OnOctober22,1986,CongresspromulgatedtheAsbestosHazardEmergencyResponseAct(AHERA),PublicLaw99-519.AHERAmandatedthatEPAdevelopregulationstorespondtoasbestosinschools.OnOctober30,1987,EPApromulgatedtheAsbestos-ContainingMaterialsinSchoolsRule(hereinafterreferredtoastheAHERARule),40CFRPart763,SubpartE.Thisrulerequiresthatallofthenation’snonprofitelementaryandsecondaryschools,bothpublicandprivate,identifyandinspecttheirschoolbuildingsforbothfriableandnon-friableasbestos-containingbuildingmaterials(ACBM)anddevelopaplantoproperlyandsafelymanageanydiscoveredasbestosmaterialforeachbuilding.ThisDocumentandNoticeoffers“AnnualNotification”thattheChattoogaCountySchoolSystemseekstoupdatethe(AHERA)AsbestosManagementPlaninatimelymannerasrequiredbytheEnvironmentalProtectionAgencyunderFederalLaw,40CFR763,SubpartE,andindoingsowillmeetthisnotificationrequirementplusotheraspectsoftheAHERAProgram.TheManagementPlanforeachschoolsiteandbuildingsareavailableforreviewinthemainofficeofeachschoolaswellastheChattoogaCountyBoardofEducationandSchoolSystemCentralOffice.TheManagementPlanincludesatleastthefollowingforeachbuilding:buildingdiagrams,re-inspectionandassessmentdocuments,individualbuildingroomschedules,asbestoslocationdrawings,periodicsurveillanceupdates,maintenanceplanguidelines,awarenesstraining,testingresults;plusresponseandremovalactivities.TheChattoogaCountySchoolsLocalAHERADesignatedContactpersonisMr.JohnWorsham,DirectorandSupervisorofFacilitiesandMaintenance.HemaybecontactedforfurtherinformationifneededattheChattoogaCountyBoardofEducationCentralOfficeattheFollowingnumbers:Office:706-857-3447orMobile:706-346-6949.

ChattoogaCountySchools:InternetAcceptableUse,BoardPolicy ItisthebeliefoftheChattoogaCountyBoardofEducationthattheuseoftelecommunications,includingtheInternet,ininstructionalprogramsisaneducationalstrategythatfacilitatescommunication,innovation,resourcesharing,andaccesstoinformation.UseoftheInternetmustbeinsupportofeducationandresearchandconsistentwiththeeducationalmission,goals,andobjectivesoftheschoolsystem.Thus,itistheintentionoftheChattoogaCountyBoardofEducationthatalltechnologyresourceswillbeusedinaccordancewithanyandallschoolsystempoliciesandprocedures,aswellaslocal,stateandfederallawsand/orguidelinesgoverningtheusageoftechnologyanditscomponentparts.Additionally,itisimpliedthatallstudentsandemployeesoftheChattoogaCountyBoardofEducationwillusetheprovidedtechnologyresourcessoasnottowastethem,abusethem,interferewithorcauseharmtootherindividuals,institutions,orcompanies.Internetaccessandelectronicmailisaprivilege,notaright.Allusersareexpectedtoactinaresponsiblemanner.AllcontentsandusageofelectronicmailshallbethepropertyoftheChattoogaCountyBoardofEducation.Tomaintainsystemintegrityandtoinsurethatthesystemisbeingusedresponsibly,theSystem-wideTechnologyStaffreservestherighttoreviewfilesandnetworkcommunications.
Internet-TermsandConditions
AcceptableUse-ThepurposeofprovidingInternetaccesstoemployeesandstudentsoftheChattoogaCountySchoolSystemistosupportresearchandeducationbyprovidingaccesstouniqueresourcesandtheopportunityforcollaborativework.TheuseofInternetAccessmustbeinsupportofeducationandresearchandconsistentwiththeeducationalobjectivesofourSystem.Transmissionofanymaterialinviolationofanyfederalorstateregulationisprohibited.Thisincludes,butisnotlimitedtocopyrightedmaterial,threatening,pornographic,obscenematerialormaterialprotectedbytradesecret.Privileges-TheuseoftheInternetisaprivilege,notaright,andinappropriateusewillresultinacancellationofthoseprivileges.NetworkEtiquette-Usersareexpectedtoabidebythegenerallyacceptedrulesofnetworketiquette.Theseinclude(butarenotlimitedto)thefollowing:Bepolite.Donotbeabusiveinyourmessagestoothers.Useappropriatelanguage.Donotrevealyourpersonalhomeaddress,e-mailorpasswordorthephonenumbersandaddressesofstudentsorcolleagues.Notethatelectronicmail(e-mail)isnotguaranteedtobeprivate.Electronicmailshouldnotbeusedforbusiness,profitorexcessivepersonalcorrespondence.Donotusethenetworkinsuchawaythatwoulddisrupttheuseofthenetworkbyotherusers.Security-Securityonanycomputersystemisahighpriority,especiallywhenthesysteminvolvesmanyusers.Protectyourpasswordandpersonalinformation.

