In exercise of the powers conferred by clause (d) of Section 29 and

Section 30 of the Boilers Act, 1923 (No. V of 1923), and in supersession of all

rules previous made on the subject , the State Government hereby ma kes the

following rules, the same having, previously been published as required by sub -

section (1) of Section 31 of the said Act, namely: —

CHAPTER I

PRELIMINARY

1. Short tit le.— (1) These rules may be called The Madhya Pradesh

Boiler Operation Engineers’ Rules 1968.

(2) These rules shall come into force immediately on their publicat ion

in the “Madhya Pradesh Gazette”.

2. Definitions.— In these rules, unless the context otherwise

requires, -

(a) “the Act” means the Indian Boilers Act, 1923 (No . V of 1923);

(b)“Boiler Attendant” means a Boiler Attendant qualified under

Madhya Pradesh Boiler Attendants Rules, 1958;

(c) “Section” means the Section of the Act;

(d) Any reference in these rules to a boiler shall be deemed to include

also a reference to an economizer.

CHAPTER II

GENERAL

3. Boiler lo be in charge of person holding Boiler Operation

Engineers’ Certif icate,— The owner of a single boiler or two or more boilers

connected in a battery or of so many separate individual boilers si tuated within

a radius of 23 meters having a total heating surface exceeding 697 Sq. meters in

any of the cases shall not use the same or permit the same to be used unless the

boiler or boilers are placed in direct charge of a competent person as defined in

Rule 4 in addit ion to such number of boiler at tendants as may be prescribed in

this behalf by the Chief Inspector of Boilers :

Provided that the Chief Inspector of Boilers may permit any boiler to

remain in operation for a maximum period of eighteen mo nths notwithstanding

anything contrary contained in these rules.

4. Competent person shall possess certificate and extent of

qualif ication.— No person who does not possess a cert if icate of proficiency as

a Boiler Operation Engineer under these rules shall be deemed a f i t and proper

person to hold charge of a boiler or boilers exceeding the l imits laid down in

Rule 3.

5. Production of Certificate.— The holder of a cert if icate under

these rules shall , at al l reasonable t imes during the period any boi ler is in his

charge. be bound to produce such cert if icate when called upon to do so by any

of the persons empowered under Section 15 to call for the production of the

cert if icate or provisional order authorising the use of the boiler.

6. Owner to furnish Chief Inspector with particulars of

certificates.— (1) The owner of a boiler who engages any person to be in

charge thereof , shall within seven days of such engagement furnish the Chief

Inspector with full part iculars of such person including the serial number, date

and place of issue of his cert if icate.

(2) The owner of a boi ler who engages any person to hold charge of a

boiler, in the event of such person leaving his employment or in the event of

the death of such person, report the fact within seven days to t he Chief

Inspector.

7. Limits of daily period of attendance, reliefs and sphere of

action.— (1) A person in charge of a boiler shall be deemed be to in direct and

immediate charge of a boiler shall be deemed to be in direct and immediate

charge of the same when he is within 46 meters of such a boiler.

(2) An operation Engineer of a boiler or boilers for which a

cert if icate of proficiency is required may be relieved of charge by a person

holding a first class cert if icate of competency as an attendant under the Madhya

Pradesh Boiler Attendant‟s Rules, 1958, in any one day for not more than two

periods, the total of which does not exceed two hours .

(3) The holder of first class certif icate of competency as an attendant

may also with the consent in writ ing of the Chief Inspector, rel ieve a person

holding a cert if icate of proficiency as an Operation Engineer for a period which

may extend to ten consecutive days which in special circumstances the Chief

Inspector may extend to any length of t ime not exceeding thi rty days at a t ime.

Notwithstanding anything hereinbefore contained, the Chief Inspector

of Boilers, may at his direction, permit a Boiler Operation Engineer, holding a

cert if icate of proficiency under these rules, to be incharge of batteries of

boilers, as he deems fi t , and further may permit a Boiler Operation Engineer

freedom of movement to such a d istance from any boiler battery, on such

conditions as he may consider necessary.

