1b) NSW RURAL DOCTORS NETWORK – BUSH BURSARY/CWA SCHOLARSHIP

PROGRAM (D.03-01 SC154)

Council has received a request to participate in the Bush Bursary/CWA Scholarship program. This is an annual request that Council has decided not to participate in previously. Council has focused its energies on providing buildings for doctors to consult from. A copy of the letter is attached with the information papers. Attachment No. 9

2b) MICHAEL McCORMACK MP – INQUIRY TO EXAMINE DECENTRALISATION

Forwarding a Media Release in regards to the Inquiry into the relocation of Commonwealth entities into the regions. Generally Council supports such proposals as stronger region are a benefit to the whole nation. A copy of the Media Release is attached with the information papers. Attachment No. 10

4) GENERAL MANAGER’S REPORT

4.1 GENERAL MANAGER REPORTS

GM1) RIVERINA REGIONAL TOURISM (t.03-06, SC427) As Councillors will recall from previous meetings, the ongoing viability of Riverina Regional Tourism (RRT) has been an issue that Council has been discussing.

Provided in the attachments is a copy of the Annual Report and Minutes of the Annual General Meeting held 15th December, 2016 whereby it should be noted that there has been a change in office bearers with Craig Sinclair from Temora Shire Council replacing Greg Lawrence in the position of Chair. Attachment No. 3 In addition to the new Chair, Ross McDonnell was appointed Deputy Chair, Ruth McRae the position of Secretary with the Treasurer being Greg Lawrence. With the changes in funding associated with tourism and the new Regional Tourism Board, Council had resolved to continue with next year’s commitments subject to the majority of other members continuing their support. Recommendation For Council information. GM2) COOLAMON SHIRE COMMUNITIES TOUR (P.11-01, SC315) The Community Tour was conducted on Wednesday, 8th February, 2017 whereby all Communities within the Coolamon Shire were visited and a meeting with the relevant community representatives held. This community visit is part of Council’s Community Consultation and provides information that will link into the annual Budget, the Management Plan and the Community Strategic Plan. It was good to hear from all the communities and understand the concerns and expectations that they have in regard to their communities. The issues raised were all recorded and a response will be sent back to each community indicating how Council will deal with these issues. The draft Community Strategic Plan will be presented to the March Meeting for Council’s comment.

GM3) 2017 AUSTRALIA DAY (A.13-11, SC581) The 2017 Australia Day Awards were conducted in Rannock and all involved should be congratulated on a great morning. Those of special mention were the MC for the event, Brent Rollins and the Rannock Community who supported him. In addition, Mel Mayer was there to make sure the sound system ran efficiently, and with Laura Higgins, Council’s Community Development Officer, the day ran smoothly. The Award winners on the day were as follows:

Citizen of the Year: Anne Trevaskis

Young Citizen of the Year: Tristan O’Brien

Shane Till Memorial Award for Sportsperson of the Year: Karen Leary

Young Sportsperson of the Year: Ellie Dalgarno-Fixter

Community Event of the Year: Ganmain Show Trust

It is now Council’s role to determine who will hold the event for 2018 and accordingly, I have attached both the location of the previous communities where it was held and the indicative location moving forward. Attachment No. 4 Recommendation That Council choose a location for the 2018 event. GM4) TELSTRA SERVICE IN ARDLETHAN (T.02-01, SC412) A Public Meeting arranged by community members was held on the 18th January, 2017 in Ardlethan with Telstra Representatives. The concerns of the community were raised in regard to the continual outages of the Mobile Tower and lack of confidence in Telstra to deliver services to the community. Businesses identified the cost to their operations through lack of phone or eftpos facilities with outages being up to a week at a time, with a total of 21 days since June 2016. The concerns about emergency service provisions and the lack of ability to reliably maintain contact during times of an emergency was of great concern. At the meeting Council spoke in regard to supporting the communities within the Shire and that the lack of a reliable, basic connectivity service was detrimental to the growth and prosperity of the town. At this meeting Chris Taylor, the Southern Area Manager indicated that he would be happy to meet with Council and provide the opportunity to talk or discuss issues and areas of concern. Recommendation That Council invite Chris Taylor, Telstra Southern Area Manager to address the next Meeting. RESOLVED on the motion of Clr McCann and seconded by Clr Logan that Council invite Chris Taylor, Telstra Southern Area Manager to address the next Meeting. 06/02/2017 GM5) KINDRA BIKE AND WALKING TRAIL RISK MANAGEMENT PLAN (C.09-46,

