1. INTRODUCTION:

C-DOT is a Telecom Technology Centre set-up by Government of India for Design andDevelopment of Digital Telephone Exchanges and for pursuing research inTelecommunications. C-DOT invites competitive bids from Prospective Bidders as per theeligibility criteria indicated in the Tender Document for undertaking Pest Control Serviceson Triennial Rate Contract Basis at our Campus situated at Electronic City – Phase I, andGuest House at Koramangala.

2. INVITATION FOR BIDS:

Competitive Bids are invited for providing Pest Control Services on Triennial Rate ContractBasis as per the requirement listed at Section 4 & 5.

4. SCOPE OF WORK

C-DOT requires the Pest Control Services in its Campus at Electronics City and the GuestHouse located at the National Games Village, Koramangala, Bangalore. The built up andopen areas in our Electronics City Campus are approximately 1,50,000 sq. ft. and 5,00,000sq.ft. respectively. The built up area of the Guest House is approximately 7,000 sq.ft.

6. GENERAL INFORMATION AND INSTRUCTIONS TO BIDDERS:

6.1 C-DOT, Bangalore invites e-bids from eligible bidders through e-Procurement CPPportal for providing Pest Control Services on Triennial Rate Contract Basis as perdetails listed in section 4 & 5 of this RFP on TWO BID SYSTEM.

6.2 Bid has to be submitted online in the e-tender portal i.e., http://eprocure.gov.in/eprocure/app. only. Bids sent by FAX, email or offlinemode will not be considered. Bids received after the due date and time will not beaccepted.

6.3 Bidders shall also attach scanned copies of all the requisite documents i.e. proof ofsubmission of Tender Fee/Earnest Money Deposit (EMD) and othercertificates/documents specified in the tender document. Bidders are requested toupload the Technical documents of Pest Control Services as a part of Technical Bid.However, the bidder shall provide any additional technical document if required byTechnical Evaluation Committee.

6.4 Any queries related to this tender shall be entertained only by means of formal officialletter or emails ([email protected]) on or before the last date for submission of queries.(i.e) 14:00 hours on 04.07.2019. No Technical and Commercial queries shall beentertained after the above date. It may be noted that it is the sole discretion ofC-DOT to consider the same or not and to reply only if it is deemed necessary.

6.5 Replies to all Queries/Corrigendum (if any) shall only be up-loaded in CPP portal &www.cdot.in. websites and will not be published in newspapers. Bidders are advisedto check the website before submitting the Tender.

6.6 Tender fees of Rs1050/- payable by way of NEFT favoring C-DOT, Bangalore andUTR No., to be uploaded in the portal along with technical bid as per the formatindicated in the NIT Document.

6.7 The EMD amount of Rs. 15,000/- (Rs. Fifteen Thousand only) should be submittedbefore the due date vide NEFT --- favouring CDOT Bengaluru and details of thesame should be uploaded as per the format indicated in the NIT Document.. EMD inthe form of fixed deposit is not acceptable.

6.8 Bids without Tender fee and EMD shall be rejected outright. However, EMD isexempted for Government Bodies/PSU, SSI/SME/MSME organization onsubmission of relevant proofs.

6.9 EMD amount will be returned interest free, to unsuccessful bidders within 6 monthsfrom the closing date of the tender or award of contract, whichever is earlier. In casethe EMD has been submitted in the form of Bank Guarantee, the same shall be validfor 6 months from the last date for submission of bids. Format of BG can be seen onPage 20 of this document.

6.10 EMD amount shall be forfeited to C-DOT in the following cases without any furtherintimation:

a) If, after submission of bids, the tenderer fails to honor the Rate contract orrefuses to comply with any/all the terms and conditions of tender.

b) If the tenderer withdraws / alters the offer / terms of the tender during the validityperiod.

c) After award and acceptance of the Contract, the Agency / Firm / Company fails tocommence the services on the date mentioned in the Rate Contract.

d) Inexcusable delay in providing services after award and acceptance of theContract

e) If any information furnished by the Bidder is found to be incorrect.

7. SECURITY DEPOSIT:

7.1 Security Deposit equivalent to Rs.50,000/- (Rupees Fifty Thousand only) has to bedeposited with C-DOT through NEFT favoring CDOT Bengaluru at the time ofsigning the contract. This will be returned, interest free, on successful completion ofthe contract or further renewals as per mutual agreement.

7.2 After acceptance of the contract if any/all the terms and conditions of the contract is /or violated, C-DOT reserves the right to terminate the contract. In such cases, thesecurity deposit will be forfeited to C-DOT at its discretion. The security deposit isalso liable to be forfeited, if at any point in time the information furnished by theContractor is found to be incorrect.