8. When boiler deemed to be in use. — (1) A boiler shall be deemed

to be in use for the purpose of these rules when there is f ire in the furnace, f ire

box or fireplace for the purpose of heating the water in the boiler or under

banked fire condition. A boiler shall be deemed to be not in use only when the

fire is removed and all steam and water connection are closed.

(2) An economiser shall be deemed to be in use for the purpose of

these rules when there is a f low of flue gases past the economiser and an

appreciable heat transfer between the water and the heating gages.

CHAPTER III

BOARD OF EXAMINERS

9. Constitution of Board of Examiners.— (1) Board of Examiners

shall be consti tuted for the State of Madhya Pradesh consist ing of the Chief

Inspector and Inspector nominated by the Chief Inspector and not less than two

other members having the theoretical knowledge of prime -movers and modern

boiler practice to be appointed by the State Government, from time o t ime.

(2) The Chief Inspector shall be the ex -officio chairman and the

inspector nominated by the Chief Inspector sha ll be the Secretary to the Board

of Examiners .

10. Term of off ice of members.— The term of office of each of the

members other than ex -officio members of the Board of Examiners shall be

three years . If a member leaves the State of Madhya Pradesh permanent ly or

absents himself from three consecutive meetings of the Board, he shall be

deemed to have vacated his seat and another person may be appointed in his

place for the unexpired term of his office.

11. Function of the Board.—The Board of Examiners shall ,

( i) conduct examination of candidates for the grant of cert if icates of

proficiency as a Boiler Operation Engineer;

( i i) have powers to appoint any person as an external paper setter and

examiner at any examination;

( i i i) grant cert if icate of proficiency as a Boiler Operation Engineer;

( iv) consider the report of inquiries into allegations of drunkenness,

negligence of duty, misconduct on the part of Boiler Operation

Engineers holding cer t if icate of proficiency granted under rules

and. take such action as they may consider necessary.

12. Meeting of Board.— (1) The Board of Examiners shall meet as

often as may in the opinion of the Chairman be necessary for transacting

business which cannot be disposed of by circulation of papers.

(2) At least thirty clear days‟ notice of the date of meeting shall be

sent to each member .

13. Quorum.— The Chairman or the Secretary and two members of

the Board of Examiners shall form a quorum.

14. Chairman of Board. - The Chairman shall preside over all

meetings of the Board of Examiners and in his absence, a member chosen by the

members present at the meeting shall preside over the meeting

15. Secretary of Board.— The Secretary of the Board of Examiners

as per rule shall maintain a register of Boiler Operation Engineers holding

cert if icate of proficiency and shall perform su ch other functions as are

specified in these Rules or as the Chairman of the Board of Examiners may

direct .

16. Board’s endorsement on application. — The Board of Examiners

shall endorse on the printed application form of each candidate the result of his

examination for a cert if icate of proficiency as a Boiler Operation Engineer. The

endorsed application shall be returned to the Secretary of the Board.

17. Board’s power to refuse issue of certificate. — (1) The Board of

Examiners may direct any candidate who in the opinion of the majority of the

members appears too old or physically unfi t through deformity, consti tutional

weakness, defective eyesight, deafness or loss of a l imb to perform efficiently

the duties of a Boiler Operation Engineer to produce a certif icate of f itness

from a Registered Medical Practi t ioner. If , however, the candidate fails to

produce a cert if icate of physical f i tness, the Board shall have power to refuse

the issue of a cert if icate of proficiency as a Boiler Operation Engineer.

(2) The Board shall have power to take any action which i t deems fi t

against any candidate, reported by lnvigilator to have been found using unfair

practice, in the examination shall for succeeding against the examination

principles, viz, copying consult ing or c arrying papers and the l ike.

