Eligibility

1. The VMware Lucky Draw ("Draw") is open to all (collectively, the "Eligible Persons" and each, an "Eligible Person") who is aged 21 and above.

5. Drawing is offered to all natural persons who are at least the age of majority. Employees, officers, and directors of VMware, its parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee, officer and director and government employees are not eligible.

6. The prize winner will be selected by random drawing at the end of vFORUM 2019 Singapore – approximately 5:15PM to 5:45PM on 14 November. There will be one (1) winner selected on the day, based on his/her attendance and event evaluation form submission at the event. The winner will receive a Samsung Galaxy Note10 on 14 November, 2019 - with an approximate retail value ("ARV") of SGD1398. Prizes are non-transferable and no substitution will be made except as provided herein at the VMware sole discretion. VMware reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Each Participant will be allocated only one chance per attendance. Winner has to be present during lucky draw session to receive the prize. VMware reserves the rights to repeat lucky draw multiple times until a winner is presence to receive the prize.

7. If any person is subsequently discovered to be not entitled or ineligible to participate in the Draw or ineligible to receive the prize, VMware reserves the right to forfeit/reclaim the prize at its discretion and confer the same on any other person whom may be

selected by VMware in any manner as VMware deems fit. No person shall be entitled to any payment or compensation from VMware should any prize be forfeited.

9. The winner agrees to co-operate with and participate in any advertising or publicity activities of VMware relating to the Draw and agrees that VMware may publicize the name and/or photograph of each winner in such mode and manner as VMware considers fit.

10. For Public Sector (government) entrants, if the Draw is won by a government official or employee, the Promoter will consider the Prize as an "agency donation" directly to the winner's agency or department, not to the individual winner, in compliance with the rules and regulations of that agency or department.

TERMS & CONDITIONS

1. This Make Your Mark ("Contest") is open only to residents of Singapore (each, a “Participant”).

2. Employees of VMware, Inc., VMware International Unlimited Company, VMware Singapore Pte. Ltd. and their affiliates (collectively, "VMware"), VMware’s partners and companies associated with this Contest, including their immediate families, are ineligible to enter. Participants from the public sector (government) may enter but are subject to, among others, Section 24 below.

3. The promoter of this Contest is VMware Singapore Pte. Ltd. ("Promoter").

4. This contest runs from 9:00AM, 4 October 2019 (Singapore timezone) to 5:30PM, 14 November 2019 (Singapore timezone) (“Contest Period”).

5. No purchase of goods, services or licenses is required to participate in the Contest.

6. To participate in the Contest, the Participant must: (i) Be at least 21 years of age.

(ii) Accept and comply with these terms and conditions as well as any other requirements set out in the promotional materials, if any, (collectively, the “Terms”).

(iii) Snap and post online a photograph using VMware’s “Make Your Mark” photograph

(iv) Complete and submit the Contest entry form to the Promoter. (v) Attend the VMware vFORUM 2019 Event to be held on 14 November 2019 in

Singapore (“vFORUM”).

7. A Submission shall only be deemed complete once it has been received by the Promoter within the Contest Period in accordance with the Terms herein. The Promoter accepts no responsibility for late, incorrect or incomplete Submissions or Submissions which are not received for any reason including as a result of any technical delay, failure or defect.

8. Participants found tampering with or abusing any aspect of the Contest, as solely determined by the Promoter, will be disqualified.

9. Submissions which contain obscene, provocative or otherwise objectionable content will be rejected. The Promoter retains the right and sole discretion to determine what constitutes content which is obscene, provocative or objectionable.

10. By entering this Contest and submitting the Submission to the Promoter, the Participant agrees and acknowledges the following: (i) All Submissions become the property of the Promoter.

(ii) By submitting a Submission, Participants irrevocably assign any intellectual property rights they may have in the content of their Submission (including their response to the question(s) therein) and consent to waive any moral rights they may have therein.

