The following are the anticipated impacts and proposed mitigationmeasures:
Environmentall Social Mitigation MeasureIssue
Increased soil erosion • Install soil erosion control structures like
and landslides gabions and check dams.
• Install and regularly empty sedimenttraps in surface drains of theconstruction areas. The contractorshould construct sediment traps alongthe pipeline route on the steep slopes toprevent and/or arrest any falling debris,soil or rocks from reaching the river andother smaller watercourses.
• Proper design for storm water drainagefacilities and maintenance during theconstruction phase are critical formitigation.
• Disposal of excavated/cut soil should beundertaken outside fragile ecosystemsand water sources, under the direction ofthe resident engineer who shouldapprove disposal sites.
• Construction during heavy rains shouldbe avoided as much as is possible aswater logged soils are easily eroded.
• Labour-intensive methods of excavationshould be applied on the steep slopes,where necessary, to minimizedisturbance of the soil by constructionmachinery.
• Revegetation of areas whereconstruction has been completed musthappen as early as possible andprogressively as the construction frontfor the low pressure pipeline moves.
• Soil erosion control measures that have -been installed during construction mustbe maintained and/or altered duringoperation to ensure that they remaineffective.
Air quality impacts Implement a journey management planto include speed limits, as trucks movingat a low speed will generate less dust.Speed bumps must be Installing speedbumps at selected locations in order to
reduce traffic speed, particularly nearsensitive receptors such as schools andclinics.
• Dust in areas with sensitive receptorsmust also be controlled by regularly (atleast daily) sprinkling water during dryperiods.
• The existing access track will beupgraded to an all-weather standard upto the position of the buffer tank — thus,dust—generation in the MKFR during thedry season will be reduced.
Poaching and logging Incorporate wildlife awarenesstrain ing/sensitization programmes intothe Contractor's ESMP to addresspossible pressures on wildlife.
• Implement education programmes forconstruction workers on, inter alia:respect for wildlife and vegetation,avoidance of fires and accidentaldamage, and generally restricting thefootprint of the construction camp andwork areas to that which is required.
• The existing access road into the forestmust be upgraded only as far as theproposed position of the buffer tank.The only other road that may beconstructed is the road along the lowpressure pipeline route (on top of thepipeline). No other roads may beconstructed inside the MKFR.
• The contractor and all other relatedpersonnel must be accompanied by aKFS—appointed guard at all times whenentering the MKFR and must haveappropriate identification as agreed withthe KFS.
• Apart from the KFS guard that willaccompany the construction team, nofirearms may be taken into the MKFR.
• The developer must develop andimplement a site access plan toprohibit/control public access into theMKFR. This plan must be developed incollaboration with the KWS and KFS toestablish effective regulation of entry tothe MKFR.
Impacts on terrestrial During construction, terrestrial faunafauna habitat disturbance should be minimised
by restricting the project activities toonly the maximum area required;
• Working in bits to avoid long exposureof open trench to wild animal and inaddition pits should be well barricadedovernight or during other work-offhours. Any borrow pits or geotechnicalsurvey pits dug inside the national parkshould be restored to avoid animalinjuries and death;
• To minimise death of fauna, vegetationclearance should always be undertakenfirst, as this scares away most of thefauna, as opposed to direct use ofgraders to clear routes for access roadconstruction, or direct dumping ofconstruction materials and excavatedsoils;
• The Developer should engage KWS andKFS supervisory construction crewshould work closely with KWS and KFSofficials to ensure no Hunting.
• The construction crew should beencouraged and sensitized not to harassamphibians and reptiles.
2430 THE KENYA GAZETTE 9th October, 2015
Structures to be constructed withinMFKR (a part from the weir) should beburied to minimize visual intrusion anddanger to terrestrial fauna.
