STAFF REPORT CHARLESTON A former West Virginia licensed real es- tate appraiser was sentenced Tuesday to one year and six months in federal prison for his role in a multi-million dollar mortgage fraud scheme involv- ing an upscale Putnam County subdivision. Mark E. Greenlee, 50, of Charleston, previously pleaded guilty to charges of aiding and abetting wire fraud in Septem- ber 2011. Greenlee admitted that he prepared a false and fraudulent appraisal in 2006 in furtherance of a multi-million dollar mort- gage fraud scheme perpetrated by Deborah L. Joyce and others, in the Stonegate subdivision in Hurricane. Greenlee is the second real estate appraiser prosecuted as part of the Stonegate mortgage fraud investigation. The court handed down the 18-month prison sentence re- sulting in part from the defen- dant’s delayed cooperation in the investigation. WINFIELD – A groundbreak-ing ceremony to start construc-tion of a new Putnam CountyAnimal Shelter has been set forTuesday, Aug. 28, at 1 p.m.

The public is invited to attend.Earlier this month, the Put-

nam County Commissionpassed an ordinance to financeconstruction of the new animalshelter.

HIV/AIDS Education inPutnam County Schools

Included in the health educa-tion classes in grades seven,eight and nine, an HIV/AIDS ed-ucation program will be con-ducted by the health teachers.Content of this program will in-clude instruction on the preven-tion, transmission, and spread ofHIV/AIDS and other sexuallytransmitted disease. The healtheducation program includes thestate required health contentstandards and objectives.

Course curriculum require-ments and materials relating toinstruction are available forpublic inspection during busi-ness hours at each middle andhigh school. Sweep ScreeningPutnam County Schools con-

ducts its annual screening pro-gram in the areas of hearing,vision, speech, and language.

Speech-language patholo-gists will screen preschool andkindergarten students not pre-viously screened, students newto West Virginia, students whohave no pervious documenta-tion of screening, and thosestudents previously identifiedas high-risk in grades 1-5.

A RESTA III audiologist andthe school health nurses willconduct hearing and visionscreenings on students new toWest Virginia, preschoolers,and kindergarteners not previ-ously screened. The federal investigationcontinued and agents gatheredsufficient information to ap-proach former real estate ap-praiser, James Thornton, 48, inOctober 2009.

When confronted, Thorntoncooperated immediately whichbroke the investigation openagainst co-defendants Joyce,Greenlee and others.

It was not until an ongoinginvestigation conducted by fed-eral agents that Greenlee en-tered into a plea agreement inJune 2011.

As a result of his unwilling-ness to cooperate initially withfederal authorities, Greenleedid not receive any relief forsubstantial assistance at sen-tencing.

Greenlee admitted that in Au-gust 2006, he prepared a resi-dential real estate appraisal fora property known as 62 Stoner-idge valuing the property at$645,000, essentially twice thethen-current market value.

The defendant further admit-ted to purposefully concealingmaterial information aboutsome of the comparables heused to justify the inflated ap-praisal price.

To further the scheme, Green-

lee admitted that he sent a copyof his appraisal, via email,across state lines to a mortgagebroker in Utah, who ultimatelyprovided the appraisal to alender who funded a loan.

In addition, Greenlee admit-ted that he subsequently al-tered his appraisal of the 62Stoneridge property in light ofan investigation conducted bythe West Virginia Real EstateAppraiser and Licensing Certifi-cation Board of the appraisalshe prepared for Joyce and oth-ers in the Stonegate subdivi-sion.

In June, Thornton admittedthat he also aided and abettedthe wire fraud scheme perpe-trated by Ms. Joyce and othersby falsifying the appraisal pricefor a property known as 45Spruce Ridge.

Specifically, Thornton admit-ted that, contrary to industrystandards, he included a below-grade basement as “Gross Liv-ing Area” thereby allowing himto use comparables that weretwice the square footage.

He also admitted that he senta copy of the false and fraudu-lent appraisal, via email, acrossstate lines to the Utah mortgagebroker.

