    TAMILS MOURN THE PASSINGAWAY OF PARVATHI AMMA

    Tamil Eelam and the Tamil speaking world

    deeply mourn the passing away of Par-vathimmal, the beloved mother of Velupil-

    lai Pirapaharan the unique leader of theTamils.

    Canada chapter of the transnational gov-

    ernment of Tamil Eelam joins the Tamilspeaking world in expressing its deep sor-

    row and sympathy to the Pirapaharan fam-ily on the passing away of his mother who

    bought him to this world and changed thehistory of the Eelam Tamils and the Tamils

    spread out through put the world. If thelate lamented Thiruvagendam Velupillai

    and Vallipuran Parvathi have thought thatwe are two and let us have two Pirapaha-

    ran may not have been born as the fourthchild. The birth of the fourth child Pirapa-

    haran have changed the history of theEelam Tamils. His revolution and his

    steadpast commitment to an independentTamil Eelam is legendary. It is in this con-

    text that the Tamils all over world are eter-nally grateful to Thiruvagendam Velupallai

    and Vallipuran Parvathimmal to have givenbirth to this wonderful child.

    I was privileged to meet Mr. Velupillai and

    Parvathimmal in Thiruchi and Chennai dur-ing my long stay in Tamil Nadu. My con-

    versation with them gave me a lastingimpression of their courage of conviction

    and their moral stand in all issues. They

    were proud of their son and gave a back-

    ing for all what is stood for. They sufferedin silence for the Eelam cause.

    Mr. Velupillai passed away in 2010 at the

    age of 86 at the Panagoda military camps.He was kept in isolation and illegal cus-

    tody by the Sri Lanka army. Though heand his wife were in the same prison, they

    were kept incommunicado. Paravathimmalwas kept in darkness when her husband

    passed away. The

    information was given to her in a belatedmanner. The sufferings they underwent

    cant be measured in words. After thepassing away of her husband she was

    taken to Malaysia for

    treatment. She suffered from acute dia-betes arthritis and blood pressure. She

    was brought to Tamil Nadu with the neces-sary passport and visa. But Mr.Karunanithi

    the chief minister of Tamil Nadu refusedentry to her in a most inhuman manner.

    She was taken back to Malaysia and aftersome time later was brought back to Sri

    Lanka at admitted to the Jaffna Hospitaland then to the Vellttinthurai regional Hos-

    pital. In the present political climate pre-vailing none of her children could visit her.

    In addition to her physical suffering the

    mental agony aggravated and she passed

    away on the 20th of February 2011 at theage of 80. The funeral will take on Tues-

    day February 22nd, 2011. In spite of armyharassment flags are flown at half mast.

    The people in Jaffna are queuing in thou-sands to pay their last homage to the

    beloved mother of Pirapaharan.

    It may be added that the house of Par-vathimmal where Pirapaharan was born

    and raised was destroyed by the SriLankan army by last year. The monuments

    at Theeruvil were destroyed by the SriLankan military a few months ago.

    Though Thiruvagendam Velupillai and Val-

    lipuran Parvathi have gone to the land ofno return, their supreme sacrifices are re-

    membered by the Tamils and they are en-shrined in our hearts.

    The moving tributes of Pala Nedumarnan,

    Vaigo, Seeman, Thirumavalavan and theleaders of Tamil Nadu speak volumes of

    their love and regards if the Pirapaharanfamily.

    Acting UN special envoy to Burma, Vijay

    Nambiar, is facing calls from two Sri Lan

    kan rights group to be included in an inves

    tigation into the armys execution of surrendering Tamil Tiger rebels in 2009.

    The charges were submitted to the Intern

    ational Criminal Court ( ICC ) by the US-

    based Tamils Against Genocide ( TAG )

    and the Swiss Council of Eelam Tamils

    (SCET). They refer to Nambiars time as

    the UNs Chief of Staff when he was sent

    to Colombo to aid negotiations towards an

    end to the countrys lengthy civil war.

    Following instructions from Sri Lankan

    President Mahinda Rajapaksa, in May

    2009 Nambiar told surrendering Tamil Tig

    ers that they would be safe to cross noma

    ns land if they hoisted a white flag. Just

    walk across to the troops, slowly! With a

    white flag and comply with instructions carefully. The soldiers are nervous about sui-

    cide bombers, said a text from foreign se

    cretary Palitha Kohona, sent via the Red

    Cross.

    But in what has come to be known as the

    white flag incident, all were gunned down

    in what observers say would be tantamou

    nt to a war crime.

