ALTERATION OF BOUNDARIES – THE TOWN OF RAYmORE AND THE RURAL mUNICIPALITY OF mOUNT HOPE NO. 279

1 Pursuant to sections 53, 56, 57, 59, and 61 of The Municipalities Act, the Council of the Town of Raymore has submitted an application to alter its boundaries to the minister of Government Relations.

2 Upon consideration of the application, the minister is of the opinion that the municipalities affected will be viable entities following the alteration of boundaries. Therefore, the undersigned hereby orders, pursuant to sections 61, 62, and 63 of The Municipalities Act, that:

(a) the boundaries of the Town of Raymore and the Rural municipality of mount Hope No. 279 be altered by withdrawing from the rural municipality and adding to the town the territory described in Schedule A;

(b) Schedule B is conclusively deemed to be the legal description of the boundary of the Town of Raymore; and

(c) the alteration shall take effect on and from the date of this Order.

PRODUCER LICENCEOrder No. 54/15. The SASKATCHEWAN BROILER HATCHING EGG PRODUCERS Board, pursuant to

the provisions of The Broiler Hatching Egg Marketing Plan Regulations, 2015 and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 A “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue of this person, and operating as a single economic unit.

2 Any person and/or production unit producing more than 999 broiler hatching eggs, chicks or broiler hatching eggs and chicks in a calendar year in Saskatchewan is required to hold quota and be licensed by the Board.

3 To apply for a new licence, an applicant must submit to the Board office:

(a) a Board-provided licence application that fulfills the information requirements listed in clause 22(b) of the regulations; and

(b) a $10 licence fee with the application submission.

4 Any new licence issued takes effect on the date of issuance and expires when the licence holder exits the industry or the licence is cancelled by the Board.

5 Before December 31st of each year, all licensed producers shall submit to the Board office a licence renewal application using a Board-provided application form that includes the information requirements listed in clause 22(b) of the regulations and is accompanied by a $10 licence renewal fee.

6 Any late licence renewal application will be subject to a financial penalty of $100 per month which will be invoiced to the producer upon receipt of the licence application at the Board office.

7 Licensed producers in compliance with all orders and regulations of the Board shall be eligible for license renewal.

8 No licensed producer shall hold more than one Board-issued licence.

9 Licensed producers shall own or lease the production unit and land on which the production associated with the licence is situated and shall provide the Board with verification of production unit and land ownership or a copy of the existing production unit and/or land lease agreement with the legal land location(s) specified.

10 In the event that a new producer acquires quota through a quota transfer or by way of an auction at any time during the calendar year, the new producer will be issued a new licence by the Board following which the producer is required to adhere to the same application requirements as all other licensed producers.

11 Any person who is not licensed under The Broiler Hatching Egg Marketing Plan Regulations, 2015 and who produces, markets or produces and markets 1,000 or more hatching eggs or chicks in a calendar year may be liable for a charge of $1.00 for each hatching egg or chick marketed.

12 To be considered for a licence and to hold a licence, the Board must be provided with the opportunity to inspect, at a time agreed upon by the licence applicant or licensee and the Board office, all production units that are owned or leased by the licence applicant or licensee that will be or are associated with broiler hatching egg quota in the Province of Saskatchewan.

QUOTA LImITSOrder No. 55/15. The SASKATCHEWAN BROILER HATCHING EGG PRODUCERS Board, pursuant to

the provisions of The Broiler Hatching Egg Marketing Plan Regulations, 2015 and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 A “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue.

2 No person, either directly or indirectly, in any manner whatsoever including without limiting the generality of the foregoing through an interest in a corporation, partnership, cooperative or in any other manner including by agreement through a trust, through his or her spouse, siblings, parents or issue, may hold more than 25 percent of the total quota held by the Board, unless such trust, spouse, sibling, parent or issue constitutes a separate economic unit.

