PREAMBLE TO BILL OF QUANTITIES..

(to be signed by Bidders)

General Directions

1.0 The Contract resulting from this Bid shall be an Item rate Contract and the Bids are invited accordingly.

2.0 A brief description of items is given in the Bill of Quantities. The Bill of Quantities shall be read in conjunction

with the Condition of Contract, Specifications, Drawings and other documents forming part of the Bid.

3.0 The Bidder shall be deemed to have fully understood the Works, the subject of the Bid and to have satisfied

himself as to the correctness of the description of Works stated in the instruction to Bidders, Bill of

Quantities and application of individual items of Works as per drawings, Specifications and Contract

Documents.

4.0 The Bidder shall fill in rates and prices for all the items of the Works given in all the sections of the Bill of

Quantities and Schedule of Rates, whether quantities are stated or not. Items against which no rate or price

is entered by the Bidder shall be deemed to be covered by the rates and prices for other items in the Bill of

Quantities and no separate payment shall be made for such items when executed.

5.0 All duties, taxes, fees, charges and other levies payable by the Contractor under the Contract, or for any

other cause shall be included in the rates and prices and in the total Bid Price submitted by the Bidder.

6.0 The unit rates entered by the Bidder against the items of Bill of Quantities shall be full inclusive value of the

Works described for the specified items and shall be deemed to include all costs consisting of furnishing all

plant, labour, equipment, machinery, appliances, materials, consumables, all fittings and fixtures and in

performing all operations of whatsoever nature required for execution and completion of the Works,

remedying of any defects therein and maintenance of utility services of the Works including but not limited to

profit, rental of equipment, payment of any taxes & levies as applicable etc. and the cost of general risks,

liabilities, obligations and any others setforth in the Contract.

7.0 The total of the Bill of Quantities shall be the Price for the execution and completion of the Works and

remedying of any defects therein, as shown on, described in or reasonably to be inferred from the Drawings,

the Specifications and the description of Works and shall include all on-costs, incidental expenses and

obligations, liabilities and risks of every kind for which the Contractor is liable under the Conditions of

Contract.

8.0 Notwithstanding any limits which may be implied by the wording of the individual items and/or the

explanations in this subsection, the rates and prices/ sums in the Bill of Quantities are to be for the work

finished complete in every respect. The Contractor will be deemed to have taken full account of all

requirements and obligations, whether expressed or implied, covered by all parts of this Contract and to

have priced the items herein accordingly.

9.0 The unit rates, beside the basic costs such as for providing material and gear, wages and salaries for

workers and other personnel etc. shall also include all incidental costs and incidental performances, which

are necessary for proper execution of the Works in accordance with the Contract. Accordingly, contained in

the submitted unit rates are also the costs for:

(a) providing and maintaining of the total Site installations/ works, transportation gear, machines, plant,

equipment, scaffolding, shuttering, staging and all other Temporary Works;

(b) the required fuels, greases, electric power, oxygen, acetylene, compressed air, water etc.;

(c) additional costs for two or three-shift operation of personnel and Construction Plant, as well as for

work on Sundays and/or on locally recognized days of rest and public holidays, insofar as such

cannot be avoided in exceptional cases;

(d) the required accident prevention facilities and devices;

(e) the entire illumination facilities for the Site;

(f) the required means of communication such as telephones, internet and facsimile transmission

facility etc. including all post, air-mail, air freight and other freight charges, as well as the costs for

telephone calls, telegrams, internet and facsimile transmission etc.;

(g) the preparation of time schedules, programmes for construction and mobilization of plant, labour

and all other things, drawings for the Site installation and all Temporary Works, as well as all other

necessary drawings, plans, sketches, lists, tables, calculations and the like, insofar as such are to

be prepared pursuant to the Contract, inclusive of the costs for the supply of prints and/or other

copies;

(h) the responsibility of checking the Engineer’s Bid and working drawings and reporting to the

Engineer of any errors, ambiguities and omissions found;

(i) the supply of additional prints (3 copies each) of all final design or working drawings, calculations

and other data pursuant to any requirements of the contract;

(j) premium payments/ any other costs for the insurances for covering all risks as per Contract

requirements;

(k) printing and legalizing the Agreement of Contract, the Contract Documents, for the Bid,

Performance Bonds/ Guarantees, Bank Guarantee for advance payment and the interest costs for

withheld amounts of statements, if any;

(l) any taxes applicable within or beyond the jurisdiction of the Republic of Pakistan, sales tax,

customs duties, octroi charges, and all other taxes leviable on the Contractor;

(m) royalties and patent fees, licenses, liability claims of third parties and the like in connection with the

Works;

(n) all surveying and setting out works;

(o) the execution of all contractually specified and/ or agreed upon tests and laboratory investigations,

on the Site and at other locations, inclusive of all materials, equipment and personnel, skilled in the

use of such materials and equipment required for such testing and inspection and supplying of

certificates;

(p) protection of all fully or partially completed facilities and/ or structures;

(q) any unforeseen additional supplies and performances, construction measures, repairs etc.,

required for the due execution and completion of the Contract by the Contractor;

(r) all increases in material prices, transportation costs and wages and salaries if not accounted under

the Conditions of Contract;

(s) the Contractor’s own pre-financing, as well as for all other special supplies and performances,

measures and installations, which are not specifically listed here or otherwise in the Contract, but

which in the opinion of the Engineer are necessary for proper and complete execution of the Works

and which can be fairly demanded from the Contractor.

10.0 All prices and unit rates entered in the Bill of Quantities or any Schedule (corrected as per the provisions of

Contract, where necessary) are fixed and unchangeable and are not subject to any variation and shall be

full compensation for the works involved as per Drawings, Specifications and Contract Conditions unless

otherwise specified elsewhere in the documents of Contract.