Vandalism-Vandalismwillresultincancellationofprivileges,aswellasthepossibilityofotherdisciplinaryorlegalaction.Vandalismisdefinedasanymaliciousattempttoharmordestroydataofanotheruser,theInternet,ouraccessproviderorothernetworksthatareormaybeusedbyourprovider.Thisincludes,butisnotlimitedto,theuploadingorcreationofcomputerviruses.»AllInternetaccessusers,includingstudentsandemployees,mustsignanInternetUseAgreement.Studentuser'sInternetUseAgreementsmustalsobesignedbyaparentorguardian.
Thesmoothoperationofthenetworkreliesupontheproperconductoftheendusers.FailuretoabidebyBoardpolicyandadministrativeregulationsgoverninguseofthedistrict'ssystemmayresultinthesuspensionand/orrevocationofsystemaccess.Additionally,studentviolationsmayresultindisciplineuptoandincludingsuspensionorexpulsion.Staffviolationsmayalsoresultindisciplineuptoandincludingdismissal.
Visitor/SchoolGuestSign-InProceduresGeorgiaLawrequiresthatvisitors,withtheexceptionofstudents,schooldistrictemployees,lawenforcementofficersorotherpublicsafetyofficialsintheperformanceofanemergencycall,sign-inatthedesignatedlocationofanyschoolbuildingbetweentheofficialstartinganddismissaltimesandtoprovideareasonfortheirpresenceattheschool.Allvisitorsarerequiredtowearproperidentificationandremainintheareasdesignatedforthevisit.
Theschooladministratorordesigneeshallhavetheauthoritytoaskanyvisitortoexplaintheirpresenceintheschoolatanytimewhentheschoolinofficialsession.Anypersonwhodoesnothavelegitimateneedorcausetobeonthepremisesoronschoolpropertyand/orwhofailstosign-inatthedesignedlocationmaybeinviolationofGeorgiaLawanduponinvestigationmayfacecriminalprosecution.
GuidelinesforParentsVisitingSchoolsduringLunchTimesWhiletheparticipationofparentsatschoolisencouraged,itmaybecomenecessaryfromtimetotime,forindividualprincipalstolimittheaccessofparentsvisitingwiththeirchildduringlunchduetothetimeandspaceconstraints.

ChildAbuseorNeglectTheChattoogaCountyBoardofEducation,inrecognitionofthefactthatabusedandneglectedchildrenarelessabletoattendschoolregularlyandtoperformtotheirmaximumpotential,andinrecognitionofthelegalmandatewhichrequiresGeorgiaeducatorstoreportsuspectedchildabuseandneglecttotheappropriateauthorities,herewithestablishesaproceduralguidelinepolicyformakingsuspectedchildabuseandneglectreportswithinthelocalschoolsystem.Inthefulfillmentoftheintentofthispolicy,localandstatepersonnelshallobservethefollowingguidelines:
• Anychildunder18yearsofage,wherethereisreasonablecausetobelievethatsuspectedphysicalinjuryorinjuriesinflicteduponsaidchild,otherthanbyaccidentalmeans,byaparentorcaretaker,orhasbeenneglectedorexploitedbyparentorcaretaker,orhasbeensexuallyabused,shallbereportedtoachildwelfareagencyprovidingprotectiveserviceswherethechildlivesandhavingbeendesignatedtoChattoogaCountyDepartmentofFamilyandChildrenServicesbystatelawandtheGeorgiaDepartmentofHumanResources.
• AllschoolpersonnelhavingreasonablecausetobelievesuspectedchildabusehasoccurredwillreportsuchcasestotheSchoolCounselorand/orAdministrator.TheSchoolCounselororAdministratorwillimmediately,andnolaterthan24hoursfromthetimethereisreasonablecausetobelievesuspectedchildabusehasoccurred,reportitsfindings,totheChattoogaCountyDepartmentofFamilyandChildrenServices.
• TheSchoolSocialWorkershallbenotifiedbythedesignateddelegateofallreferralsofsuspectedchildabuseandneglect.
• Administrators,SchoolCounselors,orcertifieddesigneewillbetheschoolliaisonwiththeProtectiveServicesstaffofChattoogaCountyDepartmentofFamilyandChildrenServicesinrelationtothechild’sschooladjustmentandperformance.Ifthestudent’scasewasreferredtotheDepartmentofFamilyandChildrenServicesbysomeoneotherthanauthorizedschoolpersonnel,theinvestigatormustnothaveaccesstothestudent’sschoolrecordunlesstheAdministratororSchoolCounselorhasbeendirectedtodosobycourtorder,subpoena,orparentalpermission.