8. VALIDITY / DURATION OF THE RATE CONTRACT:

.1 The contract will be valid for a period of 31 months, beginning tentatively duringthe first or second week of September 2019 and up-to 31.03.2022 only. However,in order to evaluate the performance and quality of services, contract will include aprobationary period of 3 months. Only after the services are found to be satisfactoryduring the probationary period, the contract will be confirmed for a further period of28 months under the same terms and conditions.

.2 During the probationary period, C-DOT alone reserves the right to terminate thecontract by giving 30 days’ notice, without assigning any reasons thereof.

9. STANDARD TERMS AND CONDITIONS:

.1 Interested tenderers are required to enclose the following documents along with thetechnical part:

Details of Registration under Shops & Commercial Establishment Details of Registration with Registrar of firms/Registrar of companies Self Attested GST Registration and PAN copy

.2 The Technical Part should contain information on the services required, and otherrelevant technical details conforming to C-DOT requirements in total as indicated inthe NIT Document.

.3 Tenderers shall submit a list of clients in India, to whom they have renderedsimilar services. This list should clearly enunciate the address of the premises /location along with the names of the contact persons and their phone nos./fax nos./e-mail ids.

.4 To understand the magnitude of the job involved, interested parties may visit theCampus on working days with prior intimation before submission of the quote.

.5 Technical Part should contain details of the Firm / Agency and all other requisitedocuments as per Annexure-A, details of which are provided in subsequent pages ofthe tender document Bids without Compliance Chart shall not be accepted.

.6 All columns should be clearly filled up. Please do not fill only as “Complied”in column 3, but, also indicate the quantitative specifications. Pleasehighlight the quantitative specifications in your data sheet / technical literature. Ifspace is not sufficient, then additional sheets may be used.

.7 Technical Compliance statement for the tendered item is a pre- requisitefor evaluation. Therefore the same must be submitted with the technical part.Any falsification / suppression of facts in the compliance statement would lead tothe rejection of the quote, along with forfeiture of the E.M.D.

.8 Incomplete quotes and quotes without data sheet / relevant technical literature willnot be considered.

.9 In case of any merger/acquisition, the Rate Contract and all terms and conditions ofthe Contract shall be honoured for the period of contract.

.10 Bidder/s must ensure that the price bid is not abnormally low considering all aspects involving rate/s quoted (i.e) Material, Labour etc.

.11 If a bid is found to be abnormally low, then CDOT may seek written confirmation / clarification on the same from the bidder.

.12 If no satisfactory reasoning / explanation is received from the bidder with respect to the rate/s quoted, then CDOT has the right to REJECT the lowest bid,so received.

.13 If, at any time, during the performance of the Purchase Order, the Bidderencounters conditions impeding timely performance of service, then they shouldpromptly notify C-DOT, in writing, of the fact of the delay, the cause ofdelay and its likely duration. C-DOT shall evaluate the situation and at itsdiscretion, decide to extend the Bidders, time for performance. C-DOT’s decisionwill be final and binding.

.14 C-DOT reserves the right to award work to deserving parties either in full/parts. Thedecision of C-DOT shall be final and unquestionable.

.15 C-DOT reserves the right to reject/accept any part or full Tender(s) without anyreason whatsoever.

.16 FORCE MAJEURE shall mean and be limited to War hostilities, riot or civilcommotion, earthquake, flood or other natural physical disaster and restrictionimposed by the Government or their statutory bodies which prevents or delays theexecution of the contract. In the event of delay lasting over one month, if arising outof cases of Force Majeure, C-DOT will still reserve the right to cancel theorder/contract.

.17 Disputes, if any, arising out of the above tender will be referred to ConsumerForums / Courts having jurisdiction over Bengaluru only and shall be subjected toIndian laws including the law relating to Consumer Protection.

.18 Tenderers are requested to study the terms and conditions of the Tendercarefully and then submit their tenders / bids accordingly. Any Rate Contractresulting from this tender shall be governed by the terms and conditions indicatedin this tender document and the bidder quoting against this tender shall be deemed tohave read, understood and accepted the same unconditionally

10. ELIGIBILITY CRITERIA OF THE BIDDER:

0.1 The Agency/Firm/Company should be registered as per Govt. norms.

0.2 The Agency/Contractor should have an office in Bengaluru and have an experience ofthree years in providing Pest Control Services and should have at least two suchrunning contracts in Bangalore.

0.3 The Agency/Contractor’s annual turnover arising out of such contracts should not be less than Rs. 10.0 lakhs per annum and proof of the same should be submitted by

way of Audited Balance Sheet, Profit and Loss Account Statement of the last 2years.

Note: Documentary evidence supporting the above should mandatorily be submittedalong with the Technical Quote.

11. EVALUATION CRITERIA OF BIDS:

Bids are evaluated as per the sequence given below:

.1 Bids are evaluated for technical compliance by Technical Evaluation Committee(TEC).

.2 C-DOT reserves the right to obtain feedback from the clients of the tenderer and alsodepute a duly constituted Committee to inspect the sites of the agency to obtaininformation regarding the quality of services provided, etc. The feedback of theclients may be one of the decisive factors to technically shortlist anagency/firm/company.

