    Minutes of a Meeting of the Council of the Municipality of Newtown, held at the Town Hall, Newtown, on Tuesday, lOth June, 1941.

    PRESENT.

    His Worship the Mayor, (Mr. Alderman I.E. Ryan, J.P.) and Aldermen Mrs Fowler Mrs Swift, Solomon (Deputy Mayor), Beaufils, Elvy, Dunshea, Fleming, Greenup and ' Collyer.

    Each Member of the Council having received a copy of the Minutes of the previous Meeting, it was resolved, "That the Minutes as circulated, be taken as read and confirmed, and signed as a true record of the Meeting held on 27th May, 1941."

    SYMPATHY.

    Feeling references having been made by the Mayor and Aldermen it was resol ved by the Members rising in silence that a letter expressing this Council's sympathy be forwarded to Miss Rapp of 44 ' Missenden Road, Newtown, on the death of her nephew.

    From the Minister for Nat ional Eme rgency uervices in reply to Council's inquiry regarding the bearing of the expenditure for the p ovision of trailers and National Emergency ervi~es equipme~t , advising that the matter is the subject of conference with the Common-

    ~ealth Government , and that in the meantime Council stay its hands. Resolved, "That the letter be received and contents noted."

    From Mr . ~ . · . Burke, M. L.A. intimating he will give attention to Council's request to have the Newtmm- Camperdmm Cemetery converted into a Park. Received.

    From the Federated Municipal & Shire Council Employees' Union agreeing with Mr. P.E.Roberts beina employed as a slow worker on the duties of a convenience attendant, and the relief to Mr . Roberts on his day off being taken by another slow worker. Received.

    • From the Department of Local Government and Housing seeking Council's co-operation in forming local committees with the assistance of the clergy and local postmasters,to devise a scheme to enable personal communication to be made to the next of kin,when telegrams are received notifying fatal casualties in war-time. Resolved, "That the letter be received and

    co -operation granted."

    From the ~wtown Branch, Red Cross Society, seeking permission to hold a Chocolate Wheel and stalls in f ront of t he Town Hall on 13th and 20th June, 1941. Resolved, "That the application be received and permission granted."

    REPORTS .

    His ·¥orship the Mayor, (Mr. Alderman I.E. Ryan, J.P.) as Mayor and Chairman of the Works, Building & Parks Committee submitted a report of a Meeting held on 5th June, 1941, as contained on folio 53 of the Committee's Report Book, which was received and ordered to be considered seriatum. After consideration it was resolved, "That the Works, Building & Parks Committee's Report be received and adopted, and all recommendations contained therein be carried into effect."

    The Engineer submitted his report of works completed or in progress during the past fortnigh wh ich was received and adopted.

    The Acting Chief Health Inspector submitted his report as contained on folio 300 of the Hea lth Inspector's Report Book. Resolved, "That the Acting Chief Health Inspector's Report be received and adopted, and that letters of thanks be forwarded to the Medical Personnel who assisted with the Immunization Campaign, and that a donation of £2- 2- 0 be made to St. John's Ambulance Brigade to cover their out of pocket expenses."

    ~UESTIONS WITHOur NOTICE .

    Alderman Dunshee drew attention to the bad gutter crossings in Lennox Street, and also one on the City boundary in Denison Street, which he had drawn attention to over twelve months ago, and to which nothing yet had been done. Resolved, "That the matters be referred to the Works Committee."

    Alderman Collyer drew attention to the fact that sometimes it was an advantage to have these dish gutters,as they had the effect of slowing down dangerous drivers and giving pedestrians a chance to cross the Streets in safety.

    Alderman Fleming moved, "That a letter be forwarded to the Minister for Local Government asking him to give eff ect to the resolutions placed before the Local Government Department through the annual Conference of the Local Government Association at the instigation of this Council, to give Councils control over private lanes and dividing fences." Seconded by Alderman Mrs SWift and carried.

    ~oved by Alderman Greenup, Seconded by Alderman Dunshee, "That application be made to the Main Roads Department to have Wilson Street declared a Main Road, and steps be taken to have it reconstructed between Burren Street and Erskineville Road as a matter of urgency,(and the also be treated as a matter of urgency)the widening of the street in the area mentioned . " Carried.

    Moved by Alderman Elvy, Seconded by Alderman Fleming, "That the Police Department be asked to exercise greater supervision of the parking in Wilson Street, between Burren Street and Erskineville Road as great danger occurs due to the narrowness of the street and the length of time vehicles are parked there." \ Carried.

    Alderman Dunshee asked that he be granted leave of absence for twelve weeks from the period commencing next week-end, 14th June, 1941. Resolved, "That the application be received and the leave of absence from Council Meetings asked for, be granted."

    Alderman Greenup asked if any repl y had been received from the Minister in connection with Council's proposal to have A.R.P. and First Aid taught to school children . Reply in the negative.

    HAlderman Mrs Fowler intimated that the official test of the National Emergency Services in Newtown would be made on 22nd June, 1941 , between 2-30 p.m. and 4-30 p .m., the control station being the Mayor's Room, which had kindly been loaned by His Worship the Mayor, (Mr. Alderman I.E. Ryan, J.P.) and asked that the Mayor and as many of the Aldermen as can make it convenient attend on that day, and thanked the Mayor for the kindness shown to her since taking office . Resolved, "That the invitation be received and accepted, and as many Aldermen as possible attend on that day."

    Alderman Dunshea asked what had been done in connection with the proposed purchase of a trailer in connection with the National Emergency Services Rescue and Demolition Squads. His attention was drawn to the fact that the matter had been dealt with in correspondence at this Council Meeting.

