    Honorable Mayor,

    In line with the mandates of the Republic Act 9003, otherwise known as the Ecological

    Solid Waste Management Act of 2000, including the directives and various projects of

    different sectors on Solid Waste Management, the undersigned seek your approval for

    the implementation of Solid Waste Management among the Junk Shop Owners of the

    City of Manila including the conduct of survey therea.

    Should this be approved, the Department of Public Services will directly handle its

    implementation and will regularly submit reports and accomplishment to your Office for

    your perusal and guidance and to various agencies implementing the same.Likewise, the Department of Public Services is equipped with capable personnel to

    secure the completion and accomplishments of this project.

    In summary, the program will ensure that:

    All junkshops owners should practice segregation with recyclables separated by

    type of material manually.

    That their recyclables should be stockpiled in segregated stocking areas in order

    to prevent flies and other insects from coming into the area;

    Bottles and glasses should be washed before being stored in designated areas.

    Posters on safety, such as emergency in case fire should be displayed on the

    walls. Proper handling of the recyclables such as providing sturdy containers for

    bottles, and metals, packaging and bundling should be practiced.

    Honorable Mayor,

    In line with the mandates of the Republic Act 9003, otherwise known as the Ecological

    Solid Waste Management Act of 2000, in order to effectively implement the Citys Solid

    Waste Management Programs the undersigned seek your approval for the organization

    of Eco-Aides among the eight hundred ninety-seven Barangay of the City of Manila.

    This will materialize by coordinating to the Barangay Officials about their responsibility

    to implement segregation-at-source as mandated by Section 10 of RA 9003 which

    explicitly provides that:

    Section 10: Role of LGUs in Solid Waste Management - Pursuant to the relevantprovisions of R.A. No. 7160, otherwise known as the Local government code, theLGUs shall be primarily responsible for the implementation andenforcementof the provisions of this Act within their respective jurisdictions. Xxx

    Conduct Information and Education Campaign on their constituents

    Orient the Barangays on how to effectively anage their solid wastes

    Appointment of barangays eco-aide among their constituent

    Compensation of the said eco-aide will come from the sale of recyclablescollected within the Barangay

    The Barangay has the liberty to use the said proceeds

    The Barangay shall furnish the Department pertinent data on their solid wastemanagement pursuant to this project.

    ORDINANCE PROHIBITING THE BURNING OF GARBAGE, TRASH OR ANYOTHER REFUSE MATERIALS IN STREETS, SIDEWALKSAND OTHER PUBLIC PLACES

    WHEREAS, the Sangguniang Panlungsod/Pangbayan is empowered under the LocalGovernment Code (Republic Act No. 7160) to pass ordinances and resolutions to(P)rotect the environment and impose appropriate penalties for acts which endangerthe environment x x x which result in pollution (Section 458, a, 1, vi); (D)eclare,prevent or abate any nuisance (Section 458, a, 4, 1); (R)egulate the use of streets,

    avenues, alleys, sidewalks, bridges ,parks and other public places (Section 458, a, 5,v); and, provide for an efficient and effective system of solid waste and garbagecollection and disposal and prohibit littering and placing or throwing of garbage, refuseand other filth and wastes (Section 458,a, 5, x111);

    WHEREAS, the City/Municipal Government has continuously provided efficient wastegarbage collection and disposal for all residents of the City/Municipality, with its regularcollection schedule at twice a week along secondary roads and daily at all primaryroads;

    WHEREAS, despite this existing laws, both national and local, against the dumping ofgarbage, some residents still dump and burn their garbage at street corners, alongsidewalks, whether paved or not, in other public place, leaving the ash and otherremains of such burnt garbage to litter such street, sidewalk or other public place;

    WHEREAS, the burning of garbage, trash and any other refuse material in public placescauses pollution and thereby creates a public nuisance which offends the senses andendangers the health and safety of others;

    NOW, THEREFORE, be it ORDAINED, as it hereby ORDAINED by the

    SANGGUNIANG PANLUNGSOD, in session duly assembled, that:

    SECTION 1. The burning of garbage, trash, solid waste, or any refuse material in anypublic place within the City/Municipality of ____________ is hereby prohibited.

