JAY LIONEL PATRY ("Jay Patry") will make a motion to the court, on

September 18, 2017 at 10:00 a.m. or as soon after that time as the motion can be

heard, at Toronto Court House, 330 University Avenue, Toronto, Ontario.

PROPOSED METHOD OF HEARING: The motion is to be heard:

in writing under subrule 37.12.1 (1 ) because it is on consent or unopposed or madewithout notice;

in writing as an opposed motion under subrule 37.12.1(4);

orally.

THE MOTION IS FOR:

(a) An Order seeking directions with respect to the alleged theft of assets

belonging to the Moving Party while in the possession of the receiver;

(b) An Order for disclosure of the relevant insurers of the Receiver;

(c) An Order directing the Receiver to make a claim with its Insurance for

the Moving Party's assets;

(d) Alternatively, an Order directing the Receiver to assign the Claim to the

Moving Party;

Costs of this motion on a substantial indemnity basis; and

Such further and other relief as counsel may advise and this Honourable Court

may permit.

THE GROUNDS FOR THE MOTION ARE:

(a) In or about the Fall of 2014, Strathcona Energy Group Inc. ("Strathcona")

entered into an agreement with the moving party whereby it removed 63

solar panels (the "Solar Panels") from the moving party's property to permit

the roof to be repaired;

(b) In or about October of 2015, the Solar Panels were moved to Strathcona's

warehouse located at 250 Sydney Street in Belleville, Ontario (the

"Warehouse");

(c) On or about October 31, 2016, the moving party commenced an action

against Strathcona with respect to the Solar Panels;

(d) Counsel for Strathcona requested an indulgence with respect to filing a

Statement of Defence due to the principal of Strathcona's health issues;

(e) Immediately prior to the moving party becoming aware of the receivership,

he was in discussions with Strathcona with respect to taking back

possession of the Solar Panels. At that time, employees of Strathcona

confirmed that the panels were at the Warehouse;

(f) After becoming aware of the receivership of Strathcona, the moving party

was advised that the panels had been "removed" and subsequently

became aware that there had been a theft at the Warehouse;

(g) There is no confirmation that the Receiver has made a claim to its insurer

with respect to the theft at the Warehouse;

(h) Such further and other grounds as counsel may advise and this

Honourable Court may permit.

AFFIDAVIT OF ANDREW JONES

I, Andrew Jones, of the 'City of Kingston, in the Province of Ontario, MAKEOATH AND SAY:

1. I am a former employee of Strathcona and as such have knowledge of thematters to which I hereinafter depose to.

2. Prior to its receivership, Strathcona carried on business supplying and installing

solar systems for commercial and residential businesses

3. For approximately 5'/ years, I worked as a sales person with Strathcona. I left

the company in May 20'16. In or about November of 2014, Strathcona and Jay Patry

entered into an agreement whereby Strathcona would remove solar panels at Jay

Patry's property located at 394 Alfred Street in Kingston, Ontario, to allow the roof to be

repaired. Strathcona was to remove the solar panels and reinstall them after the repairs

to the roof were complete. Attached hereto and marked as Exhibit "A" is a true copy

of a letter from Strathcona to Jay Patry's legal counsel confirming the agreement with

respect to the removal of the solar panels at 394 Alfred Street in Kingston, Ontario.

4. There were 54 solar panels removed. The model of the solar panels was

Solarfun SF 160-24-P PV Modules manufactured by Schuco. Canada Inc. Attached

hereto and marked as Exhibit "B" is a true copy of a single line diagram detailing the

layout and number of the solar panels on the roof. Attached hereto and marked as

Exhibit "C" is a true copy of the data sheet for the solar panels.

5. Attached hereto and marked as "Exhibit "D" is a true copy of the invoice for the

purchase of the solar panels on October 8, 2010.

6. After the solar panels were removed, they were taken to a storage unit owned

by Jay Patry. Soon thereafter, Jay Petry began inquiring about when the solar panels

were to be reinstalled. This went on for about a year. Throughout this time I was the

main contact for Jay Patry at Strathcona and I would bring Jay Patry's inquiries to the

CEO of Strathcona, Karl Hollett. After about a year, Karl told me that to pacify Jay

Patry, Strathcona would offer to pick up the solar panels to have them tested by

Strathcona without committing to a reinstall date. As such, in or about October of 2015,

the solar panels were moved from Jay Patry's storage unit to Strathcona's warehouse

located at 250 Sydney Street in Belleville, Ontario (the 'Warehouse").

7. After the solar panels were tested and some were repaired, there was a dispute

between Jay Patry and Strathcona and as to whether Strathcona agreed to reinstall the

existing mounting system. Strathcona had concerns that the roof penetrations may

cause continued leaking. Strathcona offered to have Jay Patry deal with the roof

penetrations and Strathcona would reinstall the solar panels or Strathcona would

source and install a new mounting system. Strathcona refused to reinstall the solar

panels until the dispute was resolved.

