1. DEFINITIONS

BUIDCo shall mean Bihar Urban Infrastructure Development Corporation Ltd.

Bidder shall mean the firm which participates in the RFP and submits its Bid.

Bid/Proposal shall mean the Bid submitted by the Bidders in response to

this RFP.

Bid Validity Period shall mean a period of not less than 180 days from the last

date for submission of the Bid Proposal.

Project shall mean the specialized fabrication, production and installation

services for museum exhibits as per the design proposal submitted by the

bidder in accordance with this document and as directed by BUIDCo for

Museum at Buddha Smriti Park, Patna.

Successful Bidder The Bidder who interalia meets the following requirements

(a) Meets the Technical and Financial criteria;

(b) Whose Bid Proposal are acceptable to the evaluation committee and

(c) Adheres / consents to adhere to all other conditions laid down in this

document.

2. BRIEF ABOUT BUIDCo, Buddha Smriti Park and the Project

Bihar Urban Infrastructure Development Corporation Ltd. (BUIDCo) is a

Government of Bihar Undertaking, under Ministry of Urban Development and

Housing Department, Govt. of Bihar. Buddha Smriti Park, Patna is being developed

under the aegis of BUIDCo and thereby BUIDCo has undertaken to develop the

Museum at Buddha Smriti Park, Patna. The Proposed project intends to develop the

museum through selection of agency for specialized fabrication; production and

installation services for museum exhibits. For this purpose, BUIDCo intends to

select a competent agency with experience of similar nature who can propose the

design and provide services in accordance with the conditions laid down in this

document and as per the approval accorded by the evaluation committee of

BUIDCo and Department of Art & Culture, Government of Bihar. The estimated

project cost for the stated work is around Rs. 8.5 Crores.

4. REQUEST FOR PROPOSAL

BUIDCo invites proposals for selection of an agency for specialized fabrication,

production and installation services for museum exhibits including the

Hardware and softwares at the museum of Buddha Smriti Park, Patna subject to

terms and conditions given hereunder in this document.

5 SUBMISSION OF BID

The Bidding Process shall be in two parts, viz.

Part- I : Technical Bid

Part- II: Financial Bid

Technical & Financial Bids are to be submitted on same date and time.

The Technical bid and Financial bid will be sealed in different envelopes super

scribing “TECHNICAL BID” AND “FINANCIAL BID” respectively. Both the bids

will be sealed in a bigger envelope and super scribed as “RFP FOR PROVIDING

SPECIALISED FABRICATION, PRODUCTION AND INSTALLATION SERVICES FOR

MUSEUM EXHIBITS AT BUDDHA SMRITI PARK, PATNA”.

The bidder should take care in submitting the bid properly filed so that

enclosed papers are hard bound. The bid document should be properly

numbered and signed on each page by the authorised signatory of the company

under company seal and submitted in proper manner.

5.2 Parts of Technical Bid

ANNEXURE - I contains instructions for the bidders.

ANNEXURE – II is the format for Technical Bid

5.3 Part of Financial Bid

ANNEXURE – III is the format for Financial Bid.

ANNEXURE – IV is the format of Bank Guarantee for Performance

ANNEXURE – V is the format for Agreement to be signed between BUIDCo and the

successful bidder.

ANNEXURE – VI is the FINAL DESIGN REPORT for museum exhibits submitted

by Lord Cultural Resources

Bids with all the relative annexure and the detailed proposal of the bidders

solicited herewith in this document should be submitted to the address

mentioned above and by the date of Submission of Bid as per Clause 3: Bid

To ensure uniformity at the time of evaluation and finalization of offers the

bidder shall strictly follow the format & procedure indicated in the Annexure.

5.4 Document Fee

The Bid should be submitted along with the Document Fee of Rs. 20,000/- (Rupees

Twenty Thousand Only) in favour of “Managing Director, BUIDCo” payable at

Patna.

