The County Assembly of Nyamira Committee on Appointments is constituted pursuant to the provisions of Standing Order No. 185 (1) and has executed its mandate in accordance with the provisions of the said Standing Order 185.

FORMATION & MANDATE OF THE COMMITTEE ON APPOINTMENTS

Mr. Speaker, Sir

The Committee on Appointments is constituted and draws its mandate from the provisions of the County Assembly Standing Order No. 185 (4);

185.(4) The Committee on Appointments shall consider, for approval by the County Assembly, appointments under Articles 179(2), Constitution of Kenya, 2010.

LEGAL FRAMEWORK

Mr. Speaker, Sir

The Committee confined its activities within the following statutes,inter alia;

(i) Chapter 6 of the Constitution of Kenya, 2010 onLeadership and Integrity.

(ii) Article 232 of the Constitution of Kenya, 2010.

(1) The values and principles of public service include— (a) high standards of professional ethics;

(b) efficient, effective and economic use of resources;

(c) responsive, prompt, effective, impartial and equitable provision of services;

(d) involvement of the people in the process of policy making;

(e) accountability for administrative acts;

(f) transparency and provision to the public of timely, accurate information;

(g) subject to paragraphs (h) and (i), fair competition and merit as the basis of appointments and promotions;

(h) representation of Kenya’s diverse communities; and

(i) affording adequate and equal opportunities for appointment, training and advancement, at all levels of the public service, of––

(i) men and women;

(ii) the members of all ethnic groups; and

(iii) persons with disabilities.

(2) The values and principles of public service apply to public service in—

(a) all State organs in both levels of government; and

(b) all State corporations.

(iii) Section 8(1) (a) of the County Governments Act, 2012

8. (1) the county assembly shall —

(a) Vet and approve nominees for appointment to county public offices as may be provided for in this Act or any other law;

(iv) Section 14 (3) of the County Governments Act, 2012

In considering any appointment for which approval of the county assembly is required under the Constitution, an Act of Parliament or county legislation––

(a) the appointment shall be considered first by a committee of the county assembly;

(b) the committee’s recommendation shall be tabled before the county assembly for approval; and

(c) the proceedings of the committee and the county assembly shall be open to the public.

(v) Order No.172 of Nyamira County Assembly Standing Orders.

Powers and privileges of committees

172. Committees shall enjoy and exercise all the powers and privileges bestowed on County Assembly by the Constitution and statute, including the power to summon witnesses, receive evidence and to request for and receive papers and documents from the Government and the public.

(vi)The Committee strictly adhered to the procedures provided for in the Public Appointments (County Assemblies Approval) Act, 2017.

(vii) Section 58, of the County Governments Act, 2012:-

58. Composition of the County Public Service Board

(1) The County Public Service Board shall comprise—

(a) a chairperson nominated and appointed by the county governor with the approval of the county assembly;

(b) not less than three but not more than five other members nominated and appointed by the county governor, with the approval of the county assembly; and

(c) a certified public secretary of good professional standing nominated and appointed by the governor, with the approval of the county assembly, who shall be the secretary to the board.

(2) The appointment of the members of the Board shall be through a competitive process.

(3) A person shall be qualified to be appointed as a member under subsection (1) if that person—

(a) satisfies the provisions of Chapter Six of the Constitution;

(b) is not a state or public officer;

(c) in the case of chairperson or vice-chairperson, possesses a minimum qualification of a bachelor’s degree from a recognised university and Work Experience of not less than ten years; and

(d) in the case of any other members—

(i) possesses a minimum of a bachelor’s degree from a recognised university and Work Experience of not less than five years; and

(ii) is a professional, demonstrates absence of breach of the relevant professional code of conduct.

(4) A member of the Board shall—

(a) hold office for a non-renewable term of six years; and

(b) may serve on a part-time basis.

(5) The members of the Board may only be removed from office—

(a) on grounds set out for the removal of members of a constitutional commission under Article 251(1) of the Constitution; and

(b) by a vote of not less than seventy five percent of all the members of the county assembly.

(6) The board shall elect a vice-chairperson from amongst its members.

(7) The chairperson and vice-chairperson shall be of opposite gender.

1.0 INTRODUCTION

1.1 Notification by the Governor of the Nominees to the County Public Service Board

Mr. Speaker, Sir

Pursuant to Article 179 (2) of the Constitution of Kenya 2010 and Section 6(1) of the Public Appointments (County Assemblies Approval) Act 2017, H.E., the Governor forwarded to the Clerk of the County Assembly of Nyamira 7 nominees to the County Public Service Board vide letters dated 26th October, 2018(Annex 1); 18th March, 2019(Annex 2); and 17th June 2019 (Annex 3) for approval by the County Assembly and subsequent appointment as per the table below.

1.2 Notification to the Nominees and Members of the Public

Mr. Speaker, Sir

On 30th November, 2018(Annex 4);27th April 2019(Annex 5) and 24th June 2019(Annex 6), the Clerk of County Assembly of Nyamira, Pursuant to Section 6(2) and 7(4) of the Public Appointments (County Assemblies Approval) Act of 2017, through advertisements in Newspapers, notified the Nominees and Members of the Public of the time and place for holding of the approval hearings.

