NATIONAL STEERING COMMITTEE ON THE REVIEW OF THE IMPLEMENTATION OF THE UNITED NATIONS CONVENTION

AGAINST CORRUPTION

APPOINTMENT

WHEREAS Kenya is a State Party to the United Nations Convention against Corruption (UNCAC) having signed and ratified the Convention in Merida, Mexico, on 9th December, 2003;

WHEREAS Kenya is obliged under the Vienna Convention on the Law of Treaties, 1969, and Articles 2 (6), 132 (1) (c) (iii), and 132 (5)

of the Constitution of Kenya, 2010, to implement her international obligations;

WHEREAS the Conference of States Parties to UNCAC in its Resolution 3/1, entitled ―Review Mechanism‖, adopted during the 3rd Session of the Conference of States Parties to UNCAC held in Doha, Qatar, 9-13 November, 2009, established the Implementation Review Group (of UNCAC) as an open-ended intergovernmental group of States parties to operate under its authority and report to it, and that the Group is charged with having an overview of the UNCAC review process in order to identify challenges and good practices and to consider technical assistance requirements in order to ensure effective implementation of the Convention;

WHEREAS the Implementation Review Group of UNCAC held its inaugural session in Vienna, Austria, from 28th June to 2 July, 2010, and inter alia: adopted the Terms of Reference of the Review Mechanism and the Guidelines for Governmental Experts and the Secretariat; resolved that the second review cycle will cover Chapter II

(Preventive measures), and V (Asset Recovery) of the Convention; drew lots for the States parties to be reviewed in the second review cycle (2016-2022), and that Kenya, among other States parties, was slotted for review during the second year of the second review cycle;

AND WHEREAS Kenya has been drawn for review beginning July 2017 by New Zealand and Democratic Republic of Congo, on its implementation of the Convention in accordance with the Implementation Review Mechanism of the Convention, and the resolutions of the 4th Session of the Meeting of the Implementation Review Group of UNCAC held in Vienna, Austria, 19-23 June 2017;

IT IS notified for general information that the Attorney-General, in consultation with the relevant ministries, agencies, departments and other stakeholders, has appointed a National Steering Committee on the Review of the Implementation of the United Nations Convention against Corruption consisting of the following members—

Generally, the Committee will facilitate the conduct of a review of Kenya’s implementation of UNCAC by, inter alia, undertaking a review of Kenya’s anti-corruption laws, institutions, policies and administrative measures or other arrangements and assess the impact of the same in relation to the country’s obligations under Chapters II and V of UNCAC.

Specifically, the Committee shall—

(a) undertake the necessary technical preparatory work for Kenya’s review on the implementation of its obligations under UNCAC;

(b) co-ordinate the completion of the comprehensive self-assessment checklist under Chapter II (Preventive Measures), and V (Asset Recovery) of UNCAC;

(c) discuss with concerned parties and stakeholders and plan a schedule of meetings—

(a) between the UNCAC Review Experts from the reviewing States and Kenyan

(b) authorities for purposes of preparing the UNCAC country review report on Kenya;

(d) make recommendations for new legislation or review of existing legislation and regulations to address some legislative gaps;

(e) undertake technical needs assessment, identify potential providers of technical assistance for consideration by the Government and provide guidance on the provision of technical assistance to the relevant or appropriate stakeholders;

(f) co-ordinate activities to ensure timely submission of UNCAC comprehensive self-assessment checklist and the supporting documentation (including but not limited to: laws; reports; policies or administrative instruments; case statistics, etc.) to the UNCAC Secretariat by 1st October, 2017;

(g) facilitate the provision of support and training to Ministries, Departments, Agencies and other stakeholders on the requirements of UNCAC for purposes of ensuring efficiency and effectiveness in compliance and implementation;

(h) advise the Government on measures necessary to comply with;

(i) Kenya’s obligations under UNCAC, and shall in this regard, work with the relevant ministries, Government departments, public bodies, civil society and other stakeholders to co-ordinate the collection, collation, documentation and updating of information relevant to Government in order for the concerned body or person to meet and implement their obligations in accordance with the Constitution of Kenya, and UNCAC;

(j) facilitate the publication of comprehensive self-assessment checklist on the implementation of UNCAC for public comments and debate before such reports are submitted to the Attorney General for eventual submission to the UNCAC Secretariat (the United Nations Office on Drugs and Crime, Vienna, Austria);

(k) upon receipt, from the UNCAC Secretariat, of the UNCAC Implementation Country Review Report on Kenya, prepare an analysis of the Report, identifying, inter alia, the extent to which Kenya has implemented its obligations under UNCAC, the challenges faced, technical assistance needs, and recommendations for remedial action; and

(l) prepare an Action Plan for the implementation of the UNCAC Implementation Country Review Report.

In the performance of its duties, the committee shall—

(a) be responsible to the Attorney General through the Secretary, Justice and Constitutional Affairs, Department of Justice, and the Solicitor General, Office of the Attorney-General and Department of Justice;

(b) hold meetings in places and at times as the Committee may consider necessary for the discharge of its functions

(c) co-opt any persons that it may consider necessary and expedient for the proper performance of its functions; and

(d) have all the power necessary for the expedient discharge of its mandate including the power to regulate its procedure.