5.5 Earnest Money Deposit (EMD) and Performance Guarantee

Technical Bid must be accompanied by an EMD of Rs 1,700,000/- (Rupees

Seventeen Lakhs only) in the form of Demand Draft/Bank Guarantee (Annexure

IV) in favour of “Managing Director, BUIDCo” payable at Patna. Technical bids

not accompanied with the document fee and/or EMD shall be summarily

rejected. The EMD of unsuccessful bidders will be returned to them on

selection and execution of agreement with successful bidder. No interest shall be

paid on the EMD. If the selected bidder, refuses/ or is unable to accept the order,

his EMD will be forfeited.

The EMD deposited by the successful bidder shall be returned after submission

of Performance Guarantee equivalent to 10% of the contract value in the form of

a bank guarantee as per the prescribed format provided in Annexure IV. The

successful bidder shall be required to enter into an agreement with BUIDCo and

the performance guarantee is required to be submitted by the successful bidder

before signing of agreement. The performance guarantee deposited by the

successful bidder shall be appropriated by BUIDCo based on non performance in

accordance with this document

5.6 Evaluation of Technical Bid

The Technical bids will be examined by the Evaluation Committee as decided by

BUIDCo which may call for clarifications/ additional information from the

bidders. The same must be furnished to the Evaluation Committee within the

stipulated time.

5.6 Validity of Proposal

Financial Bid of the bidders w h o h a v e b e e n short-listed by the Evaluation

Committee will only be opened. The price quoted in Financial Bid should be

inclusive of all taxes, duties, transp ortat i on, an d an y other cha rge s . No

price escalation on any ground whatsoever will be entertained during the

period of validity of the rates.

5.7 Award of Work

The work shall be awarded to the successful Bidder selected by the evaluation

committee as per Clause 9 of Annexure I – Instruction to Bidders.

ANNEXURE – I

6. INSTRUCTIONS TO THE BIDDER

6.1 General Terms & Conditions of the Quotation

6.1.1 The Proposal is being invited in Single Stage Double Envelope Process. The

technical details with the relevant information / documents /

acceptance of all terms and conditions strictly as described in this RFP

document should be submitted. If short listed, the Financial Bid of the

bidder will be opened.

6.1.2 Any incomplete or ambiguous terms/conditions/quotes will disqualify the

bidder.

6.1.3 BUIDCo reserves the right to accept / reject any or all Proposal/s without

assigning any reason thereof.

6.1. 4 BUIDCo reserves the right to stop the process at any stage and go in for

fresh bidding without assigning any reasons thereof.

6.1.5 BUIDCo may, in its absolute discretion, seek additional information or

material from any bidder after the Bidding closes and all such

information and material provided shall be taken to form part of that

bidder’s proposal.

6.1.6 Bidder should provide details of their Fax, email and full address(s) to

ensure that replies to Bids could be conveyed promptly.

6.2 Details of RFP document

6.2.2 Please fill in the relevant information in the blanks provided.

in all the relevant Annexure and return the complete set in sealed cover.

6.2.4 Bids not fulfilling any or all of the conditions prescribed or which are

incomplete are liable to be rejected.

6.2.5 No advance copy of bid through Email/Fax or in any other form should be

disclosed to any of the employee/consultant of BUIDCo.

6.2.6 No consideration will be given to bids received after the time stipulated

above. Any extension of time shall be sole discretion of BUIDCo.

6.2.7 Canvassing/Cartel in connection with Bidding process is strictly

prohibited and bids submitted by bidders who resort to canvassing are

liable to be rejected.

6.2.8 The Firm should not have been black listed by any Govt. Bodies / PSUs

etc.

7. SCOPE OF WORK

Specialized fabrication, production and installation services for museum exhibits

at Buddha Smriti Park, Patna shall comprise of the following:

The selected contractor will be required to complete all the required services to

fabricate, produce and install exhibits and interpretive media for the museum, this

includes, but is not limited to the following.

I. Complete fabrication services including – millworks, AV, multimedia,

models, dioramas, low-tech hands-on exhibits etc.

II. Produce Shop Drawings – Construction drawings for all exhibit components

must be detailed out and submitted for review and approvals

III. Multimedia Software Production – research, scripting, sourcing (images.

Stock material and new material), procurement, online and offline

productions, pre and post production work, Wi-Fi/Ethernet integration, etc.