(iii) At the Promoter’s request, the Participant must execute all documents and do all

acts required to give effect to, perfect and/or record such assignment. When the Participant assigns its rights in the Submission to the Promoter, the Participant no longer owns the Submission or has any rights over the same, and the Promoter becomes the owner of the Submission and therefore has all the rights of an owner to deal with the Submission in any manner as it deems fit, without having to seek permission from the Participant or anyone else.

(iv) The Promoter may use the Submission (or any part thereof) for display on its

Judging

11. Submissions which do not meet the Terms herein, as determined at VMware’s sole discretion, may be rejected without notice or liability to the Participant.

12. There shall be three (3) winners for the Contest (each, a “Winner") and they will be selected by the Promoter’s panel of judges by 26 November 2019 based and prioritized on, among others, the highest number of “likes” and “shares” received by the Participant for the Submission and the most creativity displayed in the Submission itself.

13. The Winners will be announced by the Promoter on the vFORUM 2019 microsite: https://vforum.vmware.com/sg/social-contest.html.

14. The Winners will be contacted via the e-mail address provided in the Submission or through the messaging via the social media channel. In the event that the Promoter (having used its reasonable efforts to do so) is unable to contact any Winner within a reasonable period of notification then the Promoter reserves the sole right (without liability whatsoever) to select another winner.

Prize

15. The Winners will receive the following prize (“Prize”):

One (1) First Prize

One (1) exclusive vFORUM mountain bicycle with a recommended retail value of US$1,200.

Two (2) Runner-Up Prizes

One (1) Samsung Gear 360 digital camera with a recommended retail value of US$250 each.

16. The Prize is not transferable and cannot be taken as cash. In the event that the Promoter is unable to supply the Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.

17. Postage and shipping of the Prize to the Participant’s address specified in the Submission will be provided by the Promoter. officers, employees, contractors, vendors and agents, from any and all claims, demands, actions, liability, losses or damages, costs and expenses of any kind, whether to person or property or direct or indirect, with respect to the conduct of, or the Participant’s participation in the Contest and/or caused by or resulting from the Participant’s acceptance, possession, use, misuse or non-use of the Prize (where applicable).

(ii) To the maximum extent provided by applicable law, and notwithstanding anything to the contrary, this Contest and the Prize are each made available on an “AS IS” basis without any warranty from VMware. VMware disclaims all warranties in relation to this Contest and the Prize including, without limitation, the implied warranties of merchantability and fitness for a particular purpose, as well as any express warranties provided elsewhere in relation to this Contest and the Prize.

(iii) In no event will VMware be liable to the Participant or any other party for any claim

for loss, including without limitation, time, money, goodwill, any lost or damaged data (including, without limitation, the loss of or damage to any user content) and any consequential damages, which may arise from the Participant’s participation in this Contest or the Winner’s use, operation or misuse of the Prize, even if VMware has been advised of the possibility of such damages.

TERMS & CONDITIONS

1. This Make Your Mark ("Contest") is open only to residents of Singapore (each, a “Participant”).

2. Employees of VMware, Inc., VMware International Unlimited Company, VMware Singapore Pte. Ltd. and their affiliates (collectively, "VMware"), VMware’s partners and companies associated with this Contest, including their immediate families, are ineligible to enter. Participants from the public sector (government) may enter but are subject to, among others, Section 24 below.

3. The promoter of this Contest is VMware Singapore Pte. Ltd. ("Promoter").

4. This contest runs from 9:00AM, 4 October 2019 (Singapore timezone) to 5:30PM, 14 November 2019 (Singapore timezone) (“Contest Period”).

5. No purchase of goods, services or licenses is required to participate in the Contest.

6. To participate in the Contest, the Participant must: (i) Be at least 21 years of age.

(ii) Accept and comply with these terms and conditions as well as any other requirements set out in the promotional materials, if any, (collectively, the “Terms”).

(iii) Describe in your post on LinkedIn what the phrase “Make Your Mark” means to

you as creatively as possible (collectively, the “Submission”). The Submission must be made accessible to the public and include (within the post) the #vFORUMSG and #VMwareSG hashtags.

(iv) Complete and submit the Contest entry form to the Promoter. (v) Attend the VMware vFORUM 2019 Event to be held on 14 November 2019 in

Singapore (“vFORUM”).