SC624) As a Section 355 Committee of Council, the management of this bike and walking trail has been delegated to the Committee.

In order to ensure that the facility is operated and managed appropriately in accordance with both the requirements of the State Forest and our Public Liability, a Management Plan has been developed to control the operations and set the standards or criteria around Councils use. A copy of the draft Management Plan has been provided for your information. Attachment No. 5

During the creation of this draft document, it has become apparent that the Committee should change the name from the previously named Multipurpose Trail to the Kindra Bike and Walking Trail to more appropriately reflect the use and operation of the area. Recommendation 1) That Council endorse the Kindra Bike and Walking Trail Risk Management

Plan. 2) That the Committee be tasked with undertaking the operations and

management of the Kindra Bike and Walking Trail in accordance with the adopted Management Plan.

3) That the Multipurpose Trails (MPT) Management Committee be renamed

the Kindra Bike and Walking Trail Management Committee. RESOLVED on the motion of Clr Hutcheon and seconded by Clr McCann that: 07/02/2017

Kindra Bike and Walking Trail Management Committee. GM6) RIVERINA REGIONAL LIBRARY – SERVICE LEVEL AGREEMENT (L.03-03,

SC269) Council has received the 2017-2018 Service Level Agreement between Coolamon Shire Council and Riverina Regional Library (RRL) for the provision of Library Services. Whilst this is an operational issue and does not require the formal consent of Council as it can be signed under delegation, it was thought appropriate that the information would be valuable to Councillors on how the RRL operates.

This is an Annual Service Level Agreement and has been operating quite successfully since 2007/2008. A copy of the Service Level Agreement is provided for your information. Attachment No. 11

Recommendation

That Council sign the Service Level Agreement. RESOLVED on the motion of Clr White and seconded by Clr Jones that Council sign the Service Level Agreement. 08/02/2017 GM7) AMALGAMATION DEVELOPMENTS (L.05-05, SC275, L.06-01, SC276) As Councillors are no doubt aware, the State Government through the Premier Gladys Berejiklian made a formal announcement on Tuesday, 14th February, 2017 about the government’s stance on the current Local Government Reform. The announcements relate to the following:

All existing amalgamations will be unchanged (in the city and in regional NSW).

Planned forced amalgamations in regional NSW will not proceed.

Pending forced amalgamations in Sydney that are subject to court proceedings will go ahead, subject to decisions of the courts.

This position obviously has limited impact on the current operations of Coolamon Shire, however, it is noted that there is still some angst with Rural and Regional Communities that believe forced amalgamations are inappropriate and should be reversed. It was refreshing however, to hear the Premier indicate that Local Government in Sydney is completely different to the regions, that they listened long and hard to the voices of Regional NSW and understand that they cannot treat Sydney the same way they treat the bush. If I can paraphrase information provided by Local Government Professionals NSW – ‘We welcome the end of uncertainty around Regional Council amalgamations following the announcement and encourage the Berejiklian-Barilaro Government to focus on delivering reform to improve Council governance, performance and transparency across the entire sector. Amalgamations and the Fit for future process have been a huge drain on local Councils. The reform process began in late 2011 with the entire local government sector coming together to develop real and lasting solutions. Regrettably, the focus shifted toward amalgamations, overshadowing the need for foundational reform.

