Drivers are calling for the abolishment of the agency that regulates the for-hire vehicle industry.

The drivers, associated with the Independent Drivers Guild (IDG), rallied at City Hall on Monday, calling for a Drivers’ Bill of Rights – and for the abolishment of the Taxi and Limousine Commission (TLC).

Citing a failure to protect the livelihoods of thousands of for-hire vehicle drivers, IDG members, who are drivers for Uber, Lyft called for the city to scrap the TLC and create a new agency with more City Council oversight.

“Drivers are dying, families are going bankrupt. How many lives must be destroyed, how many drivers must we lose to suicide before we see change? It’s time for reform, tear down the failing Taxi and Limousine Commission and start over. Today we are calling for the TLC to be abolished,” said IDG Executive Director Brendan Sexton. “Make no mistake about it, this is an emergency. The TLC failed to act in a timely manner on the taxi medallion crisis and now they are failing to act with regard to the app-

based industry. As the TLC turns Uber and Lyft into another failed medallion system, tens of thousands of families across our city are already paying the price.”

City Council Transportation Chair Ydanis Rodríguez and Councilmember Rafael Espinal joined the rally, which was held before a City Council oversight hearing regarding the TLC.

Drivers claimed out that new city legislation designed to increase pay for drivers by $10,000 per year is falling short of the target. They also complained about the extension of the vehicle cap, which they said has left thousands of drivers stuck paying more to rent a vehicle

than it would cost to own. IDG has long called for limits on new drivers rather than capping vehicles.

IDG members are seeking a Bill of Rights that accomplishes, among other things: policies that promote driver ownership over leasing; a limit on new TLC driver licenses rather than vehicle licenses; a cap on company commissions, prevention of app companies from deactivating drivers without a stated cause; the right to use rooftop ads; predatory leasing regulations; and enhanced investigations into assaults on drivers.

At the hearing, which focused on the TLC’s implementation of several local laws passed by the Council within the past year, Rodríguez and his colleagues heard testimony from different sectors of the taxi industry.

A former cab driver, Rodríguez should be reorganized to better protect the drivers’ rights and enforce industry regulations.

“We all know that the industry has been in a state of turmoil over the last several years,” he said during his opening remarks.

“This Committee is committed to finding practical solutions to help all drivers earn a decent living and to improve the performance and standards across the taxi and FHV sectors in our city,” he added. “It is my hope that working together we can continue to explore options and actions that will help us achieve that.”

Glenn Winuk died on September 11, 2001 when the South

Tower fell.

“He helped evacuate his law offices at 195 Broadway and then ran into the South Tower to save lives. He died when the tower collapsed.”

Jay Winuk has sought to channel the loss of his younger brother into a sweeping wave of service – with thousands giving of their time at once.

Nearly 5,000 volunteers from the New York City area flocked to the U.S.S. Intrepid on the 18th anniversary of the attacks to help pack more than a million meals for food-insecure locals as part of a 9/11 Day of Service.

Sponsored by nonprofit group 9/11 Day, the event was one of nine meal-packing events nationwide that sought to prepare three million healthy, non-perishable meals for those in need.

Co-hosted by NYC Service, New York Cares, the National September 11 Memorial and Museum, City Harvest and the West Side Campaign Against Hunger, the event is New York City’s largest in observance of the anniversary of the 9/11 terrorist attacks,

now a federally-recognized National Day of Service and Remembrance, widely known as “9/11 Day.”

Jay Winuk co-founded the 9/11 Day group in 2002.

His brother Glenn was an attorney at the lower Manhattan law firm Holland and Knight, and also served as a volunteer firefighter and EMT for 20 years.

“This is a labor of love for me. I do this in [Glenn’s] honor,” Winuk added. “He lived his life and died in service of others, but this has grown into something far beyond anything we could have imagined.”

On Wednesday, the Intrepid’s airplane hangar was crammed with volunteers, who worked in several shifts throughout the day.

Volunteers were sent in large groups from corporate partners such as Chase, Motorola, JetBlue, Macy’s, Motorola, Blackstone, and other firms.

Yanelia Ramírez has lost count of how many important family

moments she’s missed.

The Bronx resident’s work schedule has made it difficult not to.

A nail salon worker during the past 14 years and a mother of five children, Ramírez said she has worked six days a week for at least 10 of those years without paid time off.

