BAIL AND BOND IMPLEMENTATION COMMITTEE

APPOINTMENT

FOLLOWING the launch and gazettement of the Bail and Bond

Policy Guidelines, the National Council on the Administration of

Justice (NCAJ), in its fifteenth meeting resolved that a Committee be

established to oversee the implementation of the Bail and Bond Policy

Guidelines and Recommendations of the Taskforce that developed

them.

PURSUANT to the NCAJ resolution, and in line with theprovisions of the Constitution and sections 5 and 34 of the Judicial

Service Act, 1, the Chief Justice of the Republic of Kenya andChairperson of the National Council on the Administration of Justice

appoint the following members to form the Committee with effect from2nd July, 2015.

1. Terms of reference of the Committee:

The Committee shall ensure application of appropriate bail and

bond policy measures in accordance with the Bail and Bond Policy

Guidelines and the Recommendations of the Report of the Taskforce on

Bail and Bond.

In fulfilment of the above broad mandate, the Committee shall in

particular-

(a) conduct sensitization and training exercises among the relevant

stakeholders and the public generally on the application of the

bail and bond terms and related matters;

(b) engage the relevant actors as necessary to enableoperationalization and the streamlining of the bail and bond

processes across all relevat justice.sector actors;

(c)Recommend and/or undertake such measures, including

legislative interventions as necessary to achieve theoperationalization of the recommendations of the Taskforce by

the relevant agencies.

(d)Monitor, evaluate and report on the implementation of the Bail

and Bond Policy Guidelines and Recommendations contained in

the Report of the Taskforce.

2. The Committee shall-

(a)be guided by the Constitution;

(b)be guided by the Bail and Bond Policy Guidelines and the final

Report of the Taskforce;

(c)prepare a detailed work plan and cogent implementation

strategy for its work;

(d) make rules to regulate its own procedure.

3. The Committee may-

(a)co-opt such persons nominated by organisations identified by

the Committee to be relevant for the discharge of its mandate;

(b)engagc^such expert(s) as may be necessary for better fulfilment

of its tasks;

(c)seek and mobilize financial support as is appropriate for

effective realisation of its mandate.

4. The Committee shall regularly report to the Deputy Chief Justice.

5. The Committee shall apprise the National Council on the

Administration of Justice on its progress as required.

6. At the end of the period, the Committee shall prepare a final

Report, detailing the extent to which it achieved its mandate, the

gaps if any and its recommendations.

7. The term of the Committee shall be for an initial period of twenty

four (24) months from the effective date.

TASKFORCE ON THE ORGANIZATION AND MANAGEMENT

OF ICT PERSONNEL

APPOINTMENT

IT IS notified for the general information of the public that the

Cabinet Secretary for Information, Communication and Technology

has appointed a Taskforce on the organization and management of ICT

personnel.

1. The Taskforce shall comprise of the following-

2. The terms of reference of the Taskforce are-

(a) review the Kenya Gazette Supplement No. 118 of 2013 thatestablished the ICTA and make recommendations where

necessary;

fb) align ICT structures in the civil service in line with the ICT

Authority mandate; and

(c) make recommendations on transition of ICT staff from the Civil

Service into ICT Authority and modalities of management of

ICT personnel who will not be absorbed by ICT Authority.

3. In the performance of its functions, the Taskforce^

(a) shall prepare a detailed workitplan;

(b) shall in consultation with the 'Cabinet Secretary., 1hold such

number of meetings in -such places and at sueh ;times as it

considers necessary for the proper discharge of,its fundtiohS;

(c) shall make use of such official rqports/document-, relevant to its

mandate;

(d) shall carry out or-cause to be carried out.such studies, research

and evaluation as may inform on its mandate;

(e) may prepare any such documents related to the terms of

reference.

(J) may co-opt such other persons, who posses the appropriate

competencies as are necessary for the performance of the terms

of reference.