    SECTION 2. Any individual, whether natural or juridical, caught violating this Ordinanceshall be subject to pay a fine of Two Thousand (P2,000.00) for the first offense. Asubsequent offense shall render any offender liable to criminal prosecution and to the

    penalties of Five Thousand Pesos (P5,000.00) fine and /or six (6) months to one (1)year imprisonment, in the discretion of the court.

    If the offender is a juridical person, its manager, partner, proprietor, owner or otherresponsible officer shall serve the penalty of imprisonment.

    SECTION 3. The Citys Waste management Office shall put up signs at all public placeswhich have been used as such burning sites

    SECTION 4. The City/Municipal Council Secretary is hereby directed to cause thepublication of this Ordinance once in a newspaper of general circulation, and its postingfor three (3) consecutive weeks at all barangay halls in the City, at the Department ofPublic Services; Office, and at the City Council bulletin board.

    SECTION 5. The City Council Secretary is also directed to furnish copies of thisOrdinance to the presidents of all accredited homeowners and community associations,

    through the Department of Public. Likewise, let a copy of this Ordinance be furnishedthe Executive Officer of the Official Gazette for recording and archival purposes.

    SECTION 6. The Ordinance shall take effect on the day after its publication or thecompletion of its posting, whichever comes later.

    SECTION 2. The MRF shall be located in a suitable area at the controlled dumpsite andshall have the following functions:

    a) To receive mixed waste materials for sorting, segregation, composting andrecycling.

    b) To segregate or separate all accumulated recyclable materials, provide

    storage therefore, and to prepare the necessary documentation and regular inventoryreports thereof.c) To maintain the efficient and safe processing, movement and storage of sorted

    materials.d) To maintain an adequate and necessary number of city/municipal-hired

    garbage sorters, preferably from among the scavenger families living near the dumpsite.

    SECTION 3. For purpose of the Ordinance the following terms are hereby defined asfollows:

    a) CITY/MUNICIPAL-HIRED MRF GARBAGE SORTERS shall refer to personswho are hired by the City/Municipal Government and assigned to the MRF to

    exclusively perform sorting and segregation activities at the MRF.b) CONTROLLED DUMPSITE shall refer to a disposal site at which solid wasteis deposited in accordance with the prescribed standards of site operation.

    c) MIXED WASTE MATERIAL shall refer to waste materials scraps, or discardsof any form and kind that are collected from the garbage stream, street sweepings,domestic households, public places, factories, business and commercial establishment.

    d) RECYCLABLE MATERIALS shall refer to any waste material retrieved fromthe waste stream and free from contamination that can still be converted into suitablebeneficial use or for other purposes, including but not are not limited to, newspaper,ferrous scrap metal, non-ferrous scrap metal, used oil, corrugated cardboard, aluminum,glass, stationery paper, tin cans, and such other materials that can be used as rawmaterials in the manufacture of recycled product, or that can be used or served forsome beneficial purpose.

    e) SEGREGATION shall refer to a solid waste management practice ofseparating different materials found in order to promote recycling and re-use ofresources and to reduce the volume of waste for disposal.

    f) SOLID WASTE shall refer to all discarded household and commercial waste,nonhazardous industrial and institutional waste, construction debris, and the like, thatcan be recycled product or that can be used or serve some beneficial purpose.

    SECTION 4. The MRF shall have the following duties and responsibilities:a) All the garbage or waste materials being dumped in the controlled dumpsite

    shall be sorted out by city/municipal-hired MRF garbage sorters, segregating orseparating all recyclable materials from other wastes. All other sorted garbage or wastematerials that are not recyclable shall be disposed and dumped into the designatedsanitary landfill at the controlled dumpsite,

    b) All segregated recyclables materials shall be sorted out further and classifiedto its kind, type variety or nature, and for what purpose they may be of use as a rawmaterial to make a recycled product.

    c) An inventory report or listing of all recyclable materials, as sorted out and

    classified shall be made and submitted to the Department Head of the Department ofPublic Services. The latter shall formulate and prepare the itemization/speculationsrequired under such inventory listing

    d) The inventory report shall thereafter be submitted by the WMO to the Office ofthe City/Municipal Treasurer for announcement of bid or offer for sale to interestedparties.

    SECTION 5. All proceeds generated from the sale of the recyclable materials shallaccrue to the General Funds of the City/Municipal Government.