    Nambiars complicity or involvement in the

    incident, which Rajapaksa later triumphed

    in, is yet to be fully investigated. Sri Lankan opposition politician and then-chief of

    the Sri Lankan Army, Sarath Fonseka, clai

    med in an interview that there was a direct

    order from then defence secretary Gotabh

    aya Rajapaksa to shoot dead the entire le

    adership of the Tamil Tigers.

    Fonseka is now in jail following the claims

    and his attempt to oppose Mahinda Rajap

    aksa in the subsequent polls.

    The submission by the two groups, TAG

    and SCET, asks whether VIJAY NAMBI

    AR was in fact an innocent neutral interme

    diary or in fact a co-perpetrator within the

    negotiation-related community.

    It also pours doubt on the efficacy of Nambiars presence there, given that his broth

    er, Satish Nambiar, was at the time worki

    ng as an advisor to the Sri Lankan military,

    as well as questioning his subjective kno

    wledge of the Sri Lankan Armys widely

    (or routinely) adhered to policy of execut-

    ing surrendering [Tamil] combatants, after

    generally blindfolding and stripping them

    naked.

    UN chief Ban Ki-moon has however rejec

    ted calls for an inquiry into Nambiar, desp

    ite the Chief of Staffs own assertion inMay 2009 that, As far as the UN is conce

    rned, where there are grave and systema

    tic violations of international humanitarian

    law [ in Sri Lanka], these are things which

    should be looked at by the international

    community, by the United Nations.

    This reluctance of senior members of the

    UN to investigate possible human rights

    violations will likely concern Burma obser

    vers, particularly given that Than Shwe vis

    ited Sri Lanka shortly before the incidentand is alleged to have offered his Sri Lan

    kan counterpart anti-insurgency advice.

    Nambiar was in Burma shortly after the

    elections in November last year to meet

    with Aung San Suu Kyi and senior membe

    rs of the junta.

    The TGTE is a democratically elected bo

    dy chosen by the Eelam Tamil diaspora at

    large. The elections were held openly and

    transparently. CountryWorking Groups we

    re formed in all major centers where Tamil

    s lived to raise awareness about the forma

    tion and concept of the TGTE.

    Later, independent Election Commissions

    were established to conduct elections in

    the various countries. An independent bod

    y to adjudicate election disputes and comp

    laints was also created. The Election Com

    missions comprised Eelam Tamils as well

    as non-Eelam Tamils who were themselve

    s respected members of their communties.

    For example, the head of the Electio Com

    mision in the United States was former Att

    orney General of the United States, Ram-

    sey Clark.

    A Constitutional Committee was also estab

    lished to draft the Constitution. The Constit

    ution was debated and ratified over the co

    urse of three days at the United Nations Pl

    aza Hotel in September last year. The decision making processes and procedures we

    re set forth in the Constitution.

    The cabinet meets every two weeks to ma

    ke decisions pertaining to the execution of

    TGTE policies. We have also established

    an Ethics Commission to ensure the moral

    standing of the elected body of representa

    tives. We are now in the process of draftin

    g a Code of Conduct for the members.

    There is also a provision in the Constituti

    on for the formation ofa Senate.According to the Constitution, the memb e

    rship is not restricted to Eelam Tamils only.

    We intend to nominate the members to the

    Senate after the elections in some of the di

    sputed electorates are completed. I also w

    ould like to point out that an Advisory Committee comprising of professionals and aca

    demics from among Tamils and non-Tamils

    played a unique role in the formation of the

    TGTE and this Committee has now been

    enshrined in the Constitution. All these act

    ions demonstrate that the TGTE is an inde

    pendent and autonomous body.

    Creation of South Sudan keeps

    our hopes aliveAfter the defeat of LTTE in Sri Lanka, the

    Tamil diaspora of that country has decided

    to take their struggle forward through dem-

    ocratic and diplomatic channels. They

    have formed Transnational Government ofTamil Eelam(TGTE) after conducting elec-

    tions in each country to select the repre-

    sentatives. Viswanathan Rudrakumaran, a

    US-based Lawyer has been elected as its

    Prime minister. In an Exclusive email Inter-

    view to TSI, Viswanathan discusses the fu-

    ture plans of TGTE with N Asokan.

    In the current world scenario, what is the

    objective of TGTE?

    The main objective of the Transnational

    Government of Tamil Eelam is to continue

    the struggle of Eelam Tamil nation to achi

    eve the independent sovereign state of Tamil Eelam. The TGTE functions in the inte

    rest of Tamil people in the homeland and

    in the diaspora.

