    Introduction

    The Texas Department of Criminal Justice (TDCJ) Fiscal Year 2007 Statistical Report provides demographic information for a total of 694,238 cases under supervision on August 31, 2007, as well as those received and released throughout the fiscal year. An offender may have multiple types of supervision and be counted in more than one of the categories provided. The report includes information for both the incarcerated offender population and the adult offender population that is supervised in the community.

    The Demographic Highlights section offers a summary of the characteristics of the incarcerated population that was on hand as of August 31, 2007 and offenders who were received and released during the fiscal year. The characteristics include gender, average age, race, offense, custody, sentence length and educational achievement measures. This section also includes characteristics of offenders who were supervised by the Parole and Community Justice Assistance Divisions. In addition to demographics, information offered for the community-supervised population includes supervision status, employment, and primary needs level.

    The On Hand section of the report provides an in-depth look at the incarcerated population on August 31, 2007. In addition to comprehensive demographics, this section focuses on the offense, sentence length and release eligibility of the offenders. Detailed information is provided for the Prison, and State Jail, and SAFP populations.

    The Receives and Admissions section includes demographics of offenders that were received by TDCJ during the fiscal year. Offenders who are received are categorized as New Receives, Parole Revocations and Community Supervision Revocations/Modifications. New receives are offenders who are admitted to TDCJ who are not under the supervision of the Parole Division. This category also includes offenders who are under the supervision of local Community Supervision and Corrections Departments who have not served in TDCJ for that offense. Parole Revocations include offenders who were revoked from parole, mandatory supervision and discretionary mandatory supervision. Community Supervision revocations and modifications include those offenders under the supervision of local Community Supervision and Corrections Departments who are being incarcerated due to unsuccessfully completing the terms of their supervision after being released from TDCJ on that offense. In addition to demographics, this section also includes offense of record, county of conviction, and sentence information. As a separate category, admissions to TDCJ include offenders who returned from bench warrant from prior fiscal years and transfers from other TDCJ divisions.

    The Releases and Departures section provides demographics of offenders who were released from TDCJ custody during the fiscal year. Offenders who were released are categorized as Discharges, Releases to Community Supervision and Releases to Parole Supervision. Discharges are offenders who are released from TDCJ either by full expiration of their sentence or by court order. Releases to Community Supervision are offenders who are released to be supervised by local Community Supervisions and Corrections Departments. Releases to Parole Supervision include releases to parole, mandatory supervision and discretionary mandatory supervision. These types of releases are under the jurisdiction of the Parole Division. As a separate category, departures from TDCJ include deaths, executions, transfers between TDCJ divisions, and bench warrant releases that did not return during the fiscal year.

    Statistical tables listing categories by county of conviction (i.e., total releases by county) show the 20 counties with the highest population in the State. All other counties are grouped together.

    In conclusion, the Fiscal Year 2007 Statistical Report monitors the changes in populations for the Texas Department of Criminal Justice. It is the goal of this report to educate the legislators, TDCJ staff and the public on the changes in the offender populations in the State of Texas so that informed, thoughtful decisions can continue to be made regarding criminal justice policies and law.

    Glossary of Terms

    "3G” Offense – The offenses listed in Article 42.12, Section 3G of the Texas Code of Criminal Procedure. Examples of “3G” offenses are murder, capital murder, indecency with a child, aggravated kidnapping, aggravated sexual assault, aggravated robbery, use of a child in the commission of certain drug offenses under the Health & Safety Code, committing certain drug offenses within a drug-free zone (if it is shown that the defendant has been previously convicted of certain drug offenses for which punishment was enhanced pursuant to the Health & Safety Code), sexual assault, use of a deadly weapon, and any offense with an affirmative weapon finding.

    Administrative Segregation – Offenders assigned to Administrative Segregation have one or more of the following characteristics: constitute a threat to the physical safety of other offenders or staff; constitute a threat to the order and security of the institution, as evidenced by repeated, serious disciplinary violations; constitutes a threat to the physical safety of other offenders or staff due to have been identified as a security threat group member; or is a current escape risk.

    Admissions – Bench Warrant returns from prior fiscal years and transfers among the agency.

    Community Supervision – Placement of an offender under supervision for a specified length of time, as ordered by a court, with court-imposed rules and conditions. Community supervision (formerly called adult probation) may be ordered for misdemeanor or felony offenses and is generally imposed in lieu of a jail or prison sentence.

    County of Conviction – The county that correlates with the offense of record.

    Departures – Deaths, transfers among the agency, and bench warrant releases that did not return during the fiscal year.

    Direct Supervision – Level of community supervision requiring offenders to receive a minimum of one face-to-face contact every three months.

    Discharge Releases – Prison offenders who are released from TDCJ either by full expiration of their sentence or by court order.