18 Examiner’s fees.— Each member of the Board of Examiners other

than an official subordinate to the State Government shall be enti t led to receive

a fee of Rs. 500 per diem for each meeting of the Board at which any business

prescribed by these rules has been transacted and which he attends from

beginning to the end. Examiners appointed under Rule 11 (i i) shall be paid Rs.

100 for sett ing a Question paper and marking the an swer books of the

candidates. Each member of the Board, other than an official subordinate to the

State Government, shall also be enti t led to receive travell ing expenses to and

for each meeting of the Board, as admissible under the „Madhya Pradesh

Travell ing Allowance Rules, 1956”, to officers of the first grade .

CHAPTER IV

EXAMINATION

19. Examination.— Examination for the grant of cert if icate of

proficiency as Boiler Operation Engineer shall be held by the Board of

Examiners at such place and on such dates as may be notified by the Secretary

of the Board, from time to t ime, in the official Gazette.

20. Class of certif icate.— The cert if icate of proficiency as a Boi ler

Operation Engineer shall be of one class.

21. Postponement of Examination.— When a date fixed for the

examination is declared a gazetted holiday or when for any unforeseen reason

an examination cannot be held on the date fixed, the Chairman may fix some

other date for holding the examination and the same shall be duly notified to

the candidates for examination.

CHAPTER V

CERTIFICATE

22. Capabilit ies of holders of certif icates. — (1) The cert if icate of

proficiency as Boiler Operation Engineer shall qualify the holder thereof to be

incharge of a boiler or boilers of any type and size provided that the boilers are

so si tuated that no one of them is distant more than 46 m eters from any other of

them.

(2) The holder of cert if icate of proficiency as a Boiler Operat ion

Engineer shall for al l intents and purposes, be deemed t o have ful fi l led the

requirements of Rule 3 of the Madhya Pradesh Boiler Attendants Rules, 1958.

23. Endorsement on certificate.—A person holding a cert if icate of

proficiency as a Boiler Operation Engineer granted by a Board of Examiners

under the corresponding rules in any other State shall on application, have the

cert if icate endorsed for validity in the State of Madhya Pradesh, such

endorsement shall be made by the Chairman of the Board of Examiners

consti tuted under these Rules.

24 Fees.— (1) (a) Candidates for examination for cert if icate of

proficiency as a Boiler Operation Engineer shall pay a fee of Rs. 500.00 which

shall not, except as otherwise provided in these rules, be refundable.

(b) A fee of Rs. 50.00 shall be paid for the issue of a duplicate

cert if icate.

(c) A fee of Rs. 100.00 shall be paid for endorsement on a cert if icate

under Rule 23.

(2) All fees payable under these rules shall be paid in such a manner

as the State Government may direct .

STATE B Examination Fee,—

Fee for the Boiler Operation Engineer Examinations with details of —

Fees for examination; or

Fees for the issue of Duplicate cert if icate; or

Fees for endorsement for validity,

in the State of Madhya Pradesh, as the case may be.

25. Refund of fees.— Candidates once admitted to an examination

under these rules shall not be entit led to any refund of fees. Where a candidate

is unavoidably absent from the examination on the date fixed, the Chairman of

the Board of Examiners may allow him to appear without payment of a second

fee at the next examination.

26. Fees of Candidates found ineligible. — A candidate who has paid

the examination fee but is found ineligible for an examination may apply within

one year from the date of payment for a refund of the fee or he may be allowed

to appear without payment of second fee at any subsequent examination held

within one year from the date of payment of the fee; provided that he has

become eligible to si t for such subsequent examination.

CHAPTER VI

APPLICATION FOR EXAMINATION

27. Form of application.— Every application for examination shall

be in Form „A‟ appended to these rules. The applicant shall f i l l in such parts of

the form as are to be fi l led in by a candidate and shall sign the form in the

presence of a Gazetted Officer or an Honorary Magistrate who shall at test his

signature. The application so fi l led in, shal l be forwarded to the Secretary of

the Board of Examiners at least one month before the date fixed for the

examination and shall be accompanied by,—

(a) Originals and one copy each of all test imonials in respect of

practical experience and theoretical qualification of the

candidate.

