About your request for a completion report Brian Walsh Well 6450-02 permit number.
At this time I can not file a well drilling log for the following reasons:
1. Well Permit Number 6450-02 is not for Brian Walsh Land. I
2. The well I did drill was Owner/Builder and Mr. Walsh has gone Public with it in less than the time required O\!nel'l/Builder requirements. He is selling both water and interest in the well itself.
3. The well has not been developed or tested properly, an is not sealed, according to HawaiianllState Regulations. We are aware that a great amount of ground water escapes to the sea, especially on the island of Hawaii. This loss is due to the lack of impermeable coastal caprock barriers, such as those we have here on Oahu. Your idea of building an "inland continuous sea wall u would be theoretically possible, but may be economically unfeasible.

This letter responds to the health-related concerns expressed in your transmittal of March I, 1985 to the Governor of the State of Hawaii. These health concerns centered around the well located on property identified by tax map key 5-9-07-4, owned by Mr. Brian T. Walsh in the Kohala Estates area of the Island of "Hawaii. In your transmittal, you note.d that Mr. Walsh is selling water from the well developed on that property, and expressed your understanding that although specifically intended for agricultural purposes, this water may be used for human consumption without benefit of prior demonstration of potability. Additionally, your correspondence expressed your concerns that the well was constructed without a proper seal allowing the possibility of groundwater contamination.
As acknowledged in your transmittal, the District Health Office did respond to your telephone call expressing these concerns earlier. A field visit to the area revealed the following two major facts:
I. Water consumers on the system were aware that the water was intended for agricultural use only.
2. Water for potable purposes was being brought in from other sources. At the time of the investigation, only one household could be contacted; however, enough information was developed to determine that water consumers on the system were adequately informed about the intended agricultural use of the water. This information, when compared to the regulatory authorities with which the Department is vested, establishes the Department's capability with regard to your concerns. We would take this opportunity to express the Department's position.
The Department of Health presently administers the state's version of the Federal Safe Drinking Water Act. These regulations pertain specifically to water systems which serve potable water to the "public." In the state regulations, (as well as the federal statutes) the "public" is defined as 25 or more persons at least 60 days per year. The Department has no regulatory authority over systems that do not serve these minimum numbers of persons or serve water not intended for potable purposes.

The Department presently does have approval authority over wells developed to serve the public water systems as defined in the previous paragraph. In its enforcement of this authority, it does examine the adequacy of the protection of the well from potential of contamination. At the present time, however, we do not have any similar authority over sources not intended for potable purposes or serving a "non-public" water system. The lack of such authority limits the Department's ability to enforce the requirement of such features such as a sanitary seal for agricultural well construction.
In summary, the water system as described does not qualify as a public water system subject to regulation by the Department. The fact that consumers are appraised of the intended agricultural use of the water makes any selection to use that water for potable purposes a matter of personal choice on the part of the consumer. Finally, the Department does not have enforceable standards for agricultural wells.

SUBJECT: Telephone Conservation with Brian Walsh, Kohala Estates Well 6450-02
I contacted Brian Walsh by phone on April 11, 1985, and discussed the status of the well and the letter we sent him in January. We discussed the following:
1. Grouting of the well. The well was not grouted. There is a 15-inch diameter, 16-foot long header pipe that was left in place. The header is not grouted, neither is the space between it and the 12" dia. casing. I recommended that he have the annulus grouted. Steve Bowles and/or his son is working with Mr. Walsh on the pump so I suggested he consult Steve about grouting the well.
2. Driller's Report. Mr. Walsh stated that Mr. Tunnicliff, who drilled the well, has all the records. He suggested I write to Mr. Tunnicliff to get the data for the Driller's Report.
3. Field Visit. I mentioned that Mitch would visit the well site sometime during the next few weeks. He welcomed the visit and gave instructions on how to get to the well.
Kohala Estates is located about a mile and a half outside of Kawaihae on the road toward Hawi at about the 6 or 7 mile marker.
4. According to Mr. Walsh, the water usage is about 135,000 gallons per day.

