    This responds to item 14 in the Commission's Document Request No. 5 to the FBI, whichrequested information about the Department's declinations pursuant to 18 U.S.C. 2339A or2339B during the period from 1996 through September 11, 2001.

    Department records indicated that 37 United States Attorneys' Offices had declined casesunder Section 2339. Since the additional requested information was not readily retrievable in theDepartment's computerized systems, the Executive Office for United States Attorneys contactedthose United States Attorneys' Offices to obtain the particular information responsive to yourrequest. The data is collected on a fiscal year basis, October 1 through September 30. Therewere 23 decimations under section 2339A and nine declinations under section 2339B betweenOctober 1, 1994 and September 30, 2001. The breakdown by Fiscal Year is as follows:
