DEVELOPMENT ACT 1993, THE PORT WATERFRONTREDEVELOPMENT PLAN AMENDMENT REPORTPREPARED BY THE MINISTER—DRAFT FOR PUBLICCONSULTATION

NOTICE is hereby given that the Minister for Urban Develop-ment and Planning has, pursuant to Sections 24 and 26 of theDevelopment Act 1993, prepared a draft Plan Amendment Report(PAR) to amend the Port Adelaide Enfield Development Plan.

The draft PAR proposes to amend the Development Plan byproviding an appropriate and updated policy framework to betterpromote the revitalisation of the Port Waterfront and the PortAdelaide Centre.

The draft PAR will be on public consultation from 15 May2003 to 15 July 2003, inclusive.

The Commonwealth/State/Territory jurisdictional boundary in coastal waters is determined by the Australian Maritime BoundariesInformation System Dataset of 2000, released in January 2001 by the Australian Surveying and Land Information Group (nowGeoscience Australia National Mapping Division).

Section 5AAA of the Petroleum (Submerged Lands) Act 1967 provides that, where a change to the baseline of Australia’s territorialsea would impact on the boundary of an existing petroleum title (in Commonwealth or State or Territory waters), there is in fact no suchimpact. The Commonwealth, State or Territory Act (as the case may be) under which the title has been granted, continues to apply to thetitle and the whole title area for as long as the title remains in force. Therefore, this Instrument does not apply to any such area that isalready under title.

Applications lodged under section 20 of the Petroleum (Submerged Lands) Act 1967 are required to be made in the approved formand should be accompanied by:

(a) Details of:(i) the applicant’s technical assessment of the petroleum potential of the area, including the concepts underlying its

proposed exploration program, with sufficient detail to support that program;(ii) the applicant’s minimum guaranteed proposal (including indicative minimum expenditure) for exploration wells to be

drilled, 3D and 2D seismic and other surveying activities, data evaluation and other work, for each year of the firstthree years of the permit term. This proposal, to be known as the minimum guaranteed work program should comprisework expected to involve a substantial exploration component—normally, appraisal work should not be included;

(iii) the applicant’s proposal (including indicative minimum expenditure) for exploration wells to be drilled, 3D and 2Dseismic and other surveying activities, data evaluation and other work, for each of the three remaining years of thepermit term. This proposal, to be known as the secondary work program, should comprise work expected to involve asubstantial exploration component—normally, appraisal work should not be included.

(b) Particulars of:(i) the technical qualifications of the applicant and of its key employees;(ii) the technical advice available to the applicant;(iii) the financial resources available to the applicant, including evidence of the applicant’s ability to fund the work

program proposed, a statement of other exploration commitments over the next six years, and a copy of the latestannual report and quarterly reports for each applicant company;

(iv) where relevant, the viability of the consortium lodging the application, including evidence that a satisfactorysettlement has been, or can be, reached on the Joint Operating Agreement (a copy of a signed Heads of AgreementDealing will generally suffice); and

(v) the percentage participation interest of each party to the application.(c) Such other information as the applicant wishes to be taken into account in consideration of the application.(d) Each application must be accompanied by a fee of $A3 900, payable to the Commonwealth of Australia through an

Australian bank or bank cheque.Further details of the work program bidding system outlined above, including the criteria for assessment of applications and the

It should be noted that any income derived in the future from the recovery of petroleum from this area will be subject to theCommonwealth Government’s Resource Rent Tax.

MINISTERS OF THE CROWN AND OFFICES AND MEMBERSOF PARLIAMENT

1. Scope of Determination

This Determination applies to the undermentioned Ministers ofthe Crown and Officers and Members of Parliament.

2. Electorate Allowances for Members

2.1 There shall be payable to a Member in respect of theexpenses of discharging duties in the Electoral District theMember represents, an electorate allowance at the follow-ing annual rate:

2.2 The electorate allowance payable to a Member underclause 2.1 shall, in the case of a Member elected after 5May 2003, be calculated from the day on which he or shecommences to be a Member, but in the case of those whoare already Members on 5 May 2003, shall be calculatedfrom 5 May 2003, and except as provided by clause 2.3,shall cease to be payable on the day which such personceases to be a member.

5. Country Member’s Accommodation Allowance

A Member of either House of Parliament (including a Ministerof the Crown or the Leader of the Opposition in the House ofAssembly) whose usual place of residence is more than 75 km byroad from the General Post Office at Adelaide and who is requiredto stay in Adelaide overnight in order to attend not only toParliamentary duties but also to the Member’s duty to be activelyinvolved in community affairs and to represent and assistconstituents in dealings with governmental and other publicagencies and authorities, shall be paid an accommodationallowance of one hundred and fifty-eight dollars ($158) for eachsuch night up to a maximum of twenty-one thousand three hundredand thirty dollars ($21 330) in each twelve month period, the firstsuch period commencing from 1 July 2000.