Impacts on fresh water * During construction, aquatic faunaecology habitat disturbance should be minimised
by restricting the project activities toonly the specific areas of the riverrequired;
• Implement soil erosion control measuresand reduce soil disturbance duringconstruction activities by constructingsediment traps;
• Install and regularly empty sedimenttraps in surface drains in and aroundroads and construction areas;
• Proper design for storm water drainagefacilities and maintenance during theconstruction phase are critical formitigation;
• Disposal of cut soil should beundertaken outside fragile ecosystemsand water sources downstream, underthe direction of the resident engineerwho should approve disposal sites;
• Design and implement an agreedcompensational flow regime (withWRMA) during operation;
• Manage operations . to avoid rapidfluctuations in downstream flow;
• There should be periodic monitoring ofwater flow, quality and temperaturedownstream to ascertain the rightaquatic ecosystem conditions.
• Conduct a periodic monitoring of waterflow, quality and temperaturedownstream to ascertain the extent towhich aquatic ecosystem conditionsmay have been changed.
Waste handling In line with NEMA's WasteManagement Regulations, wastegenerated during construction andoperation should be sorted(biodegradable, non-biodegradable,Metals, Glasses) by the contractor anddisposed of appropriately at designatedwaste disposal sites.
• NHPL should ensure that all wastesgenerated during construction activitiessuch as conductors, steel and metallicbars, insulators and other accessoriesassociated with transmission lines, arecollected and disposed of appropriatelyat designated sites by a NEMA licensedwaste handler.
• All sanitary and food waste generated atlabour campsites shall be collected andtransported by the contractor todesignated landfills/dumping siteswithin the project area; Some domesticwaste will be, all plastic waste generatedat campsites and in the course ofundertaking works such as mineralwater bottles, polyethylene bags, jerrycans, should be collected and sold eitherto the local people for re-use or takenfor recycling in respective factories.NHPL must ensure that non-biodegradable waste is not disposed ofin water bodies.
• Human excreta should be managedusing a mobile toilet and then disposedin pit latrines. Human waste must not belittered in bushes and water bodies.
Community land take for
Comply with the Public Road andthe upgrading of the Access Act (Cap 399) that relates to the
access road to the dedication, conservation and alignment
power station access roads adjacent to land from thenearest part of a Public Road.
• Consultation with the Tharaka NithiCounty on road development within theproject area.
• Assess changes in traffic in the area anddevelop a traffic management plan; andall altered areas caused by roadconstruction must be rehabilitated.
• Consultation with them communitymembers to identify whether therewould be a need to carry out aResettlement Action Plan (RAP).
Social cohesion and Develop a strong communicationintegration strategy which should entail working
with local leaders among others in a bidto counter stereo-types and othernegative practices.
• There should be communityempowerment through participation andengagement through a bottom-upconsultation process.
• Promoting and development meaningfulinteraction and "bridging" activitiessuch as education, sports, recreationalleisure aciivities
• Mapping communities to ensureallocation of resources are doneappropriately and equitably.
• There should be a conflict resolutionplanning to prevent anticipatedproblems.
• Ensure that response to crisis are done ina timely manner averts a lot of adverseeffects. This can be achieved throughputting in place a communityintelligence monitoring system.
• Proponent should have in place disasterpreparedness and conflict preventionand management strategies in place.
Health and safety All workers, including Sub-contractorsand casual labourers should undergo anEnvironment, Health and Safety (EHS)induction before commencing work onsite, which should include a full briefingon site safety and rules;
• Personnel should only undertake tasksfor which they are trained/qualified anda formal permit to work' system will bein place.
• Routine toolbox talks should beconducted on different topics for allworkers prior to the start of theconstruction phase.
• All accidents, near misses and incidentsshould be recorded and such recordsmaintained as part of a health and safetymanagement programme.
• The required PPE should be providedand will be worn by personnel.
• Local community members will berequested to suspend their activitieswithin the project footprint during theconstruction phase. This is mainly fortheir safety.
• A detailed construction schedule withassociated activities will be developedand communicated to all affectedindividuals.