Deborah L. Joyce was sen-tenced in April 2011 to threeyears and 10 months in prisonand five years of supervised re-lease for her involvement in theStonegate subdivision mort-gage fraud scheme.

Joyce’s husband, Todd Joyce,38, of Hurricane, was also sen-tenced in April 2011 to one yearand six months in prison onmortgage fraud and tax evasioncharges.

James R. Thornton, 48, ofWilmington, N.C., was sen-tenced earlier this month to fiveyears’ probation for his involve-ment in the scheme.

Thornton received a reducedsentence as a result of his earlycooperation in the federal in-vestigation.

Michael S. Hurd, 37, of SaltLake City, Utah, was also sen-tenced earlier this month to twoyears and three months in fed-eral prison for conspiracy tocommit wire fraud and bankfraud in connection to his rolein the mortgage fraud scheme.

Raymond Paul Morris, 51, ofSouth Weber, Utah, previouslypleaded guilty in July to wirefraud and bank fraud for his in-volvement in the mortgagefraud scheme linked to the Put-

nam County subdivision prop-erties.

Morris faces up to 30 years inprison and a $1 million finewhen he is sentenced on Oct.29, 2012 by United States Dis-trict Judge Thomas E. Johnston.

The investigation was han-dled by the Federal Bureau ofInvestigation and the InternalRevenue Service, Criminal In-vestigative Division AssistantUnited States Attorney ThomasC. Ryan handled the prosecu-tion.

County woman was sentencedTuesday to three years and onemonth in federal prison for taxevasion.

Georgiana Ciavarello, 40, ofPutnam County, previouslypleaded guilty in May.

Ciavarello, a former book-keeper for Charleston-basedQuail Ridge Construction Com-pany (QRC), admitted that she

embezzled $759,124.67 from thecompany between September2007 and November 2010.

At the time of the embezzle-ment, the defendant was re-sponsible for drafting checksand making QRC bank accountdeposits and transfers and wasauthorized to use the company’scredit cards to make purchases.

Ciavarello admitted that dur-ing the embezzlement scheme,she unlawfully negotiated em-

ployee per diem checks for cash.In addition to the embezzle-

ment scheme, Ciavarello admit-ted that she failed to payincome tax of $216,855.52 forthe years 2007, 2008, 2009, and2010.

After representatives of QRCaddressed the Court, the judgeimposed a sentence greaterthan the sentence called for bythe Federal Sentencing Guide-lines.

The judge rejectedCiavarello’s explanations of whyshe stole the money and foundthat Ciavarello’s actions in car-rying out the embezzlementscheme betrayed the trust of heremployers and co-workers.

The Court also ordered thatCiavarello pay restitution of$1,025,428.10, the total of theembezzled money, the unpaidtax, and $49,448 of Social Secu-rity benefits she improperly re-

ceived.The investigation was con-

ducted by the Internal RevenueService, the Social Security Ad-ministration’s Office of Inspec-tor General, and the CharlestonPolice Department.

Assistant United States Attor-ney Hunter P. Smith Jr. handledthe prosecution.

The sentence was imposed byUnited States District JudgeRobert C. Chambers.

Attorney General Darrell McGrawis warning state consumers to beon the lookout for another tele-phone scam attempting to trickindividuals into believing theyhave failed to show up for juryduty.

The scheme is slowly makingits way around the state.

Victims report that an auto-

mated message claims there is awarrant for their arrest, andthreatens imprisonment for afailed jury duty appearance.

The fraudulent phone callsclaim to originate from a federalor state court, and represent thatconsumers may avoid jail time ifthey pay a fine with their creditcards over the phone.

McGraw advises consumers tocheck caller ID on incoming calls

and to avoid giving out personalinformation including policynumbers, dates of birth, socialsecurity numbers, credit cardnumbers or bank account infor-mation over the telephone or onthe Internet especially whenspeaking with strangers.