4. The Taskforce shall have the powers necessary to undertake any

matter incidental or ancillary to the matters stated herein.

5. The Taskforce shall regulate its own procedure.

6. The Secretariat of the Taskforce shal be based at the Offices of the

ICT Authority.

7. The Taskforce shall submit the final report to the Cabinet Secretary.

8. The term of office of the Taskforce shall be for a period of two (2)

months with effect from the date of its gazettement and the Cabinet

Secretary for Information, Communication and Technology may

when necessary, extend the period.

1.0 INTRODUCTION

The Commission on Revenue Allocation (CRA) was establishedin December 20 10 pursuant to Article 215 of the Constitution of Kenya2010. CRA envisions promoting sustainable and balanced economicdevelopment of the counties by way of prudentialadvise/recommendations of inter-governmental transfers in an equitableand fair manner. The Commission is mandated under the Constitutionto make recommendations concerning the basis for the equitablesharing of revenue raised by the national government between (a) theNational and County governments; and (b) among the Countygovernments for the prosperity and economic empowerment of thepeople of Kenya.

The Summary of the Functions of the Commission as per Article215 of the Constitution include:

1. Recommend the basis of equitable sharing of revenue raisednationally between the National and County governments.

2. Recommend the basis of equitable sharing of revenue raised byNational Government among County governments.

3. Recommend on matters concerning financing of County andNational governments.

4. Recommend on matters concerning . financial management ofCounty and National governments,

6. Promote fiscal responsibility while making recommendationson the sharing of revenue.

7. To be consulted when any Bill is published concerning sharingof revenue or any financial matter concerning Countygovernments.

PURPOSE OF THE LEADERSHIP AND INTEGRITY CODE

The Leadership and Integrity Act, 2012 of the laws of Kenyarequires that each public institution establishes a specific leadership andintegrity code for state officers in accordance with the Act.

This Leadership and Integrity Code is intended to establishstandards and norms of state officers at the CRA that will ensurerespect for values, principles and requirements of the Constitutiongeared towards promotion, enforcement and compliance with integrityand the set designated ethical standards and norms.

This Code shall be cited as the Leadership and Integrity CodeforState Officers of the Commission on Revenue Allocation. It will applyto all State Officers at the Commission. It should be read in conjunctionwith Chapter Six of the Constitution of Kenya and the Public OfficersEthics Act (No. 4 of 2003) which forms part of this Code.

In this Code, "he" shall refer to both gender (man or woman).

A State Officer appointed to the Commission shall sign and committo this Code at the time of taking oath of office or within seven (7) daysof assuming office. A serving State Officer shall sign and commit tothis Code seven (7) days upon publication of the Code in the KenyaGazette.

Application

This code applies to all state officers at the Commission and anyother state officers seconded or appointed to the Commission.

DEFINITIONS AND INTERPRETATIONS

In this Code, unless the context otherwise requires-

"Bank Account" means an account maintained by a bank or anyother financial institution for in the name of, or in the name designatedby, a customer of the bank or other financial institution and into whichmoney is paid or withdrawn by or for the benefit of that customer orheld in trust for that customer and in which the transactions betweenthe customer and the bank or other financial institution are recorded;

"Business Associate" means a person who does business with or onbehalf of a State Officer and has express or implied authority from thatState Officer;

"Constitution" means the Constitution of Kenya promulgated in2010;

"Commission" means the Commission on Revenue Allocation(CRA);

"Ethics and Anti-Corruption Commission (EACC)" means theCommission established under the Ethics and Anti-CorruptionCommission Act, 2011 (No. 22 of 2011);

"Spouse" means a wife or husband;

"State Office" means the definition as provided under Article 260of the Constitution of Kenya, 20 10.

"State Officer" means a member of the Commission on RevenueAllocation as provided under Article 260 of the Constitution and theCommission Secretary of the Commission as provided under Section14(3) of the Commission on Revenue Allocation Act.