    SECTION 6. The Chief of the Waste Management Office, the City/Municipal Treasurer,and the Resident COA Auditor are hereby tasked to jointly undertake the methodologyof mechanics in the disposition of the recyclable materials, including the pricing thereof.

    SECTION 7. Separability Clause. If for any reason or reasons, any part or provision ofthis Ordinance shall be held unconstitutional or invalid, other parts or provisions hereofwhich are not affected thereby shall continue to be in full force and effect.

    SECTION 8. Effectivity Clause. This Ordinance shall take effect upon itsapproval.Ordinance

    ORDINANCE REQUIRING THE SEGREGATION AT THE SOURCE OF ALL

    HOUSEHOLD, INSTITUTIONAL, INDUSTRIAL, AND COMMERCIAL WASTEAND/OR GARBAGE INTO WET OR BIODEGRABLE AND DRY ORNONBIODEGRABLE, PURSUANT TO REPUBLIC ACT NO. 9003

    WHEREAS, Republic Act No. 9003 (Philippine Ecological Solid Waste ManagementAct of 2000) provides for an ecological solid waste management program, creates thenecessary institutional mechanisms and incentives, declares certain acts prohibited andprovides for penalties and appropriates fund therefore;

    WHEREAS, Section 10 of the above-cited Republic Act provides that, Pursuant to therelevant provisions of R.A. No. 7160, otherwise known as the local Government Code,the LGUs shall be primarily responsible for the implementation and enforcement of theprovisions of this Act within theirrespective jurisdictions;

    WHEREAS, Section 21 (mandatory Segregation of Solid Waste) of R.A. 9003 haslikewise provided that, x x x LGUs shall evaluate alternative roles for the public andprivate sectors in providing collection services, type of collection system, or combinationof systems, that best meet their needs, Provided, That segregation of waste shallprimarily be conducted at the source, to include household, institutional, industrial,commercial and agricultural source, x x x. and Section 22 of the same Act haslikewise called for the standards and requirements and storage of solid waste;

    NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED by theCITY OF MANILA , in session duly assembled, that:

    SECTION 1. The City Government of MANILA hereby requires the segregation atthe source of all household, institutional, industrial, and commercial waste and/orgarbage into wet or biodegradable and dry or non-biodegradable, pursuant to Republic

    Act No. 9003.

    SECTION 2. For purpose of this Ordinance, the following terms are hereby defined asfollows:

    (a) SEGREGATION shall refer to a solid waste management practice ofseparating differentmaterials found in solid waste in order to promote recycling and re-use of resources andto reduce of waste for collection and disposal.

    (b) SEGREGATION AT SOURCE shall refer to a solid waste managementpractice of separating, at the point of origin, different materials found in solid waste inorder to promote recycling and re-use of resources and to reduce the volume of wastefor collection and disposal.

    (c) HOUSEHOLD, INSTITUTIONAL, INDUSTRIAL AND COMMERIAL WASTEOR GARBAGE shall refer to all discarded wet or dry waste in household, businessestablishments, commercial waste, non hazardous institutional and industrial waste,construction debris, and other non-hazardous/non-toxic solid waste.

    (d) WET or BIOGRADABLE GARBAGE or WASTE shall refer to post-consumermaterials which would undergo decomposition and/or can be transformed into someother forms of raw material of beneficial use, such as soil fertilizer.

    (e) DRY or NON-BIOGRADABLE GARBAGE or WASTE shall refer to post-consumer materials which could be transformed into a new product or to another usable

    material, or processed and used as a raw material in the manufacture of a recycledproduct.

    SECTION 3. Each household, institutional, industrial, or commercial garbage or wasteshall be put in separate receptacles or containers properly marked, i.e. one for the wetor biodegradable and one for the dry or non-biodegradable, secured and protected frominsects and pests, and placed in the customary or usual place where garbage collectorsfrom the Department of Public Services shall collect them.

    SECTION 4. The Department of Public Services is hereby tasked to prepare andpromulgate the necessary rules and regulations for the effective and efficientimplementations of this Ordinance.

    SECTION 5. Penalty Clause. Any household, business or commercial establishment,institution, and industrial and manufacturing plant found or apprehended not becomplying with the Ordinance shall be penalized with a fine of TWO THOUSAND(P2,000) PESOS and noncollection of their garbage or waste until such time that thefine is paid.

