3.0 Construction (Design and Management) Regs 2015 Roles Reference Responsibility

3.1 Client Role – Where St William/St James are appointed as ‘Client’ the St

William/St James Designated Individual (DI) shall establish that the proposed Principal Contractor (PC) has a written procedure for the management of temporary works that complies with the requirements of BS5975. The St William/St James DI appointment shall be undertaken in accordance with Section 4.1 of this procedure. This assessment of the PC’s procedures shall be captured by using the ‘Temporary Works Assessment Form’ (TWAF). The form shall be saved within the Client’s systems and be kept live and current through periodic reviews or where any contractual or personnel changes are implemented. The St William/St James DI shall ensure that the Principal Contractor creates a Temporary Works Management Plan (TWMP) detailing the organisational arrangements. The PC shall keep the Temporary Works Management Plan live and current through periodic reviews or where any contractual or personnel changes are implemented. The St William/St James DI shall review this plan and any revisions to ensure that the arrangements are acceptable. It is acceptable for the St William/St James DI to delegate the detailed assessment of the PC’s procedures and or TWMP to a competent individual within their organisation. However, the St William/St James DI shall ensure acceptance is documented by signing the both the TWAF and TWMP as ‘accepted’. Where the PC does not have a TWMP within their suite of forms, the St William/St James template can be used for this purpose.

3.1.1 Where St William/St James are appointed in the Client-only role, but directly appoint Contractors who work within the Principal Contractor’s jurisdiction, the St William/St James DI shall ensure that the directly appointed Contractor has appropriate procedures for managing temporary works using the TWAF. In addition, the St William/St James DI shall ensure that in terms of Temporary Works control, the appointed Contractor works under the control of the Principal Contractor’s TWC and that the arrangements are suitably captured within the PC’s Temporary Works Management Plan.

3.2 Principal Designer Role – Where St William/St James are Principal

Designer the DI shall ensure the following: a) There is a coherent construction method which identifies all key

temporary conditions and temporary works; b) The finally agreed construction method, sequence and temporary works

are not deleterious to the permanent works design; c) Designers follow the recommendations of the relevant clauses within

this procedure in parallel with their wider requirements; d) They share information with designers and the PC’s TWC that might

influence the design of temporary works or the selection of construction methods;

e) Designers take account of the Construction Phase Plan; f) They retain appropriate information relating to temporary works that

would be required for the health and safety file; this should include information on construction method or sequence including associated temporary works which might impact on future maintenance or deconstruction; this information should be obtained from the PC’s TWC.

Where the Principal Designer role is being discharged by others, the St William/St James DI shall ensure these requirements are understood and captured in the PDs scope of services prior to their appointment. The arrangements will also be clearly shown within the PC’s TWMP.

3.3 Principal Contractor – Where St William/St James is appointed as PC, the

St William/St James DI shall be appointed in accordance with Section 4.1 of this procedure. They shall establish that any proposed Contractors have a written procedure for the management of temporary works that complies with the requirements of BS5975. It is acceptable for the PC’s DI to delegate the detailed assessment of the Contractor’s procedures and or creation of the TWMP to a competent individual within the PC’s organisation. However, the PC’s DI shall ensure acceptance is documented by signing the both the TWAF and TWMP as ‘accepted’. Where St William/St James has been acting in the Client role and St William/St James are now taking on the PC role, a suitable handover meeting should occur between the Client DI and the PC DI (where applicable) to ensure that there is continuity of knowledge between the phases and that roles are responsibilities are clearly defined in an updated TWMP.

3.4 Contractor – Any Contractors appointed by St William/St James that have

an involvement in Temporary works shall have suitable procedures for managing the temporary works in accordance with BS5975. Where a Contractor is proposing to use their own temporary works procedures to manage their own items of works, they shall appoint their own Temporary Works Co-ordinator. Where St William/St James are the PC, the review of the Contractors procedures will be undertaken in accordance with Section 3.3 above. If the procedures are deemed acceptable, the Contractor’s proposed TWC appointment can then be reviewed for acceptance. Note: Where the proposed Contractor’s procedures have been identified as insufficient, their works shall be managed in accordance with the St William/St James procedures and all proposed staff are to be nominated, assessed and accepted by the PC’s DI using the Temporary Works Nomination Form.