COMPLIANCE REQUIREMENTS

2.1 Rule of Law

(1) Each State officer shall respect and abide by the Constitutionand the laws of Kenya.

(2) Each State officer shall carry out the duties of the office inaccordance with the laws of Kenya.

(3) In carrying out the duties of the office each State officer shallnot violate the rights and fundamental freedoms of any person unlessotherwise expressly provided for and in accordance with Article 24 ofthe Constitution

2.2 Public Trust

A State office is a position of public trust and the authority andresponsibility vested in each State officer shall be exercised in the bestinterest of the people of Kenya.

2.3 Personal Responsibility and Duties

. Subject to the Constitution and any other related law, each StateOfficer shall take personal responsibility for the reasonably foreseeableconsequences of any actions or omissions arising from the discharge ofthe duties of his appointment.

2.4 Performance of Duties

Each State officer shall, to the best of their ability-

(a) carry out the duties of the office efficiently, honestly with thehighest degree of personal integrity;

(b) carry out the duties in a transparent and accountable manner;

(c) keep accurate record sand documents relating to the functionsoft heir respective role at the Commission; and

(d) report truthfully on all matters of the Commission.

2.5 Professionalism

Each State officer shall —

(a) carry out duties of the office in a manner that maintainspublic confidence for corporate integrity of the Commission;

(b) treat members of the public and other public officers withcourtesy and respect;

(c) not discriminate against any person, except as is expresslyprovided by the law;

(d) to the extent appropriate to the Commission in its servicedelivery role, maintain high standards of performance and levelof professionalism within and without the Commission; and

(e) where a State officer is a member of a professional body,observe and subscribe to the ethical and professionalrequirements of that body in so far as the requirements do notcontravene the Constitution or this Act.

2.6 Financial integrity

(1) Each State officer shall not use the office to unlawfully orwrongfully enrich himself or herself or any other person.

(2) Subject to Article 76 (2) (b) of the Constitution each State officershall not accept a personal loan or benefit which may compromise himin carrying out his statutory duties.

2.7 Moral and Ethical Requirements

(1) For the purposes of Articles 99(l)(b) and 193(l)(b) of theConstitution, each State officer shall observe and maintain thefollowing ethical and moral requirements-

(a) demonstrate honesty in the conduct of public affairs subject tothe Public Officer Ethics Act (No. 4 of 2003);

(b) not engage in activities that amount to abuse of office;

(c) accurately and honestly represent information to the public;

(d) not engage in wrongful conduct in furtherance of personalbenefit;

(e) not misuse public resources;

(f) not discriminate against any person except as expresslyprovided for under the law;

(g) not falsify any records;

(h) not engage in actions which would lead to his removal from themembership of a professional body in accordance with the law;and

(i) not commit offences and in particular, any of the offences underParts XV and XVI of the Penal Code (Cap. 63), the SexualOffences Act (No. 3 of 2006), the Counter-Trafficking inPersons Act (No. 8 of 2010), and the Children Act (Cap. 141).

2.8 Gifts or Benefits Received in Kind

(1) A gift or donation given to each State officer on a public orofficial occasion shall be treated as a gift or donation to the State.

(2) Notwithstanding subsection (1), each State officer may receivea gift given to the State officer in an official capacity, provided that-

(a) the gift is within the ordinary bounds of propriety, a usualexpression of courtesy or protocol and within the ordinarystandards of hospitality;

(b) the gift is not monetary; and

(c) the gift does not exceed such value as may be prescribed byEthics and Anti — Corruption Commission from time to time.

(3) Without limiting the generality of subsection (2), each Stateofficer shall not-

(a) accept or solicit gifts, hospitality or other benefits from a personwho-

(i) has an interest that may be achieved by the carrying out ornot carrying out of the State officer's duties;

(ii) carries on regulated activities with respect to theCommission; or

(iii) has a contractual or legal relationship with the Stateofficer's organization;

(b) accept gifts of jeweler or other gifts comprising of preciousmetal or stones of ivory or any other , animal part protectedunder the Convention on International Trade in EndangeredSpecies of Wild Fauna and Flora; or

(c) any other type of gift specified by the Ethics and Anti-Corruption Commission from time to time.