    SECTION 6. Separability Clause. If this ordinance or any provision of this ordinanceshall be declared unconstitutional or invalid, other part or provision hereof which are notaffected shall continue to be in full force and effect.

    SECTION 7. Repealing Clause. All local ordinances, executive orders andadministrative regulations, or part or parts thereof, which are inconsistent with any of theprovision of this Ordinance are hereby repealed or modified accordingly

    SECTION 8. Effectivity. This Ordinance shall take effect after its publication once in anewspaper of general circulation in the locality and posting for three (3) consecutiveweeks in conspicuous places of the Manila City Hall.

    WHEREAS, Republic Act No. 9003, otherwise known as the Ecolog ical Solid Wastemanagement Act, mandates every local government unit to establish an integratedecological solid management program that will enhance sanitation and the environment;

    WHEREAS, in consonance with the mandate, the City Government of Manila seeks to

    restructure its correct management effort by adopting a more scientific technologicalapproach on solid waste management.

    WHEREAS, several companies offered to the city government the adoption of theirtechnology on solid waste management, and have made a formal presentation on thecomponents and designs of their technology, advantages, mode of acquisition,environmental effects, financial scheme, among others, before the members of theSangguniang Panglungsod/Pangbayan and the representatives of the WasteManagement Office.

    WHEREAS, said companies are willing to undertake a project feasibility study todetermine the suitability of their technology in the City of Manila

    NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY THESANGGUNIANG PANLUNGSOD in session duly assembled to manifest the intention ofthe City Government of MANILA to look into the viability/feasibility of varioustechnological approaches on solid waste management.

    RESOLVED FURTHER, that companies proposing the adoption of their technologyshall submit the project feasibility study within a period of one (1) month commencingupon the grant authority given by the City Government.

    RESOLVED LASTLY, that the Special Committee on Solid Waste Management shallreview the project feasibility studies for endorsement to the Sanggiuniang Panlungsod.

    AN ORDINANCE PROVIDING FOR THE INSTALLATION OF A THRASHRECEPTACLE AT BUSES, TAXIS AND JEEPS FOR PUBLIC USE, OPERATING

    WITHIN OR TRAVERSING THROUGH THE TERRITORIAL JURISDICTION OF THECITY OF MANILA, FOR THE USE OF THE PASSENGES, IN THE DISPOSAL OF

    THEIR PERSONAL WASTE MATERIALS AND PROVIDING FOR THEIR PENALTY

    FOR THE VIOLATION THEREOF.

    Be it ordained by the Sangguniang Bayan of the City of Manila, that:

    SECTION 1 All buses, jeeps and taxis for public use, operating within or traversingthrough the territorial jurisdiction of City of Manila, Metro Manila, shall provide thrashreceptable in the vehicle, as prescribed by the Office of the Mayor for the use of itspassengers as disposal receptacle of their personal waste materials.

    SECTION 2 Any driver operating said vehicle found violating the provisions of thisordinance shall be fined in the amount of P1000.00 for first offense; P2000 for second

    offense and P5000.00 for third offense with 3 days imprisonment.

    SECTION 3 This ordinance shall take effect upon its approval.

    SECTION 4 That the Operations Division of the Department of Public Services will bethe one implementing the inspection and supervision of this Ordinance

    CITY ORDINANCE NO _____________

    AN ORDINANCE ADOPTING THE MANILA CITY SOLID WASTE MANAGEMENTCODE AND PROVIDING PENALTY FOR VIOLATION THEREOF, SUBJECT TO ALL

    LAWS AND EXISTING LEGAL RULES AND REGULATIONS.

    WHEREAS, R. A. 9003 otherwise known as the Ecological Solid Waste ManagementAct of 2000, provides that the Policy of the State is to adopt a systematic,comprehensive and ecological solid waste management program which shall ensure theproper segregation, collection, transport, storage, treatment and disposal of garbageand adoption of the best environmental practices in solid waste management;

    WHEREAS, the Local Government Code of 1991 empowers the local government unitsto enact/approve ordinances which shall ensure an efficient and effective system ofsolid waste and garbage collection and disposal including the prohibition on littering andthe placing or throwing of garbage, refuse and other filth and waste;

    WHEREAS, the Manila City Sangguniang Panlungsod recognizes the need to have aSolid Waste Management Code for the City, providing therein a systematic solid wastemanagement process for household, business establishments and institutions,incorporating thereby waste related ordinances.