3 For the purpose of section 2, the amount of quota shall be determined as follows:

(a) the total quota held by a person is the sum of:

(i) the quota held by that person;

(ii) the proportionate share of any quota in which that person has an ownership interest through a corporation, partnership, cooperative or any other entity in which a person has an ownership interest; and

(iii) any quota in which the person has an ownership interest as a lessee of quota; and

(b) the total quota held by a corporation, partnership, cooperative or any other entity is the sum of:

(i) the quota held by that corporation, partnership, unincorporated organization or group of individuals;

(ii) the proportionate share of any quota of any corporation, partnership, cooperative or any other entity in which a person has an ownership interest; and

(iii) any quota in which the corporation, partnership, cooperative or any other entity has an ownership interest as a lessee of quota.

4 The Board shall not allocate, reallocate or approve the lease or transfer of any quota if, as a result of that allocation, reallocation, lease or transfer, any person would hold quota in excess of that allowed pursuant to this Order.

5 Subject to section 9 of the Act, the Board may reduce, suspend or cancel quota if the licensed producer to whom it was allocated or the person to whom it has been leased:

(a) has failed to observe, perform or carry out the provisions of the Act, these regulations or an order of the Board;

(b) is not utilizing or has voluntarily given up all or part of that producer’s quota or portion leased;

(c) has not received the approval of the Board for any change of ownership interest in relation to that producer if a quota has been allocated or leased in the name of a company; or

(d) has had their licence cancelled or suspended.

6 Quota that has been cancelled pursuant to section 5 shall be held for auction in accordance with procedures described in the Quota Auction Process order.

7 Quota that is allocated as a production limit to a licensed producer shall relate to and be attached to a particular production unit that is situated in Saskatchewan on a legally defined parcel of land registered with Information Services Corporation.

8 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

2 Production limits issued to licensed producers shall be stated in terms of the number of hatching eggs per year.

3 A notice of production limits shall be given to each licensed producer by the Board one month prior to the start of the production period and shall remain in effect until further notice.

4 Permits may be issued for the temporary production and marketing of specific quantities of hatching eggs or chicks in a specific year for research purposes; such permits do not qualify the holder toward the allocation of permanent quota.

1 Each licenced producer shall submit to the Board a levy based on the hatching egg quota held.

2 The levy shall be $0.0050 per broiler hatching egg as approved through a vote of licensed producers.

3 The Saskatchewan Broiler Hatching Egg Producers’ levy shall be payable by the licenced producer in four quarterly payments starting march 31 of each year.

4 If a licensed producer fails to provide payment for the levies issued by the Saskatchewan Broiler Hatching Egg Producers within 30 days, the Board may request the licensed hatchery to deduct the levies payable and remit that deduction to the Board.

5 All licensed producers shall be subject to the Canadian Hatching Egg Producers levy in the amount equivalent to that stated in the most current Canadian Broiler Hatching Egg Marketing Levies Order less the amount collected under section 2 of this Order.

6 The levy referred to in section 5 is payable to the Board by each licenced producer through a deduction from the producer’s settlement by the licensed hatchery at the time of marketing.

7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

1 The ability of licensed producers to return their quota to the Board for a period of time shall be referred to as a stand down.

2 A licensed producer may submit to the Board a written request for a stand down of all or a portion of held quota which the Board may approve based on the specifics of the request that must include the reason for the stand down and the length of time the stand down shall take place.

3 All stand down requests must be received by the Board office one-hundred fifty (150) days prior to the beginning of the start of the calendar year for which the stand down is to begin.

4 The Board shall consider situations such as Acts of God, death or any other unforeseen events as acceptable factors for a stand down and, in these cases, shall not require the 150 day notice period.

5 Any quota that a licensed producer stands down will be reallocated to all other licensed producers on a pro rata basis.

OVER-mARKETING PENALTIESOrder No. 60/15. The SASKATCHEWAN BROILER HATCHING EGG PRODUCERS Board, pursuant to

the provisions of The Broiler Hatching Egg Marketing Plan Regulations, 2015 and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 A production period lasts from January 1 through December 31 of the same calendar year.

2 If the total amount of all licensed producer’s marketings for a production period exceeds 101% of the province’s allocated quota for that period, any producer marketing in excess of 101% of his/her/their assigned production limit for that period shall be issued an over-marketing penalty.