IV. Graphic Artwork Production – the contractor will be supplied with

necessary templates, requirements, specification and content for graphic

production. The contractor will be responsible for preparing art work and

ensuring final approval by the client prior to production. The fabricator will

provide recommendations for graphic production such as substrate,

wrapping techniques and so forth if different from those specified by the

designers.

V. Original Art Work Production – The contractor is required to work with

local artists/artisans or a local art college for the production of original art

works for display in the exhibit galleries. The contractor should refer to

original art work specifications in section 5 of the final design report for

details

VI. Artifact Mounts – A small number of artifacts will be displayed in the

exhibit. The contractor will need to create a series of plinth and/or custom

mounts to ensure the security of artifacts. The identified mounts maker will

work closely with the designer from lord Cultural Resources (consultant

architects) to ensure the aesthetic quality of the mounts and with the

museum staff to ensure the safety and final layout of the artifacts.

VII. Site review and measurement confirmation

VIII. Coordination with the site/project manager and base building contractor as

required to ensure that the exhibits meet building requirements and vice

versa

IX. Provide all necessary warranties and guarantees

X. Provide training for museum staff on operating and maintaining the

exhibits

XI. Provide adequate commissioning period to correct errors and omissions

XII. Contractors must comply with the rules and regulations of the state of

Bihar

** It is advised to bidders to make a visit to the site/discuss with concerned officials

to understand the exact requirements of the work.

All specifications and drawings are provided in the final design report. This

package provides a complete description of the project including;

i. Interpretive plan

The story line and description of the experience visitors will have when

they come to the museum. This is a foundational document for

understanding the vision of this project. Proponents should carefully

review the interpretive plan in order to understand the quality of the

experience expected. Clear understanding of the interpretive plan must

be demonstrated by the proponent in their introduction. Please note the

exhibit numbers in this plan. These numbers are referenced and cross

referenced throughout the tender document and will be basis upon

which all exhibits will be identified and tracked throughout the life of

the project. Proponents, estimates must refer these exhibit numbers as

well as drawing numbers

ii. Final Design

Drawings and performance requirements for all exhibit spaces.

iii. Multimedia Specification

Additional description and performance requirements for all video and

interactive media. These descriptions identify the visitors experience

and objective for each experience as well as direction for how this

system shall be researched and programmed by the multimedia

supplier. The supplier will prepare the final list of equipments and will

be responsible for all programming, integration, researching and

sourcing assets (images, video, audio both old and new) scripting and

more.

iv. Original Art work Specifications

Description of original artwork requirements along with special

requirements to work with local artists and artisans is identified

i) This specification covers the supply, F.O.R delivery at site, installation,

testing and commissioning of stated project.

ii) All the equipment/accessories will be warranted and must operate at or

above the guaranteed values with regard to availability.

iii) The equipment proposed to be supplied by the bidders shall be industry

proven products and not the R&D models unless specified in the technical

specifications. All supplies including hardware and software shall conform

to the requirements of relevant Indian and International standard.

iv) Part/Model no., etc. as used by the manufacturer shall be indicated along

with the technical offer.

v) Technical literature of the components offered and as published by the

original manufacturer of the component, shall be submitted along with the

offer giving cross-reference of details in the technical bid.

vi) The vendor shall provide all the required equipment and services whether

explicitly mentioned in these specifications or not to fulfill the intent of the

specifications and to ensure the completeness, operability and

maintainability of the project at no extra cost to the organization

responsible for its maintenance.

vii) All the equipment, accessories supplied under this contract shall be in

accordance with the latest applicable recommendations, regulations and

standards. The bidder shall furnish a complete list of all the standards and

codes under which offered equipment and products are designed,

manufactured and assembled along with the bid.

viii) All the safety measures should be taken for the protection of the

Museum Exhibits.

ix) The vendor shall be fully responsible for installation and commissioning of

the equipment/artifacts and other related activities such as unpacking,

uncrating, inspection, etc. for which BUIDCo shall provide the required

space at Park premises. The vendor shall have to arrange all the testing

equipment and tools required for maintenance and make their own

transport arrangements.

