History of the Indian Lands

Registry System

Established in December 1967

Modelled after existing provincial registry offices

Transactions – noted in books, ledgers and cards. Files held by various units

After 1967- given a registration number and filed on a reserve by reserve basis

1990 - ILRS computer system started (approximately 200,000 files converted from manual records)

2012 – updated the computer system

Land Regimes Governing First

Nations Lands Four categories:

1/. Indian Act – ILRS (minister delegates and

approves)

2/. FNLMA (Land Code) – FNLRS (nation approves)

3/. Self Government Agreements – SGLRS (nation

approves)

4/. Modern Day Treaties or other arrangements–

Nisga’a/Tsawwassen (nation approves)

Various degrees of autonomy within each category – none

to full jurisdictional control or full jurisdictional and full title

Regime equals the type of Land

Registry System Indian Act - Sections 21, 55 and 56 allows for the ILRS to be set up

(Straight registry of lands transactions, surrendered or designated

lands and must be signed by the Minister or their designate)

FNLMA – as per Section 25 of the FNLMA. FN Lands Registry

regulations created and FNLRS is used. The FNLRS addresses two

major issues; Priority is granted to registered interests as opposed to

unregistered interests and priority is based upon the date and time of

registration

Self Government – SGLRS

Treaty or other arrangements – LTSA or setting up own system

(Nisga’a’s Land Title Act)

What is the FNLRS?

FNLRS is a database of instruments registered in the

Indian Lands Registry relating to Reserve Lands for nations

who are under the First Nation Land Management Act.

The FNLRS allows all users to perform enquiries and

generate reports on data in the system.

Electronic copies of instruments or charges registered in

the First Nation Land Register System can also be viewed

and printed from the system.

Current Subdivision Process

Steps

1/.Prepare a BCR – permission to do the survey,

permission to enter the nation’s land, sketch of the plan and the nature of the transaction (New allotment/Lease/RoW)

2/. Instructions provide to the surveyor - NRCan

3/. Field work completed and shared with the nation. Has the sketch plan been followed

4/. Sent to the regional Surveyor Branch – review and final ratification

5/. Sent to the FNLRS – up to the nation to transfer the CP

NOTE – No referral process; how can we change this? (LAND CODE)

Songhees Nation Land Code

The Land Code is a formal and legal process that removes the nation from 34 sections of the Indian Act that applies to lands related issues. Essentially the nation has all the land use powers of a local government as they relate to Parts 25, 26 and 27 of the Local Government Act. The Land Title Act, the Approving Officer function. In addition to this the nation has to function as a Lands Title Office - charges and interests are submitted to the First Nation Lands Registry System (FNLRS).

Land Codes are created under the First Nations Lands Management Act – created in 1999. In BC (May 2014) - 29 Operational Nations and 21 Developmental Nations in BC(63% of operational nations located in BC)

Summary Points of Specific Land Use Laws that can be made under a Land

Code Section 6.2 allows for the development of 27 types of land use laws, such as:

• Zoning and land use – issuance of DP, TUP, DVP

• Archaeological Assessment and protection

• Protection of cultural, heritage and spiritual sites

• Environmental assessment and protection

• Regulation, control, authorization and prohibition of residency, access and the

occupation and development of land

• Setting aside, protection and regulation of parks and parkland

• Setting aside lands for community purposes

• Management and protection of fish, wildlife and their habitat

• Subdivision of land

SECTION 6.2 (j) – the conduct of surveys

In addition to the NRCan survey requirements we can add the following tools to our regulatory requirements:

2/. Access requirements – no land locked parcels of land

3/. Referral process

4/. Legalize a PLA process