3.5 Designer – A designer includes anyone who specifies a design, design

standard or design method, alters a design, or specifies a particular method of work or material, or arranges for or instructs someone else to do so. The designer should justify their design requirements by identifying the associated risks and how they might be mitigated, residual risks shall be highlighted to the contractor.

The above is the case for designs involving either permanent works and / or Temporary Works. Permanent Works Designer requirements can be found in Section 4.7 and Temporary Works Designers can be found in Section 4.5

3.6 Combined Roles – Where St William/St James holds a combination of CDM

Duties on a given project, these are to be detailed in the Project Temporary Works Management Plan. There shall only be 1No. St William/St James DI in place at any one time on a given project even when there are combined CDM roles i.e. there are not separate roles for Client DI and PC DI.

4.0 Temporary Works Roles – Appointments and Responsibilities Reference Responsibility

4.1.1

4.1.2

St William/St James Designated Individual – A Designated Individual (DI)

is appointed to each large project (or group of smaller projects). This will depend on scale of project to ensure the DI has sufficient time and understanding of that project to discharge the role of DI effectively. This DI role may also be appointed across the CDM phases of either, Client, Principal Contractor or both as appropriate. The Project based DI role should be assigned to a senior member of the Project (or group of smaller projects) that reports to the division’s ‘Board of Directors’. As well as being a senior member of the Project team, the DI shall have also attended the Berkeley Group Temporary Works Awareness Training as a minimum. Each DI shall be appointed using the Temporary Works Nomination Form and the appointment should be accepted and signed by the regional Managing Director. The leader of the internal temporary works forum shall keep an up-to-date record of the DI appointments across the business. Each DI has the responsibility to ensure an up to date procedure is in place for St William/St James. This role will be delegated to the Head of Health & Safety to ensure consistency across the group. A DI must be appointed at the point of temporary works being undertaken on the project Once established and accepted, the ‘Designated Individual’ (DI) shall: a) Oversee the overall implementation of this procedure on the Project;

b) Ensure a TWMP is prepared, maintained which they have accepted;

c) Review & confirm the acceptance of any Contractors’ procedures for use

on the project and where proposed, the Contractors’ TWC nominations;

d) Inform the PD appointed by St William/St James (or where discharged internally) of their responsibilities under this procedure;

In addition, where St William/St James are PC: e) Formally appoint the PC’s TWC to oversee TW on the site;

f) Update the TWMP to reflect the organisation arrangements on the site;

g) Provide information and resources required by the PC’s TWC to allow

them to discharge their duties effectively; h) In conjunction with the PC’s TWC, complete monthly reviews of the TW

arrangements on site; i) Inform TWD’s appointed by St William/St James of their responsibilities

under this procedure; j) Ensure that regular external audits of the temporary works

arrangements both in terms of the documentation and site inspections are completed at a frequency proportionate to the project scale, complexity and risk – this is to be detailed within the TWMP;

k) Respond to concerns raised by any person involved in the management

of TW;

St William/St James Head of Health & Safety - The St William/St James

Head of Health and Safety has accountability to ensure that the procedure is updated to reflect current best practice, British Standards and any organisational changes that may affect the content and scope of this procedure and the relevant forms.