(b) Testimonial of good character from his employer, with a

cert if icate of age.

(c) A Treasury Challan or such other evidence, the St ate Government

may specify in this behalf in support of payment of the fee

specified in these rules for the examination at which the

applicant wishes to appear.

(d) Any certif icate granted to the candidate under the Madhya

Pradesh Boiler Attendants‟ Rules , 1958 or a cert if icate granted

by a competent authority referred to in Rule 22 of the Madhya

Pradesh Boiler Attendants‟ Rules, 1958.

(e) Two copies of recent bust photograph (50 x 57 m.m. size) one

which shall bear the signature and the thumb impression of the

applicant on the back, duly attested by a Gazetted Officer or

employer.

28. Candidate to produce satisfactory testimonials. — No candidate

shall be admitted to an examination who cannot produce satisfactory

testimonials cert ifying his experience, ab il i ty, sobriety and general good

conduct for the whole period of his qualifying service. Any break in the period

of qualifying service shall be accounted for.

No candidate shall be admitted to an Examination whose testimonials

do not relate to a period of six months or more during the twelve months

immediately preceding the date of application.

29. Essential statements.— A testimonials shall clearly state the

capacity in which the candidate was employed, whether as an Apprentice

Engineer, Supervisor, Assi stant Engineer or Engineer and the periods of such

employment stating the dates between which the candidate was so employed.

30. Signature and counter signature.— (1) A testimonial shall be

signed by a responsible person with whom the candidate was employ ed and be

countersigned by the Owner, Agent, Manager or Secretary of the Mill , factory

or workshop or by such other person as the State Government may prescribe in

this behalf .

(2) Candidates who have undergone a course of training at an

Engineering College or Technical Insti tution must produce either the diploma

of the insti tution or a cert if icate from the Principal or Superintendent of the

Insti tution giving period devoted in completing the course.

(3) A testimonial in respect of service on s team-ship, may be signed

by the Chief Engineer and countersigned by the master of the vessel or may be

in the form of a seaman‟s discharge cert if icate issued by a Shipping Master.

(4) A testimonial of service rendered on railway boiler or boilers

belonging to a Government Department or local bodies, shall be signed by a

responsible officer under whom the candidate has directly served and

countersigned by the head of the department concerned.

31. Doubtful testimonials.— If the Secretary to the Board of

Examiners has reason to doubt the truth of any statement made in any

application or testimonials; he may make such enquiries as he thinks fi t to

verify the same.

32. False testimonials.— If on enquiry the Secretary is satisfied that

any testimonial submitted by a candi date is false in any material part icular, he

shall submit his f indings to the Chairman of the Board of Examiners who may

by writ ten order debar such candidate from being admitted to any subsequent

examination held under these rules. If on the strength of a ny such testimonial a

candidate has already been admitted to an examination he shall be deemed to

have failed in such examination and any cer t if icate granted to him as a result of

his having been declared to have passed such examination shall be forthwith

recalled and be cancelled by a notification in the official Gazette; provided that

before any cert if icate is cancelled under this rule, the holder thereof shall be

given a reasonable opportunity of being heard in the matter.

33. Fil ing of copies and return of original testimonials.—

Applications and copies of test imonials submitted by candidates shall be fi led

in the office of the Chairman of the Board of Examiners. Original test imonials

shall be returned to the candidate as soon as possible.

CHAPTER VII

AGE AND TRAINING

34. Qualif ications required.— A candidate for a cert ificate of

proficiency as a Boiler Operation Engineer shall not be less than 23 years of

age and shall not be admitted to the examination unless he proves to the

satisfaction of the Chai rman of the Board of Examiners that he has —

(a)(i) successfully completed a full t ime apprentice engineers‟ course

of atleast three years in a recognised workshop engaged in

making, repairing or operation of boilers and accessories, or

( i i) a degree of diploma in mechanical or electrical engineering

recognised by the Insti tution of Engineers ( India) for

exemption from Sections A and B of their examination;

(b) served not less than two years as Engineer or Assistant Engineer

in the running and maintenance o f a battery of boilers not less

than two in number and each of not less than 93 sq. meters (1,000

square feet) heating surface.

