TERMS AND CONDITIONS OF AQUA PARK ZAKOPANE Dear Guests, Welcome to Aqua Park Zakopane - a place of entertainment, sport, relaxation and thank you for choosing our facility to spend your free time there! For the sake of order and safety of you and other guests please read these Terms and Conditions. At the time of ticket purchase, you accept the Terms and Conditions and agree to abide by their provisions and the regulations and instructions in force at the facility. In the case of groups, the group leader is responsible for familiarizing himself with the Terms and Conditions. A. GENERAL INFORMATION 1. Aqua Park Zakopane (hereinafter referred to as the Facility or Aqua Park) is owned by POLSKIE TATRY S.A. based at 7c Road to Biały Street, 34-500 Zakopane, tel.(18) 20 637 30. 2. Aqua Park Zakopane is open daily from 9:00 a.m. to 10 p.m. The swimming pool attractions are closed at 9:45 p.m. 3. The opening time may change for organizational reasons (sports and leisure competitions, time of year, failure or danger, other). 4. Each person using the facility is obliged to familiarize himself/herself with the provisions of the Terms and Conditions in force on its premises and to comply with their provisions. 5. Children under 12 years of age may stay in the Aqua Park only under the permanent supervision of adults, these persons are fully responsible for the children entrusted to their care and are liable for any damage caused by them. The caretaker pays for the stay at the swimming pool according to the valid price list. 6. Organized groups may stay in the Aqua Park only under the supervision of the person conducting the classes or the group leader, after signing a relevant statement by the group leader at the ticket offices or the Customer Service Office. 7. Lifeguards are people wearing yellow or red T-shirts with the word "Lifeguard" and red shorts. 8. Children under three years of age are required to wear waterproof diaper panties. 9. Children under 7 years of age may stay on the premises only in armbands. 10. It is forbidden to leave children who cannot swim unsupervised in the pool hall. 11. The supervision of the rescue service covers all swimming pool basins and water attractions available to customers. The constant supervision of children is carried out by their guardians. The management of the facility recommends that there should be one guardian for every child under 3 years of age, while for children aged 4-12 years there should be at least one guardian for two children. 12. The water attractions located on the premises of the facility are intended for adults and children over 12 years old. This does not apply to the basin, which can be accessed from the age of 14, and the use of a water swing, which is available to persons over 15 years of age with a minimum height of 140 cm. Children under 12 years of age may use the water attractions only under the care of adults and on their own responsibility. 13. The water attractions and basins temporarily closed are marked with information boards and use of them during this time is prohibited. In the case of a low attendance of users, water attractions are activated on request. 14. Depths in individual zones are indicated on information boards on or near the walls of swimming pool basins. 15. The management of Aqua Park Zakopane may temporarily restrict access to the facility due to exceeding the maximum number of visitors.

TERMS AND CONDITIONS OF AQUA PARK ZAKOPANE

Dear Guests,

Welcome to Aqua Park Zakopane - a place of entertainment, sport, relaxation and thank you for choosing our facility to spend your free time there!

For the sake of order and safety of you and other guests please read these Terms and Conditions. At the time of ticket purchase, you accept the Terms and Conditions and agree to abide by their provisions and the regulations and instructions in force at the facility.

In the case of groups, the group leader is responsible for familiarizing himself with the Terms and Conditions.

A. GENERAL INFORMATION

1. Aqua Park Zakopane (hereinafter referred to as the Facility or Aqua Park) is owned by POLSKIE TATRY S.A. based at 7c Road to Biały Street, 34-500 Zakopane, tel.(18) 20 637 30.

2. Aqua Park Zakopane is open daily from 9:00 a.m. to 10 p.m. The swimming pool attractions are closed at 9:45 p.m.

3. The opening time may change for organizational reasons (sports and leisure competitions, time of year, failure or danger, other).

4. Each person using the facility is obliged to familiarize himself/herself with the provisions of the Terms and Conditions in force on its premises and to comply with their provisions.

5. Children under 12 years of age may stay in the Aqua Park only under the permanent supervision of adults, these persons are fully responsible for the children entrusted to their care and are liable for any damage caused by them. The caretaker pays for the stay at the swimming pool according to the valid price list.

6. Organized groups may stay in the Aqua Park only under the supervision of the person conducting the classes or the group leader, after signing a relevant statement by the group leader at the ticket offices or the Customer Service Office.

16. In the winter season, the user has the possibility to use the main locker room and leave the outer garment there. The user is obliged to observe particular internal regulations and information placed on the premises of the facility.

17. The purchase of a ticket means the client's consent to use the facility as it stands on a given day. Breakdowns and other events beyond the control of the Directorate do not constitute grounds for reducing the ticket price.

18. The use of water facilities and attractions is at the users' own risk. Persons with unstable health should use the attractions with special care (or after consulting their doctor).

19. The object is monitored continuously, and the recordings from the cameras can be used as a basis for liability towards users who do not comply with the regulations and instructions.

20. Due to the monitoring of locker rooms, changing should take place in designated cabins. 21. Any items found in Aqua Park Zakopane should be handed over to the Customer Service Office

(Information Point) located in the main hall of the facility. The Customer Service Office staff issue items found after prior identification, i.e. the person looking for the lost item should specify: what item or object has been lost, describe its particular signs including its appearance, provide evidence that can confirm the ownership of the lost item). The staff will return the items they found up to three weeks after they were left.

22. Detailed rules of using particular parts and facilities of the Facility's water attractions are regulated by the site Terms and Conditions or pictograms located in their vicinity. Every person using parts and facilities of water attractions is obliged to acquaint himself with the provisions of these Terms and Conditions and to obey their provisions.

23. The change of clothes to swimwear takes place in changing rooms. 24. The management of Aqua Park Zakopane reserves the right to shut down the facility's facilities and

attractions due to failures or other events beyond the control of the administrator (e.g. bad weather conditions, etc.) without the possibility of reimbursement, where not excluding them would endanger the health of their users.

25. Persons prone to fainting, muscle spasms, epilepsy attacks, cardiovascular diseases as well as mentally ill persons may stay in the swimming pool area only under the supervision of a guardian, who is obliged to report the ailments of the person under his care to the lifeguard on duty.

26. Pregnant women use the facility at their own risk.

B. PERSONS USING THE AQUA PARK ARE OBLIGED TO:

1. enter the swimming pool only in generally accepted and accessible swimwear that satisfies aesthetic and hygienic requirements and does not have zips and plastic or metal or metal inserts which may pose a risk to the safety and health of the user as well as cause damage to the swimming pool equipment:

2. for women, one or two-piece bathing suit, adhering to the body, (it is allowed to enter the swimming pool in the so-called Burkini, but it is an absolute requirement that the outfit must adhere to the body),

3. for men's swimsuits or shorts, 4. change the outer shoes on swimming pool shoes before entering the locker room (barefoot walking is

allowed), 5. before entering the pool hall wash the whole body with soap, under the shower, 6. comply strictly with the instructions and sound signals of rescuers, including those given by the speakers.

Lifeguards in the swimming pool shall supervise compliance with safety and these Terms and Conditions, 7. familiarize themselves with and adapt their activity plans to their own skills and general fitness and

health,

8. immediately report any cuts, injuries, accidents and anomalies to the lifeguard on duty, 9. maintain order, cleanliness, peace, quiet and absolute obedience to the decisions of the emergency

services on duty or of the class leader and/or supervisor of an organized group, 10. comply with information signs, orders, prohibitions, orders, instructions, rules and regulations, entries

on information boards and others located on the premises of the information facility, 11. pay the entrance fee to Aqua Park Zakopane in accordance with the price list.

C. IT IS FORBIDDEN TO USE THE AQUA PARK ZAKOPANE FOR PERSONS:

1. whose condition indicates the consumption of alcohol or other intoxicants, 2. with signs of diseases posing a danger of drowning, 3. with open wounds and skin inflammation, signs of infectious diseases, 4. whose behavior poses a threat to people using the swimming pool, 5. whose state of hygiene deviates from generally accepted standards.

D. FORBIDDEN ACTIVITIES

The users of Aqua Park Zakopane must not cause situations threatening their own safety and that of the persons staying there, and in particular, it is prohibited to:

1. enter the water against the prohibition of lifeguards, in the absence of emergency service duty and during rescue operations,

2. bring in sharp tools and other dangerous objects (e.g. watches, bracelets and other jewelry), 3. carry large inflatable mattresses and toys, 4. access for persons whose condition indicates alcohol or drugs consumption, 5. run in the Aqua Park Zakopane facility, 6. jump into the water, 7. push or throw other users into the water, 8. smoke cigarettes, chew gum, 9. throw rubbish, bottles, etc. into water. 10. use water attractions and swimming pools by persons under the influence of alcoholic beverages or

other intoxicants 11. bring alcohol, food or other goods in glass packaging onto the premises 12. eat in a swimming pool area in other places than designated, 13. shout and make noise, or set off false alarms, 14. swim in glasses other than swimming goggles, 15. slide down the slope pipe in glasses, 16. bring or stay animals, 17. destroy swimming pool facilities and equipment or litter the area, 18. conduct commercial activities without the written consent of Aqua Park Zakopane Management, 19. record videos with cameras such as GO PRO etc. and the use of any cameras without the consent of the

management of Aqua Park Zakopane.

E. CUSTOMER AND AQUA PARK RESPONSIBILITY

1. Before leaving the locker room for the swimming pool area, check that the pool locker is closed. For things left in open or improperly closed lockers, money and valuables, the management of Aqua Park Zakopane is not responsible. Valuables should be left in the deposit boxes located on the first floor at the pool counters.

2. The management of the facility is not responsible for things left unattended in the Aqua Park Zakopane facility.

3. Any damage to the Client's property or person that has occurred or may have occurred in Aqua Park Zakopane, the Client is obliged to report it immediately to the Customer Service Office (Information Point).

4. The management of Aqua Park Zakopane is not responsible for damaged swimsuits. 5. Aqua Park Management is not responsible for any damage to the Client's property caused by failure to

comply with these regulations. 6. The Customer is responsible for damages caused to the property of the object due to the fault of the

Customer. 7. For damaged or lost equipment of the facility, there is a fee corresponding to 100% of the value of the

damage caused. 8. Persons staying on the premises of the facility and violating public order, good manners, including the

use of vulgarisms, posing a threat to other persons staying on the premises, as well as persons not complying with the provisions of these Terms and Conditions or the recommendations of the security services and employees may be removed from the premises without reimbursement of the costs of tickets or passes, regardless of possible criminal and civil proceedings.

F. ORGANIZED GROUPS

1. An organized group means a group of people bathing, exercising in water, using the services of Aqua Park Zakopane under the supervision of a guardian (hereinafter referred to as "Organized Group Guardian").

2. An Organized Group Guardian is understood to mean a person with appropriate qualifications for the way the group is organized (entry in the framework of the leisure activities of school children and youth, entry in public and non-public schools and institutions, other group entries).

3. There can be no more than 15 underage participants

a. or adult students, 10 participants in b. preschool age for one Organized Group Guardian, c. in the case of a group consisting of people with disabilities, the number of guardians should

depend on the type of disability and the health of the group's participants and should be given by group organizer.

4. Before entering Aqua Park, the Organized Group Guardian is obliged to sign the "statement of an Organized Group Guardian" (form to be downloaded at the swimming pool ticket office), the data contained therein constitute a secret of the POLSKIE TATRY S.A. and are stored in accordance with the provisions of the personal data protection act.

5. The Organized Group Guardian is obliged to take proper care, supervise and ensure the safety of the participants entrusted to his care to a group of people in the Aqua Park Zakopane facility.

6. The Organized Group Guardian must not force the participants of the group to use water attractions. 7. The Organized Group Guardians are obliged to dress up in sportswear or other outfit that distinguishes

it in Aqua Park and throughout the whole group's stay in the swimming pool hall stay with the group, supervising and controlling the behaviour of its participants.