(4) Each State officer shall not receive a gift which is given withthe intention of compromising the integrity, objectivity or impartialityof the State officer.

2.9 Registration of Gifts

The Commission shall keep a Register of —

(a) gifts received by each State Officer

(b) gifts given by the Commission to its State Officers

Subject to subsection (2), any State officer who receives a gift ordonation shall declare the gift or donation to the Commission Secretaryof the Commission and the same shall be recorded in the Register ofGifts. Where a gift is given to a State Officer by the Commission, itshall be recorded in the Register of Gifts.

2.10 Wrongful or Unlawful Acquisition of Property

A State officer shall not use the office to wrongfully or unlawfullyinfluence the acquisition of any property.

2.11 Conflict of Interest

(1) Each State officer shall use the best efforts to avoid being in asituation where personal interests conflict or appear to conflict with theState officer ? s official duties.

(2) Without limiting the generality of subsection (1), each Stateofficer shall not hold shares or have any other interest in a corporation,partnership or other body, directly or indirectly through another person,if holding those shares or having that interest would result in a conflictof the State officer's personal interests and the officer's official duties.

(3) Each State officer whose personal interests conflict with theirofficial duties shall declare the personal interests to the CommissionSecretary of the Commission or the Ethics and Anti-CorruptionCommission.

(4) The Ethics and Anti-Corruption Commission may givedirection on the appropriate action to be taken by the State officer 03

avoid the conflict of interest and the State officer shall-

(a) comply with the directions accordingly; and

(b) refrain from participating in any deliberations with respect tothe matter.

(5) Not with standing any directions to the contrary undersubsection (4), a State officer shall not award or influence the award ofa contract to —

(a) himself or herself;

(b) the State officer's spouse or child;

(c) a business associate or agent; or

(d) a corporation, private company, partnership or other body inwhich the State Officer has a substantial or controlling interest.

(6) In this section, "personal interest" includes the interest of aspouse, child, business associate or agent or any other matter in whichthe State officer or public officer has a direct or indirect pecuniary ornon-pecuniary interest.

(7) Where a State officer is present at a meeting, where an issuewhich is likely to result in a conflict of interest is to be discussed, theState officer shall declare the interest at the beginning of the meeting orbefore the issue is deliberated upon.

(8) A declaration of a conflict of interest under subsection (7) shallbe recorded in the minutes of that meeting.

(9) The Commission shall maintain an open register of conflicts ofinterest in which an affected State officer shall register the particularsof registrable interests, stating the nature and extent of the conflict.

(10) For purposes of subsection(9), the registrable interests includethe interests set out in the First Schedule of this Code.

(11) The Commission shall keep the register of conflicts of interestfor five years after the last entry in each volume of the register.

(12) It shall be the responsibility of the State , officer to ensure thatan entry of registrable interests under subsection(9) is updated and tonotify the Commission or the Ethics and Anti-Corruption Commissionof any changes in the registrable interests, within one month of eachchange occurring.

2.12 Participation in Commission Tenders

Each State officer shall not participate in a tender for the supplyof goods or services to the Commission in which he or she is servingor is otherwise similarly associated, but die holding of shares by aState officer in accompany shall not be construed as participating inthe tender of a public entity unless the State officer has a controllingshareholding in the company.

2.13 Public Collections

(1) Each State officer shall not solicit for contributions from thepublic for a public purpose within or without unless the President has,by notice in the Kenya Gazette, declared a national disaster andallowed a public collection for the purpose of the national disaster inaccordance with the law.

(2) Each State officer shall not participate in a public collection offunds, in a way that reflects adversely on that State officer's integrity,impartiality or interferes with the performance of his official duties.

