• Probable Cause and the Exclusionary Rule
Driving Question: Should the exclusionary rule apply to disciplinary situations in schools?•
Facts: Every day thousands of American high school students are called into the school office to be questioned regarding possible violations of school policy or even state education code. Some of these students are suspended. Some are expelled. Some are given “detentions” of varying length. In the vast majority of these situations they are not arrested or penalized criminally. Yet the “evidence” obtained through questioning or even searching might get them kicked off teams or banished by school activities. The exclusionary rule has been developed as a way of deterring police behavior.
•Issue: Should the exclusionary rule be used in school disciplinary situations to keep evidence from being used against students? Should the exclusionary rule be used in teacher disciplinary hearings to keep evidence from being used against teachers?
•Final Project Product: As an individual, you will be responsible for answering the driving question. Your answer will be presented in the form of a Popplet. Poppelets are due Friday March 22nd.