4.0 Temporary Works Roles – Appointments and Responsibilities Reference Responsibility

4.2 St William/St James PC’s Temporary Works Co-ordinator (PC’s TWC)

The DI shall ensure that a PC’s TWC is appointed using the Temporary Works Nomination Form. This should be undertaken at the earliest opportunity in the PC appointment. The PC’s TWC should assist the DI to ensure that a TWMP is created that details the organisational arrangements for managing Temporary Works on the Project. Where a particularly technically or logistically complex project can be split into more than one well-defined area, then a PC’s TWC may be appointed for each area. Each individual PC’s TWC should be responsible for all the temporary works in the area allocated, irrespective of which organisation carries out the temporary works in the area. Only one PC’s TWC should be responsible for a specific area. One of these individuals should be appointed as lead PC’s TWC to manage the interfaces between the areas. Once the above arrangements have been agreed, there are two key scenarios for the PC’s TWC roles and responsibilities as follows: 4.2.1) when managing other Contractor’s TWCs and 4.2.2) managing elements delivered by St William/St James. These are described in the following two sections respectively.

4.2.1 The roles and responsibilities of the PC’s TWC when managing Contractors who are responsible for their own items of temporary works are as follows: a) Support the DI in reviewing the suitability of the Contractor’s Temporary

Works Procedure and its suitability for the proposed works;

b) Receive and vet the Contractor’s DI assessment of the capability of their proposed TWC and TWS(s) including the individual’s acceptance of the role using the Contractor’s provided appointment form(s);

c) Ensure that the TWCs and TWSs are operating in accordance with the

approved procedures; d) Provide copies of all information relevant to the Contractor’s temporary

works design to the Contractor’s TWC; e) Define the interfaces between the contractor’s works and those of the

PC or other contractors to establish which design briefs should be provided to the PC’s TWC for approval before issue to the relevant TWD;

f) Receive copies of the relevant design briefs produced by the

Contractor’s TWC and confirm there are no adverse effects on any other works (including temporary works) which might be planned;

g) For relevant designs, receive copies of the design output, design and

design check certificates prior to implementation of the Contractor’s temporary works;

h) Agree the ‘implementation risk class’ proposed by the Contractor and

where this identifies the PC’s TWC is required to inspect the contractor’s temporary works, undertake the inspection and the required signing off of the permits to proceed, as required.

i) The PC’s TWC should ensure that a Contractor’s proposals for

temporary works do not adversely affect/are not adversely affected by other construction works including other temporary works.

j) Ensure that the Contractor’s items of work are integrated into the PC’s

TWC ‘master’ register of Temporary Works;

k) Ensure regular co-ordination meetings are held and minutes and actions recorded between all relevant parties of the Project (PC’s TWC, TWC, TWS(s), PD, PWD, TWD and DI as applicable).

4.2.2 The roles and responsibilities of the PC’s TWC when managing their own works are as follows: a) Co-ordinate all temporary works activities;

b) Ensure a temporary works register is established and maintained; c) Ensure that information relevant to the temporary works has been

received from the Client, Principal Designer and Permanent Works Designer, as appropriate;

d) Ensure that a design brief is prepared with consultation within the project

team and that it is both adequate and in accordance with the actual situation on site;

e) Ensure that any other temporary works in the vicinity are referenced in

the design brief; f) Ensure that any residual risks, identified at the design stage, assumed

methods of construction or loading constraints identified by the PWD are included in the design brief;

g) Ensure that the design brief is issued to the TWD for a satisfactory

temporary works design to be carried out; h) Ensure that a design check is carried out by someone who was not

involved in the original design and that the category of check is agreed; i) Where appropriate, ensure that information on the certified temporary

works design is made available to other interested parties, e.g. the Principal Designer and/or the designer of the permanent works, and, where required to the Client;

j) Register or record the drawings, calculations and other relevant

documents relating to the final design and store the information on the agreed St William/St James repository;

k) Ensure that the relevant client and/or third-party approvals, required by

the contract, have been received; l) Ensure that those responsible for on-site supervision receive all the

details of the design, any residual risks, including any limitations and guidance notes associated with it and ensure that a specific method statement, which details a safe system of work, is in place;

m) Ensure that an implementation plan is developed for each item of

Temporary Works. This will take account of any inspection and test plan requirements, quality control checks, hold points and permits required to ensure the Temporary Works are suitably managed throughout their construction, use, maintenance, unloading and removal life-cycle.