35. Service not in strict conformity with rules. — Notwithstanding

anything to the contrary contained in Rule 34 the Chairman of the Board of

Examiners may in hi discretion allow any candidate to appear for the

examination or grant exemption from any portion of the examination as

prescribed in these rules.

CHAPTER VIII

MODE OF EXAMINATION

36. Nature of examination.— Examination for cert if icate of

proficiency as a Boiler Operation Engineer shall be of such nature as to test the

practical abil i ty and technical knowledge of the candidate to be in charge of

steam generating plants of al l types and pressures in land use.

37. Subject for examination.— Examinat ion shall be conducted in

the following manner:—

(a) a writ ten examination comprising of one paper on mathematics,

one paper on applied mechanics and one paper on boilers and heat

engines set with reference to the syllabus prescribed in Rule 38;

(b) a drawing examination, to make within a prescribed t ime a

drawing and/or a sketch of a boiler or part thereof with reference

to clause (c) of Rule 38;

(c) an oral examination to answer questions appertaining to boiler

practice and if required by the examiner to demonstrate in the

examination room or in a workshop or boiler house his abil i ty to

carry out the practical aspects of his dut ies in a workmanlike

manner.

38. Syllabus for examination.— (a) Mathematics.—Ratio and

proportion; variation, use of logarithmic tables; calculation of areas, volumes,

quanti t ies and weight, simple quadratic algebraic equations and their

applications; plott ing of curves.

(b) Applied Mechanics.— Units of force, work power, energy and

their relationship, candidates of equil ibrium of a system of coplanar forces;

centre of gravity, levers, simple problems on moment of inert ia; stress and

strain: Hooke‟s Law : Young‟s modulus; modulus of rigidity; simple problem

relating to calculation of direct and bending stresses in different sections and

torsoinal stresses in circular solid shafts; power transmitted by shafts torque;

circumferential and longitudinal stresses in pressure vessels; r iveted and bolted

joints; pipe flanges; calculation of working pressur e of parts of boilers and

steam pipes in accordance with the Indian Boiler Regulations; 1950.

(c) Drawing.— Preparation of working sketches or drawings of steam

engines, boilers, mountings or parts thereof.

(d) Boilers and Heat Engines.—Basic principles of Thermo

dynamics; use of steam tables; description, operation and maintenance of

different types of boilers, economisers and their mountings and fi t tings

description, operation and maintenance of feed pumps, injectors; feed

regulators, water softeners, f eed heaters, air heaters, steam accumulators, and

superheaters; fuels and their characterist ic, combustion of fuels, mechanical

stokers; burners; pulveriser, draught fans; boiler scale, i ts effect on heat

transfer, internal and external cleaning of boilers ; degeneration of feed water;

pH value; hardness and alkalinity in feed and boiler water; make -up water;

boiler house instrumentation; efficiency of boilers; working of different types

of reciprocating engines and turbines; stat ion efficiency; reheat; stea m piping

layout; expansion bends, supports and heat engines; and the Indian Boiler

Regulations, 1950.

39. Assessment of work.— A candidate shall secure at least 45 per

cent of the marks in each writ ten paper as well as in the oral and drawing

examinations; but the aggregate shall not be less than 55 per cent of the total

marks in order that he can be awarded a cert if icate of proficiency under these

rules.

CHAPTER IX

GRANT OF CERTIFICATE

40. Grant of certif icate of proficiency .— If a candidate passes the

examination, his resul t will be notified in the official Gazette and he shall be

granted a cert if icate as soon as practicable after such publication.

