THE COUNTY COUNCIL OF DURHAM(VARIOUS STREETS – ST. PAULS AND THE TREES ESTATE, SPENNYMOOR)

(20 MPH SPEED LIMIT) ORDER 2017

The Council proposes to make an Order under Sections 81, 82, 84 & 87 of the Road TrafficRegulation Act 1984, the effect of which is to introduce a 20mph speed limit on (A) the full lengthsof the following roads: Ash Grove, Beech Avenue, Belle Vue Street, Charles Street, ChestnutAvenue, Edward Street, Flora Street, Oak Terrace, Rear Osborne Road, Princess Street, RosaStreet, St Paul’s Close, St Paul’s Court, St Paul’s Gardens, Todd Street and Vyner Street; and (B)part lengths of roads (incl. all side streets and back lanes) on the following streets: Osborne Roadfrom a point 8m south of its junction with C152 Clyde Terrace, in a southerly direction, for its entirelength; Belle Vue Villas from a point 13m north of its junction with C152 Whitworth Terrace, in anortherly direction, for its entire length; Beech Avenue from a point 9m east of its junction with C95Rock Road; St Paul’s Street from a point 20m north of its junction with C152 Whitworth Terrace, ina northerly direction, for its entire length; Rear C152 Whitworth Terrace from its junction with UncSt Paul’s Street, in a north easterly direction, to its junction with Unc Charles Street.

Statement of Reasons

Durham County Council as Highway Authority propose to make the above order indischarge of its duty under Section 122 of the Road Traffic Regulation Act 1984, “to securethe expeditious, convenient and safe movement of vehicular and other traffic (includingpedestrians)”, in accordance with the provisions of Section 1(1) of the Road TrafficRegulation Act 1984 namely:-

(a) for avoiding danger to persons or other traffic using the road or anyother road or for preventing the likelihood of any such dangerarising, or

(b) for preventing damage to the road or to any building on or near theroad, or

(c) for facilitating the passage on the road or any other road of anyclass of traffic (including pedestrians), or

(d) for preventing the use of the road by vehicular traffic of a kindwhich, or its use by vehicular traffic in a manner which, isunsuitable having regard to the existing character of the road oradjoining property, or

(e) (without prejudice to the generality of paragraph(d) above) forpreserving the character of the road in a case where it is speciallysuitable for use by persons on horseback or on foot, or

(f) for preserving or improving the amenities of the area through whichthe road runs; or

(g) for any of the purposes specified in paragraphs (a) to (c) ofsubsection (1) of section 87 of the Environment Act 1995 (airquality).

The County Council of Durham (“the Council”) in exercise of their powers under Sections81, 82, 84 & 87 of the Road Traffic Regulation Act 1984, as amended, (“the Act”) and allother enabling powers and after consultation with the Chief Officer of Police inaccordance with Part III of Schedule 9 to the Act, hereby make the following Order:-

PART IGENERAL

Citation and Commencement

1. This Order may be cited as The County Council of Durham (Various Streets – St.Pauls and The Trees Estate, Spennymoor) (20 MPH Speed Limit) Order 2017and shall come into operation on the day of 20

.

PART IISPEED LIMIT

Imposition of 20mph Speed Limit

2. No person shall cause or permit any vehicle to proceed at a speed exceeding20mph on the lengths of roads specified in the Schedule to this Order.

PART IIIExemptions

3. No statutory provision imposing a speed limit on motor vehicles shall apply to anyvehicle on an occasion when it is being used for fire & rescue service, ambulanceor police purposes, if the observance of that provision would be likely to hinderthe use of the vehicle for the purpose for which it is being used on that occasion.

4. No speed limit imposed by this order applies to vehicles falling within regulation3(4) of the Road Traffic Exemptions (Special Forces) (Variation and Amendment)Regulations 2011 when used in accordance with regulation 3(5) of thoseRegulations.

PART IVSavings

5. Insofar as any provision of this Order conflicts with any provision which iscontained in an Order made or having effect as if made under the Act or by orunder any other enactment then the provisions of THIS Order shall prevail.

6. The restrictions imposed by this Order shall be in addition to and not inderogation from any restriction or requirement imposed by any regulations madeor having effect as if made under the Act or by so under any other enactment.