“It pains me to think about all of the birthdays, first days of school, graduations and other special days I’ve missed because I couldn’t afford to miss a paycheck or risk losing my job,” remarked Ramírez, who was at City Hall on Monday to join rally in favor of a bill that would mandate paid personal time to all New York City workers.

Ramírez said the proposed law would provide low-income laborers with more dignity.

“We don’t deserve to be treated like batteries, to be used and then thrown away once drained,” she remarked.

The rally drew employees, First Lady Chirlane McCray, Public Advocate Jumaane Williams and City Councilmembers, who

threw their support behind the City Council bill. They said it would help about one million New Yorkers, including domestic workers, retail workers, and food service employees.

Williams, who introduced the bill in 2014 while a member of the City Council, noted that 62 percent of low-income workers have no paid personal time off, compared with 92

percent of high-wage workers.Motioning to the workers gathered on

the City Hall steps, Williams said, “All of the people behind me are not begging for something that they simply want. They are demanding something that they absolutely need to live lives as human beings.”

“They miss birthdays, weddings, and even funerals,” added McCray. “Sick days run out fast, leaving them without any options. They can’t stay home to let the plumber in, or care properly for a sick child. Can you imagine the stress that grows and grows when there is no time to take care of personal responsibilities?”

Karen LeRoy, who works two part-time jobs at a grocery store and nursing home, said workers without paid time off are forced to make tough choices.

“If we do take time off, we might give up a significant portion of our pay,” she said. “And many times, I needed a day off but was afraid to ask because I think I’ll get fired.”

According to city officials, 75 percent of part-time workers do not get paid vacation or personal time.

The legislation requires employers to offer workers 10 days per year paid personal time, which can be used for any reason, including religious observances, doctor appointments and bereavement.

If passed, the policy would apply to private employers with five or more employees or one or more domestic workers and be enforced by the Department of Consumer Affairs (DCA) and Worker Protection (DCWP).

It is still a world of hurt.

The World Trade Center (WTC) Environmental Health Center of NYC Health + Hospitals is reporting a dramatic increase in patients.

As of July 2019, the center is serving 10,944 patients, NYC Health + Hospitals announced this past week. This marks an increase of more than 1,200 patients from July 2018.

The WTC Environmental Health Center assesses and treats 9/11-related physical and mental health conditions, providing services at no cost to residents, students, workers, or passersby eligible for care under the Zadroga 9/11 Health and Compensation Act.

“It has been 18 years since the terror attacks, and New Yorkers continue to feel the effects of that horrific day,” said Mitchell Katz, MD, President and CEO of NYC Health + Hospitals. “Our hope is that those whose health was affected by 9/11 seek the care they

deserve through the WTC Environmental Health Center and continue to monitor their health.”

In the last year, the WTC Environmental Health Center expanded capacity by hiring 16 additional providers at the clinics to perform patient visits, giving patients the option to make appointments through the call center, and modernizing the electronic health records system at the three sites.

New providers include physicians, pharmacists, social workers, mental health providers, nurses, and nurse practitioners.

“The increase in patients treated by the Center demonstrates the continued need to care for persistent aerodigestive disorders, PTSD, as well as cancers in those who were exposed to

the toxic dust and fumes. Enrollment remains open and we encourage New Yorkers to get the care they need,” said Joan Reibman, MD, NYC Health + Hospitals WTC Environmental Health Center Medical Director.

Among the most common conditions treated through the WTC Environmental Health Center are: cancer, upper respiratory disease, obstructive airway disease, and post-

traumatic stress disorder. “While for many 9/11 seems like the distant

past, thousands of New Yorkers carry the attacks with them every day. 11,000 people enrolled in the WTC Environmental Health Center underscores just how important these programs are and how much they are needed, said Congresswoman Carolyn B. Maloney. “I hope everyone whose health was impacted on September 11th, and in the months afterwards, will make use of the resources they need and deserve.”

New Yorkers qualify for 9/11 health services if they:

• lived, worked, or went to school or

day care in the area of Manhattan that is south of Houston Street or in northwest areas of Brooklyn, between September 11, 2001, and July 31, 2002

• were exposed to the dust cloud on 9/11, or to dust or smoke in the disaster area after 9/11

• worked as a cleanup worker or performed maintenance work in the disaster area between September 11, 2001, and January 10, 2002

Though it has stalled for five years, Williams said there was now “momentum at our backs” to get the legislation passed. “We are poised to get this done,” he stated.