CS2) EXTERNAL AUDITOR (A-12-01, SC34) Council has been advised by the Audit Office of NSW that Crowe Horwath has been appointed as its External Auditor for the next two years with an option to extend for a further 2 years. The lead partner is Bradley Bohun from the Albury Office of Crowe Horwath. Council staff have attended a number of conferences held by Crowe Horwath over the past few years and Councils previous Auditor has also built up a working relationship with the firm in relation to Local Government Auditing. An electrical shutdown is scheduled for 14th February, 2017 and will complete the installation of the electrical service. The internal road has also received a seal and is completed. Site levelling/cleanup is to follow in the coming week and will bring the construction phase of the Subdivision to a conclusion. ES5) NOXIOUS WEEDS REPORT (N.02-01) Senior Weeds Officer, Robert Ferguson Reports

Roll out of new mapping system has continued with priority sites and weed locations being added.

RENWA has employed Jane Goldsworthy on a part time basis to assist with private property inspections, she has been on-board for a month and has been trained in the use of our mapping and DPI BIS system.

All Coolatai and Prairie Ground Cherry has been inspected, treated and mapped, two new small PGC sites were discovered and two previously known sites showed no sign of infestation at time of inspection.

ES6) FACILITIES MAINTENANCE OFFICER’S REPORT (P.01-01) Facilities Maintenance Officer Reports

Staff were busy in December preparing all towns for the Christmas period and Coolamon for New Year’s Eve Celebrations.

Mowing has been continual over the past month.

Treated effluent supplies are holding up well and storage capacity may well be an issue later in the year.

Recently staff were involved in setting up the community garden ready for its opening.

Asset Maintenance – Bollards have recently been installed at the Touch Fields to prevent vehicles from driving on the touch fields and causing damage.

Several home modification jobs have been completed recently.

Unit 24 and Unit 6 at the Allawah Retirement Village have recently been refurbished. This work included new paint, carpet and vinyl throughout.

ES7) ROUTE ASSESSMENT – BYGOO ROAD (KEOGH AVENUE TO STEWARTS LANE) (R.09-02, SC336)

At the December 2016 Ordinary Meeting of Council, Clr Jones presented a

petition raised by Doug Peacock for the upgrade of Bygoo Road from Spry’s Lane to the Ardlethan Township due to the extremely dangerous condition of the road. Attachment No. 6.1 The petition contained 94 signatures with individuals from Ardlethan, Tallimba, Beckom, Narrandera, Kamarah, Henty, West Wyalong, Grong Grong, Walleroobie, Wagga Wagga, Illabo, Junee, Griffith, Coolamon, Leeton, Moombooldool and Barellan. Coolamon Shire Council is the road authority of Bygoo Road up to Stewarts Lane with Bland Shire Council responsible for the remaining 1.26kms up to Spry’s Lane. Bygoo Road within the Coolamon Shire is currently approved for B-Double as is all other Coolamon Rural Sealed Roads. A-Double Road Trains can be considered on completion of the Fixing Country Road (FCR) Bygoo Road Realignment Project where a number of route constraints that exist in the urban area will be removed on its completion. Bland Shire Council has widespread approval of road trains which includes Bygoo Road, Coolamon Shire has received numerous requests for road train approval which it has resisted over the years due to unknown structure strength and unsuitable intersection geometry in the urban areas. The FCR project will remove the constraints and allow Council to consider the more efficient vehicles upon application. For Council to ascertain the suitability of Bygoo Road for various vehicle types, Roads & Maritime Services produce the Route Assessment Guide for Restricted Vehicles (Guide), is accepted as the industry standard and been utilized by Council in assessing the suitability of Restricted Access Vehicles on Council’s Road Network. A thorough route assessment has been performed with a summary report provided and the following explanatory notes of the detailed relevant conditions. See Attachments. Attachment No. 6.2 2.2) LEGAL/REGULATORY