8. I am advised by Jay Patry and verily believe that on or about October 31, 2016,

he commenced an action as against Strathcona with respect to the solar panels. As I

am advised by Jay Patry and verily believe that upon service of the Statement of Claim

Strathcona's counsel requested an indulgence with respect to the defence because he

advised that "his client" had significant and ongoing medical issues.

9. In or about December of 2016, Jay Patry requested assistance from me in

obtaining his solar panels.

10. On December 30, 2016, I contacted an employee of Strathcona, Adam Sweet,

and he confirmed that the solar panels were still at the Warehouse. He advised me that

I should contact a principal of Strathcona, Kelly Rumble, to discuss picking up the solarpanels.

11. On January 3, 2017, I spoke with Kelly Rumble. He immediately confirmed thatthe solar panels were being stored at the Warehouse and was fully aware of the disputeover them with Jay Patry. Kelly Rumble said that he was prepared to give the solarpanels back to Jay Patry once they sorted out the litigation.

12. I am advised by Jay Patry and verily believe that on January 6, 2017, his

counsel wrote to counsel for Strathcona to make arrangements to pick the solar panelsup.

13. In or about that time, I was advised by Jay Patry that he anticipated resolvingthe dispute shortly with Strathcona and requested my assistance in arranging to havethe solar panels reinstalled.

14. I am advised by Jay Patry and verily believe that on January 12, 2017,Strathcona's counsel responded to his legal counsel to advise that Strathcona was inreceivership.

15. On that same date, I contacted Adam Sweet as I was looking at taking the nextstep to reinstall the solar panels and asked Adam Sweet to confirm the solar paneldimensions and frame thickness.

16. I received a message back from Adam Sweet that when he went to take themeasurements, he discovered that the solar panels were no longer there and told methat they had been moved by "Kelly [Rumble] or someone else". He stated that he did

not know where they had been moved to and would ask Kelly Rumble.

17. Shortly thereafter, I followed up with Adam Sweet to see if the solar panels hadbeen located. In a telephone discussion, Adam Sweet advised me that he was no

longer employed at Strathcona and that there had been a theft at the Warehouse in

mid-January 2017 and it was believed that Jay Patry's solar panels had been among

the items stolen.

18. Within a few of weeks, Jay Patry's legal counsel made arrangements with the

Receiver for me to do a walkthrough of the Warehouse so that Jay Patry's solar panels

could be identified and returned to him.

19. On February 24, 2017, I attended at the Warehouse. I was escorted through the

Warehouse by employees of Strathcona, Jessica Longlade ("Jessica") and Ron

Jubenville ("Ron"). I was able to confirm that the solar panels were not on site.

20. I spoke with Jessica and Ron about the theft at the Warehouse in mid-January

2017. Jessica and Ron told me and I verily believe that a truck came onto the property

at night and stole a truckload of assets out of the Warehouse. Jessica and Ron told me

that the truck had been on surveillance video coming onto and then leaving the property

and that this surveillance video has since vanished.

21. Ron told me and I verily believe that once the individuals were inside the

building, they could not be seen clearly by the inside cameras but they would have

required two separate keys that gain access to the area from where they stole the

assets.

22. Ron further told me and I verily believe that the surveillance video was now

missing but he had taken some still frames of the photos showing the truck.

23. Ron told me that a report had not been made to the police. Ron expressed that

he was puzzled as to why a report was not made to the police.

24. I asked Ron if he had copies of the images that he took from the surveillance

video and he advised that he gave them to Dean Skurka of Fuller Landau and Karl

Holiett.

25. I am advised by Zola Mehlomakulu ("Zola"), an employee of Jay Patry, and

verily believe that on or about March 4, 2017, he filed a police report regarding the theft

but he has not heard back from the Belleville Police Department.

26. On or about the beginning of March, 2017, I attended with Zola at the Belleville

Police Department but the detectives were not available. I am advised by Zola and

verily believe that he has made several other attempts to reach the detectives at the

Belleville Police Department but they have not returned his phone calls.

27. On June 7, 2017, Zola and l were successfully able to meet with Constable

Darrell Hatfield of the Belleville Police Department. He confirmed that this matter is

under investigation. He also advised us that the incident report number is 8E17003524.

28. I make this Affidavit in support of the Motion for Directions of Jay Patry.

a. Strathcona agreed to remove ONLY the modules from this system while the rackingsystem was removed by roofing company replacing leaking roof AND Reinstallingracking system. Strathcona advised Mr. Patry, Strathcona would not re-install theracking system and accept liability for this new roof.

b. Strathcona advised Mr. Patry upon removing the modules that 22 modules were notproducing and were defective, Strathcona repaired them at no cost to Mr. Patry at ourplant in Belleville.

d. The total extent of agreement to remove and re-install the modules at 394 Alfred streetis still in place. We ask that a picture showing the racking is ready for install by July 11th,2016 and the modules will be delivered to site and installed with a provided lift from Mr.Patry as agreed. If this Is not done please provide a delivery address for these modulesthat are still in our possession, repaired and ready for install since October 2015.