”Do not be threatened bysomeone who is demanding yourpersonal information,” McGrawsaid. “Never offer information.

Always verify the identity of theperson on the other end of thetelephone. Remember that scam-mers will typically just hang up ifconfronted or threatened with acall to the police or attorney gen-eral.”

Issues or changes regardingjury duty are always handled bymailed letters.

Federal and state courts do notnotify the public of jury duty by

telephone.If you believe you may have

CHARLESTON -- A ScottDepot woman is suing SaharaTanning Salon after she claimsshe discovered men watchingher after she got out of a tanningbed.

Ghassan Assi and IbrahimFawaz, the former and currentdirectors of the tanning salon,also were named as defendantsin the suit.

On April 13, Samantha Simmsvisited the tanning salon for atanning session, according to acomplaint filed July 31 inKanawha Circuit Court.

Simms claims she disrobedcompletely, applied tanning lo-tion and then got into the tan-ning bed for about 12 minutes.

When the session was over,Simms opened and climbed outof the tanning bed, still nude,and began to dry herself off witha towel due to perspirationcaused by the heat of the tanningbed, according to the suit.

Simms claims while dryingherself off, she stood in front of amirror on the wall opposite ofthe tanning bed and she noticedwhat appeared to be a light re-flecting in the upper corner ofthe mirror, so she turned aroundto see a ceiling tile out of place,

revealing a few men working inthe ceiling above her tanningroom.

Upon information and belief,the men watched Simms dis-robe, apply tanning lotion whilenude, enter and exit the tanningbed and dry herself off beforeputting her clothes back on, ac-cording to the suit.

Simms claims she quicklydressed upon realizing she wasbeing watched, exited the tan-ning room and went to the frontdesk, where she informed theworker at the front desk aboutthe men working above her roomand asked to speak with themanager.

The salon employee informedSimms that no manager nor anyperson with authority was avail-able, according to the suit.

Simms claims while near thefront desk, she saw a ladder anda missing ceiling tile, indicatingthe known presence of work-men, and while speaking withthe employee, she saw the work-men leave the building.

Because of the incident,Simms became and has re-mained extremely upset at thethought of being seen naked bystrangers in a place where shehad come to expect requisite pri-vacy associated with the natureof tanning, according to the suit.

Simms claims the defendants'failure to protect the privacy oftheir customers from prying eyesof workman was extreme andoutrageous.

The defendants' actions werean invasion of privacy and wereintentional and reckless, accord-ing to the suit.

Simms is seeking compensa-tory and punitive damages. Sheis being represented by Lia Di-Trapano Fairless and ElizabethG. Kavitz.

The case has been assigned toCircuit Judge James C. Stucky.

West Virginia’s statewide squir-rel season opens on September8, 2012, and runs through Janu-ary 31, 2013, according to Curtisl. Taylor, Chief of the Wildlife Re-sources Section of the West Vir-ginia Division of NaturalResources (DNR).

This is the second year in arow that the season opens inearly September, providinghunters with more time to pur-

sue the state’s most popularsmall game species.

“Mild weather conditions inSeptember and longer days offera great opportunity to take ayoungster hunting,” said Taylor.

Poor hard mast crops in 2011reduced squirrel production thisyear, so hunters will find fewerduring the fall hunting season.Mast conditions during the pre-vious year influence the survivaland productivity of current yearsquirrel populations.

“Despite last year’s poor mastconditions, squirrel huntersshould not get discouraged be-cause the state’s squirrel popu-lation remains strong,” saidTaylor.

Early season squirrel huntersshould find success with properscouting and by focusing theirattention on mast-producingspecies such as hickory.

The daily bag limit for squirrelis six, with a possession limit of24.

In other hunting news, WestVirginia’s 2012–2013 waterfowlseasons begin statewide on Sep-tember 1, 2012, with the open-ing of the early Canada gooseseason.

Shooting hours are one-halfhour before sunrise until sunset.All other general waterfowlhunting regulations apply to theSeptember season.