    It was resolved that the Council now go into Committee of the Whole to consider a staff matter.

    Upon resuming in Council it was reported that the report of His Worship the Mayor, (Mr. Alderman I.E . Ryan, J.P.) notifying the Council that he had suspended the Engineer, (Mr. L.J. Kelly) on lOth June, 1941, on the grounds that he was under the influence of intoxicating liquor on 9th June, 1941, and that he refused to obey an order from his superior Officer, (the Town Clerk) and caused him to obtain the services of a Police Constable to have him removed from the Town Clerk's Office , be received, and that a Special Meeting of the Council be called for Monday 16th June, 1941, at 7-30 p.m. to consider the matter, and the Engineer be invited to attend and give his side of the case. Resolved, "That the report of the Committee of the Whole be received and adopted. Alderman Dunshea asked that his name be recorded against the adoption of the motion.

    There being no further business the Meeting terminated at 10-50 p.m.

    1 . That the Engineer, Mr . L.J. Kelly, was under the influence of intoxicating liquor on 9th .June, 1941 .

    2 . That he refuse d to obey an order from his superior Officer (the Town Clerk) and caused him t o obtain the services of a Police Constable to have him removed from the Town Clerk ' s Office .

    The En ineer replied and denied t he charges, an d it was then resolved, "That after hearing the evidence for and against the Engineer, the Council is of the opinion that the charges have not been sustained, and he be reinstated in his position , but in doing so, Council makes it clear that Mr . Kelly must co-operate with the Town Clerk as Senior Officer, carry out his instructions when such instructions are in agreement with Counci l ' s decision and the Local Government Ordinances . Further , any purchase made by Mr.Kelly must be approved by Council and in an emergency the Mavor and Town Clerk . Finally, Council is of the opinion that the Town Clerk and Engineer work in the best interests of the Municipality of Newtown ."

    And there being no further business the Meeting terminated.

Resolved, "That the Finance & Building Committee's Renort be received and adopted, and all recommendations contained therein be carried into effect."

    ENGINEER'S 8745 REPORT.

    The Engineer submitted his report of works completed or in pro~ress during the past fortnight, and it was resolved, "That the En~ineer ' s Report be received and adopted and the matter of theclass of sand to be used on footpath resurfacing be referred to the Works Committee for consideration and renort."

    .~endment moved by Alderman Greenup, Seconded by Alderman Beaufils:-

    "That the Council delegates to the Mayor the power to engage such servants as he may deem necessary at an hourly, daily, or weekly wage according to the rates usually paid by the Council . The Mayor shall report to Council at the subsequent Meeting that such appointment has been made to the staff. The ?~yor may also suspend such servants when he deems it necessary, any servant so suspended to be allowed to appeal to the Council and the dismissal be only by a majority vote of Counc il. Further , ~hen the Mayor makes an appointment to any position in Council Service he shall give consideration to those members employed by Council in any other Department ."

    The voting being in favour of the amendment, it was submitted as the substantive motion , and declared carried.

    ~UESTIONS 'VITHOUT NOTICE.

    Alderman Porter asked the Mayor if he could tell him when the Hand Lawn Mower was purchased, which he had referred to earlier in t he evening as being a new one in Hol l is Park. Reply in the negative . Alderman Porter asked if the Town Clerk could say when and where it was purchased. Reply: That it was impossible to say from memory and would have to ask for notice of question to consult the records if the information was re ouired. The Engineer volunteered the informatio that he thought it was six or seven years old.

    Alderman Beaufils drew attention to t he fact that when the matter of the class of sand to be used on footpath ~e surfacing was underdiscussion earlier in the evening, the Engineer had sai that River Sand was used because it did not leave a slippery surface, and asked that if Hill Sand was being used, would the matter stand in abeyance until after the Works Committee Meeting . Reply: The Engineer is carrying on with Hill Sand and will continue to do so until after the Works Committee Meeting. -~derman Beaufils then moved that the footpath resurfacing be discontinued pending the Works Committee's decision as to the class of sand to be used . Lapsed for the want of a seconder.

    P~derman Collyer drew attention to the statement made earlier in the evening by the Mayor that 600 tons of scrap metal were stacked at the Incinerator Depot, and that grass was growing through it. He asked if any attempt had been made to win it back or whether it wguld be too expensive. The Mayor replied and drew attention to the last Works Committee's Report which dealt with the matter, and said that the men could be employed on wet days forking it out, and that some of it had been there for three years.

    Alderman Greenup asked that the matter be referred back to the Works Committee. Tbe Engineer said there were not 600 tons in the Depot. Forking would not yield 50 tons for tarring. The metal was not put in the Depot haphazardly and that the metal near the Railway f Line was useless and would cost more to salvage than it was worth.

    Alderman Collyer asked what metal was used in Darley Street. The Engineer replied that it was ballast and salvage material from the aepot, and the tar bitumen compound was covered with clean metal.

    Alderman Fleming drew attention to the state of a downpipe in Bedford Street near Denison Street.

    Alderman Fleming drew attention to the state of the road in front of E.A. Turtle & Co.'s premises.

    Alderman Porter asked if he could be informed of the number of times the Electric Light & Power Supply Corpn.'s employees patrolled the lights in Newtown. Reply: that the times were not known . Alderman Porter then drew attention to the fact that a light in Mary Street had been out since Saturday night and had not yet been replaced.

    And there being no further business the Meeting terminated at 10-30 p.m.