The Clerk in the same advertisements, notified the Members of the Public of Section 7(10) of the same Act which provides that “any person may, prior to the approval hearing, and by written statement on oath, provide the Clerk with evidence contesting the suitability of a candidate to hold the office to which the candidate has been nominated”

The Committee complied with the constitutional requirements, legal provisions and established procedures throughout the vetting process. The Committee facilitated the attendance of the public and embraced openness in the entire vetting process.

2.0 COMPLIANCE WITH STATUTORY REQUIREMENTS

Mr. Speaker, Sir

The Approval Hearings were conducted on various dates as notified to the Nominees and Members of the Public (Annex 4, 5 & 6). The Committee was guided by among other laws and statutes, the Public Appointments (County Assemblies Approval) Act, 2017.

Mr. Speaker, Sir

The Select Committee on Appointments examined the nominees following the guidelines below:

i) Academic qualifications ii) Employment record and work experience iii) Professional associations iv) Public office, political activities and affiliations v) Potential conflict of interest vi) Knowledge of relevant subject vii) Suitability to the positions viii) Tax compliance ix) Integrity

2.1 Committee Preliminary Observations

Mr. Speaker, Sir

Before commencement of the Approval Hearings, the Committee made the following preliminary observations and findings:

2.1.1 Statutory Requirements for Nominees

Mr. Speaker, Sir

(i) The nominees had the requisite qualifications and experience as required by law. (ii) That the nominees met the requirements of Chapter Six of the Constitution of Kenya (2010):

Tax Compliance Certificate, Police Clearance Certificate, Clearance by Higher Education Loans Board, Clearance by the Ethics and Anti-Corruption Commission (EACC) and Credit Reference Bureau (CRB).

2.1.2 Petitions against the Candidates

Mr. Speaker, Sir

The Committee received two letters contesting the suitability of candidates. The first letter from one AbugaMakori of P.O. Box 127-40503,Gesima, dated 25th June 2019 which letter was neither signed nor drawn as per the required format. The Second letter from one Charles Ondieki of P.O.Box 91,Kebirigo, was not drawn as per the required format. Both letters were struck out for want of legal threshold for public petitions as prescribed in the Third Schedule of the County Assembly Standing Orders.

2.1.3 Committee Observations on Procedural Compliance under Section 58 (1(a), 2 & 3) of County Governments Act, 2012

Pursuant to Section 58(2) of the County Governments Act which thus states:

The appointment of the members of the Board shall be through a competitive process.

The Committee confirmed that the Appointing Authority adhered to the law after verification of documents submitted as hereunder:

3.0 VETTING OF DR. PETER ONCHARI KERERI – NOMINEE FOR CHAIRPERON COUNTY PUBLIC SERVICE BOARD.

3.1 Nominee Personal Details

Mr. Speaker, Sir

The Nominee is a male adult aged 45 years, married and hails from Nyansiongo Ward.

3.2 Academic, Professional Qualifications and Work Experience

Mr. Speaker, Sir

Dr. Peter OnchariKereri is a holder of PhD in Business (Accounting) from the Adventist International Institute of Advanced Studies, Philipines; a Master in Business Administration (Accounting Option) from the University of Eastern Africa Baraton and a Bachelor of Business Administration (Accounting & Finance Option) from Kenya Methodist University. In addition, the nominee is a Certified Public Accountant (CPA) Graduate.

The nominee has worked in Adventist University of Africa as Chief Finance Officer/Lecturer (2008to date). He also worked in Kisii Bottlers Limited as a Credit Controller (June – November 2008). Further he worked at Western Kenya Conference of SDA Church (January 2002 – June 2008).

The nominee has served as a board member in several boards and schools, notably in a Ministerial Audit Committee and Chairperson- Nyamira County Audit Committee, among others.

3.3 Committee Findings on Dr. Peter OnchariKereri

Mr. Speaker, Sir

The Committee found the Nominee to be academically qualified. He has the requisite experience and therefore, can handle the portfolio of Chairperson, County Public Service Board.

The Nominee has an in-depth understanding and interest in the portfolio he is nominated to. He is knowledgeable, coherent, eloquent and articulate in addressing issues. He exhibited intellectual prowess to solve issues amicably.

He scored an average of 83.0% from the assessment made by five Members of the Select Committee on Appointments using Schedule 2 criteria set out in the Public Appointments (County Assemblies Approval) Act, 2017.

3.4 Committee Recommendation

Mr. Speaker, Sir

In view of the above, the Committee recommends for the approval of the Nominee,Dr. Peter OnchariKereri for appointment to the position of Chairperson, County Public Service Board.

4.0 VETTING OF MS. ANNAH KERUBO MWASI – NOMINEE FOR SECRETARY/CEO, COUNTY PUBLIC SERVICE BOARD.

4.1 Nominee Personal Details

Mr. Speaker, Sir

The Nominee is a female adult aged 50 years old, married and hails from Gesima Ward.