    Looking back on the political history of the

    Eelam Tamils in the island of Sri Lanka, we

    believe only an independent state can gua

    rantee the survival of the Tamils as a peop

    le. The genocide committed by the Gover

    nment of Sri Lanka culminating in the eve

    nts in May 2009 also serve as proof that

    only an independent state can guarantee

    the very physical survival of the Eelam Ta

    mils.

    Even though the war is over, the structural

    genocide continues. Recent killings andthe aggressive state sponsored colonizati

    on in the North East demonstrates the co

    ntinuation of the structural genocide. Eme

    rging evidence of genocide, war crimes

    and crimes against humanity such as the

    Channel 4 video and theWikileaks cables

    establishes the Government of Sri Lanka's

    culpability for these acts.

    We would also point out the recent indep

    endence of subjugated nationalities in Kos

    ovo and South Sudan. These give us confi

    dence for achieving an independent Tamil

    Eelam. We are also hopeful that given the

    ever changing dynamics in the Indian Oce

    an region, the International Community will

    realize that an independent Tamil Eelam

    will contribute to peace and stability in theregion.

    It's almost two years after the Mulliva a

    ykkal massacre and LTTE's defeat. How

    does the diaspora look at it?

    The Mulliyvaaykkal massacre has reinvig-

    orated and strengthened the resolve of the

    Eelam Tamil diaspora. This is especially

    true of the second generation Eelam Tam

    ils who were born and raised in liberal wes

    tern democracies. They were shocked by

    the 2009 events and are determined to

    see justice for the Eelam Tamil nation. Th

    ey have been spearheading action in ma

    ny fronts over the past year and a half.

    The fact that Mahindha Rajapaksa's Oxford Union speech was cancelled in the UK

    and he was hiding from the public during a

    recent visit to the US, is proof that the dias

    pora is on the offensive. I believe that the

    diaspora will not rest until the perpetrators

    of genocide are brought to justice. The Dia

    spora will not rest until the long arm of just

    ice handcuffs the perpetrators and justice

    is done to our brothers and sisters.

    Do you look forward to any

    negotiations with the Sri

    Lanka Govt.?

    We believe that an independent

    state of Ta mil Eelam can be ach

    ieved through a nego tiated settlement at a stage when the intern

    ational community recognizes th

    at an ind e pendent state for the

    Eelam Tamils is the only viable

    and stable solution for the nation

    al conflict in the island. There is

    precede nt for a negotiated inde

    pendence in recent history.

    I refer specifically to the negotiat

    ed dissolution of Czechoslovaki

    a into the Czech Republic and

    Slovakia and the separation of

    Singapore from the Malaysian Federation.

    If there is a will there will be a way. Not on

    ly has there been no will among Sinhala ru

    lers to acknowledge the nationhood of Ta

    mils but instead there have been continuous attempts to eliminate any expression of

    Tamils own identity in the island of Sri Lan

    ka.

    Will it pose a challenge as the TGTE

    has no base in Sri Lanka?

    We recognize it as a challenge. However,

    in the past exile governments were able to

    achieve freedom for their people from outs

    ide their countries. Lithuania, Latvia and

    Estonia are examples of countries which

    were able to win independence from outsi

    de their homelands. They did not have a fo

    othold in the country before independence.

    However, they worked with the Internation

    al Community and when the internationalpolitical climate changed, they were able

    to take advantage and establish their inde-

    pendence.

    Furthermore, we have formed our govern-

    ment as a transnational government, and

    not as an exile government. The concept

    of transnational offers us the opportunity to

    see the whole Eelam Tamil nation living in

    a single wide space with different locations

    , in the Tamil homeland and in many sites

    in the various parts of the world. In this se

    nse, though TGTE physically does not ha

    ve a base at this particular point in time,

    we have the potential to influence the politi

    cal dynamics in the homeland.

    Moreover, in the era of globalization we believe we will be able to influence the cour

    se of events inside the country. However,

    we want to emphasize that our actions will

    be based not only on the aspirations of the

    Eelam Tamil Diaspora which is a part of

    the Eelam Tamil nation but also on the asp

    irations of the Eelam Tamils living in the isl

    and of Sri Lanka.

    What is the role model for the forma-

    tion TGTE?

    The TGTE is a novel concept. The concept

    of transnational governance has been aro

    und for some time. However, the kind of

    Transnational Government that was much

    talked about and articulated revolved arou

    nd how nation-states can internationally formulate a model of governance in the era

    of globalization. Nation-states are the ba si

    c units of this model. What we proposed

    and now attempting to build is something

    different.