    Discretionary Mandatory Supervision (DMS) – A type of release from prison provided by law for restricted categories of offenders. Offenders with offenses committed on or after September 1, 1996 who are released from prison under Mandatory Supervision contingent upon approval by a Board of Pardons and Paroles panel vote (see Mandatory Supervision).

    G/J1 – 3 and OT – Offenders in these custodies have a good disciplinary history; have served a specified portion of their sentence (varies by custody level); and do not have any security precaution designators. Some levels within these custodies do not allow current or prior convictions of any type where the offender intentionally caused the death of another person or sexual offense and do not have any pattern of freeworld offenses of violence.

    G/J4 – Offenders in this custody have two (2) or more non-assaultive disciplinary convictions resulting in major penalties within the past six (6) month; one (1) disciplinary conviction resulting in a major penalty for offender or staff assault without a weapon within the past 12 months; Line Class II or III time-earning status (prison offenders only) if the offender is not assaultive or aggressive in nature; or placement of a security precaution designator for escape (ES), staff assault (SA), or hostage (HS).

    G/J5 – Offenders in this custody have one (1) or more disciplinary convictions for an assault with a weapon on staff or offenders within the past 24 months; two (2) or more disciplinary convictions resulting in a major penalty for offender or staff assault without a weapon within the past 12 months; one (1) ore more disciplinary convictions resulting in major penalties for extortion or sexual abuse with the past 24 months; primarily Line Class I, II or III time-earning status (prison offenders only) if the offender is assaultive or aggressive in nature; or escape from a TDCJ secure adult correctional facility within the past five (5) years.

    Halfway House – A residential facility with focus on reintegration of offenders back into the community after a period of incarceration.

    Indirect Supervision – Level of community supervision that does not require face-to-face contact.

    Intelligence Quotient Score (IQ) – The individual’s score obtained from a group-administered IQ test. For treatment purposes, additional tests are used to identify mentally impaired offenders.

    Intermediate Sanction Facilities (ISF) – Short-term (up to 90 days) incarceration facilities used by the Board of Pardons and Paroles in lieu of revocation for offenders who have been found to have violated the terms or conditions of parole/mandatory supervision release.

    Mandatory Supervision (MS) – A type of release from prison provided by law for restricted categories of offenders. Eligible offenders are released on MS when their calendar time served added to their good time credit equals the length of their prison sentence. Under the law in effect until August 31, 1996, release to mandatory supervision was automatic for most offenders, with no requirement of release approval from the Board of Pardons and Paroles.

    New Offense – Violation of supervision by the conviction of or pending charges of felony or misdemeanor offenses and possible technical violations.

    New Receives – Offenders admitted to a TDCJ facility for the first time on an offense, or are repeat offenders who were not under parole or mandatory supervision at the time of their new conviction.

    Offense of Record – The offense for which an offender is incarcerated. If an offender is incarcerated for multiple offenses, the offense of record is that offense that requires the offender to be incarcerated the longest period of time.

    Parole – The conditional release of an offender from prison, by a Board of Pardons and Paroles decision, to serve the remainder of his/her sentence under supervision in the community.

    Parole-in-Absentia (PIA) – Offenders released to parole or mandatory supervision from either county jails, out of state facilities, or in federal penal institutions.

    Parole Revocations – Offenders returned to TDCJ after their parole has been revoked due to conviction of a new offense or for technical reasons.

    Pre-Parole Transfer (PPT) – Community-based residential facilities that house offenders who are within one year of their approved parole or mandatory supervision release date.

    Prison Offenders – Offenders with capital, first, second or third degree felony convictions. Formerly referred to as the Institutional Division.

    Receives – Offenders arriving at TDCJ during the fiscal year as a new offender or due to a revocation.

    Releases – Offenders leaving TDCJ due to the discharge of their sentence or to another form of supervision.

    Releases to Parole Supervision – Includes releases via parole, discretionary mandatory supervision, and mandatory supervision.

    Safekeeping – Offenders who require separate housing in the general population because of threats to their safety due to offender enemies, a history of deviant sexual behavior, a potential for victimization or other similar reasons. These offenders may still work and go to school with other general population offenders.

    State Jail Offenders – Offenders convicted of State Jail felony offenses. An individual adjudged guilty of a State Jail felony offense may be confined in a State Jail facility for a term of no more than two years or less than 30 days. There is no parole or mandatory supervision release from State Jail.

    Substance Abuse Felony Punishment Facility (SAFPF or SAFP) Offenders – Offenders who are sentenced by a judge as a condition of community supervision or sent by the Board of Pardons and Paroles as a modification of parole supervision to an intensive six-month therapeutic community program (nine-month program for offenders with special needs).

    Technical Only – a violation of one or more conditions of release, not including commission of a new offense.