41. Form of certif icate.— A cert if icate of proficiency as a Boiler

Operation Engineer shall be in Form „B‟ appended to these rules.

42. Application for endorsement on cert ificate. — An application

for endorsement in the examination for validity in a State other than the State

of issue, shall be made in Form „A‟ appended to these rules.

43. Record of duplicate certificate.— Duplicates of al l cert if icates

granted under these rules shall be recorded in the office of the Chairman.

44. Identif ication requirements.— Every Certif icate granted under

these rules bear a small bust photograph of the holder thereof previously

submitted along with his application under Rule 27 and his signature and thumb

impression and such other particulars as may be required for the purpose of

identification.

45. Grant of duplicate certif icate.— (1) Whenever the holder of a

cert if icate proves to the satisfaction of the Chairman of the Board of Examiners

that cert if icate granted to him under these rules has been lost , stolen or

destroyed or mutilated without any fault on his part , he shall be granted a

duplicate cert if icate to which, by the record so kept as aforesaid, he appears to

be enti t led, which shall have for al l purposes same validity as the original

cert if icate.

(2) If on enquiry the Secretary to the Board of Examiners, is satisf ied

that any statement made by the applicant for the issue of a duplicate cert if icate

is false he shall report the case to the said Board at i ts next meeting and the

Board may at i ts discretion cancel the cert if icate or permit the grant as

aforesaid of a duplicate either immediately or after such period not exceeding

twelve months as the Board may think fi t having regard to circumstances of

46. Application for duplicate certif icate. — Application for a

duplicate cert if icate shall be made to the Chairman to the Board Examiners

with a declaration before a Gazetted Officer or a Magistrate stating that the

cert if icate granted under these rules, has been lost or stolen or destroyed or

mutilated without faul t on the part of the applicant.

47. Invalidity of original certif icate.— On the issue of a duplicate

cert if icate, the original cert if icate shall cease to be valid and shall if in the

possession or power of the holder thereof be returned to the office of the

Chairman for cancellation.

48. Enquiry regarding certif icate holders. — (1) If a District

Magistrate or the Chief Inspector of Boilers has reason to believe from any

cause whatsoever that an enquiry should be made into an allegation of

incompetence, drunkenness, misconduct, or negligence of duty on the part of a

Boiler Operation Engineer holding cert if icate of proficiency under these rules,

he shall ei ther himself make such enquiry or cause i t to be made by his

subordinate officer.

(2) The District Magistrate may depute a Magistrate of the first class

and the Chairman of the Board of Examiners an Inspector of Boilers duly

authorised by him to hold such enquiry.

(3) The proceedings shall be held in the presence of the person whose

conduct forms the subject of enquiry and he shall have an opportunity of

making any statement he may wish to make and of producing any evidence in

his defence.

(4) The proceedings of any such enquiry shall be forwarded by the

officer conducting the enquiry where he is not the Chairman of the Board or the

Secretary to the Board of Examiners, for consideration of the Board.

49. Surrender of certificate.— When an enquiry is being conducted

under Rule 48, the holder of such cert ificate shall on demand by the officer

charged with the enquiry forthwith surrender his cert if icate to the said officer

pending the resul t of such enquiry.

50. Submission of proceedings before the Board. — The Secretary to

the Board of Examiners shall place the proceedings sent to him under sub -rule

(4) of Rule 48 before the Board of Examiners. The Board at its discretion may

allow the cert if icate to stand or suspend i t for such period as i t thinks fi t or

may cancel the cert if icate permanently. The decision of the Board shall be

final .

CHAPTER X

PENALTY

51. Cognizance of offences.— The owner of a Boiler or any person

who works or permit s or causes the Boiler to be worked at any t ime in

contravention of Rule 3, 5, 6 or 7, shall be punishable with fine which may

extend to one hundred rupees.

52. Rules to be in addition to Boiler Attendant’s Rules. - These

rules shall be in addit ion to and not in derogation of the Madhya Pradesh Boiler

Attendants Rules , 1958.