7. A Submission shall only be deemed complete once it has been received by the Promoter within the Contest Period in accordance with the Terms herein. The Promoter accepts no responsibility for late, incorrect or incomplete Submissions or Submissions which are not received for any reason including as a result of any technical delay, failure or defect.

8. Participants found tampering with or abusing any aspect of the Contest, as solely determined by the Promoter, will be disqualified.

9. Submissions which contain obscene, provocative or otherwise objectionable content will be rejected. The Promoter retains the right and sole discretion to determine what constitutes content which is obscene, provocative or objectionable.

10. By entering this Contest and submitting the Submission to the Promoter, the Participant agrees and acknowledges the following: (ix) All Submissions become the property of the Promoter.

(x) By submitting a Submission, Participants irrevocably assign any intellectual property rights they may have in the content of their Submission (including their response to the question(s) therein) and consent to waive any moral rights they may have therein.

(xi) At the Promoter’s request, the Participant must execute all documents and do all

acts required to give effect to, perfect and/or record such assignment. When the Participant assigns its rights in the Submission to the Promoter, the Participant no longer owns the Submission or has any rights over the same, and the Promoter becomes the owner of the Submission and therefore has all the rights of an owner to deal with the Submission in any manner as it deems fit, without having to seek permission from the Participant or anyone else.

(xii) The Promoter may use the Submission (or any part thereof) for display on its

website(s) or any other publicly accessible materials including social media, brochures and related documentation.

(xiii) The Promoter may use the Submission (or any part thereof) for any purpose, at any time, without any fee or compensation whatsoever to the Participant or any third party.

(xiv) The Promoter may reject, delete or modify the Submission (or any part thereof)

without prior notice or liability, and for any reason whatsoever. (xv) The Participant agrees to receive marketing material and related communication

from VMware, VMware’s partners and companies associated with this Contest. (xvi) Entry into this Contest shall be deemed to be acceptance of these Terms.

Judging

11. Submissions which do not meet the Terms herein, as determined at VMware’s sole discretion, may be rejected without notice or liability to the Participant.

12. There shall be two (2) winners for the Contest (each, a “Winner") and they will be selected by the Promoter’s panel of judges by 26 November 2019 based and prioritized on, among others, the highest number of “likes” and “shares” received by the Participant for the Submission and the most creativity displayed in the Submission itself.

13. The Winners will be announced by the Promoter on the vFORUM 2019 microsite: https://vforum.vmware.com/sg/social-contest.html.

14. The Winners will be contacted via the e-mail address provided in the Submission or through the messaging via the social media channel. In the event that the Promoter (having used its reasonable efforts to do so) is unable to contact any Winner within a reasonable period of notification then the Promoter reserves the sole right (without liability whatsoever) to select another winner.

Prize

15. The Winners will receive the following prize (“Prize”):

Two (2) Prizes One (1) Samsung Gear 360 digital camera with a recommended retail value of US$250 each.

16. The Prize is not transferable and cannot be taken as cash. In the event that the Promoter is unable to supply the Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.

17. Postage and shipping of the Prize to the Participant’s address specified in the Submission will be provided by the Promoter. No ancillary products or services in connection with the Prize are included as part of the Prize. The Promoter shall not be responsible for any loss and/or damage to the Prize sustained in the course of delivery.

18. Delivery of the Prize will be made as soon as possible, but is subject to availability of the Prize. The Promoter will use reasonable efforts to ship the Prize to the Winners within thirty (30) days of the Winners being determined and notified as above.

General

20. All taxes, levies, charges of whatsoever nature in relation to the Prize whether imposed by the federal, state and/or local government bodies, if any, shall be borne by the Winners.

21. It is the Winner’s responsibility to ensure that acceptance of this Prize does not violate any laws or regulations of any kind, including but not limited to any conflict of interest, or gift

VMware Odyssey Challenge by Hands-on Labs

HOW TO ENTER

To enter the VMware Odyssey Challenge by Hands-on Labs, Participant must login and register

at https://vforum.vmware.com/sg/programs/hands-on-lab.html between 7 October, 2019 and 30

October, 2019. Registrations will be reviewed by the Odyssey team and accepted Participant will

be notified of their acceptance and assigned team. Up to 16 teams of 3 participants will compete

against each other in a live Hands-on Labs environment to complete VMware skill-based tasks.