“It’s about time,” McCray shouted.While the bill seems to have strong support

in the City Council, Speaker Corey Johnson has expressed reservations about it. During a radio appearance in August, Johnson said that details still need to be worked through so as not to harm smaller businesses.

“Small businesses are closing because of rent increases, and then [you’re] putting this potential cost on very small businesses that can’t absorb it in the same way a larger company with 50, 100, 500 people can absorb it,” he said.

Derek Perkinson, Director of NYC Chapters for National Action Network, urged businesses to support the legislation.

“We will sit down with businesses to get something that works for both of us. Let’s all come together,” he said. “If you’re a business owner, why wouldn’t you want workers at their best?”

Jackie Orie, a domestic worker for the past 19 years, said she has benefited from paid time off from certain employers, and wants to see others in her line of work to be guaranteed the same treatment.

Orie told rallygoers that she receives two weeks paid vacation and paid personal days, which allowed her to go back to school and finish her college degree.

“Paid personal and vacation days went a long way in ensuring I could prepare for important exams,” she said.

Airport worker Pedro Gamboa said the

legislation would be “a godsend to all of us.”He said that when his mother in Guatemala

became ill, he wasn’t able to lend a hand as sibling took turns taking care of her.

“I know co-workers who fear taking time off, afraid that their jobs won’t be there when they return,” he said.

“Jobs expect a lot from you, but we need more in return,” added LeRoy. “Sometimes you have to fit in everyday life. It’s not like we want to miss work, but sometimes you need to go to the doctor.”

Andrew Rigie, Executive Director of the New York City Hospitality Alliance, which represents restaurants and nightlife venues, is against the legislation in its current form,

claiming it would harm small businesses. “Our elected leaders continue to say how important small businesses are to New York City, then go out of their way to make it more difficult for them to survive,” Rigie said.

He suggested that the city should help fund paid time off for small business workers.

“Look at other social benefit programs, like Social Security, even the recently implemented New York State paid family leave, [it is all] conducted through a payroll tax,” Rigie said. “There’s mechanisms to reduce the burdens, offset some of the costs. If we’re a progressive city, we should come together collectively to do this and not just thrust another unfair mandate on small

business owners.” The group submitted a letter undersigned

But Williams stressed that the intent was not to hurt small businesses, and vowed that they would “have a seat at the table” when it came to discussions on the legislation.

“We want them to thrive,” he said. “But it can’t be done on the backs of workers.”

Valerie Bodie and Michelle Orellana, employees from Macy’s Herald Square, said they felt it was important to participate.

“Just giving back,” Bodie said. “The memories of that day are still fresh.”

Kelly Stevens recently moved to New York City from Alabama. “I really felt compelled to get to know the city better and get more connected,” she said. “This was an amazing experience.”

Currently, 9/11 and MLK Day are the only two federally-mandated days of service in the U.S.

Other 9/11 Day project locations include Boston, Chicago, San Francisco, Phoenix, Dallas, Atlanta, St. Louis, and Los Angeles.

Overall, 3 million meals were packed in those cities on Wednesday by over 12,000 volunteers.

“It’s a great thing. We get to do good work on 9/11 so people understand that they have an opportunity to make a difference, and we don’t let the terrorists own the day,” Winuk said.

He smiled as he surveyed the swarm of

volunteer participants.“On a day that’s otherwise very difficult,

to see the enthusiasm of all these volunteers feels really good,” he remarked.

“But this is not just about doing good deeds on 9/11,” he added. “It’s about trying to encourage people to realize that they can make a difference for people at risk.”

“Esta es una labor de amor para mí. Hago esto en honor de [Glenn]”, agregó Winuk. “Vivió su vida y murió al servicio de los demás, pero esto se ha convertido en algo mucho más allá de lo que podríamos haber imaginado”.

El miércoles, el hangar de aviones del Intrepid estaba repleto de voluntarios, quienes trabajaron en varios turnos durante todo el día. Fueron enviados voluntarios en grandes grupos de socios corporativos como Chase, Motorola, JetBlue, Macy’s, Blackstone y otras empresas.