(3) Any person intending to be appointed as a State Officer shallsubmit to the EACC a self-declaration form set out in the FirstSchedule to the Ethics and Anti-Corruption Act.

2.14 Bank Accounts Outside Kenya

(1) Subject to Article 76 (2) of the Constitution or any otherwritten law, each State officer shall not open or continue to operate abank account outside Kenya without the approval of the Ethics andAnti-Corruption Commission.

(2) Each State officer who has reasonable grounds for opening oroperating a bank account outside Kenya shall apply to the Ethics andAnti-Corruption Commission for approval to open or operate a bankaccount.

(3) Each State officer who operates or controls the operation of abank account outside Kenya shall submit statements of the accountannually to the Ethics and Anti-Corruption Commission and shallauthorize the Ethics and Anti-Corruption Commission to verify thestatements and any other relevant information from the foreignfinancial institution in which the account is held.

(4) Subject to subsections (1) and (2), each State officer whooperates a bank account outside Kenya shall declare the details of thebank account including its mandates to the Ethics and Anti-CorruptionCommission as soon as possible.

2.15 Acting for Foreigners

(1) Each State officer shall not be an agent of, or further theinterests of a foreign government, organization or individual in amanner that may be detrimental to the security interests of Kenya,except when acting in the course of official duty.

(2) For the purposes of this section —

(a) an individual is a foreign individual if the individual is not.acitizen of Kenya; and

(b) an Organization is a foreign organization if it is establishedoutside Kenya or is owned or controlled by a foreigngovernment, organization or individual.

2.16 Care of Public Property

(1) Each State officer shall take all reasonable steps to ensure thatpublic property in the officer's custody, possession or control is takencare of and is in good repair and condition and not to the detriment ofthe Commission's image.

(2) Each State officer shall not use public property. funds orservices that are acquired in the course of or as a result of the officialduties, for activities that are not related to the official work of the Stateofficer.

(3) Each State officer shall return to the issuing authority all thepublic property in their custody, possession or control at the end of theappointment, or contract term or as per the valid regulations asapproved by the Commission.

(4) Each State officer who contravenes subsection (2) or (3) shall,in addition to any other penalties provided for under the Constitution,this Act or any other law be personally liable for any loss or damage tothe public property.

2.17 Misuse of Official Information

(1) Each State officer shall not directly or indirectly use or allowany person under the officer's authority to use any informationobtained through or in connection with the office or during the courseof his official position, which is not available in the public domain, forthe furthering of any private interest, whether financial or otherwise.

(2) The provisions of subsection(l), shall not apply where theinformation is to be used for the purposes of-

(a) furthering the interests of the Leadership and Integrity Act,2012;

(b) educational, research, literary, scientific or other purposes notprohibited by law; or

(c) for the general development of the vision and/or mandate of theCommission.

2.18 Political Neutrality

(1) Each State officershall not in the performance of their duties-

(a) act as an agent for, or further the interests of a political party orcandidate in an election or any other political endeavors; or

(b) manifest support for or opposition to any political party orcandidate in an election or any other political engagements.

(2) Each State officer shall not engage in any political activity thatmay compromise or be seen to compromise the political neutrality ofthe office subject to any laws relating to elections.

(3) Without prejudice to the generality of subsection(2)a publicofficer shall not-

(a) engage in the activities of any political party or candidate or actas an agent of a political party or a candidate in an election;

, (b) publicly indicate support for or opposition against anypolitical party or candidate participating in an election.

2.19 Impartiality

Each State officer shall, at all times, carry out the duties of theoffice with a high degree of impartiality and objectivity in accordancewith Articles 10, 27, 73(2)(b) and 232 of the Constitution and shall notpractice -favoritism, nepotism, tribalism. cronyism, religious bias orengage in corrupt or unethical practices.