• Theimpartialreviewofficialshallnothavethepowertosubpoenawitnesses,andthestrictrulesofevidenceshallnotapplytohearings.Theimpartialreviewofficialshallhavetheauthoritytoissuepre-hearinginstructions,whichmayincluderequiringthepartiestoexchangedocumentsandnamesofwitnessestobepresent.

MedicationPolicyWhenpossible,weencourageyoutoscheduleyourchild’smedicationsothatitmaybegivenathomeunderyourdirectsupervision.However,werealizethisisnotalwayspossible.TheChattoogaCountySchoolSystemMedicationAuthorizationFormisavailableateachschoolandmustbecompletedbyeachstudent’sparent/guardianbeforemedicationisgiven.Aseparateformisnecessaryforeachmedicationrequest.

Parentsareencouragedtoprovideduplicatemedicationandsuppliestotheschoolintheeventastudentisunabletoself-administerorfailstobringtheirmedicationorequipmenttoschool.
Nursesorotherschoolemployeesareauthorizedtoadministerauto-i=injectableepinephrine,ifavailable,toastudentwhoishavinganactualorperceivedanaphylacticadverse(allergic)reaction,regardlessofwhetherthestudenthasaprescriptionforepinephrine.Suchpersonsalsoareauthorizedtoadministerlevalbuterolsulfate,inavailable,toastudentinperceivedrespiratorydistress,regardlessofwhetherthestudenthasaprescriptionoflevalbuterolsulfate.Anyschoolemployeewhoingoodfaithadministersorchoosenottoadministersuchmedicationtoastudentinsuchcircumstancesshallbeimmunefromcivilliability.

Hospital/HomeboundServices:
If major sickness or injury occurs and absenteeism is lengthy, the student may receive credit byinstruction through application to the hospital/homebound program. Parents/guardians of studentsneedingtheseservicesmustcontactthePrincipal.
AttendanceCredits:
Students shall be countedpresentwhen theyare in attendanceat school for at leastonehalf of theinstructionalday,attendingaschool-orSchoolDistrict-sponsoredfieldtrip,orservingaspagesoftheGeorgiaGeneralAssembly.
Tardinessand/orearlycheck-outs:
Anyunexcused tardy (arriving toschool/classbeyond thepostedschool start-time)orearlycheck-out(leavingschool/classbeforethepostedschoolend-time)cannegatively impactastudent’sattendancerecordandjeopardizehis/heroverallachievementduetolostinstructionaltime.

ATTENDANCEPOLICY(HIGHSCHOOLONLY):
Anystudenthavingsevenormoreexcused,approvedorunexcusedabsencesinasemester-lengthclassor fourteen ormore excused, approved or unexcused absences in a year-length classwill receive nocredit forthatclassunlessawaiver isgrantedbytheAttendanceCommittee.However,studentsshallnotbedeniedcreditforacourseiftheyhavesevenormoreexcusedabsencesinasemester-lengthclassorfourteenormoreexcusedabsencesinayear-lengthclasswhenthefollowingconditionsaremet:(1)theabsencesarevalidatedasexcused, (2)makeupwork issatisfactorilycompleted,and(3)apassinggrade has been earned for course work during the semester. TheAttendanceCommittee is a standing committee composedof five (5)membersappointedby theprincipal and chaired by an administrator. The chair shall vote only in case of a tie. The responsibility for arranging to complete work missed is to be assumed by the student andparent/guardian in conjunction with the teacher. HONORGRADUATES
• Honorgraduateswillbedeterminedbygradesbeginningwiththeninthgradeandendingattheendofthe27weeksinthe12thgrade.Thestudenthavingthehighestaveragewilldeliverthevaledictory address. To be considered as an honor graduate a student must have grades onrecordforatleast7semestersandcarryafullacademiccourseload.
• Onlythosegradesearned ingrades9,10,11,and12willbeused indeterminingrank inclassandhonorgraduates. Ifstudentstransfer fromotherschools,allpreviousgradesearnedmustbefromahighschoolaccreditedbySACSoranequivalentregionalaccreditingagency.

