If you run an ecommerce store, a Terms and Conditions (1) (T&C) agreement is very important.

This agreement is where you’ll set out rules that you and your customers follow when making a purchase, including important terms like:

Payment details

Delivery terms

Returns and refunds

Limitations of warranty/liability

Intellectual property rights

This clause will vary depending on what goods you’re selling.

If you sell clothing, for example, your liability will be low since it’s a low risk item.

However, if you sell rock climbing gear, your liability risks are higher if a product is faulty.

There are two common methods for displaying terms (5):

Browsewrap is a passive method of displaying your Terms, typically through a link in the footer of your website.

A clause in your T&C will state that simply by using your website, a user is agreeing to your Terms.

Clickwrap is the preferred method. It requires a user to take an active step to show he agrees to your Terms, such as by clicking a checkbox or “I Accept” button.

Have users actively click something while placing an order to show that they agree to your Terms