    It calls for a new kind of civic mode of poli-

    tics. It is an innovative model. While there

    are centers for innovative governance in

    some parts of the world, those i nstitutions

    talk about the relationship between states

    and international institutions. The transnati

    onal government established by us is seen

    clearly as a vehicle for a subjugated nation

    al entity to articulate their political aspiratio

    ns in the global governance system throu

    gh the transnational political and social practice.

    The present international system, includin

    g the international institutions such as the

    United Nations is clearly biased towards

    the existing states. There is no room for

    subjugated nations and people in these int

    ernational systems. The existing armed co

    nflicts in various parts of the world are a

    testimony of the failure of the current in ter

    n ational system. Perhaps the only way for

    the subjugated national entities like Tamils,

    Kurds, Palestinians and others is to create

    a powerful civil movement of Transnational

    Government that would lead us in the right

    direction.

    Moreover, our transnational government is

    a grassroots-based collaborative effort where the representatives are elected directly

    from the people. We also hope and believe

    that this transnational model of govenance

    will force reforms in the existing governme

    ntal system. We believe that our Transnati

    onal Government of Tamil Eelam will bring

    positive changes in the international syste

    m and, as hoped by many, will also help

    address the aspirations of other subjgated

    nationalities. I also would like to point out

    that there are similarities with exile govern

    ments in terms of strategies.

    You have been invited to attend South

    Sudan's celebration which is a good

    recognition. How the world powers ha

    ve responded for TGTE? How the recognition has come in general?

    Recognition comes in two forms. One is ex

    plicit recognition, the other in implicit recog

    nition. We meet with foreign diplomats on

    a regular basis. I consider this as an implic

    it recognition of the TGTE.

    Explicit recognition depends on various fac

    tors. Primarily it depends on the changing

    geopolitical dynamics in the region and the

    world.

    What are your expectations from India?

    We, the Eelam Tamil nation, are fighting

    for justice, our struggle is premised on the

    international legal concepts of self preservation, self defense and self determination.

    We have been brutally subjugated by the

    chauvinist Sinhala politico-military estab lis

    hment. The aggression of the Sinhala poli

    tical military establishment resulting in the

    act of genocide of Tamils, and the brutal

    massacre in the final phase of war - make

    us more determined to fight for justice.

    The only way Eelam Tamil people can rec

    eive justice and ensure that their lives are

    safe against the genocide of the Sinhala

    chauvinist state is through the formation of

    an independent and sovereign TamilEelam

    state. What we need from India is only the

    recognition for the independent, sovereign

    state of Tamil Eelam.

    We are not so naive not to understand therealpolitik of the States in their decisionma

    king, where interests of the states dominat

    e making its moral position subservient.

    But, here we make a distinction between

    the people of India and the state of India.

    We are also mindful that the domestic con-

    stituency plays an important role in the for-

    eign policy process of the states. We are

    confident that the people of India and the

    brotherhood in Tamil Nadu will join our stru

    ggle for justice and push the Indian state

    to support our position over time.

    When will the Lankan Tamil refugees in

    Tamil Nadu be involved in the TGTE?

    We are working towards it. We hope thatEelam Tamil refugees in Tamil Nadu will be

    able to get involved with the TGTE soon.

    Tamil refugees irrespective of which coun-

    try they are domiciled in are important sta

    keholders in the transnational governme

    nt effort. It has been internationally recogni

    zed that refugees have fundamental rights

    such as freedom of association and freedo

    The history of the UN and other internatio

    nal organizations demonstrate that political

    factors play an important role in their functi

    ons and actions. Thus we are not very opti

    mistic that we will get justice through the

    international institutions or forums. Howev

    er, given the emerging judicial globalizatio

    n , specifically the concept of universal juri

    sdiction being accepted in most civilized

    countries, we believe we can bring the perpetrators of genocide, war crimes and crim

    es against humanity to justice in domestic

    forums.

    How do the important Eelam Tamil sym-

    pathisers in Tamil Nadu like Vaiko, Ned

    umaran and KolathurMani look at

    TGTE? Are you in touch with them?

    What kind of support do they extend?

    I have communicated with our traditional

    allies about the formation of the TGTE and

    its objectives. I sense a swelling support

    for the TGTE from the Tamil Nadu people,

    civil society and the intellectual community

    out there. We also believe that the struggle

    for Tamil Eelam is to be carried out not on

    ly by the Eelam Tamils but also by the world Tamils at large. The Tamil Nadu people

    will continue to play a key role in the strug-

    gle. I am confident that the people of Tamil

    Nadu will extend their support to the TGTE

    much like they have for the last thirty yea r

    s. I also take this opportunity to salute the

    sacrifice of Muththukumar.
