THE BOROUGH OF BLACKBURN (VARIOUS STREETS (NO .1) (DARWEN)PROHIBITION OF WAITING ORDER 1985

The Council of the Borough of Blackburn (hereinafter referred to as "theCouncil") pursuant to arrangements made under Section 101 of the LocalGovernment Act 1972 with the Council of the County of Lancashire, inexercise of the powers of the said County Council under Section 1, 2, 4, and124 of, and the Ninth Schedule to, the Road Traffic Regulation Act 1984, andof all other enabling powers and after consultation with the Chief Officerof Police hereby make the following Order:-

This Order shall come into operation on the

1985and may be cited as the Borough of Blackburn (Various Streets) (No.l)(Darwen) (Prohibition of Waiting) Order 1985 .

2 . (i) In this Order -"bus stop area" means any area of carriageway in any of the lengths ofroad or on the side of road specified in Schedules 1, 2, 3, 4 and 5,intended for the waiting of buses, which is comprised within andindicated by "a"road marking complying with either diagram 1025 .1 ordiagram 1025 .3 in Schedule 2 to The Traffic Signs Regulations andGeneral Directions 1975 ;

"disabled person's badge" has the same meaning as in The DisabledPersons (Badges for Motor Vehicles) Regulations 1975 ;

"disabled person's vehicle" has the same meaning as in The LocalAuthorities' Traffic Orders (Exemptions for Disabled Persons) (Englandand Wales) (Amendment) Regulations 1975 ;

"parking disc" means a disc, issued by a local authority, complying withthe requirements of the British Standard Specification for Parking Discs(BS No 4631 : 1970), but coloured orange, and capable of showing thequarter hour period during which a period of waiting begins .

(ii) For the purpose of Articles 3, 4, 5, 6 and 7 of this Order avehicle shall be regarded as displaying -

(a) a disabled person's badge in the relevant position, when -

(i) in the case of a vehicle fitted with a front windscreen,the badge is exhibited thereon with the obverse sidefacing forwards on the near side of and immediatelybehind the windscreen, and

(ii) in the case of a vehicle not fitted with a frontwindscreen, the badge is exhibited in a conspicuousposition on the front or near side of the vehicle, and

(b) a parking disc in the relevant position, when the disc isexhibited thereon with the side which shows the time facingforwards or outwards and immediately behind the windscreen orside window nearest to the kerb .

(iii) Except where otherwise stated, any reference in this Order to anumbered Article or Schedule is a reference to the Article orSchedule bearing that number in this Order.

3 . Save as provided in Articles 8(i), (ii), and (iii) and 9 of this Orderno person shall, except upon the direction or with the permission of apolice constable in uniform or of a traffic warden, cause or permit anyvehicle to wait on the sides of road or in any of the lengths of roadspecified in Schedule 1 .

4 . Save as provided in Articles 8(1), (ii), and (iii) and 9 of this Orderno person shall, except upon the direction or with the permission of apolice constable in uniform or of a traffic warden, cause or permit anyvehicle to wait between the hours of 8 a.m. and 8 p.m. on the side of roador in the length of road specified in Schedule 2.

5 . Save as provided in Articles 8(i), (ii) and (iii) and 9 of this Order noperson shall, except upon the direction or with the permission of a policeconstable in uniform or of a traffic warden, cause or permit any vehicle towait between the hours of 8 a.m . to 7 p .m. on the sides of road or in any ofthe lengths of road specified in Schedule 3.

6 . Save as provided in Articles 8(i), (ii), and (iii) and 9 of this orderno person shall, except upon the direction or with the permission of apolice constable in uniform or of a traffic warden, cause or permit anyvehicle to wait between the hours of 7 a .m. and 7 p.m. on any day other thana Sunday on the sides of road or in any of the lengths of road specified inSchedule 4 .

(a) a person to board or alight from the vehicle ;

8 .

(i) Nothing in Articles 3, 4, 5, 6 and 7 shall render it unlawful tocause or permit any vehicle to wait in the lengths of road referredto therein for so long as may be necessary to enable -

(b) the vehicle, if it cannot conveniently be used for suchpurpose in any other road, to be used in connection with anyof.the following operations, namely -

(i) building, industrial or demolition operations ;

(ii) the removal of any obstruction to traffic ;

(iii) the maintenance, improvement or reconstruction of thesaid lengths of road or side of road ; or

(iv) the laying, erection, alteration or repair in, or in landadjacent to the said lengths of road or side of road ofany sewer or of any main, pipe or apparatus for thesupply of gas, water or electricity or of any telegraphicline as defined .i n the Telegraph Act 1878 ;

(c) the vehicle, if it-:cannot conveniently be used for suchpurpose in any other road, to be used in the service of alocal authority or a water authority in pursuance of statutorypowers or duties .

(d) the vehicle to be used for the purpose of delivering orcollecting postal packets as defined in section 87 of the PostOffice Act 1953 ;

(e) the vehicle to be used for fire brigade, ambulance or policepurposes .

(ii) Nothing in Articles 3, 4, 5, 6 and 7 shall render it unlawful tocause .or permit any vehicle to wait for so long as may be necessaryfor the purpose of enabling goods to be loaded on or unloaded fromthe vehicle in the lengths of road specified in Schedules 1, 2, 3,4 and 5 .

(iii) Nothing in Articles 3, 4, 5, 6 and 7 shall render it unlawful tocause or permit a disabled person's vehicle which displays in therelevant position a disabled person's badge, and a parking disc (onwhich the driver, or other person in charge of the vehicle, hasmarked the time at which the period of waiting began) to wait inany of the lengths of road or on the side of road referred to inthose Articles for a period not exceeding two hours (not being aperiod separated by an interval of less than one hour from aprevious period of waiting by the same vehicle in the same lengthor on the same side of road on the same day) .

9. In so far as any provision of this Order conflicts with a provisionwhich is contained in'an Order made or having effect as if made under theAct of 1984, and existing at the time when this Order comes into operation,and which imposes a restriction or prohibition on waiting by vehicles otherthan stage carriages or express carriages in a bus stop area or grants anexemption from such restriction or prohibition, that provision of that Ordershall prevail .

10 . The prohibitions and restrictions imposed by this Order shall be inaddition to and not in derogation from any restriction or requirementimposed by any regulations made or having effect as if made under the Act of1967 or by or under any other enactment.

11 . The Orders specified in Schedule 6 are hereby revoked to the extentspecified in the Second Column thereof.