Mr. Walsh was not the owner ,of.the property stated on the application. , The location of the well was not that stated on the application. The well was not constucted by the contractors of record on the application. That Mr. Walsh became owner/builder of the' well site. That an as-built of the well had not been submitted as required by your office. The well is completed, yet no testing results appear in your office. . That Mr. Walsh is selling the water to the public, prior to the one year owner/builder requirements of the State. That the well has probiblty not been sealed •.. allowing ~ possible contamination of the aquifer. • And that although the application states clearly the water is for ag., use that it with no doubt .is being used for human consumption.
It was stated to me by a man in your office that nothing be done to stop or even hinder Mr. Walsh in continueing in this blatient violations of the regulations set o~t by the State guidelines .•• I think there must be somethigg your office can do to enforce these laws.

It is my belief that Mr. Brian T. Walsh, of ~.~. Box 4645, Kawaihae, HI. is in violation of many St~te and county building and constuction laws. Many of these complaints have been verbally stated to your office •.• as to this point in time in the investigations it seems. as nothing has been accomplished~ At this time I will restate my complai~ts and hope to be hearing soon from your office that these· pratices have been stopped or that at least he has been made to bring answers to the complaints. •
The complaints are as follows: 1. The well is not on the property stated in the application for permit from the State La~d and Natural Resources Depto
2. The well is constructed,owner/builder-not Roscoe' Moss as in the application ••• it is my belief that owner/builder can not go public from one year from the completion of any project.
3. Wate'r is being pumped off of Mr. Wal.sh's property. This water has been contracted for and is being p4id for ••• therefore is being sold to public ••. no completion report has been filed o .. t~erefore it is not one year from completion.
4. The system which runs down the hiway right of way is not permited by any agency of the state or county. No plans have even been submitted.
5. A water tank for storage of some of this water has been constucted, this also, has not been permitted by any State or county agency.
6. The water is being sold for agricultural use •.. the well has not been tested as for contamination by any agency ~ith-in my knowledge at this time, but it is quite reasonable to belief that this water must be used for human consumption just'because of it's proximity to the area •.. and normal lack of water available.
7. The well to my knowledge has probaly not been sealedo .• which can lead to the contamination of the entire aquifer of that

On or about April 25, 1984 I reported to your office that Mr. Brian T. Walsh of Pukas Unlimited; a Reg. Tradename of Seed Arbbr, Inc.; P.O. Box 4645, Kawaihae, HI~ 96743~ was operating a company in Kohala Estates on the Big:Island, and that Mr. Wa11h had no insurance of any form on his employees in this operation. as required by the 'state. Nor was he paying his employee's in a timely manner .•. #
or the amounts stated at time of hiring, pr with pay stubs as required by the state, or for over-time, or bonus situations beyond that of monatary considerations, as promised. And also that Mr. Walsh was not with-holding any form of taxes and or Soc. Sec. from the employe~s.
To this point in time my concerns have not been fully answered by your office ... or any oth~r agency contacted as to whether Mr. Walsh has been made to comply with these rules and regulations or been penalized for non-compliance.
I would like to know at this time if either happened. I am expecting your written report in answer to my complaint shortly.

In late April I applied to your office for unemployment compensation. I had been dismissed from employment, by Mr. Brian T. Walsh of Pukas Unlimited, a reg. Tradename of Seed Arbor, Inc. r.o. Box 4645; Kawai~ae, HI. 96743; (808) 882~~~2g. '. . At this time an audit of the company books was made to "determine· the wages I had received" this audit was performed by a Mr. Gl~n Matsuta, Hila. For what-ever reasons ... suposedly records of Mrs. Walsh, also, an owner, it was determined that I had made very little money amo~nts, that were not considered agriculture, by th~ auditor. • I have tried many times verbally to explain to the • auditor that the work I performed was not for agriculture work, but for the Drilling Company and that this work is not in any stretch of the imagination considered agricultural. To flO avail. .
My next problem comes when I try to f1le my Federal Income Taxes. First Mr. Walsh held no taxes, let lone Soc .. Sec. from me. Second after making request by certified letter that he furnish me with a Wage and tax Statement, nothing has been forthcoming, to this point in time.
I, al so, reported to your office that Mr.' Walsh was running a crew if not just myself, with-out virtue of insurances nor benefit of filing affidaviss a with the State to prove financial responsibility in ca59 of accident.
I am hoping that as of this time your office has arrang~d with Mr. Walsh some form of protectdng his employe~s, as required by the state,and that you may be able to furnish me with at least some form of documentation of wages, from Mr. Walsh's audit that will allow me to file my tax returns for 1984.