11.0 In the Bill of Quantities, the price per unit and the total amount are to be indicated at the end of each

individual item. Should the total amount here not correspond with the unit price, the unit price shall be

considered relevant unless there is a gross error in placing decimal point in the unit price, which shall be

corrected.

12.0 For items for which no rate or price has been entered including geo-technical investigations for verification

of bearing capacity and CBR values will be deemed included in the rates and prices of other items priced

and covered elsewhere.

13.0 The quantities inserted in the Bill of Quantities are estimated. The work will be measured in accordance with

the Contract provisions and paid for at the rates or lump sums as per the Contract. The actual sum to be

finally paid to the Contractor will be determined by measuring the Work actually done in accordance with the

Contract and valuing it at the rates or amounts inserted by the Contractor in the Bill of Quantities.

14.0 Temporary Works will not be paid separately. All costs related to temporary work items are deemed

included in the relevant unit rates or lump sums for the individual items in the Bill of Quantities.

15.0 All prices are to be quoted in “Pak. Rupees.” and payments will be made accordingly in Pak. Rupees.

16.0 Where the term “complete” is used in any item in the Bill of Quantities, it shall be taken to mean the work

finished complete in every respect in accordance with the Drawings, Description of Works and

Specifications or as approved by the Engineer, including all fixtures, fittings, tests and reports, etc.

17.0 For the rates of extra/ additional items which are not covered by the BOQ, detailed rate analysis shall be

provided by the Contractor which shall cover all direct costs to the Contractor i.e. Base price of required

material, wastage of material, labour, transportation to the site of works, tools, plant, equipment and the like.

18.0 An additional 25% shall be added to the base price, if the item of work is carried-out by the Contractor, and

15% if such item is carried-out by specialist/ nominated Subcontractor as per Contract, which shall be

deemed to cover Contractor’s Project overheads, superintendence , liabilities, insurances and income tax,

allowances for labours, time keeping, clerkal and office works, use of consumable stores, Water, lighting

and power, Scaffolding, workshop and stores, supervision by the Contractor’s staff, foremen and other

supervisory personnel etc complete.

19.0 The Employer/ Engineer reserves the right to call for detailed analysis of any or all rates for the purpose of

evaluation and checking of internal consistency.

20.0 The Contractor must seek approval and/ or clarification (if or where required) regarding all methodology,

materials and specifications (/ measurement clauses), as mentioned in the tender documents/ drawings,

prior relevant bidding and/ or procurement and/ or execution stage.

Site Office having One (1) No. Container, with two partitions. The Site Office shall be furnished and equipped with all the necessary/ required furniture, fittings, four number steel cabinets, air-conditioners, electric power, water etc complete. The Site Office shall be ready within one month of signing the Contract including required watch & ward and attendance.

17. The Site Office shall be provided with necessary/ required office equipment, consumables

including but not limited to the following:

Employer & Engineer • Two Number Desktop (Core i5), with the required software installed;

• One Water Cooler/ Dispenser;

• Two Bottles of drinking water (20 lit) per day;

• Necessary/ Required Stationary, and

• All required maintenance, repairs/ replacements, consumables, etc

18. All the Equipment and Provisions included in Items No. 16 and 17 shall be new and at the cost of Contractor.

Before issuing any Payment Certificate to the Contractor, which includes amounts payable to his subcontractors and labour, the Engineer may request the Contactor to supply reasonable proof that such subcontractors and labour have received all amounts due in accordance with the previous Payment Certificates less any deductions, if applicable. The Contractor shall then:

a) Submit reasonable proof to the Engineer of having made such payments, or

b) Satisfy the Engineer in writing that he is reasonably entitled to withhold or refuse payment to

any such subcontractor or labour and produce evidence of having notified in writing the

concerned and the reasons thereof and his entitlements in this regard.

21. All payments by the Employer to the Contractors/ Suppliers under the Contract shall be subject to

statutory deductions.

22. All waste material/ concrete, unwanted spoils, rejected material, debris, mud, wash / waste water

and materials decided by the Employer as unwanted / unsuitable shall be disposed off by the Contractor properly and regularly at his own cost as per prevailing rules / requirements and the Site / Site of Works kept clean and neat with adequate house-keeping to the satisfaction of the Engineer.

scaffolding, the use of water, lighting and appliances of all descriptions; supervision by the Contractor’s staff, foremen, gangers, and all other incidental charges whatsoever.

(2) The Contractor shall carry out all Day Work, within normal working hours unless the

Engineer has given written approval to the contrary. Payment of workmen employed on Day Work performed outside normal working hours will be made at overtime rate only if the Engineer has given such approval. Rate for overtime shall be the rate indicated above plus 50% increase for overtime work.

Materials: Materials to be supplied for Daywork, for incorporation into the Works, shall be paid for at the invoiced price for locally procured materials of local or foreign origin delivered to Site plus surcharge of 30% which shall be deemed to cover for cartage, handling and others from source to site, wastage and Contractor’s overhead and profit, income tax, sales tax, levies, royalties etc.

Plant: Any plant used for Daywork shall be charged at the hire rates entered by us in Appendix “F” to the Form of Bid or if not listed herein, at comparable rates. The hire rate of construction plant and equipment entered in Appendix “F” shall be applicable only for work done on the basis of Daywork provisions.

Payment: Any payment made for Daywork shall be final.

CONSTRUCTION CAMPS AND HOUSING FACILITIES

The Contractor in accordance with Clause 34 of the Conditions of Contract shall provide description of his construction camp, facilities and staff housing requirements. The Contractor shall be responsible for pumps, electrical works, water and electrical distribution systems, and sewerage system including all fittings, pipes and other items necessary for servicing the Contractor’s construction camp.