x) Installation of the equipment shall be done by the vendor at the exact

locations. The vendor shall arrange material/manpower required for such

installation.

xi) Cost of material/accessories required for the installation of Museum

Exhibits hardware/software shall be included in the units bid price of total

digital solution.

xii) Selected vendor shall carry out complete installation through

competent/trained supervisor and workmen. All the materials shall be

handled and installed taking due care to avoid any damage to the Park

property and its personnel.

xiii) The vendor shall guarantee that equipment to be supplied under

these specifications shall work for its intended use. The vendor shall also

guarantee that in case the equipment supplied under the contract fails to

provide its intended use, the equipment will be replaced by the vendor

without any financial liability on the part of BUIDCo.

xiv) On completion of supply of the equipment under this contract, each

item of the equipment shall be thoroughly inspected jointly by BUIDCo and

the third party inspector (i.e. the museum consultant).

xv) Project Time Line – The project shall have to be installed and

commissioned in full at the site within two and a half months from the date

of issue of the letter of award i.e latest by 15th April 2013.

xvi) In case any item is not given in the technical specification of this

tender, but which is required essentially for commissioning of the project, it

should be included in the offer so as to make the offer complete in all

respects. No claim for extra payment shall be entertained on the plea that

the equipment specification was not complete in all respects.

xvii) Defect Liability Period - The defect liability period of the work

under this contract shall be 36 months from the date of issue of the

completion certificate by the museum consultant.

xviii) Payment Terms - The payment in Indian Rupees will be made as

per the recommendation of the Exhibit Project Manager within a fortnight

for executed work of the project.

xix) The vendor shall be required to enter into an agreement separately

for any other support services solicited by BUIDCo

8. Form of Submission of technical proposal

The Vendor must submit a proposal that includes a technical proposal and a

separate financial proposal. If a team of suppliers submits a proposal a clear “lead”

must be identified who will be legally responsible for the contract. Only complete

teams deemed to be able to complete all aspects of the project shall be considered

for the contract. The proposal must be submitted according to the following:

a. Cover Letter – indicate your understanding of the project needs and

commitment to the completion date identified above. Clearly identify the

address of the lead firm and contact information of the person legally

responsible for this project on behalf of the team. Clearly summarize your

experience working together as a team and provide examples (2 pages max). If

an international firm is desirous of participating for this fabrication, they

should have a strong counter part, who will be evaluated alongside.

b. Project Statement – Indicate your understanding of the interpretive approach

and visitor experience for this project. What is your role in ensuring the vision

of this project? Please indicate your commitment to the project, the timeline

and resources you have identified. (2 pages max)

c. Methodology – Prepare a concise methodology and work plan for delivering

this project. What is your approval process? How will you ensure

communication? How will you meet deadlines and ensure quality?

d. Schedule – Prepare a detailed schedule of the work

I. Time schedule – Preapre a detailed schedule of the work

II. Material schedule – As per the attached format a detailed material

schedule, and alternatives where the proponent believes that an

alternative will help

III. Alternatives – Based on your understanding of the projet, what

alternative methods of construction/material can you suggest that may

result in cost savings or to achieve budget? DO NOT MENTION ANY

COSTS HERE

e. Lead Firm Description – Include description and size of facilities and

capabilities, years of experience, number of staff, types of services provided,

depth of experiences, awards and more (3 pages max)

f. Other Firm Profiles – Corporate description of specialist sub contractors and

suppliers required to complete the full scope of this project. The proponent

shall be evaluated on the creativity and experience of all sub contractors and

as such each profile should include a short statement as to the role and

responsibility of their service of the team (1page for each firm max)

g. Team Organization - Identify the key members of the team including the

project manager, graphic artist, mount maker, AV specialist etc. In other words,

the key members of the team necessary to fulfill the requirements of the

exhibit creatively and effectively. Provide to organizational charts – one for the

roles and responsibilities of the firm and the second for the key personnel.