3 To determine the degree to which a producer has fulfilled his/her/their issued production limits, and thus whether over-marketing has occurred, the following producer-specific data provided by the hatchery shall be evaluated:

(a) the number of broiler hatching eggs marketed by the producer to the hatchery; and

(b) the number of broiler hatching eggs that have been set in the hatchery incubator during the calendar year.

4 With respect to the determination outlined in section 3, broiler hatching eggs picked up at a producer’s premises by the hatchery in one production period and set in the hatchery incubator during the following production period shall be included in the producer’s marketings (clause 3(a)) for the period during which the eggs were picked up.

5 The amount of the over-marketing penalty per hatching egg shall be 17.5 cents per hatching egg.

6 If a producer’s routine flock replacement practices would result in an over-marketing in one production period and an under-marketing in the following production period, the producer may apply to the Board to redistribute the quota across the two periods to proactively address and prevent an over-production penalty; this results in quota being transferred from the under-production period into the over-production period.

7 If a producer chooses to apply under section 6, prior to the beginning of the production year to which the quota is to be transferred, the producer must submit to the Board an approved application form which shall include the name of the producer, the expected two production period egg flow amounts and an identification of the production periods involved.

8 Upon the issuance of an over-marketing penalty, the producer shall be provided an invoice for the penalty and 30 days to remit the payment to the Board.

9 Failure to pay any over-marketing penalties within 30 days of issuance will result in the Board requesting that the hatchery deduct the penalty payment from the producer’s marketing proceeds and remit the amount deducted to the Board.

10 Should two or more producers market broiler hatching eggs through a common business entity:

(a) the common business entity shall be designated by the Board as a single production unit;

(b) the calculation of an over-marketing penalty for the common business entity shall compare the total broiler hatching eggs marketed to the total production limit for all producers included in that single production unit; and

(c) the producers involved in the common business entity who are part of that production unit are jointly and severally liable for full payment of any over-marketing penalties issued by the Board.

11 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

1 A licensed producer (leasor) may lease out all or part of his/her quota to another licensed producer (leasee).

2 To lease out quota, a licensed producer must apply to the Board in writing on a form, provided by the Board, that is signed by both the leasor and leasee and that includes the following information:

(a) the production period, based on a calendar year, for which the lease will be in effect;

(b) the amount of quota to be leased in each production year of the lease;

(c) the proposed lessee’s name, address and a description of the production unit in which the production will occur; and

(d) any further information the Board may require.

3 Upon the Board’s approval of a lease application, the Board shall reissue the licenses of both the leasor and the leasee to reflect the lease conditions.

4 A licensed producer’s application to lease out quota must be received by the Board office no later than December 31of the proposed lease production year.

5 For a lease to be approved by the Board, the following conditions must be met:

(a) the licensed producers applying for the lease must both be in good standing with the Board, that is, the leasee must be compliant with all terms and conditions of the licence, the regulations and the board orders;

(b) approval of the lease must not result in a contravention of any provision of the regulations or any board order, including established quota limits;

(c) any hatchery impacted by the lease will be carbon copied on the notification of lease approval provided to the applicants; and

(d) the lease period may not be more than a production year.

6 Any lease granted by the Board may be subject to additional terms and/or conditions that the Board considers appropriate in the circumstances.

7 The leasor and leasee are jointly responsible for the marketing of hatching eggs in accordance with these regulations.

8 No subleasing of quota shall be permitted.

9 If the Board declines a lease request, within 10 business days of the decision, the Board shall, in writing, inform the applicants of the Board’s decision, including the rationale behind the decision, and shall accept a resubmission of a lease request if the Board’s concerns are addressed.

10 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

1 The Board may approve the transfer of all or a portion of a producer’s quota to another production unit or to a new licensed producer when:

(a) the transferor (seller) and the transferee (purchaser) have successfully completed and submitted all Board-required transfer forms which shall require the following information to be provided: the names of the transferor and transferee, their addresses, the amount of quota to be transferred and the production period for which the transfer shall be effective;

(b) the transferor and transferee are in compliance with all regulations and orders of the Board;

(i) any legal interest of any nature that the transferee may have in other quota, production units or processing companies; and

(ii) the licensed hatchery to whom the transferee intends to market the production resulting from the operationalization of the quota associated with the transfer request;

(d) the transferee has agreed to abide by all regulations and orders;

(e) the transfer will not result in production units larger than, or quota ownership greater than, the limits defined by the Board as stated in in the Quota Limits board order;

(f) the Board has determined the effective date of the transfer such that it corresponds with a particular production year; and

(g) in the event the transferor has over-marketed, all outstanding levies and judgements with respect to that over-marketing are to be paid by the transferor to the Board prior to the transfer taking place.