2.20 Giving Advice

Each State officer who has a duty to give advice shall give honest,accurate and impartial advice without any fear or favor.

2.21 Gainful Employment

(1) Subject to subsection (2), a State officer who is serving on afulltime basis shall not participate in any other gainful employment.

(2) In this section, "gainful employment" means work that a personcan pursue and perform for money or other form of compensation orremuneration which is inherently incompatible with the responsibilitiesof the State office or which results in the impairment of the judgmentof the State officer in the execution of the functions of the State officeor results in a conflict of interest in terms of Clause 10.

2.22 Offers of Future Employment

(1) Each State officer shall not allow himself or herself to beinfluenced in the performance of their duties by plans or expectationsfor or offers of future employment or benefits.

(2) Each State officer shall disclose, in writing, to the public entityand the Commission, all offers of future employment or benefits thatcould place the State officer in a situation of conflict of interest.

2.23 Former State Officer Acting in a Government or Public EntityMatter

Each former State officer shall not be engaged by or act for aperson or entity in a matter in which the officer was originally engagedin as a State officer, for at least two years after leaving the State office.

2.24 Misleading the Public

Each State officer shall not knowingly give false or misleadinginformation to any person.

2.25 Falsification of Records

Each State officer shall not falsify any records or misrepresentinformation to the public.

2.26 Conduct of Private Affairs

Each State officer shall conduct private affairs in a manner thatmaintains public confidence and decorum in the integrity of the office.

2.27 Tax, Financial and Legal Obligations

(1) Each State officer shall pay any taxes due from him or herwithin the prescribed period.

(2) Each State officer shall not neglect their financial or legalobligations.

2.28 Bullying

(1) Each State officer shall not bully any person both within andwithout of the Commission.

(2) For purposes of subsection (I ),"bullying" includes repeatedoffensive behavior which is vindictive, cruel, sexual advances,malicious or humiliating and is intended to undermine a person.

2.29 Acting Through Others

(1) Each State officer contravenes this Code if the officer-

(a) causes anything to be done through another person that wouldconstitute a contravention of the Code if done by the Stateofficer; or

(b) allows or directs a person under their super-vision or control todo anything that is in contravention of the Code.

(2) Subsection (1) (b) shall not apply where anything is donewithout- the State officer's knowledge or consent or if the State officerhas taken reasonable steps to prevent it.

(3) Each State officer who acts under an unlawful direction shall beresponsible for his or her action.

2.30 Reporting Improper Orders

(1) If a State officer considers that anything required of themisincontravention of this Code or is other-wise improper or unethical,the State officer shall report the matter to the Commission Secretary.

(2) The Commission shall investigate the report and takeappropriate action within ninety days of receiving the report.

2.31 Enforcement of the Code

(1) Any person may lodge a complaint alleging a breach of thisCode by a State Officer to the Commission, the Ethics and Anti-Corruption Commission or National Assembly.

(2) Breach of this Code amounts to misconduct for which the StateOfficer may be subjected to disciplinary proceedings including removalfrom office according to the relevant written laws.

(3) Where a breach of this Code amounts to a violation of theConstitution, the State Officer may be removed from office in

accordance with Article 95(5)(a) and /or Article 251 of theConstitution.

(4) Subject to the Constitution, the Leadership and-Integrity Act, orany other related law a State Officer who is under investigation forbreach of this Code, shall be suspended from office until suchinvestigations are completed.

FIRST SCHEDULE (Clause 10(10)

REGISTRABLE INTERESTS

I . Directorships in public or private companies, whether or notremunerated directly or indirectly.

2. Remunerated employment (including office, trade, profession orvocation which is remunerated or which the State officer has anypecuniary interest).

3.Securities (shares, bonds, debentures or any other similar holding)in a company or enterprise or undertaking the aggregate nominal ormarket value of which exceeds a prescribed value while the stateofficer was in office.