n) As part of the implementation plan, determine which role is authorised

to sign permits to proceed to the next stage of the TW life-cycle based on the ‘implementation risk class’ in Appendix B;

o) Ensure that any proposed changes in materials or construction are

checked against the original design and where discrepancies are found prevent their use until agreement has been sought by the TWD and TWDC;

p) Advise the designer of any changes or modifications to the scheme or

differences from the envisaged conditions;

4.3 Contractor’s Temporary Works Co-ordinators

Where St William/St James appoints a Contractor in accordance with Section 3.4, the Contractor’s TWC shall discharge their roles and responsibilities in accordance with their own company procedures. In addition to their own procedures, the Contractor’s TWC shall: a) Report to and co-operate with the PC’s TWC in discharging their duties;

b) Ensure that items of Temporary Works are included and recorded on the

Principal Contractor’s Temporary Works Register; c) Agree the ‘Category of Design Checks’ with the PC’s TWC; d) Agree the ‘Implementation Risk Class’ with the PC’s TWC; e) Based on the ‘implementation risk class’ agree with the PC’s TWC the

proposed construction, inspection, maintenance and removal permit control and who will be the authorised to issue the permits;

f) Only commence construction of TW when:

A specific method statement has been prepared for the construction and dismantling of the TW, which includes any sequence or method of construction imposed by the TWD and / or permanent works designer;

The method statement has been reviewed and accepted by the PC’s TWC and St William/St James project team;

The method statement has been briefed to operatives involved in the construction or dismantling.

g) Ensure that all records of inspections and permits are provided to the

PC’s TWC. h) Refer to the PC’s TWC, their line manager, St William/St James DI, any

TW matters that are not being satisfactorily managed on site. i) Attend regular reviews of TW, as required by the appointed PC’s TWC.

Where a subcontractor’s procedures have been deemed insufficient, the Contractor’s TWC shall operate in accordance with these procedures and their roles and responsibilities will be as per 4.2.2 and 4.3.

4.4 Temporary Works Supervisors (TWS) Appointed by St William/St James

Where St William/St James is the Principal Contractor and it has been identified that the PC’s TWC has a requirement for one or more TWS, this can be done via the Temporary Works Nomination Form (TWNF). It is envisaged that this scenario mainly arises for items of temporary works that require St William/St James to manage as there is no subcontractor ownership of the item (e.g. hoarding once the demolition contractor has completed), or alternatively where a subcontractor does not have the competences to perform the role. Where a TWS has been identified, their scope and limits of authority will be captured formally in the TWNF. For all elements of TW that they supervise, the TWS shall: a) Liaise and co-operate with the PC’s TWC and assist the PC’s TWC in

ensuring that the site is operating in accordance with the procedures; b) Supervise the erection, use, maintenance and dismantling of the

temporary works as applicable; c) Carry out or supervise the required checks at appropriate stages during

the construction erection or installation of the temporary works; d) Carry out or supervise planned maintenance of the temporary works; e) Ensure that any changes or modifications to the scheme or differences

from the envisaged conditions (use or environmental) are drawn to the attention of the PC’s TWC;

f) Carry out the final check prior to use of the temporary works; g) In the event that any inspections reveal discrepancies between the

certified and as constructed temporary works, issue a notice to prevent loading (or unloading) until the discrepancies have been rectified to the satisfaction of the PC’s TWC;

h) After a final check, which is satisfactory, and where authorised, ensure

a permit to load or proceed (bring into use) is issued and provide a copy of the permit to the PC’s TWC;

i) When it has been confirmed that the permanent structure has attained

adequate strength and/or stability, and when authorised, ensure a permit to unload (take out of use) the temporary works is issued and provide a copy of the permit to the PC’s TWC;

j) Only commence construction of TW when:

A specific method statement has been prepared for the construction and dismantling of the TW, which includes any sequence or method of construction imposed by the TWD and / or permanent works designer;

The method statement has been reviewed and accepted by the PC’s TWC and St William/St James project team;

The method statement has been briefed to operatives involved in the construction or dismantling.

k) Provide all records of inspections / permits to the PC’s TWC. l) Refer to the PC’s TWC or DI any TW matters that are not being

satisfactorily managed on site; m) Attend reviews of TW, as required by the PC’s TWC or DI.