2 Following its decision, the board shall send a letter to both the transferor and transferee stating that the transfer has been approved or not approved for the specified quota amount and production period.

3 If the transfer is approved, the board shall issue to both parties new licenses that shall state the transferor and transferee’s new quota holdings for the specified production period; should the transferor have transferred all held quota, no new licence shall be issued.

4 If the transfer is not approved, within 10 business days of the decision, the Board shall, in writing, inform the applicants of the Board’s decision, including the rationale behind the decision, and shall accept a resubmission of a transfer request if the Board’s concerns are addressed.

5 Quota will not be transferred out of the Province of Saskatchewan.

6 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

1 Any party engaged in the hatching of more than 999 hatching eggs for marketing to a broiler producer in a calendar year shall register annually with the Board using an application form provided by the Board.

3 By December 31 of each year, each license holder must submit a licence renewal application to the Board office; this application shall require the same information be submitted as the initial licence application.

4 For late licence renewal applications, a financial penalty of $100 per month will be invoiced to the hatchery upon the receipt of the application by the Board office.

5 A condition of licensing is that the Board may have an inspector and/or auditor inspect the production records of licensed hatcheries.

6 Each licensed hatchery shall be required to report to the Board:

(a) the number of broiler hatching eggs picked up, the date of pick up, the number of eggs set in the hatchery incubator, the date the eggs were set, the hatch date and the number of saleable chicks on a weekly basis;

(b) the number of broiler breeder chicks placed, the date of placement and the type of broiler breeder for each licensed producer; and

(c) any information the Board deems necessary to administer the Plan.

the provisions of The Broiler Hatching Egg Marketing Plan Regulations, 2015 and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 The Board may suspend or cancel a hatchery’s licence, after consultation with that hatchery, if the hatchery is not compliant with The Agri-Food Act, 2004, The Broiler Hatching Egg Marketing Plan Regulations, 2015 and the Board’s corresponding orders.

2 Notice will be given to a hatchery regarding the suspension or cancellation of the hatchery’s licence and will include the rationale for suspension or cancellation and the effective date of the suspension or cancellation.

3 A hatchery will be given a minimum of 15 business days to respond to a suspension or cancellation decision.

4 The Board may reinstate or uphold its decision to suspend or cancel a hatchery licence based on the response from the hatchery.

5 If a hatchery licence has been suspended or cancelled, licensed producers cannot market broiler hatching eggs to that hatchery.

6 A hatchery may re-apply for a licence if the issues associated with the suspension or cancellation have been addressed to the satisfaction of the Board.

7 Any decision of the Board regarding the suspension, cancellation or reinstatement of a licence must be provided in writing to the affected hatchery, including:

(a) the rationale, including specific factors considered in making the decision;

(b) the effective date of the suspension or cancellation;

(c) in the case of a suspension or cancellation, any processes that must be undertaken for reinstatement to be considered; and

(d) in the case of a suspension, the duration of the suspension.

8 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

CANADIAN HATCHING EGG QUALITY PROGRAmOrder No. 65/15. The SASKATCHEWAN BROILER HATCHING EGG PRODUCERS Board, pursuant to

the provisions of The Broiler Hatching Egg Marketing Plan Regulations, 2015 and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 All production units must be Board-certified under the Canadian Hatching Egg Quality (CHEQ) program and must be annually recertified by complying with the provisions of annual audits.

2 Any new licensed producer whose production unit(s) is (are) not CHEQ-certified must be engaged in the process of initial CHEQ certification by:

(a) submitting to the Board all required information; and

(b) agreeing to have the corresponding production unit(s) audited.