Hunters must possess a fed-eral waterfowl stamp and a freeMigratory Bird Harvest Informa-tion Program (HIP) registrationcard in addition to their regularhunting license.

The HIP card is available freefrom DNR offices and all hunt-ing license agents.

HUNTINGTON – Five newscholarships have been createdfor medical students at the Mar-shall University Joan C. EdwardsSchool of Medicine, courtesy ofseveral different benefactors.One of the scholarships is gearedtoward medical students whoplan on careers in specific areasof medicine.

All five scholarships will bene-fit students who have demon-strated financial need.

Two of the new scholarshipsare being created by the facultyand staff of the Department ofOrthopaedics, under the direc-tion of Dr. Ali Oliashirazi, chair-man of the department.

The Department of Or-

thopaedics Third Year MedicalStudent Scholarship will beawarded to a third-year studentwho has an interest in or-thopaedic medicine, excels aca-demically and has ademonstrated financial need.The Department of OrthopaedicsFourth Year Medical StudentScholarship will be awarded to afourth-year student who hasmaintained a 4.0 GPA duringmedical school and also has a fi-nancial need.

A third scholarship has beenendowed by Dr. Monica A. Valen-tovic, professor of Pharmacology,in honor of her parents. The Ed-ward and Anne Valentovic Me-morial Scholarship is named in

memory of Valentovic’s parents,who lived and worked most oftheir lives in Cleveland, Ohio. Thescholarship will be awarded to athird- or fourth-year medical stu-dent who has been involved withresearch either at the undergrad-uate level or while in medicalschool. Preference will be givento a student who has done or iscurrently involved in researchwith a full-time faculty memberin the Department of Pharmacol-ogy, Physiology and Toxicology.

“It is thrilling to work with in-dividuals who are committed tohelping our students in whateverways are needed,” said LindaHolmes, director of Developmentand Alumni Affairs. “Dr.

Oliashirazi and Dr.Valentovic areboth incredible, dynamic profes-sors and for them to take thisextra step to help students finan-cially speaks volumes about theirsincere desire to see our studentsand our School of Medicine suc-ceed.”

Holmes said two other scholar-ships have been establishedthrough the generous support ofa JCESOM alumnus and thegrateful family of a recent gradu-ate. They are the Janssen Scholar-ship for the School of Medicine,created by Dr. Eric W. Janssen,Class of 1986, and the Sekar Fam-ily Scholarship, created by Dr.Chandra S. Sekar.

The Janssen Scholarship was

created in memory of EricJanssen’s parents, Mr. Fred L. andMrs. Louis J. Janssen. The recipi-ent of the award will be a first-year medical student who has afinancial need. The award is re-newable for all four years pend-ing satisfactory academicprogress.

The Sekar Family Scholarshipwas created in honor of Dr. Chan-dra S. Sekar’s son, Dr. Krish D.Sekar, Class of 2012, in memoryof his late wife, Hema Sekar, andto show appreciation to theSchool of Medicine for his son’smedical education. The awardwill be given to a first-year stu-dent and is renewable based onnormal academic progress.

After 34 years of service, he re-tired from Union Carbide, Insti-tute Plant.

He was a member of MiltonBaptist Church. He served 5 yearsin the National Guard and washonorably discharged.

Gary also served six terms onthe Milton City Council. He lovedthe city. He enjoyed the water andcity employees.

He was an honest, humble manwith an impeccable work ethic.He will be sadly missed by all whoknew and loved him.

Donald was a West Virginiastate trooper and also worked forthe West Virginia Parkways Au-thority. Ruth worked for West Vir-ginia Division of Highways andWorkers Compensation. He was aUnited States Marine veteran,having served in the Korean War.He was also a member of theAmerican Legion, the VFW, theWest Virginia State Police RetiredMembers and Troopers Associa-tions, and the Masonic Lodge. Shewas a member of the Order ofEastern Star.