4.0 Temporary Works Roles – Appointments and Responsibilities Reference Responsibility

4.4.1 Temporary Works Supervisors (TWS) Appointed by Contractors

Where the TWS role is to be appointed by the Contractor, the TWS shall operate in accordance with the Contractor’s accepted procedures. In addition to their own procedures, the Contractor’s TWS shall: a) Report to and co-operate with the PC’s TWC in discharging their duties;

b) Based on the ‘implementation risk class’ only sign permits within the

‘very low’ or ‘low’ risk categories; c) Only commence construction of TW when:

A specific method statement has been prepared for the construction and dismantling of the TW, which includes any sequence or method of construction imposed by the TWD and / or permanent works designer;

The method statement has been reviewed and accepted by the PC’s TWC and St William/St James project team;

The method statement has been briefed to operatives involved in the construction or dismantling.

d) Refer to the PC’s TWC or Contractor’s TWC any TW matters that are

not being satisfactorily managed on site. e) Attend regular reviews of TW, as required by the PC’s TWC.

Where a subcontractor’s procedures have been deemed insufficient, the Contractor’s TWS shall operate in accordance with these procedures and their roles and responsibilities will be as per 4.4 and 4.4.1.

4.0 Temporary Works Roles – Appointments and Responsibilities Reference Responsibility

4.5 Temporary Works Designer - For all elements of TW they design, the

TWD shall: a) Only issue a design for approval following receipt of a Design Brief; b) Determine the appropriate category of design check, as defined by

BS5975 and agree this with the TWC / PC’s TWC; c) Highlight any specific requirements for the installation and dismantling

of the temporary structure; d) State the types of materials / components required for the design; e) Highlight any assumptions used for the design; f) Highlight any residual hazards in the design; g) Mark design drawings as ‘for construction’ upon receiving written

confirmation of: i) of the design’s adequacy from the TWC who commissioned the design, ii) of the design check having been successfully completed, iii) that the TWC confirms the design allows for the conditions on site, and that third-party considerations have been allowed for (e.g. Network Rail, TfL);

h) Provide written approval for any design changes or deviations requested during the construction and dismantling phase.

i) For Categories 2 & 3, issue a D&C Cert signed by all parties where the certificate confirms that the design conforms to the requirements of the design brief, states the standards/technical literature used and list the constraints or loading conditions imposed. The certificate states the category of check and identify the drawings/sketches, specification and any methodology that are part of the design.

j) Where the design involves multiple design inputs, collaborate with the ‘lead designer’ to ensure that the elements of the design are compatible;

k) Any specific inspection or test requirements associated with the temporary works or its fixings / interface with permanent works or other items of temporary works.

4.6 Lead Designer (LD) in relation to Temporary Works Design – Where a

temporary works scheme involves design contributions from more than one designer, one of the designers, or a competent 3rd party design organisation should undertake the role of ‘lead designer’ and manage the design interfaces. The name of the nominated lead designer should be recorded in the TWR. On completion of the design, a single D&C certificate should be issued signed by the Lead Designer, designers and checkers as appropriate. The lead designer should ensure that: a) The communication of design data between organizations is controlled

and any iterations are completed to the required levels;

b) Design contributions from all designers are compatible with each other; c) They have a holistic understanding of the whole design; d) The design output is complete and clearly communicated; and e) The Principal Designer and TWC are informed about significant residual

risks associated with the design. f) That the level of checking is appropriate in accordance with the EDB

across the individual design elements. Where the requirement for a Lead Designer has been identified by the TWC, this shall be included in the Engineering Design Brief.