4.2 Academic, Professional Qualifications and Work Experience

Mr. Speaker, Sir

Ms. AnnahKeruboMwasi is a holder of Masters in Business Administration (Strategic Management) from the University of Nairobi and a Bachelor of Commerce (Accounting &Auditing Option) from Marathwada University, India. The nominee is currently pursuing a PhD in Strategic Management at the University of Nairobi.

In addition, the Nominee is a Certified Public Secretary, Certified Internal Audit Quality Assessor, a member (in good standing) of the Institutes of Certified Secretaries and Internal Auditors; among other certifications.

The nominee has worked as a Chief Internal Auditor in Musoni Microfinance Organisation (August 2010 –February 2018). She also worked as Group Chief Finance and Administration Officer at Jamii Bora Micro-Finance (August 2007-August 2010). In addition, the nominee worked as Senior Auditor in PFK Audit Firm (January 2002- December 2006).

4.3 Committee Findings on Ms. AnnahKeruboMwasi

Mr. Speaker, Sir

The committee found the Nominee to be academically qualified.She has the requisite experience and therefore, can handle the portfolio of CEO/Secretary, County Public Service Board.

The Nominee has an in-depth understanding and interest in the portfolio nominated to. She is coherent, eloquent and articulate in addressing issues. She exhibited ability to solve matters amicably.

She scored an average of 82.5% from the assessment made by the Select Committee on Appointments using Schedule 2 criteria set out in the Public Appointments (County Assemblies Approval) Act, 2017.

4.4 Committee Recommendation

Mr. Speaker, Sir

In view of the above, the Committee recommends for the approval of the nominee Ms. AnnahKeruboMwasi for appointment to the position of CEO/Secretary, County Public Service Board.

5.0 VETTING OF MRS. MARY MORAA MAMBOLEO– NOMINEE FOR MEMBER COUNTY PUBLIC SERVICE BOARD.

5.1 Nominee Personal Details

6.0 The Nominee is a female adult aged 47 years old, married and hails from Nyamaiya Ward. 6.0 Academic, Professional Qualifications and Work Experience

Mr. Speaker, Sir

Mrs. Mary Moraa Mamboleo is a holder of a Bachelor of Education in Early Childhood and Primary Education from Moi University. She is a holder of Diploma in Early Childhood Development and Education from KerichoDistrict Center for Early Childhood Education (DICECE). The nominee is currently pursuing a Masters in Early Childhood Development and Education at Kisii University.

The nominee has worked as a part-time lecturer at the following Universities: Mt. Kenya University - Kisii Campus (2015 -2017); Bugema University - Kisii Campus (2014 -2015); Kisii University (2014 – to date); Great Lakes University (2012-2013) and Technical Institute College (2010-2011).

6.1 Committee Findings on Mrs. Mary MoraaMamboleo

Mr. Speaker, Sir

The Committee found the Nominee to be academically qualified for the position.

The Nominee demonstrated ability to serve. She has an in-depth understanding and interest in the portfolio she is nominated to,albeit her weak emotional character.

She scored an average of 69.8% from the assessment made by the Select Committee on Appointments using Schedule 2 criteria set out in the Public Appointments (County Assemblies Approval) Act, 2017.

5.4 Committee Recommendation

Mr. Speaker, Sir

In view of the above, the Committee recommends for the approval of the nominee Mrs. Mary MoraaMamboleo for appointment to the position of Member, County Public Service Board.

7.1 Nominee Personal Details

Mr. Speaker, Sir

The Nominee is a male youth aged 33 years old, married and hails from Manga Ward.

7.2 Academic, Professional Qualifications and Work Experience

Mr. Speaker, Sir

Mr. Erick Ondieki Maroro is a holder of a Bachelor of Education (Arts) from Kenyatta University.

The nominee has worked as a teacher of English and Literature in the following schools: Maagonga SDA (2010-2019), Mutongori Academy, Athi River (May-September 2010), St. Kizito Nyansiongo Boys High School (2009-2010). He also held various positions in the said schools including Director of Studies, Guidance and Counselling and Head of Department among other positions.

7.3 Committee Findings on Mr. Erick OndiekiMaroro

The nominee has worked as a Research Consultant with Ideal Consultants (2018); Director Distance Learning (2013-2017); Deputy Director –Admissions (2011-2013); Liaison Officer (2006-2007); Undergraduate Mentor (2011-2017) - Kampala International University, Nairobi Campus and Assistant Lecturer (Part-time) – Media School Africa (2011 to date).

Mr. David Nyachiro is a holder of Master in Educational Management, a Post-Graduate Diploma in Education and a Bachelor of Arts in Economics. The nominee is currently pursuing a PhD at JaramogiOgingaOdinga University.

The Nominee has worked as a Secondary School teacher in various Secondary schools where he has held various positions including; Head teacher, senior teacher and Deputy Head teacher. He has a total work experience of 24 years.

The Nominee has worked as a part-time lecturer for Early Childhood and Primary Education.

The Committee found the Nominee to be academically qualified.

The Nominee showed interest and relative understanding of the portfolio he is nominated to. He exhibited ability to solve matters amicably.
