TERMS AND CONDITIONS In the U.S.,

• the 4TH AMENDMENT protects against unlawful search and seizure.

• the 9TH AMENDMENT implies that you may have other rights than those that are specifically mentioned in the Constitution.

• the 14TH AMENDMENT keeps the government from taking your “life, liberty, or property.”

Today, defendants are citing these portions of the Constitution in social media-related cases. There’s also

• the FEDERAL PRIVACY ACT OF 1974, which says that the government can’t share what it knows about you without your permission…

…But guess what.

YOU LOSE THIS RIGHT AS SOON AS YOU DIE. There is no for-sure legal document that says social media gets any of these protections– whether you’re dead or alive. Does that mean whatever happens to your digital footprint is up in the air? Well. Sort of.

The verdict from WARSHAK V. UNITED STATES: “the Court…is not persuaded…that an individual surrenders his reasonable expectation of privacy in his personal emails (or electronic copies thereof) to be stored on a subscriber account…” Hopefully you forgive the legal jargon, but that basically means the court recognizes that some privacy rights should apply to our digital lives.

When it comes down to it,

IT’S ALL IN THE TERMS OF SERVICE.

You know, that big, bulky, unreasonable document that you just don’t have the time to read before clicking “AGREE”? Unfortunately, fine print

matters here.

Because you see, Yahoo! specifically mentions that if you die, your account belongs to nobody and

WILL BE SHUT DOWN immediately, whereas Facebook mentions that it may

MEMORIALIZE OR DELETE an account via your next of kin. Evan and John, previously mentioned creators of thedigitalbeyond.com, predict and suggest the creation of

1 MASTER TERMS OF SERVICE that applies to all social media services. This would fix a lot of problems. It would help the law catch up. It would put everyone on the same level. It would make civil privacy disputes go smoother. It would just make sense.

HERE’S THE CATCH. This involves government stepping up. And social media really doesn’t

like to go near government. Once the government has their hands in something, well, it tends to be hard to let go.

It’s not too brash to say that one day Facebook (or something similar

to it) may be a mandatory

IDENTIFICATION SYSTEM for citizens of certain countries. It would be an efficient and detailed

way to keep tabs on the alive and the dead.