She was a Gunnery Spe-cialist Second Class in the WAVESin the U.S. Navy duringWorldWarII, where she met and marriedMack. Ruth taught in high schoolsin Birmingham, Ala., during theearly years of her marriage, andwhen they moved back to WestVirginia she began teaching atHurricane High School in 1954,continuing there until her retire-ment in 1980. While at HHS shewas head of the English Depart-ment and Putnam CountyTeacher of the Year in 1976.

Upon her retirement she be-came an avid quilter and was afounding member of the QuiltLover's Guild of Putnam County.At the time of Mack's retirementthey made an art of their retire-

ment years, enjoying them to thefullest. Ruth was an Episcopalianbut fellowshipped with First Bap-tist Church of Hurricane withHurricane family members.

In addition to her husband andparents, Ruth was preceded indeath by her sister, Mrs. James J.(Jo Clare) Robinson.

Born April 12, 1949, in SouthCharleston, he was a son of thelate John W. III and Margaret Lu-cille Hill Yates.

Butch was a former heavyequipment operator and was re-tired from Wackenhut Securi-ties. He was a member ofSouthwest Church of God andwas a graduate of Winfield HighSchool.

Surviving are his wife, Linda;his stepchildren, Christina L.(Mark) McGrew of Hurricaneand Jack J. Carr of Scott Depot;his sisters, Kathleen A, Shirkeyof South Charleston and TerriDawn Moles of Scott Depot; hisbrother, Edward L. Yates of Poca;one step-grandson; two step-great-grandsons; and severalnieces and nephews.

In addition to her parents, shewas preceded in death by herloving husband, Frank E. Za-miela, who passed in November2009; and a brother, LouisReinacher.

She is survived by two sonsand daughters-in-law, Keith Za-miela and Jill of Stuart andKevin Zamiela and Ellen ofDunbar; and three grandchil-dren, Christian, Tallee andChloe, all of Stuart. Also surviv-ing are a sister-in-law, GayeReinacher of Charleston; twonieces, Laura Hunt ofCharleston and Cindy Bailey ofWinfield; and many friends.

Work on the expansion is ex-pected to be completed byMarch 2013.

County Commissioner JoeHaynes said that the expansionannouncement, coupled withother recent groundbreakings inthe county, show that it is an ex-citing time to live and do busi-ness in Putnam County.

“There are few things that givea county commissioner morepleasure than breaking ground,”Haynes said. “And I will get to doit three times this month,” headded referring to the recentgroundbreaking for the expan-sion of Valley Park, and nextweek's groundbreaking cere-mony for a new Putnam CountyAnimal Shelter.

U.S. Sen. Jay Rockefeller, whohas been active in recruitingJapanese businesses to West Vir-ginia, did not attend the expan-sion announcement, but issueda statement praising NipponThermostat's decision.

"I am so honored by my asso-ciation with Nippon Thermostatover the years, and I am ab-solutely thrilled they are expand-ing their operations in PutnamCounty," said Rockefeller. "Whenwe convinced Nippon Thermo-stat to come to West Virginia, wepromised them a dedicated work

force, a great business climateand a gracious community.We've clearly delivered. This is agreat day for Putnam County,and our entire state."

Nippon Thermostat of Amer-ica supplies engine thermostatsfor automotive manufacturersincluding Honda and Toyota.

The parent company NipponThermostat Company holds thelargest share of Japan's thermo-stat market. TheWestVirginia fa-cility marked the company's firstplant in the United States. Cur-rently, Nippon Thermostat oper-ates a 26,000-square-footmanufacturing facility and a

5,000-square-foot office man-agement facility in the PutnamCounty Business Park. The new$4 million investment will add 30jobs and 26,000 square feet to theplant.

"The expansion of our facilityis the result of the successfulgrowth of our business here,"

said Nippon Thermostat GeneralManager Akira Mori. "We wouldlike to thank state and local offi-cials in West Virginia for theirmany years of support and assis-tance. We look forward to thecontinued success of our rela-tionship for many more years tocome."