The term of the Committee shall be one (1) year from the date of appointment or the date of the 9th Session of the Meeting of the Implementation Review Group of UNCAC, to be held in Vienna, Austria, June, 2018, during which Meeting a report on Kenya’s implementation of UNCAC is expected to be considered, whichever is later.

The Secretariat of the Committee will be based at the Ethics and Anti-Corruption Commission (EACC) and will be responsible to the Committee for—

(a) providing appropriate background briefing to the Committee;

(b) preparing the Committee’s report and disseminating any information deemed relevant to the Committee;

(c) undertaking research and liaising with the relevant government ministries, departments, commissions, independent offices, and any other institution in order to gather relevant information necessary for informing the Committee;

(d) organizing consultative forums and meetings for purposes of ensuring that the Committee delivers on its mandate; and

(e) facilitating the provision of the necessary administrative support to the Committee.

The Committee shall submit to the Attorney-General, Kenya’s comprehensive self-assessment checklist and the relevant supporting documentation on Chapters II and V of UNCAC, on or before 25th September, 2017, an Interim Report on its work by 31st January, 2018 and a final report within one month of receipt, from the UNCAC Secretariat, of the final UNCAC Implementation Country Review Report on Kenya.

PURSUANT to section 9 (1) and (5) of the Banking Act, it is notified for information of the general public that—

(a) at an extraordinary general meeting held on 17th August, 2016 the shareholders of NIC Bank Limited passed a resolution authorizing the company to transfer its Kenyan banking business, assets and liabilities (save for the excluded assets and liabilities) to NIC Bank Kenya PLC pursuant to the agreement between NIC Bank Limited and NIC Bank Kenya PLC dated the 25th November, 2016;

(b) at an extraordinary general meeting held on 16th November, 2016 the shareholders of NIC Bank Kenya PLC passed a resolution to acquire the Kenyan banking business, assets and liabilities (save for the excluded assets and liabilities) of NIC Bank Limited;

(c) the Cabinet Secretary, the National Treasury has approved the transfer of its Kenyan banking business, assets and liabilities (save for the excluded assets and liabilities) from NIC Bank Limited to NIC Bank Kenya PLC; and

(d) the transfer and acquisition shall take effect on the 31st August, 2017.

IN EXERCISE of the powers conferred by Articles 88 (4), 93, 97 (1) (b) and 101(1) of the Constitution, section 4 of the Independent Electoral and Boundaries Commission Act, 2011, section 24 (1), (2) and (3) of the Elections Act, 2011 and Regulation 87 (2) of the Elections (General) Regulations, 2012, the Independent Electoral and Boundaries Commission declares that the persons whose names are listed in the schedule hereunder were elected as County Woman Member to the National Assembly having received the majority of the votes cast in the election held on8th August, 2017 and complied with the provisions of the Elections Act, 2011 and the Constitution.

that it has considered an application from the Oil Marketing

Companies (OMCs) for recovery of levies under the Road

Maintenance Levy Fund (Imposition of Levy) (Amendment) Order,

2015 and varies its earlier decision contained in Gazette Notice No.

2824 dated 19th April, 2016 as follows:

(a) The cargoes that were discharged from 17th July, 2010 to 9th

August, 2015 be compensated for increase arising from the

Road Maintenance Levy Fund (Imposition of Levy)

(Amendment) Order, 2015 in the sum of Kenya Shillings Five

Hundred Ninety Seven Million, One Hundred Eleven

Thousand and Seventy Five (KSh. 597,111,075).

(b) The recovery of this amount shall be through the Open Tender

system by following Kenya Shillings nought point two six

ninety nine (0.2699) per litre in the import cost of super petrol

for a period of (6) six months.

This decision is based on the objects and mandate of the

Commission under section 5 (b) and 6 (d) of the Energy Act.

that it has considered an application by the Oil Marketing Companies

(OMCs) for compensation following the enactment of Excise Duty

Act, 2015. The Commission varies its decision contained in Gazette

Notice No. 2825 dated 19th April, 2016 and orders that the cargoes

that were discharged between 1st December, 2015 and 9th December,

2015 be compensated as follows:

(a) Recover of Kenya Shillings Thirteen Million Two Hundred and

Twelve Thousand and Four (KSh. 13,212,004) only.

(b) The recovery of the same amount shall be through the Open

Tender System by factoring Kenya Shillings nought point three

seven four two (0.3742) per litre in the import cost build up of

diesel for a period of (6) six months.

THE following notes are for the guidance of persons submitting ―copy‖ for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All ―copy‖ submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and

should be typewritten with double spacing. Copy should be clear, legible and

contain no alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name

of the signatory in capital letters.

(ii) Must be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition. of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D—

Kenya Gazette

―D 34. (1) Communications for the Kenya Gazette should reach the

Government Printer not later than 9 a.m. on Friday of the week before

publication is desired. The Government Printer will not publish communications

received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested

that persons submitting copy for publication first satisfy themselves that such

copy is complete in every respect.