4. Contracts for supply of goods and services.

5. Plans or expectations for or offers of future employment.

6. Public affairs advice and services to clients.

7. Shareholdings (amounting or not amounting to a controllinginterest).

8. Land and property.

9. Sponsorship (from companies, trade unions, professional bodies,charities, universities or other organizations or individuals).

10. Travel facilities and overseas visits (made by a State officer orthe State officer's spouse or child substantially catered for by the officeof the State officer).

11. Gifts, benefits and hospitality (to a State officer or the Stateofficer's spouse or partner or child or any other material benefit of aprescribed value, from a, company, organization or person within Kenyaor overseas, which relates substantially to the membership of a stateoffice to a state office or Parliament or County Assembly).

12. Miscellaneous financial interests (not falling within the abovecategories but which a reasonable member of the public would thinkmight influence the conduct of a State Officer in his office).

13. Non-financial interests (which may reasonably be thought toaffect the way a member discharges the duties in a State Office (such asunremunerated directorships; membership of public bodies such ashospital trusts, governing bodies of universities, colleges or schools,and other spheres of government; trusteeships, etc.).

14. Pending civil and criminal cases touching on the State officer orbusiness associate or firm.

15. Possession of dual citizenship or pending applications for dualcitizenship and the status of such application.

THE ENVIRONMENTAL MANAGEMENT ANDCO-ORDINATION ACT

THE NATIONAL ENVIRONMENT MANAGEMENT AUTHORITY

ENVIRONMENTAL IMPACT ASSESSMENT STUDY REPORTFOR THE PROPOSED NITHI SMALL RIVER HYDRO POWER

PROJECT IN THARAKA NITHI COUNTY.

INVITATION OF PUBLIC COMMENTS

PURSUANT to Regulation 21 of the Environmental Managementand Co-ordination (impact Assessment and Audit) Regulations, 2003,the National Environment Management Authority (NEMA) hasreceived an Environmental Impact Assessment Study Report for theabove proposed project.

The proponent, Frontier Investment Management, is proposingNithi Small River Hydro Power Project, in Tharaka Nithi County. TheProject will consist of the following elements of infrastructure: Anintake structure, A low pressure pipeline which will follow the contour,A de-sanding structure; A buffer tank, A steel penstock (high-pressurepipeline), a power station and a power transmission line. The intakestructure; low pressure pipeline, de-sanding structure and buffer tankwill be constructed within the MKFR while the penstock and the powerstation will be constructed within the farming zone outside the MKFRboundary.

The following are the anticipated impacts and proposed mitigationmeasures:

Increased soil erosion • Install soil erosion control structures like

• Install and regularly empty sedimenttraps in surface drains of theconstruction areas. The contractorshould construct sediment traps alongthe pipeline route on the steep slopes toprevent and/or arrest any falling debris,soil or rocks from reaching the river andother smaller watercourses.

• Proper design for storm water drainagefacilities and maintenance during theconstruction phase are critical formitigation.

• Disposal of excavated/cut soil should beundertaken outside fragile ecosystemsand water sources, under the direction ofthe resident engineer who shouldapprove disposal sites.

• Construction during heavy rains shouldbe avoided as much as is possible aswater logged soils are easily eroded.

• Labour-intensive methods of excavationshould be applied on the steep slopes,where necessary, to minimizedisturbance of the soil by constructionmachinery.

• Revegetation of areas whereconstruction has been completed musthappen as early as possible andprogressively as the construction frontfor the low pressure pipeline moves.

• Soil erosion control measures that have -been installed during construction mustbe maintained and/or altered duringoperation to ensure that they remaineffective.

Air quality impacts Implement a journey management planto include speed limits, as trucks movingat a low speed will generate less dust.Speed bumps must be Installing speedbumps at selected locations in order to

reduce traffic speed, particularly nearsensitive receptors such as schools andclinics.

• Dust in areas with sensitive receptorsmust also be controlled by regularly (atleast daily) sprinkling water during dryperiods.

