The standard Texas form is located at https:// www.dads.state.tx.us/forms/dadsmpoa/DADSMPOA.pdf. It states that the Medical Power of Attorney document becomes effective when the person’s physician certifies in writing that the person is unable to make his/her own health care decisions. The document becomes legal with signature in front of a Notary Public of Texas or with signatures of two witnesses. In addition to this general form, your attorney can also draft a document detailing your wishes in naming a Medical Power of Attorney. Although predicting life expectancy is difficult, it is better for the patient to have an early referral to hospice so that hospice professionals have the time to help the patient make the most of the time remaining. Remember that hospice does not focus on death, but on compassionate, specialized care for the living; providing hope when quality is more important than quantity.