    NOW THEREFORE, BE IT ENACTED AS IT IS HEREBY ENACTED BY THESANGGUNIANG PANLUNGSOD OF MANILA, METRO MANILA, BY VIRTUE OF THEPOWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, THAT:

    CHAPTER 1

    General ProvisionsSection 1. SHORT TITLE - This ordinance shall otherwise be known as the SolidWaste Management Code of the City of Manila.

    Section 2. DEFINITION OF TERMS - As use in this ordinance, the following termsshall mean:

    BIO-DEGRADABLE Any thing that originate from living things, whether animal, plant orhuman, which decomposes and reduced into fine particles by microorganism orenzymes, e.g. paper, wood,fruits, peels, left over, seed, fish, fowl innards and the like.

    BULKY WASTE Waste that has large volume by itself, generally materials with a lengthof more than one meter e.g. refrigerator and other appliances, furniture, large branchesof trees.

    COLLECTION The gathering/collecting of stored waste, setting it out and hauling themto transfer stations or to other facilities.COLLECTION EQUIPMENT Vehicle used in thegathering of stored waste set out for collection.

    COLLECTION SCHEDULE Designated time given for the collection of waste in the

    route.

    CONSTRUCTION/DEMOLITION DEBRIS Solid waste arising from construction anddemolition of structure, such as earth mounds, dilapidated concrete, pieces of stones,rocks and woods, metal and plastic scraps.

    DISCHARGE OR SET OUT Putting or setting out of stored waste set out for collection.

    ENVIRONMENTAL FRIENDLY MATERIALS Products which are biodegradable andhave no harmful effect to the environment such as paper plates, paper bags, papercaps, paper board-food packs and the like.

    GARBAGE COLLECTOR Any person tasked to pick up stored waste set out forcollection.

    IMMEDIATE SURROUNDING Frontage or immediate vicinity of the house orestablishment.

    JUNK DEALER Any person engaged in recovering recyclable materials as a trade orbusiness.

    LITTER Waste improperly set out or scattered, with a volume of one (1) liter (1,000 ml)or less.

    NON-BIODEGRADABLE Any thing which comes from a non-living source which doesnot easily decompose, e.g. cans, metals, glass, bottles, plastics, styrofoam, rubber,cloth, fibers, feather, leather, hard shells and bones.

    PUSH CART/PEDICAB Vehicles used for the collection or recyclable materials in veryhousehold and establishments to be sold to junk dealers.

    SCAVENGING The act of opening stored waste set out for collection and disposal toretrieve recyclable or reusable materials.

    SELF-GENERATED WASTE Waste that are generated by a house/establishment.

    SOLID WASTE A non-liquid waste material arising from domestic or household. It alsoincludes waste arising from the conduct of public services such as street sweeping,clean and green activities, and the clearing of typhoon-wrought debris. Or Any solid orsemi-solid material resulting from human and animal activities that areconsidered

    useless, unwanted or hazardous, Or Any material that becomes waste only when aspecific owner ceases to have use for it.

    SPECIAL COLLECTION Collection outside of the regular garbage collection schedule,in compliance to the request or complaint received.

    STORAGE Isolation of waste from the environment to prevent health hazard and tofacilitate collection.

    TOXIC & HAZARDOUS WASTE Waste that is harmful to human beings, plants andanimals and the environment, by reason of its quantity, concentration or physical,chemical or infectious characteristics.

    VACANT LOT Any lot occupied, idle, abandoned, whether residential, commercial andindustrial, not intended for open spaces, parks, playground, road, alleys and the like.

    YARD WASTE Refers to wood, small or chipped branches, leaves, grass clipping,garden debris, vegetable residue that is recognizable as part of a plant or vegetableand other material accumulated by reason of trimming, pruning and weeding of plantsand trees.

    CHAPTER IISolid Waste Management System

    Section 3. Basic ConceptsBasically, any waste should be left in the place of purchase or in the household and noother person or individual in between has the obligation to keep that waste. All stores,establishments and households are required to have suitable trash receptacles to keepones garbage to be kept inside its premises and not on the sidewalk except duringscheduled collection time.