4.7 Permanent Works Designer (PWD) – Permanent works designers should

address the buildability of the permanent works and make provision for any temporary works and temporary conditions required by their design and their assumed method of construction. This should include: a) A proposed method and sequence of construction which should have no

adverse effects on the permanent works;

b) Deciding on and communicating the intended construction process, giving particular attention to new or unfamiliar processes;

c) Considering the stability of existing structures and partially

constructed/erected/ demolished structures and, where this is not immediately obvious, providing information to show how temporary stability could be achieved;

d) Identifying where standard industry details are not suitable, and where

detailed structural design is to be carried out by others; e) Considering the effect of the proposed work on the integrity of

adjacent/existing structures, particularly during refurbishment; f) Ensuring that the overall design takes account of temporary works which

might be needed, no matter who is to develop those works; g) Ensuring that consideration has been given to the availability of sufficient

space required to construct or maintain the structure; h) Clearly stating loads for which the structure has been designed including

the proposed plant installation loads and plant routes. i) The designer should liaise with the PD to provide all necessary

information relevant to any temporary works or temporary condition(s) to the PC through the PD.

5.0 Competence Reference Responsibility

6.0 Forms for use in accordance with the Temporary Works Process Reference Responsibility

6.1 “TWAF” Temporary Works Assessment Form

This form shall be used by the PC’s DI for the review and acceptance of proposed ‘Principal Contractor’ and ‘Contractor’ appointments. The PC’s DI can request the support of suitable resource to undertake the review (e.g. PC’s TWC), but the formal acceptance of the procedures lies with the PC’s DI.

6.2 “TWNF” Temporary Works Role Nomination Form

This form shall be used for the appointment of all Temporary Works Roles (DI, PC’s TWC, TWC, TWS, TWD and TWD). It has been designed to review competency, ensure supporting evidence is provided and be signed as ‘accepted’ by the PC’s DI

6.3 “TWR” Temporary Works Register

The Temporary Works Register is an electronic spreadsheet that records the Temporary Works items on a given project throughout their lifecycle. The PC’s TWC shall control a ‘master’ register that captures all temporary works that are known at a given point in time. The interface between Contractors controlling their own Temporary Works and the PC’s Register shall be detailed within the Temporary Works Management Plan.

6.4 “TWMP” Temporary Works Management Plan

The TWMP is a critical document that shall be created as soon as the requirement for Temporary Works has been identified. It is acceptable for the DI to delegate the development of the TWMP to a competent individual within the organisation. However, the DI shall ensure acceptance is documented by signing the TWMP as ‘accepted’.

6.5 “EDB” Engineering Design Brief

The design brief should be prepared to serve as the basis for subsequent decisions, design work, calculations, drawings and design checks. All concerned with the construction should contribute towards the preparation of the brief. The brief should include all data relevant to the design of the temporary works including residual risks introduced by the methodology chosen by the site team or by the PWD. It should be prepared early enough to allow sufficient time for all subsequent activities, i.e. design, design check, procurement of equipment and construction/erection of the scheme. The TWD shall be provided with the EDB to enable a safe, effective and efficient design to be developed. Where the EDB ‘evolves’ through changes in methodology or site conditions for example, the EDB should be updated to capture the latest requirements.

6.6 “D&C Cert” Design and Check Certificate

For check Categories 2 and 3, a D&C cert shall be issued. The certificate shall confirm that the design conforms to the requirements of the design brief, state the standards/technical literature used and list the constraints or loading conditions imposed. The certificate shall state the category of check and identify the drawings/sketches, specification and any methodology that are part of the design and it should be signed by the designer and design checker and where applicable the ‘lead designer’. The package of information issued to the TWC should include this certificate.

6.7 “Permit to Proceed”

A specific form that enables the item of temporary works to move to the next stage of its lifecycle, which is signed by the identified role with the relevant authority as outlined in the implementation plan.