(a) GRADES 6-8: COMPETITIVE INTERSCHOLASTIC ACTIVITIES are defined as any school-sponsoredprograms involving competition between individuals or groups representing two or more schools.Cheerleadingisincludedinthisdefinition.Studentsparticipatingincompetitiveinterscholasticactivitiesshall be enrolled fulltime during the grading period of participation and pass five (5) subjects in thesemester immediately preceding participation. Board Policy IHE states that eligibility for competitiveinterscholasticactivities ingrades6-8,asdefined in theGeorgiaBoardofEducationRule160-5-1-10,cannotbemetduringsummerschool.Eighthgradestudentsplayingonninthgradeteamsmustalsomeet these requirements. RESPONSETOINTERVENTION(RTI)
ChattoogaCountySchoolsusestheResponsetoIntervention(RTI)methodformeetingtheinstructionalneeds of studentswho are experiencing problems in school and assisting the teachers in addressingthose problems. The RTI provides services through the regular education program, includinginstructional planning and consultation that includes those individuals responsible for the educationwell-beingofthestudent.

• Studentsshouldbeatthebusstopfive(5)minutesbeforethebusarrives,waitinginasafeplace,clear of traffic, and a safe distance from the road. If a student misses the bus in the AM, aparent/guardian is responsible for findingalternative transportation. If a studentmisses thebusafterschool,theparentoremergencycontactiscalledtoarrangefortransportation.
• Students should scan school ID card when entering and exiting the bus. While it is not arequirement to ride toand fromschoolonaChattoogaCounty School systembus, it is requiredthat every student who does ride has in their possession a school provided ID card. Failure topresentanIDcardwhileboardingthebuswillresultindenialofbusservices.
• Quicklygotoyourassignedseatandremainproperlyseated:backagainstthebackofseat,bottomagainstbottomofseat,handstoyourself,withfeet,legsandbelongingsoutoftheaisle.
• Studentsshouldbecourteousandobeyallthedriver’sinstructions.• Itemsstudentsshouldnotbringoruseonthebusinclude,butarenotlimitedto,tobacco,alcohol,
illegal drugs, animals, glass objects, balloons, matches, nuisance items, hazardous materials,weapons,itemstoolargetohold,oranyobjectsthatmightdistractthedriver.
• GeorgiaLaw20-2-751.5statesthatstudentsshallbeprohibitedfromusinganyelectronicdevicesduring the operation of a school bus, including, but not limited to cell phones, pagers, audibleradios, tape or compact disc players without headphones, or any other electronic device in amanner that might interfere with the school bus communications equipment or the school busdriver’s operationof the school bus; and students shall beprohibited fromusingmirrors, lasers,flash cameras or any other lights or reflective device in amanner thatmight interferewith theschoolbusdriver’soperationoftheschoolbus.
• Studentsshouldnoteat,drink,orchewgumonthebus.• Studentswillnotextendbodypartsoranyobjectoutofthebuswindow.

• StudentsshallbetotallysilentatRailroadCrossingsuntilthebusiscompletelyacrossthetracks.• Noobjectistobethrowninto,outof,orinsidethebus.• Fightingorphysicalplayisprohibited-classroomconductisexpectedatalltimes.• Do not damage or litter the bus. The student or his/her parents must pay for any deliberate
damagetothebus.Failuretodothismayresultinsuspensionfromridingthebusuntilrestitutionismade.
• The emergency exits are to be used only at the direction of the bus driver, including roofhatch/vents.Nothingshouldeverbeplacedintheaisletopreventeasyexiting.
• Studentsmustprovideabuspasstothebusdrivergivingthempermissiontorideadifferentbusorto get off the bus at a different bus stop. This bus pass must be stamped with a schooladministrator’ssignature.
• Ifastudentdropssomethingunderornearthebus,askthedriverwhathe/shewantsyoutodo.Ifthe student has already crossed the street, he/she should wave their arms to get the driver’sattention. A student shouldNEVER go back into the roadwithout the driver giving them verbalpermissiontoretrievetheitem.Noitemisworththisrisk!
BUSPASSES
StudentIdentificationCardswillbeissuedtoallstudentsatthebeginningoftheschoolyearandshouldbewornwhileonschoolproperty.Thiswillallowthebusdriver,monitorandotherChattoogaCountySchoolstafftoquicklyidentifyeachstudent.Theseidentificationcardscannotserveasatrackingdeviceonceachilddisembarksfromhisorherbus.Thereisnootherpersonaldatastoredonthecard,noristhecardconnectedtotheschooldatabasecontainingthestudent’sinformation.
EverystudentridingaschoolbusmustpresenttheirIdentificationCardwhenenteringandexitingthebus.Thisisforstudentswhorideabuseverydayandforanystudentthatridesabusforfieldtripsandotheractivities.Studentswillbegivenawarningthefirsttimetheydonothavetheircard.Afterwards,theywillnotbeallowedonthebus;aparentorguardianwillneedtocometotheschooltopickupthestudent.Thisisforthesafetyofthestudentsaboardthebus,sowewillknowthenamesofthoseonthebusintheeventofanaccidentorifastudentgetsoffatanundesignatedstop.
LostIdentificationCardswillbereplacedtwiceatnocosttothestudent.Therewillbeareplacementchargeof$3.00foranyadditionalIdentificationCards.