3 In the event that a licenced producer’s production unit is not CHEQ-certified or a new licensed producer’s production unit is not engaged in the process of initial CHEQ certification, the Board shall have the discretion to impose one or more of the following sanctions with respect to the infringing licenced producer:

(a) provide additional time to comply with certification, recertification or initial certification under certain terms and conditions;

(b) impose monetary penalties on all hatching eggs marketed while the production unit is not certified or is non-compliant in an amount up to $1 per hatching egg;

(c) reduce the producer’s production limit as deemed appropriate by the Board;

(d) suspend, cancel or refuse to renew the producer’s licence; or

GENERAL QUOTA AUCTION ORDEROrder No. 66/15. The SASKATCHEWAN BROILER HATCHING EGG PRODUCERS Board, pursuant to

the provisions of The Broiler Hatching Egg Marketing Plan Regulations, 2015 and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 An auction shall be held when the province is allotted an increase in quota such that the total provincial quota allocation exceeds any previous maximum allocation.

2 In the event that an auction is to be held, the Board shall advertise the time, date and location of the auction at least 30 days before the auction is to take place.

3 As determined by the Board, the quota will be set out in one or more blocks of hatching eggs, dependent on the overall amount of quota to be auctioned.

4 The highest bidder for each block of hatching eggs will be the successful bidder for that block of quota; however, the Board reserves the right to refuse the highest bid if that purchaser has exceeded their quota limit maximum as stated in the Quota Limits board order.

5 In the event of an auction for the quota resulting from the cancellation of a license, the licenced producer shall receive the auction’s net proceeds, i.e. the total auction value of the cancelled quota less all Board expenses related to the conduct of the auction, including advertising.

6 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

The Workers’ Compensation Act, 2013 [subsection 134(4)]

Saskatchewan’s system of workers’ compensation was founded in 1930 by a coalition of business and labour. Workers gave up the right to sue their employers for workplace injuries and losses resulting from those injuries. Employers agreed to pay the cost of the compensation system. This working partnership provides for fairness, protection, and economic stability when workplace injury or illness occurs.

The WCB and its Board members act as trustees of this agreement between employers and workers. The agreement is based on five principles: no-fault compensation; security of benefits; collective employer liability; independence of the Board; and exclusive jurisdiction. These principles are the basis of a compensation system regarded as one of the most successful in North America.

Covering the Cost of the Compensation System

The WCB has two sources of revenue: employer assessments based on payroll, and return on its investments.

Employer assessments, or premium rates, are set annually for each of 50 industry rate codes. Premium rates vary depending upon the number of injuries and costs incurred by the employers within each rate code.

The premium rate setting process is based on the premise that today’s employers are responsible for the cost of today’s injuries. The WCB holds discussions with employers and associations regarding premium rates each year. This year, two public sessions were held with employers and associations representing the majority of employers.

Notification of Rates

The WCB notifies each Saskatchewan employer by letter of the 2016 rates.

As required under subsection 134(4) of The Workers’ Compensation Act, 2013, the WCB publishes the provisional premium rates for any industry rate code that exceeds the 2015 premium rate by more than 10.5%.

One rate code will see a premium rate increase for 2016 greater than 10.5%:

COURT OF QUEEN’S BENCH FOR SASKATCHEWAN – AmENDmENTS TO THE QUEEN’S BENCH RULES

The Queen’s Bench Rules for Saskatchewan are hereby amended, effective the 1st day of January, 2015, in the manner set out below:

1(1) Rule 2-40 is amended in the manner set forth in this section.

(2) Subrule (1) is amended by repealing clause (b) and substituting the following:

“(b) filing proof of service in accordance with Part 12”.

(3) Subrule (2) is amended by repealing clause (b) and substituting the following:

“(b) file proof of service in accordance with Part 12”.

2 Rule 2-41 is amended by adding the following subrule after subrule (6):

“(7) The lawyer withdrawing as lawyer of record shall provide the local registrar with any other address, phone number, cell phone number and email address the lawyer may have concerning the party stated in the notice of withdrawal unless that disclosure is, in the opinion of the lawyer, contrary to:

(a) the safety or well-being of the party; or

(b) the interests of justice”.