• The existing access track will beupgraded to an all-weather standard upto the position of the buffer tank — thus,dust—generation in the MKFR during thedry season will be reduced.

Poaching and logging Incorporate wildlife awarenesstrain ing/sensitization programmes intothe Contractor's ESMP to addresspossible pressures on wildlife.

• Implement education programmes forconstruction workers on, inter alia:respect for wildlife and vegetation,avoidance of fires and accidentaldamage, and generally restricting thefootprint of the construction camp andwork areas to that which is required.

• The existing access road into the forestmust be upgraded only as far as theproposed position of the buffer tank.The only other road that may beconstructed is the road along the lowpressure pipeline route (on top of thepipeline). No other roads may beconstructed inside the MKFR.

• The contractor and all other relatedpersonnel must be accompanied by aKFS—appointed guard at all times whenentering the MKFR and must haveappropriate identification as agreed withthe KFS.

• Apart from the KFS guard that willaccompany the construction team, nofirearms may be taken into the MKFR.

• The developer must develop andimplement a site access plan toprohibit/control public access into theMKFR. This plan must be developed incollaboration with the KWS and KFS toestablish effective regulation of entry tothe MKFR.

Impacts on terrestrial During construction, terrestrial faunafauna habitat disturbance should be minimised

by restricting the project activities toonly the maximum area required;

• Working in bits to avoid long exposureof open trench to wild animal and inaddition pits should be well barricadedovernight or during other work-offhours. Any borrow pits or geotechnicalsurvey pits dug inside the national parkshould be restored to avoid animalinjuries and death;

• To minimise death of fauna, vegetationclearance should always be undertakenfirst, as this scares away most of thefauna, as opposed to direct use ofgraders to clear routes for access roadconstruction, or direct dumping ofconstruction materials and excavatedsoils;

• The Developer should engage KWS andKFS supervisory construction crewshould work closely with KWS and KFSofficials to ensure no Hunting.

• The construction crew should beencouraged and sensitized not to harassamphibians and reptiles.

• NHPL should ensure that all wastesgenerated during construction activitiessuch as conductors, steel and metallicbars, insulators and other accessoriesassociated with transmission lines, arecollected and disposed of appropriatelyat designated sites by a NEMA licensedwaste handler.

• All sanitary and food waste generated atlabour campsites shall be collected andtransported by the contractor todesignated landfills/dumping siteswithin the project area; Some domesticwaste will be, all plastic waste generatedat campsites and in the course ofundertaking works such as mineralwater bottles, polyethylene bags, jerrycans, should be collected and sold eitherto the local people for re-use or takenfor recycling in respective factories.NHPL must ensure that non-biodegradable waste is not disposed ofin water bodies.

• Human excreta should be managedusing a mobile toilet and then disposedin pit latrines. Human waste must not belittered in bushes and water bodies.

IMPORTANT NOTICE TO SUBSCRIBERS TOTHE KENYA GAZETTE

THE following notes are for the guidance of persons submitting "copy" for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya GaZetre contains Notices of a general nature which do notaffect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which areissued by the Central Government. Because of this, they must be

submitted to the Government Printer through the office of the

Attorney-Getieral.

(3) Hill Supplement contains Bills which are for introduction in theNational Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All "copy" submitted for publication should be prepared on one side of an A4

sheet no matter how small the Notice is, each page being numbered and should be

typewtitten with double spacing. Copy should be clear, legible and contain no

alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name of

the signatory in capital letters.

(iiust be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION 13—

Kenya Gazette

"D 34. (1) Communications for the Kenya Gazette should reach theGovernment Printer not later than 9 a.m. on Friday of the week before publication

is desired, The Government Printer will not publish communications received

after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet thecost of advertising in it.

It is Omphasized that these notes ate for guidance only, but it is requested that

persons submitting copy for publication first satisfy themselves that such copy is

complete in

every respect.