6. Travelling and Accommodation Allowances

6.1 A Minister who actually incurs expenditure when travellingon official business shall be paid:

6.1.1 outside the metropolitan area, as defined by theDevelopment Plan published pursuant to Part 4 ofthe Planning Act 1982, but within the State—up toone hundred and eighty dollars ($180) per day;

6.1.2 interstate—up to three hundred and forty dollars($340) per day for Sydney and three hundred andtwenty-six dollars ($326) per day for places otherthan Sydney;

6.1.3 any extra expenditure necessarily incurred inaddition to the allowances provided in 6.1.1 and6.1.2.

6.2 The allowances provided by this clause shall also bepayable to the Leader of the Opposition who actuallyincurs expenditure when travelling on official business, andto the Deputy Leader of the Opposition when he or shedeputises, at the Leader’s request, for the Leader of theOpposition in his or her official capacity.

The provisions of this Determination, which supersede those ofall preceding Determinations, with the exception of Clause 5which shall continue to operate from 1 July 2000, shall operatefrom 5 May 2003.

REMUNERATION TRIBUNAL

REPORT RELATING TO DETERMINATION NO. 2 OF 2003

1. Introduction

1.1 Section 4 (1) (c) of the Parliamentary Remuneration Act1990, confers jurisdiction on the Remuneration Tribunal todetermine from time to time electorate allowances andother allowances and expenses for Members of Parliament.

1.2 On 15 January 2003, the Tribunal wrote to all Members ofParliament and major political parties advising that theTribunal would conduct a review of those allowances andexpenses, having regard to existing electoral boundaries,and seeking submissions on any matter relevant to such areview, including evidence of increased costs and expensesincurred for the allowances.

1.3 On 28 January 2003, the following was published in TheAdvertiser newspaper:

REMUNERATION TRIBUNAL

Review of Electorate and Other Allowances

Section 4 (1) (c) of the Parliamentary Remuneration Act 1990, confersjurisdiction on the Remuneration Tribunal to determine from time to timeelectorate allowances and other allowances and expenses for Members ofParliament.

Electorate allowances compensate members of Parliament for the expensesthey necessarily incur in the performance of their duties.

Other allowances referred to include:

• Expense Allowances of Ministers of the Crown;

• Expense Allowances of Officers of Parliament;

• Country Member’s Accommodation Allowance; and

• Travelling and Accommodation Allowances.

It should be noted that the Remuneration Tribunal does not set salaries forMembers of Parliament.

Interested persons, organisations and associations are invited to submit inwriting any views they consider should be taken into account in the abovereviews.

1.4 The Tribunal received a number of requests from Membersfor an extension of time to respond to the Tribunal’srequest for submissions in relation to the review. At itsmeeting on 24 February 2003, the Tribunal granted thoseMembers an extension until Wednesday, 12 March 2003.

1.5 The Tribunal heard oral submissions from Members ofParliament on 24 February 2003 and 18 March 2003.

1.6 Written and/or oral submissions were received from:

1.6.1 the Hon. John Rau who sought the provision ofmotor vehicles to the Members of the SouthAustralian Parliament under an arrangement similarto that of Federal Parliament. Mr Rau considered itquiet anomalous that vehicles were not providedwhen compared with what occurs in other states

and to Public Servants and other Private Sectoremployees of similar seniority. Mr Rau alsorequested that the Global Allowance be increased toallow for stretched office resources as a result ofadditional staff allocations;

1.6.2 the Hon. Bob Such who sought a specific allocationof a motor vehicle to Members of Parliament inreturn for appropriate adjustments to Member’selectorate allowances. He claimed ‘the issue hasdragged on for a long time and needs to be resolved’and that ‘many MPs from various political partieshave approached me on this issue and I have agreed,along with others to raise the matter with you’;

1.6.3 the Hon. Liz Penfold who provided details of thediverse activities within her electorate of Flindersand the expenditure involved in servicing thatelectorate including the cost of staff wages andoverheads;

1.6.4 the Hon. Martin Hamilton-Smith who sought anincrease in electorate allowances given the increas-ing costs associated with communicating on mattersof concern with constituents through quarterly newsbulletins and letters to each household in theelectorate;

1.6.5 the Hon. Mark Brindal who sought an increase inelectorate allowances to meet the myriad of costsassociated with running an electorate office and theability to access salary sacrifice arrangementssimilar to those offered to public servants;

1.6.6 the Hon. Vicki Chapman who detailed activitiesundertaken in her electorate and expenses incurredincluding those incurred in visiting properties etc.outside her electorate but owned by people orbusinesses inside her electorate;

1.6.7 the Hon. Wayne Matthew who sought clarificationof matters related to allowances determined by theTribunal and supplied a detailed summary ofexpenses incurred in the 2000-2001 and 2001-2002years above that provided for in the electorateallowance;

1.6.8 the Hon. Angus Redford and the Hon. TerryStephens who drew the Tribunal’s attention to thehistory of the electorate allowance and, whilst notcommenting on the adequacy of the currentamounts, advised the Tribunal that at least nineMembers of the Legislative Council had indicatedthey would record expenditure for a 12 monthperiod to assist the Tribunal in fixing appropriaterates; and

1.6.9 members of the public. Both of the two submis-sions received stated that Members of Parliamentshould be subject to normal Taxation rules andreceive re-imbursement, upon presentation of proofof purchase, only for costs actually incurred.