.3 Financial bids of the technically qualified vendors only are opened.

.4 Procedure for arriving at (Lowest Quoted Bidder) L1- the price comparison shall bemade on landing cost (Basic cost + statutory levies) on overall lowest quote basis forall the services required.

.5 Falsification / suppression of information will lead to disqualification of the bid.

12. PAYMENT TERMS:

.1 The Contractor should submit his claim for the services rendered showing distinctly the charges payable. These claims are to be made in the first week of the month immediately following the month for which the bill is raised.

.2 Payment will be made once a month after ascertaining the satisfactory Performance.

.3 No advance payment claims or running bills will be entertained by C-DOT.

.4 Income Tax or any other statutory levies will be deducted at source as per the rules inforce from time to time.

13. PENALTY:

Penalty will be levied for not providing services for the week or part thereof or inadequateand unsatisfactory services at Rs.1,000/- per occurrence. The decision of CDOT to levypenalty and the quantum of penalty will be final and unquestionable

14.MEETINGS:

The Contractor should depute his authorized representative to attend a meeting everymonth or as and when called by CDOT for discussion and evaluation of performance withthe C-DOT representative with prior appointment.

15. OBLIGATIONS OF THE CONTRACTOR:

.1 The successful bidder should commence the services within fifteen days from the receiptof the award of contract or from the date as decided by C-DOT and this will bebinding on the Agency.

.2 C-DOT at its discretion may curtail the number or type of services, which will beintimated in advance. Accordingly, any additional services, if required, should beprovided at contract rates only.

.3 Any payment to be made by C-DOT to the statutory authority due to non-adherence ofthe stipulated norms should be borne by the agency.

.4 The Contractor should use only approved, eco-friendly pesticides, chemicals, etc.

.5 The Contractor should ensure that the disposal of pests, etc., subsequent to the treatmentis taken care of by his personnel.

.6 In case of resurgence of pest(s), interim calls if any should be attended to, without extracost.

.7 The Contractor should ensure adherence to precautionary measures so that the methodsadopted for pest control do not have any adverse effect on human beings or cause anydamage to the furniture/machinery/records of the Centre.

.8 The person deputed by the Contractor to carry out the requisite work in our campusshould carry a valid ID Card and should also be equipped with necessary gadgets tocarry out such work. The Contractor should ensure that the person provided by himto carryout adheres to the safety measure without fail. The Contractor will be solelyresponsible for ensuring safety of his personnel while carrying out the work in theCampus.

.9 C-DOT will not be directly responsible for any accident, death or injury to youremployees which would arise during the course of their duty nor would C-DOT beresponsible/ liable to pay damage or compensation to such persons. TheAgency/Contractor should at all times indemnify and keep C-DOT indemnifiedagainst all claims which may be made under Workmen Compensation Act, anystatutory modifications thereof or otherwise for or in respect of any damages orcompensation payable in consequence of any accident or injury sustained by anyworkman while in our premises or during course of their duty. The agency/contractorwill also be responsible for appropriate insurance coverage of their employees. In theevent of theft, pilferage or damage to the Centre’s property by the personnel posted

by the agency, the agency should make good all the losses and replace the personnelimmediately.

.10 Your Personnel should be made to carry-out the pest control work on obtaining priorpermission from C-DOT. The dates and timings to carry out a specific type of pestcontrol service will be intimated in writing, which will be binding on the Contractor.

.11 The Contractor should not appoint any sub-Contractor to carry out his obligations underthe contract.

.12 The Contractor should ensure that the laid down assignments are carried out by thepersonnel posted by him.

.13 In the event of any query, objection, delay or dispute with regard to any bill or a partthereof, the Contractor will not be entitled to any interest to be paid by the Centre forlate payment.

.14 The Contractor will solely be responsible for conduct and behaviour of his personneland any loss or damage to the Centre’s property due to the conduct of his personnelshould be made good by the Contractor.

.15 The Contractor and his personnel should strictly follow the Security Manual of C-DOT to the extent it is applicable.

16. TERMINATION:

C-DOT reserves the right to terminate the contract if the services provided are notsatisfactory. C-DOT at its sole discretion can terminate the contract without assigning anyreason whatsoever by giving 30 days’ notice to the agency.

17. STATUTORY OBLIGATIONS:

All the requisite statutory regulations/Acts should be strictly adhered to during the period of contract.

ii. We also confirm that in case of unsatisfactory services, CDOT has the righ to takeany legal course of action against us.

I / We certify that all information furnished by the our Firm is true & correct and in the eventthat the information is found to be incorrect/untrue or found violated, then your department/organisation shall without giving any notice or reason therefore or summarily reject the bid orterminate the contract, without prejudice to any other rights or remedy including the forfeitureof the full said earnest money deposit absolutely.