3 Rule 3-18 is amended by adding the following subrule after subrule (5):

“(6) This rule does not apply to:

(a) noting a defendant in default pursuant to rule 3-21; or

(b) taking out a default judgment for a debt or liquidated demand pursuant to rule 3-22”.

4 Subrule 4-4(2) is amended by striking out the portion preceding clause (a) and substituting the following:

“A request for a conference pursuant to this rule must be in Form 4-4, and the party making the request shall:”.

5 Rule 4-15 is amended by adding tbe following subrule after subrule (2):

“(2.1) Unless the Court orders otherwise, in any action where the consent of an insurer may be required to settle the action, the insurer’s claim representative shall be present at all pre-trial conferences”.

6 The Information Note that follows rule 5-6 is amended:

(a) by striking out “No. 6” and substituting “CIV-PD No.1”; and

(b) by striking out “http://www.qp.gov.sk.ca/documents/English/Rules/practice.pdf” and substituting “<http://www. publications.gov.sk.ca/details.cfm?p=69850>”.

7 Rule 5-23 is amended by adding the following subrule after subrule (1):

“(1.1) The appointment for questioning must:

(a) be in Form 5-23; and

(b) fix the time and place for the questioning”.

8 Subrule 5-29(1) is amended by repealing clause (b) and substituting the following:

“(b) the questioning must be taken down by question and answer either in shorthand or recorded in a recording device in the presence of a court transcriber appointed pursuant to The Court Officials Act, 2012”.

9 Rule 6-85 is amended by adding the following subrule after subrule (13):

“(14) This rule applies to third person claims and interpleader proceedings by a sheriff arising under The Enforcement of Money Judgments Act to the extent that this rule is not in conflict with the provisions of that Act or its regulations”.

10 Subrule 7-5(6) is repealed and the following substituted:

“(6) If the Court is satisfied there are one or more genuine issues requiring a trial, the Court may nevertheless grant summary judgment with respect to any matters or issues the Court decides can and should be decided without further evidence”.

11 Subrule 10-3(3) is repealed and the following substituted:

“(3) The original order must be retained by the Court”.

12(1) Rule 10-7 is amended in the manner set forth in this section.

(2) Subrule (3) is amended:

(a) by repealing clause (a) and substituting the following:

“(a) be prepared in accordance with the fiat recorded by the judge or by the chamber clerk under the direction of the judge”; and

(b) by repealing clause (c) and substituting the following:

“(c) be signed and dated by a local registrar and sealed with the seal of the Court”.

(3) Subrule (4) is amended by adding “, dated” after “signed”.

13(1) Rule 10-9 is amended in the manner set forth in this section.

(2) Subrule (3) is amended by striking out “A judgment” and substituting “Subject to subrules (4) and (5), a judgment”.

(3) The following subrules are added after subrule (3):

“(4) Subject to subrule (5), if an Act provides that an order or decision of another court or authority may be filed with the Court to be enforced as an order of the Court, then, unless the Act provides for an alternate procedure, the original or certified copy of the order or decision may be entered as a judgment of the Court when:

(a) an address for service of the applicant is provided; and

(b) the order or decision is endorsed with a court file number and stamped as filed by the local registrar.

“(5) If only a portion of an order or decision issued by another court or authority may be filed with the Court as a decision of the Court, then a judgment for that portion of the order or decision may be entered in Form 10-9F”.

14 Subrule 10-40(1) is repealed and the following substituted:

“(1) Except as otherwise provided in this Division, the claim in all actions commenced pursuant to this Division must:

(a) be in Form 10-40A; and

(b) include the notice to defendant in Form 3-9 on the first page”.

15(1) Rule 13-24 is amended in the manner set forth in this section.

(2) Subrule (1) is amended by striking out “stamped” and substituting “sealed”.

(3) Subrule (2) is repealed and the following substituted:

“(2) A counter claim or third party claim is issued when it has been served and filed”.

(4) The following subrule is added after subrule (2):

“(3) The original commencement document must be filed with the local registrar”.

16 Subrule 16-10 is repealed and the following substituted:

“Proof of death

16-10(1) Proof of death of the deceased must be filed with an application for grant.

(2) If an application states that an executor or other person entitled to a grant is deceased, proof of death of that person must be filed with the application for grant.