The Challenge will take place at vFORUM 2019 Singapore on 14 November.

Registration by Participant in a manner other than by logging into the site above will not be

considered. All registrations must be in English and must be received by VMware no later than

30 October 2019 11:59 GMT (VMware shall be the sole arbiter of the time that any registration

was received).

ELIGIBILITY

By registering to participate in the Challenge, Participant agrees to be bound by these rules and

to all decisions of VMware, which are final, binding and conclusive in all matters. Participant is

solely responsible for reviewing and understanding his/her employer's policies regarding eligibility

to participate in trade promotions such as the Challenge. If Participant takes part in this Challenge

in violation of his/her employer policies, Participant may be disqualified from continued

involvement in the Challenge or from receiving a prize. VMware disclaims any and all liability or

responsibility for disputes arising between a Participant and Participant’s employer related to this

matter, and prizes will only be awarded in compliance with a Participant employer's policies.

INELIGIBLE INDIVIDUALS

VMware full and part-time employees, interns, contractors, individuals involved in the production

(including prize suppliers), implementation and distribution of this Challenge and their advertising

or promotion agencies, parent companies, service providers, agents, officers, subsidiaries or

affiliates, and any other persons or entities directly associated with the Challenge and members

of the immediate families and/or persons living in the same household as such are ineligible to

participate in the Challenge.

VMware is committed to complying with government and public sector gift and ethics rules and

therefore government/public sector employees or any person acting in an official capacity for or

on behalf of any such government, department, agency, or instrumentality are not eligible to

participate in the Challenge.

This Challenge is void where prohibited or restricted by law. Prizes will not be awarded to

residents of Cuba, Iran, Iraq, Libya, North Korea, Sudan, or Syria.

COMMENTING

By registering, Participant agrees that he or she has reviewed and agreed to the terms and

conditions set forth in the VMware Hands-on Labs Terms of Use which govern, in part,

Participant’s access to the labs and Challenge. In the event of a conflict among any of the VMware

Websites Terms of Use and these Official Rules, these Official Rules govern and take

precedence.

JUDGING CRITERIA

The team will receive a score based on accuracy and speed. The team with the highest combined

score on Thursday 14 November, 2019 will move to the semi-finals. The team that has the highest

score from the Final round will win the Challenge. Hands-on Labs engineers will verify the

environment is complete and in the correct state after each task has been completed.

PRIZES

First prize winners – each Participant of the winning first place team will be awarded one (1) Apple

iPad Pro 12.9-inch 1TB Wi-Fi with a recommended retail value of US$1,720. No cash alternative

or refund will be awarded in lieu of stated prize(s). If a prize becomes unavailable for any reason,

VMware reserves the right to substitute a prize of approximately equal or greater value.

Second prize winners – each Participant of the winning second place team will be awarded one

(1) LG - PH30JG 720p Wireless DLP Projector with a recommended retail value of US$221 each.

No cash alternative or refund will be awarded in lieu of stated prize(s). If a prize becomes

unavailable for any reason, VMware reserves the right to substitute a prize of approximately equal

or greater value.

VMware will announce the winning team at the end of the Challenge on 14 November, 2019.

Prizes are non-transferable without VMware’s prior consent, which may be withheld in its absolute

discretion. If the winner does not claim the prize within the thirty (30) day period, VMware shall

have the discretion to award the prize to the runner-up. Except where otherwise required by

mandatory law, all taxes, including income taxes, are the sole responsibility of the winner. No

prize substitution is permitted. The winner may be required to verify his or her entry.