Provide half page profiles of each of the key personnel within the body of the

proposal. Provide all full CVs in an appendix to the proposal (No Page limit)

h. Project manager and Process – Provide a statement regarding your philosophy

for project management and how you will conduct yourselves on this job.

Identify the project Manager and discuss his/her experience and approach to

achieving success? How will you manage all your sub consultants and control

costs? How will you work with the client and exhibit Project manager?

i. Relevant experience – The team must illustrate that they can meet the

minimum and mandatory qualifications of this project. The lead firm must

have completed at least 3 projects of similar size and scope INR 4 crores

(approx. $735,000 USD) and above in the last 5 years. A lead proponent who

does not meet these requirements shall be disqualified.

I. Proponent shall present 5 relevant examples (of which 3 must meet the

budget requirements identified above) of your firm’s fabrication work.

Illustrate how this experience is comparable to this project. Include

visuals and description of the project including size, schedule, team

roles and budget. The lead firm must have been the lead proponent for

a minimum of 3 of the 5 relevant projects. For each off the five examples

provide name of the client, institution and contact information (No page

limit)

j. Relevant Experience of core team – Provide three relevant examples for each

of the firms that will join the lead proponent on this project. Limit each

example to a half page description of the project, role and relevance to this

project, etc. include 1 to 2 pictures within the half page limit (2 pages max for

each core team member) This is for firms only – Not individuals/personnel

k. References – Identify three individuals, their titles and institutions for whom

you have provided exhibit fabrication. All references must be selected from the

5 relevant examples that include the lead firm and must be for lead firm (1

page max)

9. Form of submission for financial proposal

Financial Proposal – In a clearly marked an sealed envelope, provide a detailed

cost estimate of the project. Complete your proposal according to the template

provided. The financial proposal must be submitted separate from the technical

proposal. Please ensure to cross reference drawing numbers accordingly. List

assumptions in your pricing. Clearly identify exclusions and identify the following;

a. Exclusions: What all exclusions are identified in the bid

b. Change orders – What constitutes a change order and how shall you manage

this process. What are strategies you will put in place to prevent cost over-

runs?

10. MINIMUM ELIGIBILITY CRITERIA

a. Experience of execution of at least 3 similar projects of comparable size in

India and abroad. Bidder must have executed each project of at least 2/3rd

of the estimated value of amount published in the Notice Inviting Tenders

during last 5 years. Proof of completion should be attached.

b. The firm/company should have positive net worth in audited accounts of

last five years, and an average turnover of at least Rs. 1500 Lakhs

(approximately 2.75 million USD, or equivalent) per annum. Audited

accounts need to be attached

c. No consortium or Joint Venture will be allowed, but the lead firm can have

sub-contractors who will need to be named, and their roles defined. If any

subcontractors have a role which will be 10% or more of the scope of work,

their credentials as per the above will also need to be submitted.

11. BID EVALUATION

The bids shall be evaluated on the basis of technical and financial proposal

submitted by the bidders. The evaluation of technical proposal is detailed below.

The financial bids of bidders scoring at least 75 in the technical evaluation will

only be opened and reviewed for financial evaluation. The bidder scoring highest

in the financial bid evaluation will be awarded the project.

A. Pre-qualification:

The details given by the applicants in the Application form will be evaluated as per

terms & conditions and requirements detailed in the minimum eligibility criteria

at pre-qualification stage.

B. Technical Evaluation:

The pre-qualified applicants will then be technically assessed based on following

C. Financial Evaluation

10. MISCELLANEOUS

10.1. Dispute Resolution a. In case of any dispute, final decision of the Managing Director of

BUIDCo will be binding upon all.

b. Any dispute with respect to this contract shall be subject to Patna

jurisdiction.