AllpersonsemployedasbusdriversasofJuly1,1994,mustsubmitthemselvestorandomdrugtesting,includingrandomtestingforevidenceofalcoholuse.Anybusdriverfoundtohaveusedanillegaldrugwillbeterminated.Anybusdriverfoundtohaveanymeasurablealcoholinhisorhersystemduringtheschooldayissubjecttodisciplinaryactionasdeemedappropriate.Anybuddriverwhorefusesadrugoralcoholtestwillbeterminated. Drugtestingisarequirementofanyemployee,includingcoaches,whomaydriveavehicleprovidedbytheBoardofEducation.
EmergencyEvacuationProcedures
GeorgiaBoardofEducationrulesrequirethatALLstudentsreceiveinstructioninsafebusridingandemergencyevacuationprocedures.Thisrequirementisforallstudentsregardlessofwhethertheyaretransportedtoandfromschoolonregularbasis.Simplypostingrulesandevacuationproceduresdoesnotsatisfythisrequirement.Simulateddrillsaretobeconductedtwiceduringtheschoolyear.

PoliceInvolvementwithUnrulyStudentsontheBus
Inextremecasesofunrulyorthreateningbehavior,busdriversmaycontacttheTransportationDirectortorequestassistancefromlawenforcementofficials.Ifthisassistanceresultsinthestudentsbeingtakenintocustodybylawenforcementofficials,parentsandschooladministratorswillbenotifiedbytheTransportationDirector.
Studentparking
Studentparkingoncampusisaprivilegenota“Right”.Itisareasonableexpectationthatstudentswhoreceivetheprivilegetodrivetoschoolshoulddemonstrateahighlevelofresponsibility,self-discipline,andmaturitybefore,duringandafterschool.
Allstudentswhodrivetoschoolaretoparkinthestudentparkinglotintheassignedarea.Studentsaretoleavetheircarsandreporttothebuildingimmediatelyuponarrivingoncampus.Studentsaretoobserveallsafedrivingpracticesandlawsoncampus.StudentsarenottoreturntotheparkinglotduringtheschooldaywithoutbeingaccompaniedbyanadministratorortheResourceOfficer.Studentsareremindedthatthespeedlimitoncampusis15MPH.ItisaviolationofGeorgiaLawforstudentsunder18torideinthebedofapick-uptruck.Speedersandrecklessdriverswilllosetherighttooperateavehicleoncampus.
Thepurchaseofaparkingpermitentitlesstudentstoparkonschoolgroundsinadesignatedarea.Allparkingspotsarethesame.Studentsarenotallowedtoparkinspacesthataredesignatedforfaculty,staff,visitors,handicapped,etc.Allstudentcarsmusthaveaparkingpermit.Toobtainaparkingpermit,studentsmustshowavaliddriver’slicenseandproofofinsurance.Thepriceofaparkingpermitis$20.00peryear.Parkingpermitsaretagsandshouldbehungontherearviewmirrorinsuchawaythattheycanbeseenfromtheoutside.Theparkingpermitistobeusedonlybythestudenttowhomitisissued.Parkingspacesmaynotbesold,tradedorsharedwithanotherstudent.Studentsfoundbreakingthisrulewilllosetheirdrivingprivileges.Sincedrivingavehicletoschoolisaprivilegeandnotaright,studentsmaylosedrivingprivilegesforruleinfractionsandattendanceproblems.Theschoolreservestherightwithreasonablesuspiciontosearchstudentvehicles.Vehicleswithoutaparkingpermitwillbetowedwiththedriverbeingresponsibleforthetowingfee.
StudentInfractionsandDisciplineProcedures
TheChattoogaCountyBoardofEducationisdedicatedtosounddisciplinepractices.ThepurposeofthiscodeofconductistoprovidestudentsintheChattoogaCountySchoolDistrictaneffectiveandsafelearningenvironmentandtopromotelearningandencourageresponsibilityduringtheschooldayaswellasduringallschool-relatedactivities.Compliancewiththeserequirementsismandatory.
PursuanttoSB413,allinformationregardingschoolclubsandorganizationsaretobemadeavailableforparents/guardians.Thisinformationincludesthename,missionorpurpose,nameoffacultyadvisor,plannedorpastactivitiesoftheclubororganization.

StudentsandtheirparentsneedtoknowandunderstandtheCodeofConductinordertoachieveasuccessfullearningexperience.ThisstudentcodeofconductisnotlimitedtoPolicyJCDA.Instead,itincludesallstudentbehaviorpoliciesinSectionJoftheChattoogaCountyBoardofEducationPolicyManual.

Authority

AsusedinthisCodeofConduct,schoolpropertyincludes,butisnotlimitedto:
The land and improvements which constitute the school; any other property or building, includingschool bus stops, wherever located, where any school function or activity is conducted; any bus orother vehicle used in connection with school functions and activities, including but not limited to,schoolbuses,busesleasedbytheChattoogaCountySchoolDistrictandprivately-ownedvehiclesusedfor transportation to and from school activities; personal belongings, automobiles or other vehicleswhicharelocatedonschoolproperty.
Schooltechnologyresourcesinclude,butarenotlimitedto:
Electronicmediasystemssuchascomputers,electronicnetworks,messaging,andwebsitepublishing,andthe associated hardware and software programs used for purposes such as, but not limited to,developing, retrieving, storing, disseminating, and accessing instructional, educational, andadministrativeinformation.
SCHOOL OFFICIALS HAVE THE AUTHORITY TO USE PROFESSIONAL JUDGMENT IN DISCIPLININGSTUDENTSWITHINTHEGUIDELINESOFTHISBEHAVIORCODE.
Theschoolsystemrequiresadministratorstoinformallteacherstowhomthestudentisassignedwhenastudent, includinga"transferstudent",hasbeenconvictedofcertainfeloniesasdefinedinGeorgiaCode Annotated, (O.C.G.A.), and Section 15511-63. The schools may refuse to re-admit or enrollstudents expelled/suspended for being convicted of, being adjudicated to have committed, or beingindictedfororhave informationfiledforthecommissionofanyfelonyordelinquentactunderCodeSection15-11-28whichwouldbeafelonyifcommittedbyanadult.Aschoolisauthorizedtorefusetoenrollorsubjectastudenttoshort-termsuspension, long-termsuspension,orexpulsionforanytimeremaining inanother school system'sor school'sdisciplinaryorderupon receivinga certifiedcopyofsuchorderiftheoffensewhichledtosuchsuspensionorexpulsionintheotherschoolsystemorschoolwasanoffense forwhichsuspensionorexpulsioncouldbe imposed in theenrollingschool.Studentsenrollingmustprovideanofficialcopyofrecordsfromthepreviousschoolsystem,includingdisciplinerecords,foradmission.Schoolsmayenrollstudents"conditionally"ifparentssignareleaseauthorizingthepreviousschoolsystemtoforwardrecords.Further,thereleasemustindicatewhetherthestudent

The Student Behavior Code shall be provided annually to students through a handbook uponenrollment. The parent and student shall acknowledge their receipt of the code by completing therequired form. IEP-CommitteeReviewforStudentswithDisabilities
Special education personnel shall be consulted in matters involving special education students. Aspecialeducationstudentshallbeaffordedall rightsunder the IndividualswithDisabilitiesEducationAct(IDEA),20U.S.c.§1400,etal.seq.,Section504oftheRehabilitationActof1973,29U.S.c.,§706(8),794,794a,andtheAmericanswithDisabilitiesAct(ADA),42U.S.c.12101,etal.seq.
Any student who is receiving special education services or has been identified as a student with adisability under the Individuals with Disabilities Act (IDEA) and whose acts are determined by thePrincipal, or designee, Disciplinary Hearing Officer or Tribunal to have violated any of the rules,regulations or laws as alleged, shall be referred to an IEP committee if cumulative days of exclusionexceeds ten days, or the recommendation constitutes a change in placement. The IEP committee isresponsible for determining if the student's conduct is amanifestation of his/her disability,whethersuch conductwarrants a change in placement, amendments to the individual educational plan (IEP)and/or disciplinary actions. If the IEP committee determines that the student's conduct is not amanifestationofthestudent'sdisability,thestudentmaybedisciplinedasanyotherregulareducationstudent,butshallreceiveeducationalservicesduringthisdiscipline.TheIEPcommitteeshallalsohavetheauthoritytoconsider,recommendandimplementanychangesinthestudent'sIEPoreducationalplacement. Nothing in this rule shall alter or adversely affect the rights of students with disabilitiesunderapplicablefederalandstatelaws.
Suspension/Expulsion
Asuspensionisdefinedasanydisciplinaryactionthatremovesastudentfromregularclassesandotherschool activities. Chattooga County schools use both in-school and out-of-school suspensions in aneffort to provide a safe and appropriate learning environment. Georgia law (O.C.G.A. 20-2-764-766)requires students who have been suspended to have a conference with their parents and a schoolofficial before returning to class. They will discuss the reason for the suspension and write a plandesignedtosupportmoreappropriatebehavior.Parentswhoareunabletoattendaconferencemustcontact the school for further information. A notation of the conference is placed in the student'spermanentfile.

1. In-School Suspension (ISS) - An educational environment for students whose behaviorprecludes attendance in the regular school program. This setting is in the local school and isstaffedbyacertifiedteacher.
2. ShortTermOutofSchoolSuspension(OSS) - removalof thestudentfromtheschoolcampusandexclusionfromschoolsponsoredactivitiesforaspecificperiodoftimeupto10days.

5. Permanent Expulsion- removal of a student from the school systemwith no opportunity toreturn.
ChattoogaAcademy
An educational environment for students in Grades 6-12 whose behavior precludes continuedattendance intheregularschoolprogramandwherethe instructionalprogramisbaseduponnormalcoursecontent,andbehavioriscarefullymonitored.
CorporalPunishment
Corporal punishment is a disciplinary responseoption for the administrator’s discretionary use.Onlyadministratorswillusecorporalpunishmentfordiscipline.
A faculty member will witness the use of corporal punishment by the administrator. After corporalpunishmentisadministered,theadministratorwillnotifytheparentorguardianofitsuse.

TheTeacherAuthorityProvisioninGeorgiaCode20-2-737and738providesfordisciplinaryactionforastudent being identified as a student who substantially interferes with a teacher's ability to teach,including:

TheSuperintendentshall,anddoes,fullysupporttheauthorityofprincipalsandteacherstoremoveastudentfromtheclassroompursuanttoGeorgialaw.
Incaseswherethestudentisachronicdisciplinaryproblem,theprincipalshallnotifytheparent(s)andinvite themtoobserve thestudent inaclassroomsituation.At leastoneparent shallbe invited toaconferencetodeviseadisciplinaryandbehavioralcorrectionplan.
Parents shall be invited to a conference todevise a behavioral planbefore studentswhohavebeensuspended or expelled return to school. Failure of the parent to attend such conference does notprecludethestudentfrombeingreadmitted;however,schoolofficialsshallmeetwiththestudenttodeviseabehaviorplan.
Astudentsupportprocessshallbeinplace.Itmayinclude,butisnotlimitedto,charactereducation:aparentconference,abehaviorplan,mentoring,mediation, tutoring,advisement,angermanagement,violenceprevention,StudentSupportTeam(SST),BehaviorActionTeam(BAT),appropriatecommunityagenciesinvolvement,andexemplaryinterventionprograms.
PLACEMENTREVIEWPROCEDURESFORREMOVINGSTUDENTSFROMCLASS
BasedonO.C.G.A.20-2-737and738, a teachermay remove fromclassa studentwho repeatedlyorsubstantiallyinterfereswiththeteacher'sabilitytoconductinstructionalactivitiesprovidedthestudenthas previously been reported or the teacher determines that the behavior of the student poses animmediate threat to the safetyof the student's classmatesor the teacher. In the caseof immediateremovalfromtheclassroom,theteacherwillsubmitawrittenreferralbytheendoftheschooldayoratthebeginningofthenextschooldaytotheprincipalorotherschooladministrator.Theadministratorwill,withinoneschooldayafterthestudent'sremoval fromclass,sendtothestudent'sparents,andthespecialeducationcasemanager,ifapplicable,awrittennoticethatthestudentwasremovedfromclass,acopyoftheteacher'sreferral,andinformationregardinghowtheparentmaycontactaschooladministrator.Whena teacher removesa student fromclass,asprescribedabove, theadministratorwilldiscussthematterwiththeteacherbytheendof theschooldayorat thebeginningof thenextschoolday.Theadministratorwillgivethestudentoralorwrittennoticeasthebasis(evidence)fortheremoval from class. If the teacherwithholds his or her consent to the student's return to the sameclass,orthestudent'smisbehaviorprecludesreturningtoschool(suchascommittingamajorviolationoftheCodeofStudentConduct)theadministratordeterminestheconsequencesforthestudentbythe

