INTRODUCTION

The records contained in Record Group 277, Tennessee Department of Correction span the period 1902 through 1992, although the bulk of the collection is concentrated in the 1970s and 1980s. The record group consists of clippings, correspondence, minutes, reports, and subject files, reflecting the various responsibilities of the Department of Correction. The records contained in Record Group 277 came to the Tennessee State Library and Archives from the State Records Center. The final disposition of the collection was determined by the Records Disposition Authorization (RDA) process. In accordance with the RDA, all the material in Record Group 277 has been microfilmed and the originals were disposed of by state approved method. Record Group 277 consists of approximately 76 cubic feet before microfilming and two oversized volumes. Records removed and destroyed during processing were duplicate copies and routine office correspondence was sampled. The records of the Board of Pardons and Paroles were separated from the collection, and formed into Record Group 280. Record Group 280 is confidential and restricted for public use until 2061. Record Group 277 may be used in conjunction with other record groups relating to the Department of Correction. SCOPE AND CONTENT NOTE

Record Group 277, Tennessee Department of Correction Records spans the period 1902 through 1992, although the bulk of the collection is concentrated in the 1970s and 1980s. The collection consists of approximately 75 cubic feet of material. In accordance with the Records Disposition Authorization (RDA), the collection was microfilmed and the originals disposed of by state approved method. Due to the immensity of the collection, Record Group 277 was divided into fourteen series, reflecting the divisions of the department throughout its existence. The largest series in the record group is the Division of Adult Services, and the Commissioner’s Office files (Commissioner and Assistant Commissioner’s files). The other record group series includes: Central Office Records; Community Services; Correctional Enterprises; Counseling Services; Internal Audits; Juvenile Probation; Organizational Development; Board of Pardons and Paroles; Rehabilitative Services; Tennessee Law Enforcement Agency; Tennessee Main Prison and Youth Services. The collection is composed of clippings, correspondence, minutes, reports, and subject files. The correspondence, in keeping with the original order, is filed alphabetically by sender or topic. Topical correspondence, such as letters concerning penal institutions, was not separated, but was maintained in the original filing system. There is very little correspondence before 1960 in the collection. Routine office correspondence, such as letters of requests, have been sampled and the majority disposed of. A vast amount of the collection consists of the large number of reports generated by the department, the various state prisons, and penal institutions. Population reports include information concerning prison population, those inmates transferred to other institutions, and inmates paroled. Although there are gaps in the records, each state institution is represented in the reports. Discipline Reports detail the infractions committed by the inmates on a daily basis and the disciplinary actions taken against the inmate. The records found in the Tennessee Department of Correction record group provide an extremely important view of corrections in Tennessee in the mid-twentieth century. Although there are many gaps in years, the collection should prove useful to students of Tennessee social and penal history.

TENNESSEE DEPARTMENT OF CORRECTION

The Tennessee Department of Correction was established for the care and custody of inmates and the various adult penal and juvenile and correctional institutions. The Department of Correction also operated a system of state industries in the penal institutions, supervised the operation of farmlands, and supervised the program of the Board of Pardons and Paroles. The department’s role and scope has changed since the Tennessee State Penitentiary opened in 1839 with 13 prisoners. From 1871 to 1939, the department went through various name changes and reorganizations to become the modern day Tennessee Department of Correction in 1955. At that time various divisions were created, one for juvenile probation in 1957, and the Division of Adult Probation and Parole in 1961. In 1979, the Adult Board of Parole became an autonomous unit with probation remaining under the jurisdiction of the department. The juvenile division of the department also underwent changes in 1989 with its removal from the department to create the Tennessee Department of Youth Development. Modern day alternatives to traditional incarceration were developed in 1970, with the passage of the Prisoner Rehabilitation Act, authorizing adult release, and in 1974, with the opening of juvenile group homes in Memphis and Nashville. In the 1970s, the department began a major building program to accommodate a growing inmate population. Over 3000 beds were added to the system in regional prisons at Lake, Bledsoe, Morgan, and Davidson counties. The 1980s ushered in a period of great change due to a federal lawsuit (Grubb’s Case) filed by the inmates complaining of unfit and crowded conditions, and the increased demand for bed space, surpassed the supply because of changes in the state’s sentencing structure. Consequently, the department came under federal supervision. In October 1985 a special session of the Tennessee General Assembly was convened to address prison problems. The legislature approved the 1985 Comprehensive Correction Improvement Act that addressed these areas and funded over $320 million to improve current facilities and build new ones. In 1987, Governor McWherter inaugurated another multimillion dollar construction program. Two new maximum security facilities were completed by 1990. Riverbend Maximum Security Institution, the first high security prison built since the turn of the century, was completed in the Cockrill Bend area of Nashville and West Tennessee High Security Facility, adjacent to the Cold Creek Correctional Facility. Northeast Correctional Center in Wayne County opened in March 1992, and Northwest Correctional Center in Lake County opened in June 1992. Each was designated as a medium security facility. In June 1992, Lois M. DeBerry Special Needs Facility opened to house 612 inmates. The Wayne County Work Camp, originally designed to house inmates who could furnish labor to the state, and local and nonprofit agencies, was converted to a boot camp where offenders go through 90-120 days of extensive work and exercise. On May 21, 1993, after 11 years of court ordered supervision, federal Judge Thomas Higgins ruled that Tennessee’s correctional system was constitutional.