As of this date, your office has stated to·me that Mr. Walsh bas not applied for any' further permits. but I would like to put in a formal complaint that Mr. Walsh is in fact constucting, or having constructed. or finished constucting: 1. One large one room house for residence. 2. One two stories buildiAY for residence. 3. One extremely ljrge wat~r storage tank. 4. One smaller water storage tank. 5. Power sorces fov both residences. 6. Possible sewage systems for both residences. 7. One,'large car-port area. , 8. Paved road leading to both residences. " 9. One water system leading'off of his property. onto hiway rjght-of-way and continuein~ down the Willside for at least one mile.
It is my assumption that your office does' have the power to enforce the ordinances. rules. regulations; and laws of this County. and I belief that Mr .. Walsh is indeed if not in fact guilty of many violations of the above stated regulations. I think that your office should be able to enforce this group of laws, and I 'am asking you to do just that at this time .'

MEMORANDUM FOR THE RECORD

SUBJECT: Review of letter dated March 1, 1985, from Mr. & Mrs. William Tunnicliff to Mr. Ono Concerning Well 6450-02 owned by Mr. Brian T. Walsh, Kohala Estates, Island of Hawaii.
Following is the chronology of events regarding the above subject:
September 21, 1983 - Received a well drilling application from Roscoe Moss Company. The well application was signed by Brian T. Walsh.
October 3, 1983 - A well drilling permit was issued to Mr. Walsh for Well No. 6450-02 at Kawaihai, Hawaii.
May 7, 1984 - Mr. Walsh called Dan Lum for advice on the well. Stated that it is an owner-drilled well.
June 5, 1984 - Ann, who works for attorney David Deka, visited the office and inquired about the well. I provided her with copies of some well records.
January 14, 1985 - Mr. Sewake of the Hawaii DWS referred a complaint from Mr. Tunnicliff to us by letter dated January 8, 1985.
January 21, 1985 - I called the Tunnicliffs and obtained the following information:
1. Well 6450-02 is on TMK 5-9-7: 4, owned by Mr. Walsh. (The permit has TMK 5-9-07: 5 in pencil)
2. Mr. Tunnicliff was the well driller. He was "fired" after water was reached.
3. The Tunnicliffs are concerned that the well is not properly sealed.
4. The well may serve 20 to 25 houses. They were not sure if the water was used for drinking as well as irrigation or just for irrigation.

o o January 22, 1985 - Wrote to Mr. Walsh requesting he complete the Drillers Report and send in other items required by the drilling permit.
February 11, 1985 - Mrs. Tunnicliff called Mr. Tagomori's office regarding the well. He was not available so she said she would call later.
February 13, 1985 - Mrs. Tunnicliff called. I told her we wrote to Mr. Walsh for more information. I also explained that our well drilling application is largely for data gathering and we cannot deny issuing permits in non-designated areas such as the Big Island. She again mentioned that people were drinking the water so I told her I would contact the drinking water section of the Dept. of Health. I called Melvin Hamano, DOH, and reported the conversation with Mrs. Tunnicliff.
February 27, 1985 - Melvin Hamano called to let me know that a DOH representative on the Big Island contacted Mr. Walsh. According to Mr. Walsh, residents who hook up to the system must sign a contract stating that the water is to be used for irrigation only. The DOH representative also contacted the Tunnicliffs and informed them of his findings.
Possible actions to be taken by the board against anyone not complying with its rules and regulations include:
1. SI3-166-(42) Injunctions. The board is empowered to seek injunctions for infringment of these rules as provided in Sec. 177 -10, Hawaii Revised Statutes.
2. SI78-7, Hawaii Revised Statutes, states, "any person violating this chapter shall be fined not more than $100. For violations under sections 178-5 (Drilling, notice of) and 178-6 (Well records to be kept and filed), each day's continuance of the same shall constitute a separate offense after 30 days have elapsed from the time of written notice of violations.

SUBJECT: Kohala Estates I Well {c:,
On Hay 7, 1984, a Brian Walsh called for advice on his well being drilled in the Kohala Estates I, Subdivision, Hawaii.
He reports the well's elevation to be 800' (799'+), presently at 802' depth with a 16" dia. hole. Construction is with a cable tool rig. He reports a head of 3.3 ft. and chlorides of 151 ppm with electrical conductivity reading and 170 ppm with a Hach Kit. Planned casing size is 12 inches.
I suggested that he keep the depth of the well as shallow as possible, preferably 20 feet or less below sea level.
He stated, he and his partner Naji Kawamata plan to put a 15 HP (40 gpm) pump in the well. His phone numbers are