end of the first day, which may include in-school suspension or out-of-school suspension or anappropriatetemporaryplacement.Anyin-schooloroutschoolsuspensionmustbedeterminedbytheprincipal,ordesignee.Suchsuspensionsmaynotexceedtenschooldays.SuspensionsorexpulsionsoflongerthantendaysmaybeimposedonlybytheDisciplinaryTribunalHearingPanel.
If the teacher withholds his or her consent to the student's return to the same class and theadministrator does not impose other disciplinary action, the administrator will convene the LocalPlacement Review Committee by the second day of the removal from the classroom, and thecommitteewill render a decisionwhether the student should or should not return to the teacher'sclassroom. The committee's decision will bemade no later than three days after the removal fromclass.Intheinterim,theadministratorwillmakeatemporaryplacementforthestudent(otherthaninthe classroom from which the student was removed, unless the teacher gives permission for thestudenttoreturntoclass).
APPOINTMENTANDFUNCTIONOFLOCALPLACEMENTREVIEWCOMMITTEE
Each school principal shall establish the Local Placement Review Committee. The school faculty willselect twoteachersandonealternateandtheprincipalwill selectonestaffmember toserveon thecommittee(schoolsmayhavemorethanoneLocalPlacementReviewCommittee,atthediscretionoftheprincipal,buteachcommitteemusthavethreemembersselectedasstatedabove).Theselectionofthecommitteeshouldproceedasfollows:(1)principalasksforvolunteersandnominations;(2)asecretballot istakenatafacultymeeting;(3)resultsaretabulatedbyateacher;(4)resultsoftheballotaresharedwiththefaculty.TheLocalPlacementReviewCommittee(bysimplemajorityvote)determinestheplacementofastudentwhenateacherwithholdshisorherconsenttothereturnofthestudenttotheteacher'sclasswhenanadministratorhasnotimposeddisciplinaryaction(providedtheteacherhasmetthereportingrequirementsenumeratedaboveorifthestudentposesathreat).Thecommitteeisauthorizedto(1)returnthestudenttotheteacher'sclassupondeterminingthatsuchplacementisthebestoronlyalternative;or(2)referthestudenttotheadministratorforotherappropriateaction.Thedecision of the committee shall be in writing and will be made within three school days after theteacher withholds consent to the return of the student. If the Local Placement Review Committeedecidesnot to return thestudent to theclass fromwhichheor shewas removed, theadministratormay place the student into another appropriate classroom, in-school suspension, or out-of-schoolsuspension.In-schoolsuspensionorout-of-schoolsuspensionsmaybeforuptoten(10)days.Anyandall disciplinary action will be sent to the parents in writing, by either letter or copy of the StudentDisciplineReferralform,withanotetotheparenttoconfirmreceiptofthenotice.
Members of the Local Placement Review Committee may resign from the committee, with thereplacementselectedbythesameprocess.Ifastudentislaterreferredforalocalformalhearingandfor an evidentiary hearing, the members of the Local Placement Review Committee shall not berequiredtotestifyastoanycommitteedecisionoraction.

TribunalHearingProcedures
Tribunal hearing officers are appointed by the Board of Education to hear disciplinary matters. If ahearingiscalled,thestudentwillbesuspendedfromschooluntilthehearingcanbeheld.Asrequiredbystate law,disciplinaryhearingsare tobeheldno later than10schooldaysafter thebeginningof thesuspensionunlesstheparentandschoolmutuallyagreetoanextension.
Priortothehearing,studentsandparents/guardianswillreceiveanoticetoincludethefollowing:
1. Therulewhichthestudenthasallegedlyviolated.2. Adescriptionofthestudent’sact3. Thenamesofthewitnesseswhomaytestifyagainstthestudent(thelistofwitnessesmaybe
addedtopriortoandduringthehearing).4. Themaximumpenaltythatthestudentcouldreceive.5. Thetimeandplaceforthehearing.6. Thatthestudentisentitledtorequirewitnessestobepresentatthedisciplinaryhearing.The
studentmustnotify the schooladministratoror thedisciplinaryhearingofficer if the studentdesiresasubpoenatobeissuedbythesuperintendent.
Atthetribunalhearingbeforethedisciplinaryhearingofficer,studentshavethefollowingrights:
1. Topresentwitnessesandevidence.2. Toexamineanyandallwitnessespresented.3. Tohaveanattorney,atthestudent’sexpense,torepresentthestudent.
Astudentorastudent’srepresentativemayappealanydecisionofthedisciplinaryhearingofficerbysubmittingawrittennoticeofappealtothesuperintendentwithintwenty(20)daysfromthedatethedecisionismade.
When a tribunal hearing is appealed, the Chattooga County Board of Education will review thetranscriptofthehearing,makeadecisionbasedsolelyontherecord,andnotifystudentsandparentsinwritingoftheBoard’sdecision.AtthetribunalhearingbeforetheBoard,studentshavetherighttobe represented, at the students’ and parents’ expense, by an Attorney. Anyemployeewhohasreasonablecausetobelievethatastudentpossessesaweaponasdefinedinparagraph1,isinvolvedinanassaultusingaweaponasdefinedinparagraph2,orisinvolvedinasecondoffensewithaweapononcampusmustreportsuchviolationstotheprincipalorassistantprincipaloftheschool.Iftheprincipalhasreasonablecausetobelievethatsuchreportisvalid,he/shemustimmediatelymakeanoralreporttotheSuperintendentandtotheappropriatelawenforcementauthorityanddistrictattorney.
Thestudent’sparentsorguardianwillbenotifiedimmediatelyofhis/herchild’sinvolvementinanyactivityinvolvingweapons.