INTRODUCTION

The records contained in Record Group 277, Tennessee Department of Correction, Addition, span the period 1981 through 1995, although the bulk of the collection is concentrated in the late 1980s. The record group consists of correspondence and subject files reflecting the various responsibilities of the Department of Correction. This record group is an addition to the larger collection of Department of Correction records housed at the Tennessee State Library and Archives. The collection came to the Archives from the State Records Center. The final disposition of the collection was determined by the Records Disposition Authorization (RDA) process. In accordance with the RDA, all the materials in this addition has been microfilmed and the originals disposed of by state approved method. The addition consists of approximately 19 cubic feet before microfilming. Records removed and destroyed during processing were those deemed confidential, such as medical, psychiatric, and employee records. Routine duplicate copies were removed from collection and destroyed. Several published Correction audits were removed and transferred to the State Library. This addition to Record Group 277 should be used in conjunction with the other larger Correction record groups. SCOPE AND CONTENT NOTE

Record Group 277, Tennessee Department of Correction, Addition, spans the period 1981 through 1995, although the bulk of the collection is concentrated in the late 1980s. This addition consists of approximately 19 cubic feet of material. In accordance with the Records Disposition Authorization (RDA), the collection was microfilmed and the originals disposed of by state approved method. The addition is divided into two series: Commissioner’s Files and the Deberry Correctional Institute. The largest and most significant part of this collection is the Deberry records. This series provides a comprehensive history of the correctional institute and an important overview of penal rehabilitation for inmates with “special needs.” The collection is composed of correspondence, meeting minutes, inner-office memorandum, and inspection reports. The correspondence, in keeping with the original order, is filed alphabetically by the sender of the general subject of the correspondence. Topical correspondence, such as letters concerning institutions, was not separated, but was maintained in the original filing system. A large amount of the correspondence is from wardens and regional administrators. The regional administrators were located in each of the three grand divisions and were responsible for supervising wardens and coordinating the fiscal operations of the institutions in the regions. Inmate/physician correspondence detailing medical and psychiatric treatment was considered confidential and disposed of. The subject files contain the large number of reports generated by the department. There are several types of reports found in the collection. The accreditation reports detail the condition of the institutions at inspection time, and provide an important social history of prison life in Tennessee. Discipline reports detail the infractions committed by the inmates on a daily basis and the disciplinary actions taken against the inmate. The majority of the reports were generated by the Deberry Correctional Institute, although some reports are found in the Commissioner’s Files. The records found in this addition may provide an important view of the history of the Tennessee prison system in the late 20th century. The late 1980s was a period of great reform in the prison system and this collection, supplemented with the larger record groups, should prove useful to students of Tennessee social and penal history.