2.2.1 Vehicle B-Doubles are vehicles which satisfy the current regulations and are a commonly used vehicle across Councils and States Road Network, Bygoo Road is an existing approved B-Double route. A-Double Road Trains up to 36.5m are an accepted type 1 vehicle of the National Heavy Vehicle Regulator (NHVR) with approval on select routes in

Temora Shire, widespread approval within Bland Shire and regions west of the Newell Highway. Roads & Maritime Services (RMS) provide mapping of approval Restricted Access Vehicles (RAV) routes and attached are plans of approved B-double and type 1 A-Double routes. Attachment No. 6.3

2.2.2 Zoning of Land Road Reserve of route is classified as a Council Public Road, zoning is approved for vehicles and freight movements and as the road authority, Council is the responsible authority for assessing and approving appropriate vehicle types.

2.3) ROAD SAFETY ISSUES

2.3.1 At Terminals

The identified section of Bygoo Road does not involve any terminal access/egress points but it should be noted that with recent Development Applications submitted to Council by both Graincorp and Emerald Grain, allowances have been made for vehicle tyres up to A-Double at access/egress points in addition to internal vehicle movements.

2.3.2 Road Safety Assessment A desk top analysis of road crash history over the previous 5 years revealed a single crash occurred on Bygoo road in 2016. The crash was a fatality, occurred at culvert 3.29kms, travelling in northerly direction under fine weather conditions and at approximately 6.00pm. Police and detailed crash report identify speed as a factor. Attachment No. 6.4

Going back to 1996 no additional crash data was observed relating to Bygoo Road and considering the lack of incidents over a 10 year period a Road Safety Audit Report is not warranted. 2.3.3 Road Alignment Bygoo Road is a two lane/two way road with an III AADT (Average Annual Daily Traffic) (8% HV) obtained in June 2011. Vertical inclination is minimal and considered very slightly undulated to flat. Horizontal alignment is generally long straights with four curves at chainages 1.14kms, 1.61kms, 2.04kms and 3.87kms ranging from 400m to 800m radius.

As can be seen all road widths satisfy the guidelines. It should be noted that at culverts (ch 1.89 and 3.29kms), the left hand shoulder narrows to 0.3m and 0.6m respectively but still satisfy the overall formation width requirements. While the total formation widths are satisfactory, the culvert locations are identified with guide posts and may be considered for extension to further improve safety. In comparison sections of Bygoo Road outside of Coolamon, a seal width of 5.8m and carriageway width of 8.2m is observed, these measurements are 0.7m and 1.1m less than Coolamon and do not meet the current guide standards. A narrow shoulder width of 0.3m was also noted at culvert ch5.17. In this regard the length of road in Coolamon Shire Council exceed that in the neighbouring Shire and met all assessment criteria. Attachment No. 6.6 A second requirement for a two way structure is the width ratio and utilizes the following formula: Width Ratio = Approach Road Carriage Width (w) < 1.25 Structure Width Calculated width ratios are located in the above table and are all satisfactory, producing a figure < 1.25. As indicated in 2.3.4(a), the current structure and formation widths satisfy the guide standards but road safety may be further enhanced by extending culvert at ch 1.89 and 3.29 which could be incorporated into the Bygoo Road Realignment Project.