(3) For the purposes of this rule, proof of death includes a statement of death or certificate of death issued by:

(a) a funeral director;

(b) a coroner; or

(c) the Registrar of Vital Statistics.

(4) If the applicant is unable to file direct evidence of death and there is evidence from which death may be presumed, the Court may give leave to swear to or affirm the death, on application without notice or on any notice that the Court may require”.

17 The following Information Note is added after rule 16-14:

“Information Note

There is a rebuttable presumption that property held by a deceased with an adult child in joint names with right of survivorship is held in a resulting trust for the benefit of the beneficiaries of the deceased’s estate. (See Pecore v Pecore, 2007 SCC 17, [2007] 1 SCR 795.)

”.

2 La règle 2-41 est modifiée par insertion du paragraphe suivant après le paragraphe (6) :

« (7) L’avocat qui se retire de sa charge d’avocat commis au dossier fournit au registraire local toute autre adresse, tout autre numero de telephone, tout autre numero de cellulaire et toute autre adresse de couniel dont il dispose relativement a la partie indiquee dans l’avis de retrait, a moins que, a son avis, cette divulgation soit contraire :

a) soit à la sécurité ou au bien-être de la partie;

b) soit à l’intérét de la justice ».

3 La règle 3-18 est modifiee par insertion du paragraphe suivant apres le paragraphe (5) :

« (6) La présente règle ne s’applique pas aux cas suivants :

a) la constatation du défaut du défendeur régie par la règle 3-21;

b) l’obtention d’un jugement par défaut en matière de recouvrement de créance ou de somme détetminée en vertu de la règle 3-22 ».

4 La règle 4-4(2) est modifiée par suppression du passage précédant l’alinéa a) et son remplacement par ce qui suit :

« Une demande de conférence présentée en vertu de la presente règle est établie a l’aide la formule 4-4, et la partie qui la présente doit : ».

5 La règle 4-15 est modifiée par insertion un paragraphe suivant apres le paragraphe (2) :

« (2.1) Sauf ordonnance contraire de la Cour, chaque fois qu’un règlement amiable de l’action peut exiger le consentement d’un assureur, l’enquêteur-régleur de l’assureur doit assister à toutes les conférences preparatoires ».

6 Le complément d’information qui suit la règle 5-6 est modifié :

a) par abrogation de « n° 6 » et son remplacement par « CIV-PD No. 1 »;

b) par abrogation de « http://www.qp.gov.sk.ca/docurnents/English/Rules/practice.pdf » et son remplacement par « <http://www.publications.gov.sk.ca/details.cfm?p=69850> ».

7 La règle 5-23 est modifiee par insertion du paragraphe suivant apres le paragraphe (1) :

« (1.1) L’avis de séance:

a) est établi à l’aide de la formule 5-23;

b) fixe les date, heure et lieu de l’interrogatoire ».

8 La règle 5-29(1) est modifiée par abrogation de l’alinéa b) et son remplacement par ce qui suit :

« b) les questions et réponses de l’interrogatoire sont soit prises en sténographie, soit enregistrées dans un appareil d’enregistrement en presence d’un transcripteur judiciaire nommé sous le régime de la Loi de 2012 sur les fonctionnaires de justice ».

9 La règle 6-85 est modifiée par insertion du paragraphe suivant après le paragraphe (13) :

« (14) La présente règle s’applique aux mises en cause et aux procédures d’entreplaiderie d’un shérif régies par la loi intitulée The Enforcement of Money Judgments Act dans la mesure où la règle n’est pas en conflit avec les dispositions de cette loi ou de ses règlements ».

10 La règle 7-5(6) est abrogée et remplacée par ce qui suit :

« (6) même si elle constate qu’il existe une ou plusieurs véritables questions en litige nécessitant un procès, la Cour peut rendre un jugement sommaire relativement à un point ou à une question en litige si elle estime qu’il peut et doit être tranché sans autre preuve ».

11 La règle 10-3(3) est abrogée et remplacée par ce qui suit :

« (3) L’ordonnance initiale est conservee par la Cour ».

12(1) La règle 10-7 est modifiée de la manière enoncee au présent article.