10.2. Other Terms and Conditions

i) The performance of the service will be the essence and shall form a major

factor. The Agency should endeavour all possible steps to ensure to

maintain its performance as determined by BUIDCo from time to time.

ii) If BUIDCo notices that the personnel of the firm has/have been negligent,

careless in rendering the said services, the same shall be communicated

immediately to the Agency who will take corrective steps immediately to

avoid recurrence of such incidents and report to BUIDCo.

iii) If any of the personnel of the firm indulges in theft, negligence & any

illegal/irregular activities, the firm shall take appropriate action against its

erring personnel and intimate accordingly to BUIDCo or itself can take

action in accordance with law.

iv) All payments made by BUIDCo shall be after deduction of tax at source

wherever applicable.

v) The Firm shall issue identity cards with certification of BUIDCo, on its own

name and trading style, to its personnel deputed for rendering the said

services, which would be subject to verification at any time. BUIDCo may

refuse the entry into the Park to any personnel of the Firm not bearing such

identity card or not being in proper uniform provided by Agency.

vi) Agency shall obtain all registration(s)/permissions(s)/license(s) etc. which

are/may be required under any law governing for providing the services.

vii) The Firm shall at its own expenses make good any loss or damage suffered

by BUIDCo as a result of the acts of commission or omission, negligently or

otherwise of its personnel while providing the said services at any time in

the premises of Park or otherwise.

viii) The Agency shall at all times Indemnify and keep indemnified

BUIDCo against any claim on account of disability/death of any of its

personnel caused while providing the services within/outside the site or

other premises of the Park which may be made under any Acts or any other

Statutory modifications hereof or otherwise for or in respect of any claim

for damage or compensation payable in consequence of any accident or

injury sustained while working of the personnel of the Agency or in respect

of any claim, damage or compensation under labour laws or other laws or

rules made there under by any Person whether in the employment of the

Agency or not, who provided or provides the service at the Park.

ix) The Agency shall at all times indemnify and keep indemnified BUIDCo

against any claim by any third party for any injury, damage to the property

or person of the third party or for any other claims whatsoever for any acts

of commission or omission of its employees or personnel during the hours

of providing the services at the Park or before and after that.

x) The Agency declares that it has the necessary skills, knowledge, expertise,

adequate capital and competent personnel, system and procedures,

infrastructure and capability to perform its obligations to the satisfaction of

the Statutory Bodies.

xi) The Agency has complied with and obtained necessary

permissions/license/authorizations under the Central, State and local

authorities and obtained all required permissions/licences for carrying out

its obligations.

xii) The agency awarded the contract will have to enter into an agreement on

the stamp papers of appropriate value that it will abide by the terms and

conditions as mentioned herein.

xiii) It is specifically clarified here that the Firm shall have to deploy the

complete the project within stated timeline i.e. 15th April 2013 and for

achieving this, the firm is required to preplan and execute accordingly.

xiv) Any delay/deterioration in the work performance by the firm shall

invite the penalty to the Firm in the following manner:

a. Liquidity Damage = 0.1% per day to a maximum of 5% of the contract

value

be caused or suffered by the Beneficiary on account thereof and the decision of the Beneficiary that the said Firm has committed such breach or breaches and as to the amount or amounts of loss, damage, costs, charges and expenses suffered by or that may be causes to or suffered by the Beneficiary from time to time shall be final and binding on us.

3. We, the said Bank, further agree that the Guarantee herein contained shall remain in full force and effect during the period that would be taken for the performance of the said Contract and till the dues of the Beneficiary under the said Contract or by virtue of any of the terms and conditions governing the said Contract have been fully paid and its claims satisfied or discharged and till the Beneficiary certifies that the terms and conditions of the said Contract have been fully and properly carried out by the said claim under this Guarantee after 180 days from the date of issue of Bank Guarantee i.e. valid upto ……… as provided in the said Contract or from the date of cancellation of the said Contract, as the case may be unless a notice of the claim under this Guarantee has been served on the Bank before the expiry of the said period of 180 days in which case the same shall be enforceable against the Bank notwithstanding the fact, that the same is enforced after the expiry of the said period of 180 days i.e. ……………...

