Snyder In Memoriam On February 15th, the Bar Association of Montgomery County and many of its mem- bers lost a dear friend in William (Bill) C. Davis, III. To state that he was an excellent attorney practicing with a number of dis- tinguished Law Firms wouldn't begin to describe Bill as our friend. He was always generous with his time and talents. He skillfully helped organize and run the committee to reelect our Sitting Judges as noted in the moving eulogy given by David Merkin. Bill always had a kind word, an easy smile and quick comeback to teasing from his colleagues. Not long ago Mimi Magyar asked what I thought of Bill's new facial hair (Goatee). When I replied that I had never before met Robin of Locksley or his merry men Bill simply rolled his eyes smiled and shook his head. A class Bill Davis response! I always assumed that I would be able to enjoy his good company for many years to come. Bill will truly be missed! I wish to extend condolences to Mimi Magyar, Bill’s children and extended fam- ily. On a happier note, at our last Bar Luncheon we were pleased to honor courthouse employees Joette Gangley, Sandy Thorogood, and Tom Murray for completing thirty five years of exemplary service to the Judiciary, members of our Association and the People of Montgomery County. Association of MontgomeryCounty and many of its mem-bers lost a dear friend in William(Bill) C. Davis, III. To state thathe was an excellent attorneypracticing with a number of dis-tinguished Law Firms wouldn'tbegin to describe Bill as ourfriend. He was always generous

with his time and talents. He skillfully helpedorganize and run the committee to reelect our SittingJudges as noted in the moving eulogy given byDavid Merkin.

Bill always had a kind word, an easy smile andquick comeback to teasing from his colleagues. Notlong ago Mimi Magyar asked what I thought ofBill's new facial hair (Goatee). The Children’s Waiting Room,“KiDS SpoT” is expected to open April6, 2015. Kids Spot will be a kid-friendlywaiting area for children whose familieshave business with the Circuit Court forMontgomery County. Children betweenthe ages of 2 and 12 will be welcomed atKids Spot, free of charge, as long as theirguardian is in the Circuit Court Building.

The Terrace Level Corridor con-necting the Circuit Court to the EOB isscheduled to reopen March 31, 2015.Until that time, all access between theCircuit Court and the EOB will bethrough the EOB Lobby located on theMonroe Street side of the Circuit Court.

There are a number of things that Ihave learned this past year that I thoughtmight be of interest to you. I was pleas-antly surprised to find that at the ABAmeetings in Chicago and Boston that ourprogressive county association and itsExecutive Director were both well-known and respected. Many of the newprograms that the ABA was touting atthose meetings had for some time beensuccessfully adopted and further devel-oped by our association. These programsinclude Long Range Planning, theLeadership Academy and a myriad ofprograms to enhance the enjoyment of thepractice of law.

What many of our members still maynot realize is how many meaningful ben-efits we provide. Our challenge will be toencourage our members to go to our web-site, utilize these services, and discussthem with others. These important servic-es and benefits are not simply the dis-counts to restaurants, legal supplies, andsupport services to law firms, travel andhealth. They include a number of impor-tant programs which are still regrettablyunderutilized.

Many members may still be unawarethat we have revamped our EthicsCommittee as well as the LawyerAssistance Committee to provide greatersupport and protection to our membersand their clients. Our community out-reach programs with local charities havebeen more successful than ever; yet needto be expanded to magnify the service toour community.

One of the most important challengesto any association is to grow and expandmembership. Our single greatest chal-lenge is to get more members involvedand overcome what appears on its face tobe "apathy". In reality our members arecommitted to their practices and familiesand they don't often have unaccounted forspare time on their hands. Our challenge isto let them know that even a small com-mitment of time can yield great benefit tothe association while enriching their lives.

I can't understate my surprise at theoverwhelming willingness of members tohelp when I have called asking for assis-tance. Likewise the willingness of our

Here are two methods you might utilize to lead your team and your firm:In the first leadership method, you wait until someone does something wrong

and correct the behavior. This draws attention to negative behavior.In the second, you meet with each team member regularly (monthly perhaps).

At these meetings you can review important markers that tell you how this personis doing- Billable hours, responsiveness to clients, responsiveness to other teammembers, how hard they work, how much they get done, etc. You also discuss whatthis team member does well and ask them how they will improve areas they need toget better at.

The first method almost always has negative emotions connected with it. Thesecond takes more time but prevents problems and creates a dialog for this personto be a better team member who contributes more.

The first method is stressful for you, the team member and others at the firm.The second creates a relationship that can relieve stress every day and improvesindividual and firm performance.

We can’t thank everyone enough withtheir assistance and flexibility with thisyear’s Mock Trial Competition. This is my11th year organizing this terrific Programand it was a challenge. We had a recordnumber of teams compete in this year’s com-petition. We also had a record number ofcancellations due to the snow, freezing rain,sleet and ice. We had to re-schedule over 25trials. In total, we had to schedule 87 trials ina six week period. That is not an easy taskand it is not a task that we took on ourselves.