(2) Le paragraphe (3) est modifie :

a) par abrogation de l’alinéa a) et son remplacement par ce qui suit :

« a) rédigées suivant le fiat consigné par le juge ou le greffier en cabinet sous la direction du juge »;

b) par abrogation de l’alinéa c) et son remplacement par ce qui suit :

« c) signées et datées par un registraire local et revêtues du sceau de la Cour ».

(3) Le paragraphe (4) est modifié par insertion de « , de la date » après « signature ».

13(1) La règle 10-9 est modifiée de la manière énoncée au present article.

(2) Le paragraphe (3) est modifié par suppression de « Le jugement » et son remplacement par « Sous réserve des paragraphes (4) et (5), le jugement ».

(3) Les paragraphes suivants sont inseres apres le paragraphe (3):

« (4) Sous réserve du paragraphe (5), lorsqu’une loi permet qu’une ordonnance ou une décision d’un autre tribunal judiciaire ou d’une autre autorité soit déposée auprès de la Cour afin que les moyens d’exécution forcée rattachés aux ordonnances de la Cour s’y appliquent, l’ordonnance ou la décision peut, à moins que la loi ne prévoie une autre procédure, être inscrite, dans sa version originale ou sons forme de copie certifiée conforme, comme jugement de la Cour, si les conditions suivantes sont remplies :

a) une adresse aux fins de signification est fournie;

b) l’ordonnance ou la décision porte un numéro de dossier et une estampille confirmant son dépôt par le registraire local.

« (5) Lorsqu’une ordonnance ou une décision rendue par un autre tribunal judiciaire ou une autre autorité ne peut être déposée dans son intégralité auprès de la Cour dans le but d’être assimilée à une décision de la Cour, un jugement correspondant à la partie admissible de l’ordonnance ou de la décision pent être inscrit à l’aide de la formule 10-9F ».

14 La règle 10-40(1) est abrogée et remplacée par ce qui suit :

« (1) Sauf dispositions contraires de la présente section, dans toute action introduite sous le régime de la présente section, la demande :

a) est établie à l’aide de la formule 10-40A;

b) comporte sur la première page l’avis au défendeur établi à l’aide de la formule 3-9 ».

15(1) La règle 13-24 est modifiée de la manière énoncée au présent article.

(2) Le paragraphe (1) est modifié par suppression de « estampillé » et son remplacement par « scellé ».

(3) Le paragraphe (2) est abrogé et remplacé par ce qui suit :

« (2) Pour la demande reconventionnelle ou la mise en cause, l’émission s’opère sur signification et dépôt du documente ».

(4) Le paragraphe suivant est inséré après le paragraphe (2) :

« (3) Le document introductif original est déposé auprès du registraire local ».

16 La règle 16-10 est abrogée et remplacée par ce qui suit :

« Preuve du décès

16-10(1) Une preuve du décès du défunt doit être déposée avec la requête en obtention de lettres successorales.

(2) Lorsque la requête mentionne qu’un exécuteur testamentaire ou une autre personne ayant droit à des lettres successorales est décédé, une preuve du décès de cette personne doit être déposée avec la requête en obtention de lettres successorales.

(3) Pour l’application de la présente règle, la preuve du décès s’entend notamment d’une déclaration de décès ou d’un certificat de décès délivré par l’une des personnes suivantes :

a) un entrepreneur de pompes funèbres;

b) un coroner;

c) le registraire des services de l’état civil.

(4) Si le requerant est incapable de produire une preuve directe du décès, mais qu’il existe des éléments de preuve permettant d’inférer qu’il y a eu décès, la Cour peut autoriser la preuve du décès par serment ou affirmation solennelle, sur requête sans préavis ou moyennant le préavis qu’elle prescrit ».

17 Le complement d’information suivant est insere apres la règle 16-14 :

Complement d’information

Il existe une présomption refragable voulant qu’un bien appartenant en propriété conjointe, avec droit de survie, à un défunt et à un de ses enfants majeurs soit détenu en fiducie résultoire au profit des bénéficiaires de la succession du défunt. (Voir Pecore c Pecore, 2007 CSC 17, (2007] 1 RCS 795.)