As a condition of winning, Participant may be required to complete and provide to VMware the

following: (i) Affidavit of Eligibility and Liability and Publicity Release (the "Affidavit"), and (ii) IRS

Form W-9 or W-8BEN or other tax form, as applicable. In completing the Affidavit, a winning

Participant (a) confirms Participant eligibility, (b) represents and warrants that Participant has not

cheated, (c) verifies the accuracy of the information submitted in the Challenge registration

process, (d) authorizes VMware to publicize the Challenge results and winner, (e) agrees to sign

any applicable forms required by tax authorities, and (f) releases VMware from liability arising out

of any prize won.

PUBLICITY

Participant hereby grants VMware the right to publicize Participant’s name(s), likeness(es), and

the description of Participant’s Submission. Apart from the prizes associated with being selected

as a winner, VMware shall not be obligated to compensate Participant in any way for such

publicity. In addition, all Participants agree to cooperate with VMware’s publicity efforts, including

the agreement to use their name, address (city, state and country only) and likeness for publicity

purposes and to use the statements made by, or attributed to, the winners relating to VMware

and any and all rights to said use, without further compensation.

DATA PRIVACY

By registering, Participant acknowledges that Participant is sharing personal data with VMware

that may need to be shared with other VMware affiliates, VMware employees or third parties

providing services to VMware in support of this Challenge and the evaluation process for the

registration. Participant has read and agrees to VMware’s Privacy Policy available at

http://www.vmware.com/help/privacy.html. Participant agrees to VMware’s Privacy Policy and the

processing by VMware (or any other VMware affiliate involved in the administration of the

Challenge) of his/her personal data included in the Challenge in the manner stated therein for the

purposes of administering the Participant’s participation in the Challenge, assessing the

Participant’s submission, contacting the Participant in connection with the award of any prize in

the Challenge and otherwise in connection with the Challenge.

LIMITATION OF LIABILITY AND INDEMNIFICATION

Participant acknowledges that Participant shall have no approval rights and no claim (including,

without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out

of VMware's use or alteration of Participant's information or submission. By participating in the

Challenge, Participant agrees to waive all rights to seek injunctive or equitable relief, or to claim

punitive, incidental or consequential damages, or attorneys’ fees.

VMware is not responsible for any miscommunications such as technical failures related to

computer, telephone, cable, and unavailable network or server connections, related technical

failures, or other failures related to hardware, software or virus, or incomplete, indecipherable,

late or misdirected Submissions. Any compromise to the fair and proper conduct of this Challenge

may result in the disqualification of a submission, termination of the Challenge, or other remedial

action, at the sole discretion of the VMware.

Each Participant shall indemnify, defend, and hold VMware, and all of its respective affiliates,

subsidiaries, directors, officers, employees, representatives and agents, harmless from and

against any and all liability for any loss or damage to person or from any third party claims arising

from or related to that Participant's participation in the Challenge. In no event shall VMware be

liable to a Participant for acts or omissions arising out of or related to the Challenge or Participant's

participation in the Challenge.

Nothing in these Official Rules shall be taken as excluding any liability which cannot lawfully be

excluded.

Any delay or omission by VMware in enforcing its rights under, or the fulfillment of any requirement

contained in, these Official Rules shall not be interpreted as a waiver of such right or requirement.

SEVERABILITY

In the event that any of the terms of this Challenge or the performance of any obligation by either

VMware or a Participant hereunder becomes or is declared to be illegal by a court of competent

jurisdiction or other governmental body, such term(s) shall be null and void and shall be deemed

deleted, all remaining terms of this Challenge shall remain in full force and effect.

CHOICE OF LAW AND JURISDICTION

The Challenge and the rights and obligations of VMware and Participant will be governed and

controlled by the laws of Singapore, applicable to contracts made and performed therein without

reference to the applicable choice of law provisions. All actions, proceedings or litigation relating

hereto will be instituted and prosecuted solely within Singapore. The parties consent to the

jurisdiction of the Singapore courts with respect to any action, dispute or other matter pertaining

to or arising out of the Challenge. A person who is not a party hereto has no right under the

Contracts (Rights of Third Parties) Act (Cap 53B) to enforce any term herein. In particular and to

the extent legally possible, the parties specifically exclude the application of any law in Singapore

or elsewhere which provides that any third party has the right to enforce the terms of this