8. The Organized Group Guardian should be in a place close to the water from which he would see all participants and be seen by them.

9. Participants of organized groups enter the swimming pool area at the same time under the supervision of the guardian.

10. The Group Guardians are required in particular to: a. arrange all the formalities in the box offices of Aqua Park Zakopane related to the entrance of

the group to the swimming pool,

b. instruct group participants on how to use swimming pool cabinets and transponders, c. remind the group to wash their bodies under the shower, d. lead the group, before entering the water, to the lifeguard on duty for instructions, e. control the behavior of the group participants during their stay in the pool hall, especially to

stay in constant eye and voice contact with them throughout their stay at the pool hall and, if necessary, take action to maintain order and safety,

f. ensure that the group behaves calmly, culturally, without noise and without destroying the property in the area of the swimming pool,

g. acquaint the group with the facility Terms and Conditions. 11. The group guardian is responsible for the entrusted identifiers given to the group participants. 12. Organized groups without a guardian will not be allowed into the facility. 13. The instructors or guardians may only enter the swimming pool in a swimsuit and special footwear for

swimming lessons or barefoot. 14. Teachers or guardians are obliged to check the numerical status of the group before entering and after

leaving the swimming pool; in case of discrepancies (changes in the number of participants) they are obliged to report this fact immediately to the lifeguard on duty.

15. The guardians of an organized group and the instructors of the activities are fully responsible for the safety of the group, its proper behavior and compliance with the Terms and Conditions and all actions of the participants of the group.

16. At the signal indicating the end of classes, the swimmers should leave the pool immediately. 17. The swimming instructor is obliged to deposit the swimming equipment in a designated place after the

end of the class. 18. The organizer is responsible for safety during the competition.

G. PAYMENT

1. The fee for admission to swimming pools and other services is collected in accordance with the price list approved by the Management Board of POLSKIE TATRY S.A. Price lists are available at Aqua Park cash desks, on the website of the facility and in the Customer Service Office of Aqua Park Zakopane.

2. Discounts and promotions are not cumulative and cannot be applied jointly. 3. When leaving the swimming pool and the area of the object, the Client is obliged to make a complete

settlement of used services and consumption on the object area. 4. The time of stay in the swimming pool hall is calculated from the moment of issue to the return of the

badge at the box office of Aqua Park Zakopane. After purchasing a ticket, you must immediately pass through the entrance gate.

5. In the case of leaving the pool before the end of the purchased time of stay for reasons not attributable to Aqua Park Zakopane, it is not possible to return the money for unused time.

6. It is not possible to stop the time or shorten the stay after buying a ticket. 7. Aqua Park is open until 10 p.m. The management of Aquapark Zakopane does not refund money or

grant discounts on tickets purchased before 10 p.m., the full use of which is not possible due to the working hours of the facility. The swimming pool attractions are closed at 9:45 p.m.

8. An invoice for services provided by Aquapark Zakopane can be obtained from the Customer Service Office on the basis of the submitted fiscal receipt.

9. The fee for the declared time is not refundable. 10. Surcharge after 10:10 p.m. additional PLN 10 per person. 11. The fee for a lost badge is PLN 65. 12. Fees for a lost towel and a lost locker room key are charged according to the valid price list. 13. Reduced tickets are sold on the basis of presentation of a valid school ID (children up to 16 years of age),

an identity card (senior +60 years of age), and in the case of persons with a significant degree of disability (1 gr disability) on presentation of a document issued by an authorized body.

14. Youth tickets (from 17 to 26 years old) upon presentation of the student's identity card.

15. All prices include VAT.

H. FINAL PROVISIONS

1. In Aqua Park there is a total ban on soliciting; placing of any advertisements, announcements, etc. on the premises of the facility is possible with a written consent of the Director of Aqua Park.

2. In matters not covered by these terms and conditions, decisions are made by the Director of Aqua Park. 3. Complaints and requests and comments should be submitted to the Customer Service Office. The Aqua

Park Management responds only to complaints or written requests. 4. Aqua Park Zakopane is not responsible for any events resulting from failure to comply with these Terms

and Conditions.