2. Electorate Allowances

2.1 Electorate allowances are provided to compensateMembers of Parliament for the expenses they necessarilyincur in the performance of their duties. A significantcomponent of the allowance covers the cost of running amotor vehicle in the servicing of electorates. Other items ofexpense may include accommodation and travellingexpenses (not otherwise covered), donations, subscrip-tions, telephone, printing, stationery and postage, withoutattempting to give a fully exhaustive list.

2.2 These allowances were last increased from 1 February2001, having regard to movement in the Consumer PriceIndex for the period from July 1999 to December 2000.

2.3 Submissions from Members of Parliament, in addition toseeking increased electorate allowances, also raised twosignificant issues for the Tribunal to consider as part of itsreview. These issues were the ability for Members ofParliament to access salary sacrifice arrangements and theallocation of motor vehicles.

2.4 Whilst the Tribunal believed it did not have the jurisdictionunder the Parliamentary Remuneration Act 1990, to makedeterminations in relation to these matters it sought legaladvice from the Crown Solicitor’s Office on these issues.

2.4.1 Salary Sacrifice Arrangements

In relation to salary sacrifice arrangements, theCrown Solicitor has confirmed that the Tribunaldoes not have jurisdiction to make a determinationto provide for salary sacrifice arrangements. TheTribunal is advised that any salary sacrificearrangement for Members of Parliament would needto be by variation to the ParliamentaryRemuneration Act 1990, by Parliament as it is anact of Parliament that determines the salaries ofMembers of Parliament.

2.4.2 Allocation of Motor Vehicles

A number of Members of Parliament made sub-missions for the allocation of motor vehicles toSouth Australian Members of Parliament on thebasis that all other States had arrangements in thisregard.

The Tribunal is informed that Federal Membersalong with Members in Victoria, Western Australiaand the Northern Territory have access to motorvehicles under various arrangements. HoweverMembers in New South Wales, Queensland andsome Members in Tasmania do not have vehiclesprovided.

The Crown Solicitor has confirmed that, under theParliamentary Remuneration Act 1990, the Tribunaldoes not have the power to determine that motorvehicles be supplied to Members of Parlia-ment aspart of their salary and allowances. Having regard tosection 6A of the Act, both Parliament and theCrown have the power to provide Members ofParliament with motor vehicles. Indeed that powerhas been exercised with the provision of a motorvehicle to one Member of Parliament in lieu of achauffer driven vehicle.

As a significant component of the ElectorateAllowance covers the cost of running a vehicle inthe servicing of electorates, if vehicles are providedto Members of Parliament the Tribunal would needto consider a downward adjustment of the elec-torate allowance.

2.5 Whilst the Tribunal received various other submissionsfrom Members in relation to electorate allowances, onlylimited evidence was given to the Tribunal as to themeasure of increase (if any) in any of those componentsspecifically, since the date of the last Determination.

2.6 The Tribunal has on a number of occasions (in 1969, 1975and 1994) endeavoured to gain more detailed informationfrom Members of Parliament on actual expenses incurredin servicing electorates. It has therefore been a matter ofsome concern that on each of these occasions the Tribunalhas received only limited information.

2.7 The Tribunal however is encouraged from submissionsheard in this review that at least nine Members of theLegislative Council have indicated they would complete asurvey of expenditure if the Tribunal was to conduct afurther full review of allowances and expenses payable.

2.8 Accordingly, whilst the Tribunal is at this stage onlyprepared to accept that the movement in the ConsumerPrice Index justifies a minimal adjustment to the electorateallowances and has therefore determined new electorateallowances as set out in the Determination, it has decidedto conduct an extensive review of electorate allowancespayable to Members of Parliament by way of a survey inthe near future.

2.9 This survey will be conducted for the period 1 July 2003 to30 June 2004 and each Member of Parliament will be sentin advance a copy of information which the Tribunal willbe requesting. Members will be reminded that electorateallowances are payable for personal expenses in

servicing the constituents in the electorate in which theyserve as distinct from those occurred in campaigning orsecuring support for re-election.