2.3.7 Overtaking Opportunities The guide identifies a desirable distance between overtaking opportunities at an average distance of 30kms and a maximum distance of 50kms. Distances for the vehicle types is obtained from the AustRoads Design Guide and specify required overtaking distances of 930m (B-Doubles) and 990m (A-Double). An assessment indicates that two overtaking opportunities are achievable in the northern part of Council’s 4.87kms of Bygoo Road with sight distances of 1010m and 1440m. These locations are identified on the attached plan. Attachment No. 6.8 2.3.8 Traffic Facilities 2.3.8(a) Signs, Lines and Markings As per the AS 1742.2 Manual of Uniform Traffic Control Devices, intersection warning signs are to be provided in advance of intersection where there is insufficient sight distance along the main road to a vehicle about to enter from the side road. All sight distances are greater than the stopping sight distance standards and intersection warning signage is not warranted. (See 2.3.6) Horizontal curves to be considered as substandard require the advisory speed of the curve to be at least 15kmp less than the 85th percentile speed. The traffic counts obtained in 2011 provide a 85th percentile of 86kph and when applied to the Bygoo Road curves utilising the method described in AS 1742.2 they were determined not to be sub-standard and additional devices are not required. Attachment No. 6.9 All appropriate signage and guideposts are present advising motorists of any hazards present.

The RMS Delineation Guide suggests dividing line markings should be used on sealed pavements 5.5m or more wide, if the AADT is in excess of 300. Traffic counts obtained in June 2011 provided an III AADT. Traffic counts over a two month harvest period would elevate the AADT but even allowing for a 500 AADT for that period the AADT would equate to 170, well below the 300 AADT guide. It is noted Bygoo Road outside of the Shire is not line marked. Attachment No. 6.10 At the time of considering A-Double Road Trains and if approved by Council, these vehicle types are not a type which motorists commonly interact with and consideration of vehicle type advisory signage may be implemented. Considering the lack of incidents (See 2.3.2) and satisfactory road widths and alignment, (see 2.3.4) implementation of safety barriers cannot be justified. 2.3.9 Traffic Interaction with Other Users While local residents are familiar with B-Double operation, interaction with A-Double would be limited, if at all. As mentioned in 2.3.6, implementation of vehicle type advisory signage may be recommended at time of considering A-Double consent. No designated bus stops occur along the route and is the bus operator’s responsibility to perform their own risk assessment in determining appropriate pick up locations. Sufficient locations are available along the route for the bus operator to perform their duties in a safe, satisfactory manner. Provisions for pedestrian blisters has also been made in the Bygoo Road Realignment Project. See Attachment 6.11.

2.5) WORK, HEALTH AND SAFETY

2.5.1 Decoupling Operations On completion of the Bygoo Road realignment, road train constraints that exist will be removed and access will be provided all the way to grain terminals. Currently the constraints require decoupling to occur at the Coolamon/Bland Shire boundary or the transport operator to deliver produce to an alternate grain terminal. Provision of a rest/decoupling area has been provided in the Bygoo road realignment project, this will permit heavy vehicles to decouple and access fuel/food or just rest. See attached project plan. 2.6) EXISTING APPROVED LAND USE

2.6.1 Noise and Vibration Noise from the proposed vehicles should be no more than from the vehicles that are currently operating. The route is already approved for B-Doubles with no history of noise complaints available. An A-Double will not noticeably change vehicle noise and with increased mass, the proposed more efficient vehicles may reduce number of vehicle movements. A degree of vibration exists on Bygoo Road, is considered similar to Councils extended Rural Local Sealed Network, no history of incidents or Heavy Vehicle complaints exist and the road is considered safe and satisfactory. Bygoo Road is inspected on a 6 monthly basis as per Council’s Road Inspection Policy with records back to 2014 noting the only defects identified relating to guideposts. Attachment No. 6.12 Two shoves/saturation points have been noted recently and accomplished as a result of the recent wet winter.

2.7) INFRASTRUCTURE LOADING

2.7.2 Bridge/Culvert Structures Culvert structures of concern to Council were identified for assessment under the Fixing Country Roads (FCR) project in 2015 and found to be of a structural capacity to withstand HML vehicles. Attachment No. 6.13 2.7.3 Pavement Structure Generally Council’s Rural Local Sealed Network were constructed many years ago and are earth formed with minimal pavement depth (<100mm) and a bitumen seal applied. In many cases it is thought that at times multiple reseals are the only thing holding the road together and were not constructed with consideration of the types and loads of today’s vehicles. In saying this, Bygoo Road has performed exceptionally well with minimal pavement defects as noted in 2.6.1. In recent years the subject section of Bygoo Road has received the following works.