4. The Beneficiary shall have the fullest liberty without effecting in any way the liability of the Bank under this Guarantee or indemnity, from time to time to vary any of the terms and conditions of the said Contract or to extend the time of performance by the said Firm or to postpone for any time and from time to time any of the powers exercisable by it against the said Firm and either to enforce or forebear from enforcing any of the terms and conditions governing the said Contract or Securities available to the Beneficiary and the said Bank shall not release from its liability under these presents any exercise by the Beneficiary of the liability with reference to the matters aforesaid or by reason of time being given to the said Firm or any other forbearance, act or omission on the part of the Beneficiary or any indulgence by the Beneficiary to the said Firm or any other matter or thing whatsoever which under the law relating to sureties would but for this provision have the effect of so releasing the Bank from its such liability.

5. It shall not be necessary for the Beneficiary to proceed against the Firm before proceeding against the Bank and the Guarantee herein contained shall be enforceable against the Bank notwithstanding any security which the Beneficiary may have obtained or obtain from the Firm shall at the time when proceedings are taken against the Bank hereunder be outstanding or unrealized.

6. We, the said Bank, lastly undertake not to revoke this Guarantee during its currency expect with the previous consent of the Beneficiary in writing and

agree that any change in the constitution of the said Firm or the said Bank shall not discharge our liability hereunder.

India, hereinafter referred to as "BUIDCo" (which expression shall unless excluded

by or repugnant to the context be deemed to mean and include its successors-in-

business and assigns) of the One Part.

(2) The Firm is engaged in the business of specialized fabrication, production and installation services for museum exhibits and as such has the experience in providing the aforesaid supply of services. Accordingly, Firm

submitted its offer along with other bidders & BUIDCo has accepted its offer in accordance with the RFP document as mentioned hereinafter and declared as successful bidder.

(3) Pursuant to acceptance of the offer of Firm by BUIDCo after comparing Firm’s bid with other bidders, BUIDCo has issued Letter of Award vide ref. no. ……………………….. dated ……………….. and Firm has acknowledged the letter.

(4) The parties are hereby recording the terms and conditions of the performance of various obligation by this Agreement.

THE PARTIES hereto that Firm will provide specialized fabrication, production

and installation services for the museum exhibits at Buddha Smriti Park, Frazer

Road, Patna as per the details mentioned in the below listed documents that form

an integral part of this agreement:

and accepted by BUIDCo vide Sl. No. (a) above c) The Request for Proposal Document and the Bid quote submitted by the

1. The location for the project will be the site premises of Buddha Smriti Park, Frazer Road, Patna (hereinafter referred to as “Location”).

2. Scope of firm

The Firm shall provide the specialized fabrication, production, installation

services for the museum exhibits at Buddha Smriti Park, Frazer Road, Patna

as per the specifications and condition of the RFP document and any

supplementary document issued by either parties and agreed by both the parties.

3. Contract Value

The net contract value is Rs……………………. (Rupees

of all taxes, duties, transportation/installation charges, and any other charges

etc associated for the said work.

4. Payment Terms

BUIDCo will pay to Firm in accordance with the relevant conditions of the

RFP.

5. Definition of Satisfactory Completion of Project

The project shall be declared complete by the BUIDCo after complete supply,

installation, commissioning and thereafter trial run on site, and after issuance

of completion certificate from the museum consultant.

6. No escalation in rates on any account shall be allowed in this contract.

7. FORCE MAJEURE - If the performance of this Agreement or of any obligation of either party is prevented, restricted or interfered with by reasons of fire, explosion, strike, casualty, accident, epidemic, cyclone, earthquake, flood, war, terrorist activity or requirement of any Government or authority or representative of any such Government or any cause whatsoever beyond reasonable control of parties hereto, the party so affected, upon giving prompt

notice to the other party shall be excused from such performance to the extent of such prevention, restriction or interference for the period it persists, provided that the party so affected shall use all reasonable efforts to avoid or remove such causes of non performance, if possible and shall continue performance hereunder with the utmost dispatch whenever such causes are removed.

10. This agreement shall be valid from the date mentioned herein above till the satisfactory completion of the project as defined herein above in this agreement.

11. Any alteration, addition, substitution, extension or modification in the contract, if required, shall be carried out in writing by exchange of letters, which must be accepted by both the parties
