Deputy AcquittedMathew Eisenberg found not guilty

On May 31, BSO Deputy Mathew Eisenberg was found not guilty. Mathew was represented by attor-ney Al Milian, who never ceases to amaze us with

his excellence. No words can truly express how much I appreciate his work on this case and all of the cases he handles for our PBA members.

The trial was held in Judge Michael Robinson’s courtroom. Deputy Eisenberg was charged with official misconduct, falsifying reports and battery in conjunction with an arrest he made in November 2011 in Tamarac. A complaint was filed by a homeless man who alleged that Eisenberg punched him in the face during the arrest. The man, who had numer-

ous prior convictions, had been told previously by Deputy Eisenberg not to be in the area.

I would like to thank everyone who came out in support of

Deputy Eisenberg during the trial. I don’t have the names of everyone who at-tended, but you know who you are, and I just wanted to say thank you for being

there for Mathew and his family.

Thank you once again to Al Milian for the outstanding job.

We are busy wrapping up negotiations on outstanding contracts before city governments recess for the summer. Hollywood is close to a deal, and we have some reopeners with other agencies that we are trying

to expedite. This is an important time; cities set “not-to-exceed” millage rates before the break in order to finalize budgets when they reconvene.

The PBA is also attempting to assist Sheriff Israel with BSO’s budget shortfalls. Raising taxes is certainly unpopular, but we realize that the public is always con-cerned about crime and the safety of their communities.

A number of state legislators will be leaving Tallahassee this year when their terms expire. We’ve been meeting informally with several candidates who un-derstand our issues. Clearly the biggest race this year will be for the governor’s office, in which we will take an active role.

It is an honor for us to serve those who protect and serve. Thank you for standing with us.

SCOTUS: DNA Collection On Arrest OK

On June 3, the Supreme Court ruled that police can take DNA samples from suspects who have been arrested and

charged, but not convicted of a serious crime.

The majority opinion was written by Justice Anthony Kennedy, said that taking DNA samples was “like fingerprinting and photographing, a legitimate police booking proce-dure,” and that Fourth Amendment rights had not been violated.

The case in question was a 2010 rape convic-tion and subsequent life sentence for Alonzo Jay King. King gave a DNA sample after his

arrest in 2009 on unrelated charges. That sample linked him to a 2003 rape. The Maryland appeals court concluded that King’s Fourth Amendment rights were violated when he was

required to provide the sample.

The Court was split 5-4, with Justice Antonin Scalia joining Justices Ruth Bader Ginsberg, Sonia Sotomayor and Elna Kagan in the dis-sent. In that dissent, Scalia takes issue with Kennedy’s assertion that DNA sampling is akin to fingerprints and mug shots because it took police three days to take the swab. “I suspect, though, that they did not wait three days to ask

his name or take his fingerprints,” he wrote.Source: Reuters.com