Over the last 10 years approximately $160,000 in works have been provided and is considered to be in a satisfactory condition with only normal maintenance to be provided. Depending on vehicle numbers, loads and weather, bitumen reseals are applied on a 20 year interval with Bygoo Road (Keogh Avenue to Tin Mines Road) 1.76kms not scheduled until 2027. Being identified as a strategic Heavy Vehicle route by Council, it will pursue additional funding to further improve the pavement strength for the modern vehicle types.

This has been a 3 step process to improve freight transport to and from the defined Grain Receival Centres. The final piece in the network is from town boundary to Shire boundary. It was proposed that this would be the best piece as it was important to remove the bottleneck points at the path through town first. In essence the structure, road dimensions and alignment satisfy the investigation levels of the NSW Route Assessment Guide. A degree of roughness exists which can only be addressed with a complete reconstruction and is the third step in the process. Council will continue to pursue additional funding to improve engineering, safety and driver comfort and as always motorists should drive to the conditions present. ES8) ROADS TO RECOVERY AND NATURAL DISASTER RELIEF AND RECOVERY ARRANGEMENTS (NDRRA) (R.07-09, SC334)

Council is in receipt of correspondence from the Hon Fiona Nash notifying of a temporary exemption for Councils to utilize their own day labour and plant during disaster reconstruction activities. The current NDRRA only permit reimbursement to Councils for cost associated with overtime of staff, employment of temporary staff and contractors. Whilst the states have been advised of this temporary exemption, Council is yet to receive acceptance/confirmation of these new arrangements from the Roads & Maritime Services who are managing NDRRA on the states behalf. See Attachment. Attachment No. 12 Whilst these arrangements and Natural disaster allocation are yet to be confirmed, Council still have a full programme of works remaining in the 2016/2017 year in addition to the untied $500,000 grant for Natural disaster Declared Councils. For Council to satisfy the Roads to Recovery (RTR) arrangements and retain levels of own expenditure whilst addressing the Natural Disaster items a number of RTR items have been deferred with funding re-allocated to the final year of the programme 2018/2019. Recommendation It is RECOMMENDED that Council note the report on the request for additional information from Integrated Development Agencies for Development Application 2016/67 – Ardlethan Tin Mine Rehabilitation and Tailings Reprocessing. Summary This report provides advice to Council on the status of Development Application 2016/67 – Ardlethan Tin Mine Rehabilitation and Tailings Reprocessing. Background A development application was received at Council on 23 December 2016 for the Rehabilitation and Tailings Reprocessing at Ardlethan Tin Mine. The application is for integrated development as per the provisions of Section 91 and 91 A of the Environmental Planning and Assessment Act 1979 and as such the development requires that certain aspects of the development be issued with required approvals under various pieces of legislation. The approvals required include:- Approval under the Protection of the Environment Operations Act 1997 for an

Environmental Protection Licence. The Approval Body is the Environmental Protection Authority.

Approval under Water Management Act 2000 for Water Supply Works, Use

and Water Access Licence. The Approval Body is the Department of Primary Industries.

Furthermore, a Mining Lease under the Mining Act 1992 is required. The Approval Body is Division of Resources and Energy. Agency referrals were distributed to integrated agencies on 5 January 2017, which have resulted in a request for additional information from both the NSW Environmental Protection Authority and the NSW Department of Primary Industries. The requests for additional information are attached to this report. Background Council is in receipt of an application for the proposed rezoning of land located at Lot 252 DP 750846, Wallace Street North, Coolamon. The proposal seeks to rezone the land which is currently zoned RU4 (Rural Small Holdings) with a minimum lot size of 2 Ha to RU5 (Village) with a minimum lot size of 800 m2. A report on the public exhibition of the planning proposal was tabled at the Ordinary Council Business Meeting held on 20 October 2016, where Council resolved to: 1) Note the report on the Public Exhibition for the Planning Proposal for the

land known as Lot 252 DP 750846, Wallace Street North, Coolamon; and 2) Defer the determination of the planning proposal until such time as the

applicant provides an Odour Impact Assessment that addresses the potential impacts that the rezoning may have on the Coolamon Sewerage Treatment Works.