    Section 4. Storage of Waste4.1 Waste shall be stored only in the place of purchase or in the household. Under nocircumstances shall waste be stored in any other place. Waste shall be stored onlywithin the premises of the generator.On collection day, the waste may be placedimmediately beside the fence of the owner. The waste shall be packed and tied toprevent scattering and spillage.

    4.2 Waste shall be stored and set out for collection in a closed plastic bag or anyappropriate container to avoid the entry of insect, pest and vermins, escape of bad odor;and spillage of leachate. Unpacked, improperly packed and spilled garbage shall not becollected.

    Spilled garbage due to improper packing shall not be collected. The owner shall beresponsible in sweeping, cleaning and repacking of the spilled garbage and shall cleanthe mess caused by it.

    4.3 Household toxic and hazardous waste (THW) shall be placed in a separateappropriate container and shall be disposed of in a specific manner in accordance withR.A. 6969. Broken glasses or lamps and other sharp objects shall be securely enclosedin hard cardboard with tie to prevent injury to handlers and rip and tear ofbags/containers.

    Section 5. Discharge or Set Out of Waste for Collection5.1 Waste shall be set out for collection only within the scheduled date and time ofcollection.

    5.2 Household, commercial establishments and institutions shall set out their wasteconspicuously only in front of their premises during the designated collection time.

    5.3 Bulky waste shall be collected separately or scheduled for special collections.5.4 No burning of waste shall be allowed at source.

    Section 6. Waste Collection System

    6.1 Only the authorized garbage collector shall be allowed to handle the waste from thegenerators.

    6.2 Selling, scavenging and sorting or pag-bubulasi by the garbage collection crew orother person shall not be allowed at all times. Violation of this rule shall be the cause ofoutright dismissal of the employee and the contractor shall be held liable for its crewandmay cause the suspension or termination of the contract of the contractor with theCity Government.

    6.3 All garbage collectors, drivers and those involve in the collection of refuse shall berequired to wear proper uniforms and identification cards to be prescribed by the City.They must posses an up-todate health certificateissued by the City Health Officer.

    6.4 The garbage collector shall empty and return all containers to the designatedcollection area with care. Paper and other temporary containers shall be collected.

    6.5 The garbage collector shall not dent, bent or otherwise damage or alter thecondition of the container.6

    6.6 Waste collected shall only be transported directly to the prescribed disposal site.

    6.7 Junk dealers are not allowed to collect recyclable materials during the scheduledtime of collection.

    6.8 Scrap buying and selling shall not be allowed during the scheduled collection time.

    Section 7. Waste Collection Truck Standards

    7.1 Collection Equipment Standardsa) All collection equipment shall be registered with the city government to ensure theproper markings, safety and sanitation of the vehicle.

    b) All collection equipment shall be provided with visible and proper markings of plate

    and body number on both sides, name and telephone number of the contractor.Markings shall have a minimum of twenty (20) centimeters (8 inches) in height.

    c) All collection truck shall be in good body condition and equipped with tools and sparetires. No sacks nor any eyesore must be seen hanging in the truck.

    d) All collection trucks shall meet the emission standard set by the DENR includingsmoke-belching standards.

    e) Collection trucks and all equipment shall be kept clean and properly maintained andshall be washed after each disposal.

    7.2 Waste Collection/Transport Standarda) All trucks shall be properly covered toprevent spillage of garbage and escape of odor when travelling.

    b) All trucks shall have complete taillights, flasher, side mirror, plate number, tailgate,wiper and horn.

    c) Contractors shall not park their garbage collection truck and other equipment alongany of the streets and major thoroughfares within the city limits, nor shall it use anyproperty within the city of Manila, whether public or private as transfer station forgarbage hauled by it without written authority from the city.

    d) Reckless driving/irresponsible driver, crew under the influence of liquor, regulatedand prohibited drugs shall not be allowed.

    e) Owners and operators of trucks shall sanitize, disinfect and deodorize the collectiontrucks before leaving the dispatching area and after its disposal.

    f) All trucks shall be equipped with proper cleaning and clearing tools, e.g. brooms,dustpans, spade, shovels, etc. for cleaning and collecting spillage garbage caused bythe collectors improper handling.

    CHAPTER IIIInstallation of Provisional Wall

    Section 8. Owners of vacant lots within the City of Manila are required to keep their lotsenclosed by a provisional wall made of indigenousmaterials like sawali, G.I. Sheets,barbed wire, interlinked wire and the like with a height in accordance with therequirement of the National Building Code to prevent it from becoming a dumping areaof refuse.

    CHAPTER IV

    Segregation/Sorting-out of Solid Waste Refuse Into Bio-Degradable (wet) and Non Bio-Degradable (dry)

    Section 9. All owners, lessee, tenants and the like of residential houses,commercialestablishments, buildings and other entities within the

    City of Manila are required to separate, sort-out their solid waste, refuse, garbagematerials into Bio-Degradable (Nabubulok) and Non-biodegradable (Hindi Nabubulok).

    Section 10. Requirement of segregation for site collection: For individual household:Enclosed plastic bag with separate and appropriate markings of the word Bio-Degradable or Nabubulok and Non-Biodegradable or Hindi Nabubulok.In case ofpremises containing six (6) or more residential units:

    In addition to the obligation of individual household, owner/personin charge shallprovide a designated area and separate containers for each type of waste.

    For commercial, institutional and industrial establishments:

    Owners/managers/head/person responsible for the operation shall be required toprovide a designated area and separate containers for each type of recyclablematerials.

    Solid Waste shall be disposed of in accordance with the procedures provided in ChapterII hereof.

    Section 11. Any person who posses unsegregated garbage during the time of garbagecollection is presumed to be the violator under this chapter.

    CHAPTER VMaintenance of Clean and Sanitary Frontage and Immediate Surroundings

    Section 12. Household owners/caretakers/tenants/establishment owners, managers orany person responsible for the operations of establishment within the City of Manila arerequired to maintain their frontage and immediate surrounding clean and sanitary.

    In case of the contractor hired by the owner to construct buildings or structures inhis/her area, the contractor shall be required to provide receptacles/storage for theconstruction debris/materials that may accumulate on account of the constructionactivity, pending its collection and disposal.

    Section 13. All person covered by this chapter are required to report and coordinate tothe Manila Solid Waste Office within 24 hours from the time of accumulation of bulkywaste or construction/demolition debris in their property, yard or immediate

    surroundings and accordingly coordinate with the said office the collection and disposalthereof.

    However, in case of self-generated bulky waste or construction/demolition debris,the house owner/care taker or establishment owner/manager/person responsible for

    its operations, before generating bulky waste or undergoing construction/demolitionactivity, shall have prior coordination with the Department of Public Services on thecollection and disposal thereof.

    13.1 Fees and ChargesFees and Charges for special collection and disposal shall be paid by person/personsresponsible for the generation of bulky waste at the rate to be determined by the ManilaDepartment of Public Services on a per volume basis.

    Section 14. In the same manner, they are also required to coordinate with the ManilaDepartment of Public Services in the event of their trimming, pruning and weeding of

    plants, trees and grass or accumulation in their immediate surroundings of woods, smallor chipped branches, leaves, grass clipping, garden debris and vegetable residue tofacilitate its prompt and proper disposal.

    CHAPTER VIInstallation of Trash Receptacles on Public Utility Vehicle

    Section 15. All owners/operators/drivers of buses, jeeps and taxis for public use,operating within or traversing through the territorial jurisdiction of the City of Manila,shall provide trash receptacle in their vehicle as prescribed by the Department of PublicServices.

    CHAPTER VIIDumping and Littering of Waste

    Section 16. The dumping, placing, throwing, scattering of waste, refuse or garbagematters, papers, cigarette butts and the like, in any place in the streets or public buildingor property, including waterways, river banks not otherwise designated as garbagedumping place is hereby prohibited.

    CHAPTER VIIIPush Cart/Pedicab Registration

    Section 17. All pushcart/pedicab owners/operators operating within the City of Manila inline with recycling business and garbage collection are required to register theirpushcart at the Solid Waste Management Office for purposes of monitoring pushcartoperations.

    Section 18. Pushcart/pedicab used without registration as required in this chapter shallbe confiscated and its operator shall be penalized in accordance with the penaltyimposed in Section 25 hereof.

    Section 19. The Department of Public Services will provide the policy and guidelines ofpushcart registration.

    Section 20. Obligation of Junk shop operators operating within the City of Manila:

    20.1 Shall provide an area for the sorting and storing of each type ofrecyclablemmaterials and maintain their area of operation and immediate surroundingsclean and sanitary.

    20.2 Shall record the volume of each type of recyclable materials collectedeverydaymand submit a written report quarterly to the Manila Department of PublicServices for the purpose of monitoring.

    CHAPTER IX

    Use of Environmental-Friendly Materials

    Section 21. All food chains, restaurants, supermarkets, eateries and other similarestablishments within the City of Manila, are given nine (9) years to dispose all of theirstocks of plastics, styrofoams and thelike that are being used as food and productpackages and shall be replaced by environmental-friendly materials such as paperplates, paper bags, paper cups, paper board-food packs and other similarbiodegradable materials.

    Section 22. Gradual Reduction of Stocks:For the first 5 years, 5% reduction each yearSucceeding 3 years, 20% reduction each yearFor the last 1 year, 15% reduction

    Section 23. For purposes of monitoring, establishments mentioned in this chapter shallbe required to give the Manila City Solid Waste Management Office a written updatedinventory report at the end of each year on the number of their stocks of plastics,styrofoams, plastic caps and the like that are being used as food and product packages.

    CHAPTER XAdministrative Procedure and Imposable Administrative Fines

    Section 24. Administrative Fines:

    24.1 Issuance of Citation Tickets - Violator/s of any provision of this ordinance shall beissued Citation/Violation Ticket by Manila City Environmental SanitationPolice/Enforcers or other environmental enforcers deputized by the city, informing themthe nature of the infraction committed and the corresponding fines to be paid.

    24.2 Payment of Fines - If the violator is a corporation, firm, institution or othercorporate entities, the president, manager or person responsible for its operation shallbe held liable. The head of association or owner of mall, condominium, tenement houseand household shall be the respondent in case of violation of this Ordinance.

    24.3 Compliance to this Ordinance shall be a pre-requisite for the issuance or renewalof business permit for commercial and industrial establishments.

    CHAPTER XIPenal Provision

    Section 25. Penalty25.1 Any person who shall violate, disobey, refuse and/or neglect to comply with any ofthe provision of these ordinance shall be punished in accordance with the followingpenalty:

    Individual - a fine of One Thousand Pesos (P1,000) or imprisonment of not less than

    five (5) days but not more than thirty (30) days or both fine and imprisonment dependingupon the discretion of the court.

    Corporation/Establishment - a fine of Five Thousand Pesos (P5,000) or imprisonmentof not less than Thirty (30) days but not more than One (1) year or both fine andimprisonment depending upon the discretion of the court.

    In case the violator of the provision of this Ordinance is a garbage contractor hired bythe city the penalty provided under the garbage hauling contract shall be enforced, ifapplicable.

    25.2 Fines or penalty imposed herein shall be without prejudice to the administrativesanctions that may be imposed to erring establishments.

    CHAPTER XIICollection and Disposition of Fines

    Section 26. The payment of fines for violation of this Ordinance shall be at the CityTreasurers Office.

    26.1 The fines collected in violation of the Ordinance shall accrue in favor of thefollowing:26.1.1 60% to the city government

    26.1.2 15% to fund Research and Development Projects related to waste managementof the LGU SWM Board.

    26.1.3 25% to fund the incentive program in support to this Ordinance.12

    CHAPTER XIIIConduct of Public Information, Education and Communication (IEC) Campaigns

    Section 27. The city government in cooperation with other government agencies shallconduct a massive public awareness campaign to inform and instruct the people andcommunicate with people and all stakeholders on matters relative to theimplementation of the Solid Waste Management Code.

    CHAPTER XIVProvision for ImplementationSection 28. The City Mayor may issue subsequent rules, implementing guidelines andsystem of procedures.

    CHAPTER XVSeparability Clause: If, for any reason or reasons, any part orprovisions of thisordinance shall be held to be unconstitutional or invalid, other parts or provisions herebywhich are not affected thereby shall continue to be in full force and effect.

    Section 31. Effectivity Cause: This Ordinance shall take effect after the conduct of

    Information, Dissemination Campaign for a period of three (3) months which shall startimmediately fifteen (15) days after its publication in two (2) newspaper of generalcirculation in Metropolitan Manila.