Patrick Hoover (March 16, 2015)reporting from Austin, Texas at SXSW(South by Southwest), where everyonewho is anyone in the Tech world cometogether to meet, present, see and beseen; to eat, drink and party in a trulyawesome display of wealth and power.SXSW attendees run the gamut from thebiggest guns in tech – Oracle, Sony,Cisco, Microsoft, AT&T and many oth-ers – to the newest tech team startupslaunching a dazzling array of new offer-ings in tech.

For one week, SXSW participantstravel to Austin from every corner of theglobe to hear and learn of the newestofferings in tech. Software engineers(programmers), UX architects (usabilitydesigners), VC's (venture capitalists),Designers and Developers from everytech sphere and every market segmenttravel to this friendly Uber hip corner ofTexas. I write this after three days afterwitnessing but a sample of the many pre-sentations, highly sophisticated tech sem-inars, elaborately staged panel discus-sions, highly produced, live streamedglobal presentations and talking withscores of tech vendors whose "booths"appear on the very large floor of theSXSW trade show.

I arrived in Austin Friday morningwith three young, 20 something profes-sionals. Programmer, Usability Expertand Designer, my three friends each workin the DC area and each specialize in var-ious forms of tech, earning an excellentincome while providing their differentemployers, the essential knowledge andmarket means to stay out front and in playin the breakneck world of tech develop-ment. SXSW literally takes over theAustin city limits. I’m told on goodauthority that up to 80% of residents fleeduring SXSW, many renting out theirhomes using Air B2B for week longrentals averaging no less than four fig-ures.

Even more amazing to me was theprodigious after hours partying found in

The Montgomery County BarFoundation (“MCBF”) is excited toreport that it has implemented theCreating an Improved Tomorrow (“C-IT”) Program this year, and is currently inthe midst of its third set of interactiveclass sessions at Blair, Northwood, andSpringbrook High Schools, during this2014-15 school year. The C-IT Program:(a) encourages communication withyoung people in our community regard-ing legal issues; (b) enhances high schoolcurriculum; (c) promotes the analyticalskills and knowledge of, and respect forself and others among, high school stu-dents; and, (d) encourages high schoolstudents to participate in legal processesand decision making, rather than justbeing subject to them. Furthermore, thestudents provide feedback on the issuepresented, through an essay contest inwhich they apply the facts of a hypothet-ical situation to the laws, regulations, andpolicies that affect students in MCPS, andpropose ideal policy changes to helpimprove the situation.

The Bar Association of MontgomeryCounty (“BAMC”) and the MontgomeryCounty Public Schools (“MCPS”) beganthe C-IT Program as a joint, collaborativeeffort, during the 2013-14 school year.Last year’s C-IT theme focused on theself-defense laws in Maryland andFlorida, and the related issues derivedfrom the Trayvon Martin trial. The C-IT

Program received the 2013-14 MSBALocal & Specialty Bar Best Service to thePublic Project Award.

The 2014-15 C-IT Program topiccenters around electronic information law,or “cyber law”, including cyber-bullying,cyber-harassment, and sexting. MCBFattorneys have presented PowerPointPresentations and engaged in discussionswith more than 1000 students in class-rooms and assemblies at the three highschools, resulting in heightened aware-ness regarding the laws prohibiting, andpenalties associated with, the offensiveuse of electronic communication devices.The proliferation of attacks on peoplethrough electronic media exponentiallyincreases the speed, rate, area, and popu-lation over which negative information isdispensed. The attorneys emphasize theimpact that cyber-harassment, cyber-bul-lying, and sexting cause young peopletoday, including increased damage to rep-utation, civil and criminal liability expo-

sure, exposure to pedophiles, and teen sui-cide. The C-IT Program has provided avoice to students, several of whom haveapproached attorney presenters after theclasses to discuss challenges they haveexperienced as victims of cyber-bullyingand cyber-harassment, as well as potentialresources or solutions.

The MCBF hopes to award prizes tostudents and/or schools at the upcomingculminating event for the essay contestwinners, and is soliciting tax deductiblecontributions for that purpose. The District Court Bench BarCommittee held its March meeting onMarch 10, 2015.

The Court passed along informationto make the bar aware of Civil Claims

There has been much discussion ofjudgments that have been denied, or dam-ages not awarded, due to the submissionsof counsel for the items claimed. Forexample, attorneys must review the docu-ments that are sued upon, to be certainthere is an attorney’s fee provision beforeasking the Court to award attorneys fees.The documents must provide for interestand late charges in order for attorneys toclaim interest and late charges. If theseitems are requested in the claim, but notsupported by the agreement or other doc-uments that are sued upon, the attorneyshould not be asking for these and thecourt is not granting these amounts andthe Court is concerned about these mat-ters.

The Court is encouraging transparen-cy in the presentation for ex parte proof ofdamages, and damages in general for civilclaims. If an attorney submits proof ofdamages, the attorney should make cer-tain that the amounts claimed are notalready included in a prior judgment, thatpayments made since the entry of a priorjudgment were properly credited, and that

the items claimed in the new lawsuit arejustified and based upon solid ground inthe documents. Judges believe that someattorneys are intentionally “hiding”charges in their accounting submissionsto try to collect improper fees. Althoughthis could be attributable to accountingstatements prepared by clients withoutknowledge of what the court has alreadyruled, or can rule, the attorney has aresponsibility to make an independentreview before submitting the claim to thecourt. The Court wants the attorneys toshow a breakdown of fees in their presen-tation, that is clear, transparent, does nothide fees that should not be included,takes into account what may have alreadybeen included or not included in a priorjudgment, and that payments on that priorjudgment were properly credited. Civil overbooking

There has been a recurring problemwith overbooking of trials by defenseattorneys who have multiple cases on thesame docket. The insurance defense firmsand other large firms that have multiple

cases need to have cases rescheduled ifby not doing so, they will be committedto more than two cases. Otherwise, ajudge and courtroom may go empty wait-ing for a lawyer to finish up another caseand be available for a case that is ready togo. This can unnecessarily tie up thejudge, courtroom staff, interpreters, wit-nesses, parties, etc. The clerk’s office willwork with attorneys in this situation toavoid the overbooking.

Richard London, Co-ChairAnnouncements in Criminal Cases

Civil citations for possession of lessthan 10 grams of marijuana require acourt appearance if the recipient wasunder 21 at the time the citation wasissued. The District Court will send“must appear” notices for actual trialdates, for example, the docket inCourtroom 412 in Rockville.

When defendants appear on theirtrial date they will be instructed to go tothe IPSA referral office on the 6th Floorto be interviewed and scheduled for anevaluation. That will take place separate-ly at the regular IPSA office in Rockville

and will cost $100.00 when they appearfor the evaluation. In most cases, IPSAwill then refer these individuals to a fourhour drug education course which is cur-rently being given on Tuesdays in theRockville District Court in a courtroomon the 6th Floor.

Unlike the original IPSA program,there is no community service require-ment for this new program.

The above drug education program isa substitute for the $100.00 fine thatwould otherwise be ordered by the Court.However, under 21 violators cannot pay afine in any amount to avoid a courtappearance or the drug education course.

Drug education is also required forthird offenders 21 and older, but the like-lihood of these people being identifiedand notified to appear is similar to thechances of the Washington Redskins win-ning the next Super Bowl.

District Court still encourages allpersons 21 and over to pay the $50.00civil penalty for these under ten gramcitations, but will enter a judgment for

Lawyers are nearly 4 timesmore likely to suffer from depression thanthe general population and we rank 4thamong all professions in suicides.

Your call to the Pro BonoProgram to say that you want to be ofassistance would be greatly appreciated.Please believe that lending a hand to thosewithout resources will not go unnoticedespecially by our community residents.

We are also seeking attorneys forcollaboration with Catholic Charities,where by a MD-barred attorney willassist in the family law portion of aSpecial Immigrant Juvenile Status case,usually via the establishment of a custodyor guardianship.

There are two ways for county resi-dents to receive FREE LEgAL SERV-iCES in civil cases – at a legal adviceclinic or through the client intake line forreferral to an attorney volunteer for directrepresentation. The legal advice clinicsoperate in four locations across the coun-ty (SEE BOX BELOW) and provide res-idents the opportunity to walk-in andmeet with an attorney volunteer withoutscheduling an appointment. Eligibleclients present their legal problems to anattorney and receive free immediate legaladvice and/or referral to a non-profit orgovernment social service agency thatmay be helpful. The client intake lineoperates out of the main office where thestaff screens calls from potential clients.The Pro Bono Program staff conducts allscreenings over the phone. Cases referred

to attorney volunteers include family law,debt collection, bankruptcy, limitedemployment, limited immigration, willsand power of attorney.

Another reminder for those of youthat may be interested, the Pro BonoProgram has purchased the Best CaseBankruptcy Software. The Software pur-chased includes both Chapters 7* & 11.A computer, printer, and internet areavailable for use. Please contact Maria toreserve the office . *Please keep in mindthat the Pro Bon Program will continue toonly handle Chapter 7 Bankruptcy.

The Pro Bono Program currently isparticipating in three projects. First, weparticipate in the Judicare project.Contested custody and complex familylaw cases are referred at a reduced fee toexperienced family law attorneys.Attorneys can seek reimbursement of $80per hour with a cap of 20 hours per case.The Pro Bono Program requires that theattorney must accept a pro bono case foreach case accepted under the JudicareProject. Second, we have a workingagreement with the Collaborationproject of Maryland for family law casereferrals that include modifications.Third, we refer eligible clients with debtbuyer cases to attorney volunteers fordirect representation under theConsumer protection project.

The pro bono program providesFREE LEgAL TRAiNiNg to attorneyvolunteers. It is not too late to sign up forThe Rita Rosenkrantz Family LawTraining. But hurry! It’s only opened forthe first 50 registrants! It is scheduled fortwo evenings: Monday, April 20 &Wednesday, April 22 from 5:30 pm to