Request for Additional Information - Odour Impact Assessment] As a result of a submission made during the exhibition period and concerns from Council staff, Council requested that the applicant undertake an odour impact assessment to investigate any potential odour impacts / suitable mitigation measures to manage odour impacts from the Coolamon Sewerage Treatment Plant (STP) with regards to the land subject of the planning proposal. The applicant subsequently engaged Advitech Environmental (Consultants) to undertake an odour assessment that assessed odour impacts from the Coolamon Sewerage Treatment Plant to determine what affect, if any, this will have for future residents at the proposed sub-division on the subject site. The report’s findings (attached) have indicated that predicted odour impacts above the 5 Unit Odour Criteria will not be encountered at the proposed development site. In essence the report concludes that there will be no odour impacts if the land is rezoned and subsequently subdivided for dwelling purposes in accordance with the subdivision density and lot layout as outlined in the report. Any proposed future subdivision would need to be restricted to a maximum of four (4) dwellings within the 2 Unit Odour Contour and a maximum of fifteen (15) dwellings within the 1 Unit Odour Contour. Internal / External Consultation The Odour Impact Assessment that was supplied by the applicant as a result of Council’s additional information request was referred to the NSW Environmental

Protection Authority (EPA) on 31 January 2017. The EPA have provided the following comments in relation to the odour impact assessment:

“It appears consistent with the EPA’s guideline the ‘approved Methods for the Modelling and Assessment of Air Pollutants in NSW South Wales’ (January 2017).

Compliance with the ‘Approved Methods’ odour criteria is marginal

There is considerable uncertainty inherent in an OIA and a marginal result is indicative that there is a risk odour impacts may be unacceptable to affected residents.

The odour emission sources are modelled with a constant emission rate and do not take into account diurnal flows, so it is unclear if the worst case scenario has been modelled”.

If Council decides to support this proposal consideration will need to be given to:

Investigating at Councils cost odour mitigation measures to reduce odour emissions from the sewerage treatment plant

Providing information to potential purchasers of the subject land via Section 149 Certificates highlighting proximity to sewerage treatment plant and potential odour issues; and

Introducing building controls on building design for future dwellings proposed to be located at the subject site (ventilation systems, draught stoppers etc.)

Note: All bolding is Council In essence the EPA are providing a disclaimer that indicates, should Council approve this than the EPA will still act according to their legislative requirements which may require Council to make improvements to the STP to ensure odour impacts are reduced. This is no change to the existing situation with EPA enforcement, however, this proposal will increase the density of houses and subsequently increase the chances of sensitive receptors (people). Currently the proposed site identified for rezoning exists closer to the STP then some existing land zoned RU5 – namely in Iverach and Loughnan Streets. Council manage the location of dwellings in these areas through the DCP and exclusion zones from the STP. These zones and distances were established in 1994 and are smaller than the more recently developed policies or guidelines. Internal consultation has been undertaken with relevant Council Staff in relation to the compiling of this report.