DEBERRY CORRECTIONAL INSTITUTE

For several years, officials of the Tennessee Department of Correction recognized that there were large numbers of incarcerated individuals suffering from emotional, personality, and/or adjustment problems to such a degree as to preclude these individuals from appropriate functioning in the penal system. With the increasing population of inmates needing mental health treatment in a secure environment as well as the limited availability of such services from the Tennessee Department of Mental Health and Mental Retardation, the Tennessee Department of Correction established the Deberry Correctional Institute in 1976 (House Joint Resolution No. 154). The employment of staff members began in September 1976, and the first inmates were received on May 16, 1977. The original program was located in a building opened in Davidson County on October 5, 1932, known as the Tennessee Hospital for the Criminally Insane. Originally the property included 176 acres, and included four administrative, program and housing buildings. The complex was renovated in 1976-1977 after it was transferred to the Department of Correction. In the late 1980s, the institute became a leader in the sex offender treatment program. In 1992, the Lois M. Deberry Special Needs Facility became operational, replacing the Deberry Correctional Institute. In the 1980s, the Deberry Correctional Institute had a total of 237 positions for employees. Organizationally, the institution was divided into three sections: Treatment, Security, and Administrative Services. Under the Treatment Section, there were 57 employees who provided goal-directed activities designed to provide inmates with opportunities for positive behavior changes. In addition to the position of the Associate Warden of Treatment, the section included the following services: clinical services, counseling, recreation, occupational therapy, education, chaplain services, and volunteer services. The primary purpose of the Security Services section was to maintain a safe and humane facility for inmates and employees. Security staff were charged to provide the inmates with an opportunity to participate maximally in projects and to learn behaviors and attitudes compatible with lawful conduct and normal psychological functioning. Under the direction of the Associate Warden of Security, security services were provided on a 24 hour basis, seven days a week, to all 285 inmates and 237 employees. At its peak of operation, 104 correctional officers were employed at Deberry. The Administrative Services staff provided support services and fiscal operation. Staffing consisted of 36 employees. Today, the Lois M. DeBerry Special Needs Facility (DSNF) provides a number of services for the department including acute and convalescent health care, intensive mental health intervention, a therapeutic program for sex offenders, and departmental pharmaceutical services

The Tennessee Department of Correction: A Brief Outline, 1981-1995

1981 A volunteer prisoner work program for minimum risk prisoners is established. 1982 The department is required to undertake a study and report to the

Tennessee General Assembly Joint Governmental Operations Committee on: (1) reorganizing and staffing the department, (2) increasing work opportunities for inmates, (3) improving performance and morale of correctional officers and other staff.

1983 Commissioner William Long appointed. Federal Court appoints a Master to oversee correction of unconstitutional

conditions that were found to exist in Grubbs vs Bradley. Highland Rim School for Girls closed and Spencer Youth Center becomes

coed the summer of 1983 1984 Commissioner Ernest Pellegrin appointed. Tennessee Correction Academy opens at site of former Highland Rim

School for Girls 1985 Commissioner Stephen H. Norris appointed. Prison riots throughout system during summer months, causing millions of

dollars in damage. General Assembly holds First Extraordinary Session on Corrections in late

1985, resulting in many significant changes through the Comprehensive Corrections Improvement Act of 1985; Select Oversight Committee on Corrections is established; Community Corrections programs are initiated; random drug testing of inmates begins; Sentencing Commission is established.

1987 Governor Ned R. McWherter elected. 1989 Commissioner W. Jeff Reynolds appointed. Regional concept is born. TDOC facilities fall under one of three regions,

East, Middle, or West. Administrators are appointed for each region.

1989 Riverbend Maximum Security Institution is opened. Sentencing Reform Act of 1989 is passed by the General Assembly. 1989 State and Local Correction Reform Act of 1989 provides mechanism for

the state to reimburse counties for housing felons. Wayne County Boot Camp (Special Alternative Incarceration Unit) begins

operation. 1990 West Tennessee High Security Facility is opened. 1991 Northeast Correctional Center is opened. 1992 Commissioner Christine J. Bradley appointed. South Central Correctional Center becomes operational under the

management of Corrections Corporation of America in March. The facility is the test case for privatization of prison operations in Tennessee.

Wayne County Boot Camp begins accepting offenders up to 35 years of

age. Lois M. Deberry Special Needs Facility is opened in June replacing

Deberry Correctional Institute. Tennessee Offender Management Information System (TOMIS) is

implemented. Northwest Correctional Center is opened in May. Tennessee State Penitentiary closes in June. 1993 Department of Correction released from Grubbs suit; required to report on

health services for one years; permanent injunction entered prohibiting TDOC to house inmates in the old Tennessee State Penitentiary.

1994 Funding was approved to add 1,000 beds to prison system. The Department of Correction’s final two institutions passed their

American Correctional Association accreditation audits. This made the department the first adult correctional system in the United States to have all of its programs nationally accredited.