3. Expense Allowances of Ministers of the Crown and Officers ofParliament

3.1 These allowances are to compensate Ministers of theCrown and Officers of Parliament for the extraordinaryexpenses incurred when performing the duties of theseoffices and were last increased from 1 February 2001.

3.2 The Tribunal received no submissions to increase theseallowances and had no evidence put before it as to themeasure of increase (if any) in costs and expenses relatingto any of those components specifically, since the date ofthe last Determination. The Tribunal therefore hasdetermined not to increase these allowances at this time.

3.3 The Tribunal will be writing to Ministers of the Crown andOfficers of Parliament receiving these allowancesrequesting additional information in order to be satisfiedthat any increase to these allowances are justified.

4. Country Members’ Accommodation Allowance

4.1 This allowance was last increased from $140 to $158 pernight from 1 July 2000 and is payable to members ofParliament whose usual place of residence is more than75 km by road from the General Post Office at Adelaideand who are required to stay in Adelaide overnight in orderto attend to parliamentary duties and to also meet theirduties to be actively involved in community affairs andrepresent and assist constituents in dealings withgovernmental and other public agencies and authorities.

4.2 The maximum amount payable for a 12 month period is$21 330 and this amount was effective from 1 July 2000.

4.3 The Tribunal received submissions from two Membersdetailing benefits potentially gained by Country Memberswho utilise this allowance to subsidise the purchase of asecond residence in Adelaide.

4.4 Whilst the Tribunal notes these submissions (along withsimilar submissions received in previous years), and isaware of growing public expectations that persons in publicoffice do not benefit from that position, it is not prepared toalter the arrangements which have been in place for over 30years without full consideration. In its determination in1994, the then Tribunal stated:

‘In addition, the Tribunal is aware that some membershave deliberately chosen to acquire a second residence,either by way of house, flat, unit, etc. and it is verydifficult to determine the actual expenses in thesecircumstances.

As a matter of policy, the Tribunal does not wish todisadvantage such members for the exercise of thischoice and has therefore decided to provide an allowanceof a flat amount per overnight stay in Adelaideirrespective of the form of accommodation used. Suchpayment should not exceed the maximum prescribed inthe Determination for each 12 month period and shouldonly apply to those members who are eligible to receivethe allowance by virtue of the fact that:

(i) the Member remains in Adelaide overnight; and

(ii) the Member’s usual place of residence is more than75 km by road from the G.P.O. Adelaide.’

4.5 The Tribunal is aware that the Commonwealth Remunera-tion Tribunal has determined an allowance of one-third ofthe commercial rate for those Members who do not availthemselves of commercial accommodation.

4.6 The Tribunal received no submissions to increase thisallowance and had no evidence put before it as to themeasure of increase (if any) in costs and expenses relatingto overnight accommodation in Adelaide.

4.7 Accordingly, the Tribunal has decided to review this policyand will consider determining a rate for those not usingcommercial accommodation at a figure considerably lessthan that determined for those using commercialaccommodation. The Tribunal will also consider replacingthe overnight allowance for commercial accommodationwith reimbursement of actual costs incurred up to a

maximum overnight rate and annual ceiling. As part of theTribunal’s review of this allowance it will be writing tocountry Members in the near future inviting submissions onthe matter.

4.8 Having regard to the above, the Tribunal has determinednot to increase the Country Member’s AccommodationAllowance at this time.

5. Travelling and Accommodation Allowances of Ministers andthe Leader and Deputy Leader of the Opposition

5.1 These allowances are payable when expenditure is incurredwhen travelling on official business. These rates were lastincreased from 1 April 2002.

5.2 The Tribunal received no submissions to increase theseallowances and had no evidence put before it as to themeasure of increase (if any) in costs and expenses relatingto any of those components specifically, since the date ofthe last Determination. The Tribunal therefore has deter-mined not to increase these allowances at this time.

5.3 The Tribunal has decided to review the basis of thisallowance and will consider determining a rate for thosenot using commercial accommodation at a figure con-siderably less than that determined for those usingcommercial accommodation. The Tribunal will also con-sider replacing the overnight allowance for commercialaccommodation with reimbursement of actual costsincurred up to a maximum overnight rate. As part of theTribunal’s review of this allowance it will be writing toMinisters of the Crown and the Leader and Deputy Leaderof the Opposition in the near future inviting submissions onthe matter.

5.4 Having regard to the above, the Tribunal has determinednot to increase the Travelling and AccommodationAllowances at this time.

6. Date of Operation

6.1 The Tribunal has decided that the provisions of thisDetermination, which supersede those of all precedingDeterminations, with the exception of Clause 5 which shallcontinue to operate from 1 July 2000, shall operate from 5May 2003.

Development Plan Review—Public Consultation

NOTICE is hereby given that the City of Onkaparinga isreviewing its Development Plan, pursuant to section 30 of theDevelopment Act 1993.