Budget Potential financial implications exist in the form of costs associated with any required upgrades to the Coolamon Sewerage Treatment Plant. Policy This report has considered the following Council Policies in its formulation;

Coolamon Local Environmental Plan 2011; and

Coolamon Development Control Plan 2015. Risk Management and Work Health and Safety Issues for Council By approving this planning proposal when there is still uncertainty with regards to odour impacts at the subject site/future residents from the Coolamon Sewerage Treatment Works creates the risk that Council will have to manage odour complaints by initiating untimely and costly upgrades to the sewerage system. It is considered that there are no organisational health and safety issues arising from this report. HS4) TENDER SUBMISSIONS - COUNCIL DWELLING HOUSE (TENDER 2017/01) T.03-05, SC420)

Recommendation It is RECOMMENDED that Council accept the tender of J Tokley Constructions for the amount of $379,763.40 (GST Incl.) for the construction of a dwelling house at proposed Lot 19, William Kelly Drive, Coolamon. Summary This report provides information and a recommendation to Council with regards to tenders received for the erection of a Council Dwelling House on proposed Lot 19, William Kelly Drive, Coolamon. Background Coolamon Shire Council has for many years provided housing options for senior staff. The provision of such a housing option has been viewed as a mechanism to attract and retain suitably qualified and experienced employees to fill senior management roles within the organisational structure. Council has generally ensured that three (3) Council dwelling houses are available for use by senior staff at any given time and such assets have been managed and maintained in accordance with best value asset management practices, i.e. dispose of assets and invest in new assets as required. With the new Council Subdivision almost complete and the employment of the new Executive Manager, Development & Environmental Services, it is proposed to locate the new premises in William Kelly Drive and therefore plans were created for the erection of a single storey brick veneer dwelling. This is seen as a kick start to Council’s new residential area. A tender for the erection of a 4 bedroom brick veneer Council owned dwelling house was advertised on Friday, 6th January, 2017 until Friday 3rd February, 2017. Tender Submissions Council received a total of seven (7) tenders during the submission period. Tenderers and tender prices are listed in the following table from lowest to highest tender received.

Table 1: Tenderers and Tender Prices Tender Evaluation Submitted Tenders were evaluated on the following criteria: Price Experience and Inclusions Initial assessment identified two (2) tenders as being comparable based on the evaluation criteria, AJ and VA Rudd and J Tokley Constructions. An additional information request was made to the two (2) tenders requesting greater details on the list of inclusions and clarification on any omissions from submitted tender documentation to greater inform the tender evaluation. Both Builders provided revised submissions and their final tender prices are included in table 1 above. Both J Tokley Constructions and AJ & VA Rudd have successfully carried out building work on Council’s behalf before and are considered appropriately experienced and qualified to do the work. Consultation Internal consultation has been undertaken with relevant council staff. The tender was advertised from 6 January 2017 to 3 February 2017. All tenderers will be notified by telephone and in writing of Council’s decision after the report has been determined by Council. Financial Implications Council has a budget available for the project and there are no adverse financial implications resulting from this report. The proposed dwelling house tender from of $379,763.40 from J Tokley Constructions is within the allocated budget.

HS5) NBN ROLLOUT (T.02-06, SC416) Recommendation It is RECOMMENDED that Council receive the report for information and invite NBN’s Community Affairs Manager NSW/ACT, Jonathon James to a future Council meeting to discuss the NBN rollout. Summary This report presents an update to Council on the rollout of the NBN network across the Shire. Background Fixed Line NBN has engaged Tata Consulting Services (TCS) to undertake the design activities for the fixed line rollout (i.e. Fibre to the Node) in Coolamon. This is due to commence from approximately March and will involve survey and inspection activities including assessment of the existing Telstra network (i.e. rodding and roping existing conduits, checking pits and manholes etc.) and inspection for the placement of cabinets. Prior to this NBN will take the opportunity to introduce TCS to Council and discuss the engagement process. The design process is then taken to commencement of construction activities, which is anticipated to begin early in the 4th quarter of 2016 (approximately around October). Residents are able to visit the NBN website and search an address in Coolamon and it will identify an anticipated ready for service timeframe of Jan-July 2018 for Coolamon. Based upon the design and construction timeframes above, it is estimated a ready for service date somewhere in the middle of this timeframe.
