differential general rate for all rateable land within the area of the Council which has a land use of Vacant be declared at 0.1891 cents in the dollar.

Community Wastewater Management System Schemes

1. PORT BROUGHTON SCHEME

(1) Adopts the Estimates of Expenditure totalling $208 265 (excluding depreciation), relating to the operation, main-tenance, replacement and improvements and residual balance being allocated to reserves for the financial year 2009-2010.

(2) Pursuant to section 155 of the Local Government Act

1999, imposes annual service charges on rateable and non-rateable land within the District to which this service is provided as specified:

• in respect of each effluent unit applying to occupied allotments a charge of $290; and

• in respect of each vacant allotment, a charge of $205.

2. BUTE SCHEME

(1) Adopts the Estimates of Expenditure totalling $34 645 (excluding depreciation), relating to the operation, main-tenance, replacement and improvements and residual balance being allocated to reserves for the financial year 2009-2010.

(2) Pursuant to section 155 of the Local Government Act 1999, imposes annual service charges on rateable and non-rateable land within the District to which this service is provided as specified:

• in respect of each effluent unit applying to occupied allotments a charge of $240; and

• in respect of each vacant allotment, a charge of $55.

3. Any reference to a ‘unit’ being as defined in the CWMS Property Units Code in accordance with Regulation 9A of the Local Government (General) Regulations 1999.

Natural Resources Management Levy

That pursuant to section 95 of the Natural Resources Manage-ment Act 2004 and section 154 of the Local Government Act 1999 and in order to reimburse the Council the amount contributed to the Northern and Yorke Natural Resources Management Board for the year ending 30 June 2010, being $121 092 a separate rate in the dollar of 0.0151 is declared on all rateable land in the Council’s area.

Payment of Rates

Notice is hereby given that the requirements for the payments of rates are as follows:

1. Rates (i.e. Differential General Rates plus Fixed Charges, Service Charges and Separate Rates) declared by Council for the financial year ending 30 June 2010, will fall due in four equal or approximately equal instalments.

2. The said instalments shall be payable on or before 9 September 2009, 9 December 2009, 9 March 2010 and 9 June 2010, failing which the said rates shall be regarded as being in arrears and subject to the imposition of fines, as prescribed.

A Poll to Determine if the Composition of Council will be Altered

NOTICE is hereby given that in accordance with the provisions of the Local Government Act 1999, Kingston District Council is undertaking an Elector Representation Review, which requires Council to review all aspects of its composition (Mayor/ Chairperson, number of members, ward structure).

As a result of this review process, Council proposes that the composition of Council be altered so that the Principal Member be a Mayor elected by the community, rather than a Chairperson elected by Council members.

In accordance with section 12 of the Local Government Act 1999, before the proposal can proceed, a poll of electors must be conducted on the question of Council operating with a Mayor elected by the Community, with a majority response in favour of the change.

Postal Voting

The Poll will be conducted entirely by postal voting. Voting material will be dispatched commencing on Tuesday, 14 July 2009, with all voting material to be delivered by Monday, 20 July 2009.

Completed ballot material must be returned to reach the Returning Officer no later than 12 noon on Monday, 3 August 2009.

A ballot box will be provided at the Council Office, 29 Holland Street, Kingston SE, for electors who wish to personally deliver their completed ballot material during office hours.

Place of Counting Votes

The scrutiny and counting of votes will take place at the Council Chambers, 29 Holland Street, Kingston SE, as soon as practicable after 12 noon on Monday, 3 August 2009. A provisional declara-tion will be made at the conclusion of the count.

Light Regional Council Development Plan Kapunda (North-East) Residential and Retirement Living

Development Plan Amendment— Draft for Public Consultation

NOTICE is hereby given that the Light Regional Council has prepared a draft Kapunda (North-East) Residential and Retirement Living Development Plan Amendment (DPA).

The DPA proposes to amend the Light Regional Council Development Plan by rezoning some 17 hectares of land north-east of Kapunda for retirement living and residential development.

The affected area is bordered by Nash Street (north), Jaffrey Street (east), Maxwell Street (south) and Shannon Street (west). The DPA includes appropriate planning policies and mapping to achieve the following:

• Rezone the Area Affected from Fringe (Kapunda) to Residential (Kapunda) to accommodate the uses envisaged (residential, retirement living and associated development together with containment of the existing hospital and child care centre site in one zone) as a logical extension of the existing abutting Residential (Kapunda) Zone.

• The creation of a new policy area (to be named Residential (Kapunda) Policy Area 16—Seniors Living) over part of the Area Affected to facilitate retirement living development as appropriate.

• The incorporation of the remaining portion of the Area Affected within Residential (Kapunda) Policy Area 15—General, allowing residential subdivision of the land, as well as accommodating and supporting the existing hospital, childcare centre and other associated uses.

Policy will be introduced which supports the key outcomes sought in terms of desired character, land use, density, access, open space distribution, stormwater management and buffers to the railway line (relevant in the event of its future reactivation).

The draft will be available for public inspection and purchase during office hours (9 a.m. to 5 p.m.) at the Council Offices being the Principal Office, 93 Main Street, Kapunda, or the Branch Office, 12 Hanson Street, Freeling. The draft Development Plan Amendment is also available at Council’s library and on Council’s website: www.light.sa.gov.au from 18 June 2009 to 21 August 2009. A hard copy of the DPA can be purchased from the Council Office at $45 each.

Written submissions should also clearly indicate whether you wish to speak at the public hearing on your submission. Copies of all submissions received will be available for inspection by interested persons at the Light Regional Council offices from 25 August 2009 until the date of the public hearing.
